Literally, the pre-colonial culture of Maori was stone age. The concepts of law and justice were by consequence limited to that phase of development which is why there is a single word that covers different concepts like honour, prestige and status. There is no nuance. The lack of technology meant they had no concept for roads or land vehicles which is why NZ was lumbered with the ridiculous situation of the roading authority being named after a paddle boat in Maori. This is dragging the country down into third world status. The Maori who campaigned in the early 20th century to rid their people of superstition and successfully petitioned the government to pass the Tohunga Suppression Act would be horified at the backsliding going on.

As I mentioned somewhere, NZ's the cheapest country in the English-speaking world to study the common law (the law of the English-speaking world)! So lots. More and more all the time. The requirement to teach tikanga won't change a thing.

He Whakaputanga - Declaration of Independence, 1835 On 28 October 1835, at the home of British Resident James Busby in Waitangi, 34 northern chiefs signed He Whakaputanga o te Rangatiratanga o Nu Tireni (known in English as the Declaration of Independence of the United Tribes of New Zealand). The handwritten document consisting of four articles asserted that mana (authority) and sovereign power in New Zealand resided fully with Māori, and that foreigners would not be allowed to make laws. Te Whakaminenga, the Confederation of United Tribes, was to meet at Waitangi each autumn to frame laws, and in return for their protection of British subjects in their territory, they sought King William's protection against threats to their mana. They also thanked the King for acknowledging their flag. By July 1839, 52 chiefs had signed He Whakaputanga, including Te Hāpuku and Te Wherowhero, the first Māori King. The document was officially acknowledged by the British government. Busby saw it as a significant mark of Māori national identity and believed it would prevent other countries from making formal deals with Māori. [We] invite the southern tribes to set aside their animosities, consider the well-being of our land and enter into the sacred Confederation of New Zealand. 4. We agree that a copy of our declaration should be written and sent to the King of England to express our appreciation (aroha) for this approval of our flag. And because we are showing friendship and care for the Pākehā who live on our shores, who have come here to trade (hokohoko), we ask the King to remain as a protector (matua) for us in our inexperienced statehood (tamarikitanga), lest our authority and leadership be ended (kei whakakahoretia tō mātou Rangatiratanga). The Codicil We are the rangatira who, although we did not attend the meeting due to the widespread flooding or other reasons, fully agree with He Whakaputanga Rangatiratanga o Nu Tirene and join the sacred Confederation. It was then translated into te reo Māori by Henry Williams and written out by Eruera Pare Hongi. Busby despatched the English text to both the New South Wales government and the Colonial Office in Britain. Declaration of Independence of New Zealand 1. We, the hereditary chiefs and heads of the tribes of the Northern parts of New Zealand, being assembled at Waitangi, in the Bay of Islands, on this 28th day of October, 1835, declare the Independence of our country, which is hereby constituted and declared to be an Independent State, under the designation of The United Tribes of New Zealand. 2. All sovereign power and authority within the territories of the United Tribes of New Zealand is hereby declared to reside entirely and exclusively in the hereditary chiefs and heads of tribes in their collective capacity, who also declare that they will not permit any legislative authority separate from themselves in their collective capacity to exist, nor any function of government to be exercised within the said territories, unless by persons appointed by them, and acting under the authority of laws regularly enacted by them in Congress assembled. 3. The hereditary chiefs and heads of tribes agree to meet in Congress at Waitangi in the autumn of each year, for the purpose of framing laws for the dispensation of justice, the preservation of peace and good order, and the regulation of trade; and they cordially invite the Southern tribes to lay aside their private animosities and to consult the safety and welfare of our common country, by joining the Confederation of the United Tribes. 4. They also agree to send a copy of this Declaration to His Majesty, the King of England, to thank him for his acknowledgement of their flag; and in return for the friendship and protection they have shown, and are prepared to show, to such of his subjects as have settled in their country, or resorted to its shores for the purposes of trade, they entreat that he will continue to be the parent of their infant State, and that he will become its Protector from all attempts upon its independence. When I was in University, my tutors wanted us to write a paper on the how colonisation impacted Māori. I wrote several things that positively impacted the lives of Māori, and by doing so was told by my tutor to remove it or my paper will be failed. The amount of pandering to the loud minority and hand-holding is pathetic. Those idiots who wish to make Māori compulsory do not represent the majority of the Māori population, nor do Te Pati Māori

The issue between law and Tikanga/ custom was decided way back in 1841. Maketu, a young chief of the Nga Puhi tribe, murdered Mrs Robertson and her family, and others, on their island in the Bay of Islands. Maketu fled to his tribe. A very large meeting was then convened by all chiefs in the area to discuss whether he should be given up to the fledgling British authority and tried for murder. After much discussion, they gave him up. Heke of course did not want to... and went on to fight his inglorious war. To allow Tikanga equal status to law would be very.. retrograde.

We want our kids to have the best opportunities so if they are studying law for example more time should be spent learning the processes etc that will give them skills that are adaptable to the rest of the world.

Every iwi has been given billions in reparations and land, and are now all VERY wealthy. They are all building huge buildings in all main centres, renting them to government departments and corporations. They do not pay tax - how many New Zealanders know that? Given that they pay no tax, they have been able to increase their wealth hugely. There are now large numbers of highly educated and wealthy Maori. However, they don't want you to know that, they want you to think that they have been disadvantaged by the European, and demand every more money. If there are still disproportionate numbers of Maori committing crimes, why are these wealthy iwi not doing anything about it?.

Thats why so many Chiefs were willing to cede sovereignty by signing the T.O.W! Life under civilized colonial rule was far, far more peaceful than life under Maori tribal rule. That a fact my guy.

We will be at the mercy of every individual maori who can claim this 'tikanga' is peculiar to him and his whanau. The 'planned' adoption of this notion that a belief/cultural understanding/practice of a specific group will take precedence is not tenable under the justice system we hold to which considers that there is a social contract we ALL are party to (citizenship) and the rules I.e. laws that govern that apply equally to all regardless of race/ethnicity. It is like saying that islamists hold to sharia law and that it is this law that must determine how we prosecute what is considered lawful in a judeo christian court setting.

You raise a good point, different tribes had different names for some plants suggesting long periods of non-interaction with different groups. That would easily lead to cultural differences.

@@damionkeeling3103 That's what I was thinking. There are different protocols, names, even how Māori arrived here for some Iwi. Te Reo is an anglised transliteration of dialects. I'm mixed so only have one Hapu but many of my cousins have 2 or more. This takeover is getting ridiculous.

The common law isn't the same throughout the common-law world, but we still teach it. Also, NZ lawyers are able to practise law in Australia (even though Australian common law isn't the same), as long as they take the oath in Australia.

In NZ, we somehow manage to learn (some) Australian, Canadian, English, and US law, even though it's not exactly the same as NZ law. Do you think that are any NZ lawyers who know all of NZ law? There aren't! Also, NZ lawyers have the right to practise in Australia, as long as they take the oath there. It's not as difficult as you think, if you use your imagination.

It's incompatible with modern law, it's a system that comes from the stone age. My ancestors lived in the stone age around 5000 years ago, I wouldn't want our legal system which has developed over millenia to be replaced by something from back then. At best issues between Maori could have that option but that's problematic too as then you're creating parallel societies which overlap in physical space. It's not like there is some great Maori tribal hinterland, the vast majority of them live within regular NZ society and the tribal lands are scattered and relatively small.

Cui bono? Lawyers. Tikanga, as custom, folklore, oral history and tradition, is by necessity local and specific to iwi/hapu. It is not law, in terms of administrative or common law, criminal law or tort. It should not be brought in the back door through the courts. Parliament has that role and right. Tikanga, as local specific, should not be imbedded in case law because it is multivariate and unknowable in advance. There can therefore be no certainty or clarity around what it might mean. If a case involves a plaintiff from hapu A, and is resolved, then case law cannot rest on precedent for a plaintiff from hapu B in another case. Either there will be a miscarriage of justice applying the wrong precedent, or there will be appeals ad infinitum over the tikanga in question. In is genuinely Pandora's Box. So far so murky. Where it spirals WAAYYY out of control is property rights decided at individual level, then applied to property rights or claims at the level of corporate body, ie iwi or hapu trust. At that point, property rights as we know them are all subject to dispute. And all this to satisfy Susan Glazebrook's personal crusade to be in the vanguard of the decolonising woketariat. Great.

Proof of these customs would actually be reassuring. With no written language, it’s easy to make up any sort of mumbo jumbo to suit the narrative. I doubt if there was much ‘justice’ for a transgressor prior to 1840, especially if they weren’t one of the elite.

I honestly don't agree making it compulsory. But when you look way way back to when the Pakeha first started settling in Aotearoa things were being put in place to take control of the whole country and put in place English governance and hence the Treaty of Waitangi came into reality. To this day both the English and the Maori versions have been disputed due to their interpretations. The situation with this matter in a lot of ways is about some people trying to right the wrongs of what happened in Aotearoa stretching all the way back in the past where Maori were not afforded any voice of how this country was run, governed. Today we all reap the good and bad things created by all our forbears and that is what we are now seeing today.

@@MrWillt100 Incorrect, the proper and original name of the country is New Zealand. Aotea or sometimes Aotearoa referred first to the Great barrier island and was ocassionally used to refer to the North Island (probably because it was easier to say than Te ika a Maui). It was not used to refer to the South Island or Stewart Island and it wasn't used to refer to the Chathams or the NZ Subantarctic Islands. The original name for the current collection of islands that comprise New Zealand is New Zealand.

​@@Dave183the point of course is that many civilsations have left their stamp on aspects of what we know, how we govern, how we live,the industries we have evolved etc. Aa we read the span of history we see civilsations rise and fall but their contributions are weighed and noted. The primitives of Britain in the early 1st century were colonised by the Romans which started the journey to Empire. I would argue that the Britain of the 1st century was further advanced in many if not all aspects than the stoneage Maori if the 1840s. Native populations living in isolation naturally create some form of culture and ways of living. But let us not be deceived that such limited evolved tribal mores and culture should be jammed willy nilly into 3000+ years of accumulated and developed knowledge and experience. There are always lessons to be learned and absorbed. But to swallow te ao maori and tikanga holus bolus into New Zealand would be foolhardy and send us into third world status.
