I didn't see any marks on him or him say they were roughed up. There is no need to throw in lies. Its a good lawsuit. I can imagine after reimbursing the man walmart offers them a $25 gift card for their troubles. That seems to be their go-to thing to do.

Lawyers are amazingly feckless. Case is weird b/c prisoner's phone call was to the media instead of speaking to the judge later that day. Not really a story. If judge bonded him, them that is a crooked judge for not sending a detective out. Another hard to follow crime vid. ho hum.

Doing a half-arsed job is a CHOICE. It's done with Intent. Why? Because these uniformed cowards know that innocent people are far safer to handle than actual criminals. It's an easy way to fulfill arrest quotas. They KNEW he was innocent the very moment they REFUSED to see the receipt. Actually they knew he was innocent way before, because they CHOSE to not see all of the video and they CHOSE to not check the cashiers' records.

I have to fix one of those mistakes as florida sent me something that affects my right to carry where they got no details other than "we was told to do this take his right to carry" because when I asked them questions they were playing guessing games, could certain people be laughing in the background where they would either go silent or be like "we are just gonna repeat ourselves" got to go pay out of pocket for a lawyer plus have to pay for a plane just because they decided to out the blue send me these things like they being cute till someone audits them. None of the case numbers they sent I have access to and if I did they won't let me see the entire thing. Haven't got any letters from the state I reside in because either this is going to take time or some dummy down there needs to be fired. And one of their maybe were "maybe it was due to a background check" for what I don't know

I've done AP for years for different companies, including Walmart. Often employees will believe something stupid like that, and AP/LP should be the grown ups who stop and say "Hold on, this doesn't sound right. Even if I have all 5 steps, I'm not making the approach/wasting LE time with that." The problem is Walmart pays less than market rates for AP, so the smart ones leave after a year or two. They spend tons of money on investigative tech, then hand it over to a dude making slightly less than a TSA agent and wonder why things aren't working out.

The sheriff's office is not at fault. The blame is soley on Walmart 100% for giving police poor evidence. I work for loss prevention and wherever I have shopliftings that occur and need to give evidence to police I go from the time they came onto the property until the time they left property so thay nobody can scrutinize me.

The Walmart people were incompetent. But when you hire minimum wage you get minimum wage worth of quality. The Cops on the other hand were outright criminal, because they CHOSE to not properly investigate. They CHOSE to not review the whole video or ask questions whether there are cashiers inbetween or check the cashiers' records, whether the same person who bought the other stuff also made a payment for the sand. And then they likely lied on the affidavit (which was necessary to obtain the warrant). You know they did this intentionally because it makes their job so much safer, when they go after people who they know to be innocent, rather than actual criminals... it's the same M/O that Uvalde's Finest employed.

The LP officer and the cops should have investigated enough to actually know the receipt existed on the day of the incident. No warrant would have been issued because they had the evidence no crime was committed. So the guy wouldn't ever have had to produce a receipt.

Because it's cheaper for Walmart just to review the video, report the incident to the police and let the police be the security/manual labor. if the 'criminal' gets injured, the police is liable. Trust me someone plugged all this information into a spreadsheet and figured out this is the cheapest way.

You aren't allowed to profit from criminal conduct, and he did. Thus the fine. Now we have the hush-money case. He could get jail time from New York state. We'll see if he has any defense, but I suspect he doesn't. In fact, I'd bet a dollar that he refuses to testify under oath, and then claims they _wouldn't let him_ testify.

You can blame the sheriffs department on that. They didn’t do anything. That was 100% Walmarts fault. Those 2 cops knew the guy was guilty. They got told by a legitimate source what happened. So they were 100% convinced that he couldn’t get a receipt saying it. It was probably a few hours later until they even k anything.

Also yeah he claimed he had a receipt and they refused to let him show it because it wasn't on his person.

@@stumpel54 When asked if he could produce the evidence, he told the cop he could, and then the cop denied him the time to go and get the evidence, so the cop intentially suppressed the evidence so that he could make the charges. The cop had already decided guilt, which is not his job. People don't do things just once. A theif doesn't rob just once, a killer doesn't just up an kill, and a cop doesn't file charges based on no or poor quality evidence just once. ALL of his arrests need to go to IA at a minimum, but preferably go to an independent audit, so at least folks can find out how many people he's put in jail that didn't do the crime.

Hell they could have probably have let him show a bank account bank account transaction on a phone app and see he spent money at Walmart at that designated time. It's very odd how law enforcement will act fast for a business when it comes to theft, but when it comes to your personal property, they could care less. You can literally tell them that you have a tracker and that I am able to track it live, and all they say is let them handle, 2 weeks later, I am left with a burnt car, towing and impound fees.

Retired LEO here, I’ve been inside Walmarts Asset Protection room watching video years ago, their camera system (back then even) was so advanced it was impressive. They can pull up the transaction and watch each item you scan impose on the screen, then it will show the form of payment. I was investigating a stolen check book where the suspects went shopping there, yea we got’em but for Walmart not to exercise due diligence and view the entire footage of the shopper is simply negligent. Write that man a check.

should its the key word - but "failure to correctly investigate a crime" isnt a crime according to practiced law - failure to investigate wont overcome the qualified immunity cause a reasonable officer could likley be wrong in the investigation - Thats the problem today - in the past it was likley more servier but technology make as aware of the behavior and praticec of LEO across the US. The practiced Law hasnt changed and the standard frase of "we investigated ourselve and found no wrong doing" is the outcome of most instances of investigation into wronddoing of cops. Also the behavior of wallmart for "wrongfully reporting a crime" wont change soon cause the cops wont do anything about it. And even if they do something and decide to charge wallmart mostlikley the prosecutor will decline to prosecute - wallmarts are reported to be hiring active duty cops in there freetime to provide security and this relationship could be seen as potential a conflict of intressed but no one is botherd by it

"failure to investigate" its not a failure to investigate because cops were shown a unedited video that shows a man enter walmarts garden section where they keep the sand. load up 7 bags then immediately leave. this is even said in the video but not show for some reason. then about the cops going after walmart, yes there was negligence on their part but the cops would have to prove malice for falsely reporting a crime. so more than likely they wont do that because there probably wasnt any malice on walmarts part only negligence. if there was risk for criminal prosecution for reporting a crime and being wrong then people wouldnt report anything. but it is a crime to falsely report a crime because it was done maliciously

This all could've been avoided IF they did there job CORRECTLY not just say "oh yeah they stole go get 'em boys!". Walmart can SEE EVERY TRANSCATION MADE AND RUN BACK CAMERAS. All stores with self-checkout and even regular registers are capable of looking at past transactions. I worked at enough of them and have done that before when someone said they forgot to pick up an item or if they doubled scanned something by accident! Its also called COMMON SENSE!!! Walmart defiantly made a false report and made this family GUILTY without proving INNOCENCE and the police officers acted stupidly and he should sue BOTH Walmart and the Sheriffs Dept for False Arrest and False Report!

I know of a sand, gravel and concrete business where their property was next to state land. The state land included extensive sand dunes. The S&G company had been helping themselves to this sand over several decades. The S&G workers were told that their employer owned the land where they were taking the sand. The S&G company was figured to have stolen over 20,000 tons of sand from a state before a state surveyor figured out what was going on. Neither the founder of the company who had started taking the sand or his son who followed his dad's lead ever spent so much as a night in jail for the theft.

As a former Wal-mart employee (I worked there from 2014 to 2019), it's important to know the facts before jumping to conclusions, not the other way around. Innocent people who legally pay for their purchases should not be arrested; genuine shoplifters who take things without paying and leave empty packages behind should. Also as a former employee, I've paid for every purchase I've made at Wal-mart.

Working for a “corporation” does not give one immunity in civil or criminal matters. The Loss Prevention employee signed their own name when they filed a complaint with the police department. Lying or misrepresentation on that form is on the employee criminally and civilly, and on the corporation civilly. Given your comment, it is not clear that you understand corporations as it relates to this scenario. Working for Walmart does not give one “qualified immunity” nor does it excuse gross negligence. I’m sure you can think of a hundred scenarios where a Big Box employee would be responsible for their actions while at work?

@@AV84USA You mean just like you did. So tell me how many individual Walmart employees have been jailed for for this in the past to your knowledge. They work for a corporation. The corporation takes responsibility for their actions. And even more why would you sue Walmart employee? What would you get? Do you think they’re rich? If it was that blatant, then they’d be criminal charges. Did the report include the Walmart employee or employees being arrested? Qualified immunity is not something you have as an employee of a corporation. Do you know what it means? It’s illegal distinction generated by the Supreme Court. It’s not a law and it doesn’t apply to civilian employees.

@@neilkurzman4907 I’m assuming you’re young, but you really have to read before going off on what you think you read. I wrote “needs to be personally held accountable as well as Walmart” that can mean civilly, and you can bet your smug butt that they’ll be sued, and criminally if they’ve broken any laws. Signing an affidavit falsely is illlegal, and depending what exactly the affidavit the loss prevention officer signed, it could be a crime. (I did not say that in my original post, but since you’re going there…) I have seen many cases where loss prevention officers testify that “I observed suspect enter store, select items, conceal items, and proceed past checkout with items” or some combination of that. Almost always do they state that they observed the suspect entering store, presumably without the merchandise… In this case, they did NOT go back to the entry point or they would have seen him prepay. I do not know what is worded on the affidavit that they personally signed.

How did Walmart know who they were to issue warrants for? Were they recognized and known by somebody? If they had records of when they paid they should have been able to see what they paid for,

How does whatever Walmart allege get turned immediately into an arrest warrant? That is a lot of power to get immediate and complete credibility over someone's life. The detective following up the next day after the arrest should have happened before a warrant was signed by a judge. Half-ass work at an innocent families expense. Hopefully a large settlement can prevent future incompetence.

Do large settlements EVER stop incompetence? There is never any PERSONAL accountability, and also never ANY changes in procedure. The money ALWAYS comes out of deep pockets and is considered a cost of doing business. Our society has LOST the concept of PERSONAL RESPONSIBILITY for wrongdoing. Performing official actions NEEDS to have Personal Danger involved to make it SERIOUS ENOUGH that all parties tread carefully and deliberately. For all of the risk and damage to be one one side of the equation is NOT justice.

Walmart treats every customer like a crook. I had a cashier's assistance ringing up a tv one evening and before I could even walk 10 feet from her register a man who watched me pay for it asked for my receipt, then 3 feet beyond him another man asked for my receipt. I told him, "No, all three of you watched me go through the cashier's line and pay. Call the damn cops. I'll be in the gray Ford f150." I literally HATE Walmart!!

The part that they don't tell you is that even if the arrest is expunged from your record, an arrest still shows up on your record. You'd still have to explain what that arrest was for. So, it is still a hinderance when it comes to getting credit or applying for a job.

They use facial recognition and know every time you've been there and they can easily pull up and watch your history at 10X speed and see if you stolen before... Walmart will probably tell you they DO NOT us facial recognition, but that what the wall mounted, face level, Bosch cameras are doing. Extreme resolution...
