So. if he decided to grab some smaller bag inside the other bag and open it, now he's overstepping. He can reasonably see there were no fish in the bigger bag and no chance of hiding a large fish in the smaller bag so there was no need to be searching anything else.
@T C If he didn't catch you with a pole in your hand or gun in your hand (hunting), he can't search your stuff. Now, if you're with other people, he can probably articulate reasonable suspicion that you would say "not fishing or hunting" and try to claim ownership of the coolers and bags in an attempt to hide evidence and search your stuff anyway. Their authority without a warrant only extends to conservation duties, which means looking for illegal fish or other illegal animals, illegal equipment if caught using it, etc.. They can only glance in the bag, not rummage through it. Any judge would see rummaging around in your bag as unnecessary for trying to locate a fish or other killed animals. In fact, even opening to glance in to it can be considered extreme if they pick the bag up and it's clearly not heavy enough to contain any animals. But as we all know, these arrogant d-bag ego driven power hungry thugs will ultimately do as they please figuring you won't do squat about it if nothing was found anyway and if something is found, they'll find some reason to justify it all. You can't stop thugs who are willing to violate your rights, you can only go after them later in court.

You're full of shit, rendkee11. He objected and put it on RU-vid, which is enough. Going further meant being arrested, which is way too expensive and the warden would love the opportunity.
While I don’t agree with it, fish and game are a State “owned” resource therefore any activity that is related to the taking of them fall under a completely different set of rules, much like limited public access buildings, or restaurant/shop keeper laws that allow detainment of customers. No matter this warden is a dick and needs to learn how to be professional.
you say state owned like someone else owns the state besides us the citizens? like drivers license that say in the wording it's a privilege bit your taxes pay for it? Founding Fathers would vomit if they saw this is where we are w the government they left us!
who said poaching was ok?literally no one said that. if you're legal minding your own business then you should be free of searches and seizures period.
God forbid few fishermen with fishing rods gonna deplete the whole Pacific Ocean off of fish. This is more to ensure that people do not feed for free without paying heavy toll to government thieves.

No such thing as freedom, unless you consider everyone else when you do something. Every action you take or make may affect others and their freedom. I don't know about California but here in Georgia any game warden has the right to inspect and go through any equipment or gear related to hunting or fishing without a warrant
It’s in the federal code. It’s everywhere. Including house boats, regular boats, bags, coolers, and even persons. There are also businesses like pet stores and other exotic creature places that they can just walk into and search.
@@edwardwebster8123 you have that right. He would not have thought twice about hauling him in and charging with probably taken all his fishing gear too
Game wardens are the only law enforcement that are legally allowed to search. He’s actually wrong on this one. They can board your boat and everything to see if you have illegal game. The officer clearly knows this.
@@deontaeb5466 technically, they aren't. The Constitution is clear and makes no exceptions. Doesn't matter what a court or local law says. That's the problem with people in this country. They ACCEPT their rights being taken. If you want to give game wardens that authority, THEN AMEND THE CONSTITUTION!!!! Until then, you either have the 4th amendment or you don't.
@@deontaeb5466 they can ask to see in your bag but just walking down the is not legal I've never had a game warden do that or have I ever seen one do that
Fish and Game Wardens have authority to inspect your coolers, containers, etc to ensure compliance with F&G regulations. Look it up. This guy filming made an ass of himself, he doesn't know the law.
@@bobbyheenan4061, they have more power then local law enforcement. The poster is a Karen. Pull that crap on a Gulf Coast fishing pier and the fishermen would likely throw you over the side.
know your laws before you make a video that makes you look uneducated. Fish and game absolutely have the authority to check your gear and coolers/bags.
@STRONG ISLAND FISHING @Bobby Heenan @Chris Fraser Absent consent or probable cause, F&G has no greater Constitutional authority than any other law enforcement agency to conduct an intrusive search, which includes reeling in the line, opening containers and bags and demanding ID. Just because they routinely do so doesn't make it lawful.
To be fair cop is 💯 in the right he has the right to check fishing IDs and to look for people illegally taking fish. It’s a huge problem over fishing can kill a whole food chain so by him doing this he’s protecting a part of the food chain. Yes I agree he shouldn’t just look through stuff but still.
General Rule. Service officers may conduct warrantless searches with consent. Probable cause is not required for a consent search. When a person consents to a search by a Service officer, he/she/they waives his/her/their Fourth Amendment right of protection from search without a warrant
At one time you didn't need a license to fish on your own property. Not sure nowadays. But a game warden in Texas has more power than a cop. They can come into your house without a warrant and search your refrigerator or freezer. The only person I saw get away with anything was a post man on a rural mail route. He put his doves in a box and put stamps on it and the game warden couldn't do anything. The only person who could check would be a postal inspector. aka Post office police.
So if you don't get a license, show up around a lot of fishing poles, bring an ice chest, and don't answer questions, then it's likely you'll get an unreasonable search.

What's hilarious is that if he hadn't admitted those were his fishing poles, the Game Warden could've seized them as abandoned fishing equipment. This ignorant douchebag who's filming doesn't know sh!t about the law.
They actually have the right to search you or your house at anytime for any reason, it's on the fishing license. Falconers are also fighting against this.
@@deontaeb5466 they have to “believe” not just hope. The 4th amendment protects our right against unreasonable searches. He was obviously on a fishing expedition, pun intended
In California, when you have a fish and hunting license, it clearly states that game wardens are allowed, by law, to search your coolers, hunting gear, hunting tags, so on. This is done to help with wildlife conservation and also to make sure you are not outside if hunting and fishing regulations. Seems like you lost your cool on this one. Fail! 💀
Exactly, The Mission of the Law Enforcement Division is to protect California natural resources and provide public safety through effective and responsive law enforcement.
This is one of the many reasons I love living in Thailand; I can go fishing and nobody bothers me. I can park my car at the beach and nobody is tries to collect a parking fee. I can go to a pharmacy and buy my medications without a prescription. I can drive my electric cart along the roads where I live (Not Freeways) and the police don't bother me.
The game wardens and park police do have some extra powers in parks and maybe on the piers. How they choose to use those powers reflects on the type ot person they are.
that may be true but I am sure if that was challenged in the court a lot of those powers would disappear ,no law can do an end run around the constitution ,accept when allowed by corrupt supreme court judges e.g. qualified immunity
Yeah, the warden was extremely professional and kept his cool even with all that trash talking. If that warden talked to that guy the same way it would be a different story.
Coolers that are being used to hold fish. A cooler on a beach with a family enjoying the sun is not being used for fishing. They would have no reason to search that. Also the backpacks he is searching are not being used to store fish, unless he saw someone or somehow suspected someone of stuffing fish into their backpack then he has no reason to search those.
This one and the county executive that can trespass on your property kill me. What part of the 4th don't they understand? Wait they have to Care. We have our standing army right here our for-fathers warned us about. shall we quarter them too? we do with our Tax slavery.
The catch 22 is that to hunt or fish legally, you need a licence, and that opens you up to 4th Amendment violations by the fish cops. They also assume the authority to trespass on private property if they have any suspicion that hunting or fishing activity is going on there. The Game Wardens are seldom challenged and I'm happy to see you doing so. I had one of those SOB's open up my tent and look through it while I was away from camp hiking in the National Forest.
Their ‘right’ to go through your stuff and check everything for no reason or come on your property for no reason might be given to them by the state game codes. However, state game codes do not supersede the constitution of the United States. It needs fought in court though
