Panama has also passed a mining moratorium law, that prohibits open pit mining for the foreseeable future.

The contract was determined to be unconstitutional by the Panama Supreme Court. A case for renegotiating the contract along constitutional lines. Am sure first quantum is already reviewing amendments to the agreement. Too much at stake not to .

Renegotiation is not possible since our law prohibits future concessions or renewals for he existent ones. Since the Supreme Court ruling said “the mining concession doesn’t exist”, there is no room for another contract. What they have to negotiate is their closure.
@tigalbaby

@@lalito2136d8cc not necessarily . First the terms of the investment treaty need to be examined to determine what recourse the investor has at an international court . But the Panama government can always bring a bill to parliament to reopen negotiations. My support is for the people of Panama to obtain the best agreement possible respecting both Panama and international law .

Because we care more about our land, the contract was illegal, we do not belong to any other country, I would like to see if the same contract was placed against Canada. The started mining without a legal contract, the invested all that money without a legal support. We are a small "poor" country, with dignity.

@@cellula8480 The government officials are elected to speak for the people of Panama. If the people didn’t want mining in their country, they should’ve not let FQ waste their $7 billion building the mine. Also, I’m sure many Panamanian’s who are employed there and all of the citizens who would’ve benefited from the $375 million yearly royalty from the mine are in favor of the mine.

The opposition was not only from the ecologist, it was nation wide. We did not oppose because we don’t want trade, investment…it was because we want fair trade, responsible investors in our country. In this interview is suggested that we opposed to the mining activities (in this Court case against the Canadian Company first Quantum) from past fear of our experience with United States and our Canal however this is a very reductionist affirmation as deny (I hope by ignorance!) that Panama granted by Law No. 287 of February 24, 2022, to “Nature" the status of subject of law.The above implies that the Panama must have the necessary public policies to ensure "the best interest of the nature", now for its intrinsic value, and regardless of the utilitarian value it has for human being. From a legal perspective, as ruled by Panama’s Supreme Court, the contract between First Quantum and Panama breached more than 20 articles or Panamanian constitution therefore has no place in Panama. Furthermore, article No. 55 of that Contract establish that if is proven that the Contract was obtained through bribery and corruption practices, Panama has the right to finishes the contract without paying indemnity to the company. If our Supreme Court ruled that this contract is unconstitutional, easily you can deduct how the company got the contract signed in first place!

@@DaveG-qd6ugYou mean the capital FQ invested knowing they have no contract signed, extracting Gold, Cooper etc for years, and reporting whatever they wanted without being verified by the Panamanian government? FYI, that's a crime (stealing from the government). And what about the unpaid taxes while the above mentioned happened! Yes, I figured it out, you have no idea. Panama is losing over $1 million a day on royalties. Plus 40,000 mine workers will not be getting paid. Then there are all the other businesses that rely on the employees and business generated by the mine. What is the Panamanian government going to do for all those who become unemployed? Why would investors invest in Panama, they just recently re-negotiated the deal with First Quantum. Then 2 months later the Panama Supreme Court ruled the deal unconstitutional. Why would anyone invest in anything in Panama? Panamanian Bonds will fall to junk status. There are mines everywhere in the world, they don't seem to have issues. What is so special in Panama that the mine has to be closed down. Because eco-zealots say so? So the price of copper will rise and countries that have copper will get increased profits. Exploration will take place in other countries. Panama loses.

First Quantum was operating for years without a proper license....plus Panama's constitution forbids foreign countries to own land in Panama...The Chinese own more than 50 percent of the FQ stock. Besides, they have devastated a biological corredor...and have never paid Panama taxes in all the years they have been operating. Panama does not want any mining operations.
@don-cw1yz
@don-cw1yz 7 месяцев назад
@@tinamcbride343 But it cost Billions of dollars for First Quantum to set up the mine. It is normal anywhere in the world that companies don't pay taxes for a period of time until they recoup some/most of their setup costs. In many cases, governments pay manufacturers billions of dollars to a company to set up a manufacturing plant in a country. They will give them a period of time to recoup costs before paying taxes. A subsidized deal on power etc. It is a mine. I am sure the Panamanian government that signed a deal to allow FQ to operate knew that there would be some digging and roadwork etc to allow the mine to operate. Yes, a mine will result in some pollution and in general they use a lot of water. The new 20-year deal allows for over one million dollars a day in royalty payments. Then of course there are all the people that work at the mine and jobs related to the mine. I understand in total you are looking at 40,000 jobs. You say Panama does not want mining but how about all the jobs and wealth the mine brings to Panama. Plus the Panamanian government signed a deal with FQ and then renegotiated that deal. It is a 20-year agreement.

They think they will make more nationalizing the mine, just like Venezuela with oil jajaja
@don-cw1yz
@don-cw1yz 7 месяцев назад
@@DaveG-qd6ug Canadian mining companies are considered the best at mining and respect for the environment. You need people with the expertise to run a large-scale mine. Venezuela nationalized their oil industry under Chavez. That is when everything started to go wrong. Maduro took over and was forced to bring back outside help from other countries. The US, Iran, China, Spain, Russia. Oil production dropped to a trickle of what it had been due to a lack of maintenance. Oil pipelines leaking on land and into the ocean. The Venezuelan oil workers were not getting paid and fainting at work sites due to a lack of food. The Fleet of Venezuala oil tankers was banned from ports worldwide due to lack of maintenance they were considered unsafe. The world's largest oil reserves and they messed it up. Communism never works. If Panama tries to nationalize the mine it will be subject to International lawsuits from First Quantum . They will want money back for the $billions they sunk into the mine. Then the mine becomes a liability as the Panamanians have no clue how to maintain and run the mine.
