On Thursday December 16, 2021 I, TFC A. Aponte-Gotay was patrolling the area of GA-13 southbound and Sidney Marcus Blvd when I visually observed the driver of a silver Honda Civic (GA Tag CNM4872) holding a cell phone in his right hand looking down while driving. I activated my emergency equipment and initiated a traffic stop. The driver of the vehicle changed lanes into the gore area and accelerated initiating a pursuit. I notified the GSP Troop C radio room of the pursuit immediately. At the end of the gore area the driver cut across the right lane of travel and continued to drive at a high rate of speed down the right shoulder past heavy traffic. Upon coming up to the Piedmont Rd entrance ramp the driver made an improper lane change into the entrance ramp lane, continued down that lane before entering the right shoulder again after the Armour Dr exit. Again the driver changed lanes into the entrance ramp lane from Armour Dr to GA-13 southbound and cut across to the right shoulder continuing to drive recklessly. As the driver approached the exit for I-85 southbound he struck the right concrete wall then struck a white van in the left lane of travel. The driver continued fleeing southbound on GA-13 at a high rate of speed changing lanes erratically as traffic cleared. There were no other patrol units in the area to attempt to set up stop sticks or attempt to box the vehicle in. I positioned my patrol vehicle to the left of the fleeing vehicle to perform a P.I.T maneuver and backed away due to upcoming traffic that was slowing down as we approached. As we passed the slowed/stopped vehicles I again positioned my patrol vehicle to the left of the fleeing vehicle to perform a P.I.T maneuver and again backed away due to upcoming traffic. Again as we passed the slowed/stopped vehicles I positioned my patrol vehicle to the left of the fleeing vehicle and performed a successful P.I.T maneuver. The left side of the vehicle struck the left concrete wall, then traveled across both lanes while spinning clockwise and struck the right concrete wall with the left rear of the vehicle before continuing to spin clockwise and coming to an uncontrolled final rest facing northbound in the southbound lanes of travel. I immediately notified the Troop C radio room of the successful P.I.T and the crash while requesting an ambulance be en route. I exited my patrol vehicle and drew my department issued Glock 45 and began giving verbal commands to both the driver and passenger to put their hands up where I could see them. The passenger, Mr. Malik Matthew Davis, immediately followed commands and placed his hands against the windshield and remained there until instructed otherwise. The driver, Mr. Carlton McDonald, failed to follow any commands, and continued to reach underneath the drivers seat of the vehicle before crawling into the back seat of the vehicle and taking a drink out of a silver and blue can. At this point I took cover at the rear of my patrol vehicle and notified the radio room the driver was non compliant and moving, requesting more units to my location. I continued to give verbal commands to show me their hands and stop moving around within the vehicle. Mr. McDonald crawled between the front seat and the backseat multiple times, reaching underneath the seats, drinking out of a can and failing to comply with direct orders. Mr. McDonald also repeatedly exited the vehicle through the rear passenger side door of the vehicle, briefly showed his hands then entered the vehicle again. Mr. McDonald again exited the vehicle and still had his hands out of my line of sight from the back of my patrol vehicle. SGT Rariden 335 arrived on scene shortly after and had a higher vantage point due to being on the northbound lanes of GA-13 looking down onto the southbound lanes. At this point Mr. McDonald showed his hands as we approached and we continued to give verbal commands to get on the ground. SGT Rariden instructed the passenger, Mr. Davis, to exit the vehicle and lay down on the floor, to which he complied without issue. I then drew my department issued Taser and approached Mr. McDonald giving him commands to get on the ground or he will be tased. Mr. McDonald got on the ground but continued to attempt to reach into the car and crawl around on the ground. I again gave Mr. McDonald a warning that if he did not stop he would be tased, and he complied and stayed still on the ground. I holstered both of my weapons and prepared to effect an arrest on Mr. McDonald. As I attempted to place his left hand in the handcuffs Mr. McDonald pulled away and began to actively resist. Mr. Mcdonald grabbed my handcuffs which were now on the ground and threw them into a storm drain next to us on the floor. I began struggling with Mr. McDonald attempting to gain control of his arms using my feet against the concrete wall behind us as leverage. As Mr. McDonald attempted to stand up I wrapped left arm around his upper body and brought him back down to the ground and rolled him onto his side. I heard SGT Rariden say "taser taser taser" and I turned my head away while attempting to keep control of Mr. McDonald. The taser was effective and I then gained control of Mr. McDonalds left arm while under power. Upon gaining control of his left arm I was able to control his legs by sitting on them while gaining control of his right arm as well. SGT Rariden placed his taser on the wall and jumped down before placed the passenger Mr. Davis under arrest at this point without incident. Mr. McDonald continued to physically resist arrest and all ignore verbal commands. As I struggled to keep control of his arms SGT Raridens taser fell off the wall and landed in front of me. I laid all of my body weight onto Mr. McDonald before reaching with my left hand for the taser. I told him that if he did not stop he would be tased again. I noticed the wires from the initial probes still protruding from underneath his body and fired the taser towards the concrete wall to re-energize the probes already on Mr. McDonald. SGT Rariden came over and gained control of his right arm as I gained control of his left arm and we placed him in handcuffs. We sat Mr. McDonald down and leaned him against the wall and searched his person. He was then placed in the rear of my patrol vehicle. Mr. Davis was placed in a separate patrol vehicle after being searched as well. When I returned to my vehicle at approximately 1543 hours I read Mr. McDonald his Miranda Rights and asked if he understood and would still like to speak to us, to which he gave a verbal yes. During a vehicle search a handgun, $892 in cash, multiple individually packed baggies of marijuana, rolling paper, blank gift cards, credit/debit cards with different names, a card reader/scanner and numerous other retail items were recovered from the vehicle. Mr. McDonald was transported to Grady Memorial Hospital by EMS personnel on Grady Bus without further incident. Mr. McDonald was released from Grady Hospital at approximately 2349 hours and transported to Fulton County Jail by TFC Howerton 832 and turned over to detention officers without incident.
It's one thing if the officer is alone in a struggle and needs help from a bystander.. but the stupidity of bystanders just walking up to it on an interstate more concerned about their camera angles is a brilliant display of ignorance to situational awareness. 16:45 All i heard was "Excuse me sir, make sure you send my car to be stripped apart because I'm hiding a whole lot of something inside it." 19:00 if you're arranging bail from the backseat, I'd call you a flight risk; I pray prosecutors highlighted this in court to make the point that he had no due respect for the totality of the situation and push for maximum sentencing, why does this man still have any property on his person
When did they find that phone? I hope a warrant was issued to find out all the people he texted and called while in that back seat. He sure squirmed lots to get that phone out of his crotch and back what with the broken hip and all. He would not want me on a jury seeing that video.

It won't be long before Atlanta is similar to other places where they just won't stop you at all or ticket you for no insurance/registration/speeding etc. Maybe it's already like that; the last time I was in Atlanta and saw homeless tents lining the street I decided it was not the place for me.

Nah. It was good but a dangerous one as unsuspecting and uninvolved civian drivers almost were involved in it as the vicinity had a lot of traffic. Why they allow these criminals to hang onto their cell phones after arrest is beyond me. They get one call by law and not as many as they can make from their cell phones.
Allowing the perpetrator to still use the phone is actually a smart police tactic. That's why they read him his rights so quickly. After that, all those phone calls and contacts will be used later to catch more criminals. All the data on the phone will be downloaded, contacts, etc. Smart criminals do not carry cell phones. - j q t -

But in this situation, looking at who they pointed the gun at, the passenger that had his hands up the entire time, would be the one getting shot if they opened fire. And I think thats also why they did not open fire even with a suspect reaching around and crawling out.

That guy filming needs to get a ticket or arrested for obstruction and endangering his life especially when the scene was not checked and cleared for weapons.

The pedestrian should've helped instead of record. He first seemed like he was doing it to get attention, but when he signaled the other officers to the trooper, it seemed like he was assisting him.
Maybe he should’ve physically helped the cops, but I think he was just trying to document it, maybe even to help protect the cops from liability. There should be a law for people that just walk up in a active emergency scenes just to video. Fine them $500 bucks first time then jail on the second time. They just make the job harder for all involved. You can video from a safe distance and not cause confusion till things get under control.

Right in my old area. So glad I left Atlanta. Where I live now I can leave my keys in the car and don't have to wake up every morning and go out to the parking lot to see if my car window was smashed out or if it was stolen.

I grew up in the country...always wanted to live in a big city...I left, for a few years to a bigger city. It wasn't me, came back home and found a nice spot in the country...I can leave my front door open with the screen closed, car doors unlocked...that type of peace is priceless.

That certainly looked much closer than any 8 foot from a scene to me but then since no one is in control of it who is to say where 8 foot really is anyway.

I think you might be missing what happened. I think all his verbal bs and apologizing and claiming ignorance in this situation was intended to be distracting. That whole segment with him on camera in the back seat of the squad car. He pulls out his phone and is actively doing something with it. Even makes a call to someone (seemed he placed several unanswered calls, then one finally answered).. could have been deleting stuff.. could have been doing anything. All the while he keeps periodically tucking the phone down, yelling out something to the officers to keep up the act, and then back to the phone. When EMS comes he goes from having been perfectly fine in the backseat for a while to suddenly crying again about injuries. The posted narrative says he was searched before he was put in the squad car, but I question that.. or clearly he wasn't searched carefully. I think that's because he had that officer all riled up and angry that the officer just wanted to get him into the car quickly and not deal with him anymore. So it all feels like a show. He played them.. without that backseat camera he would have done it well. So my point is maybe he wasn't really trying to do any negotiating or real apologizing. Maybe it was all intentional and calculated. Which is worrisome to think about.
Always do a thorough search of the suspects before placing them in your patrol car. You never know what they could pull out of their pockets etc... it could have been more than a cellphone
The first videographer was OK, however the second one was not. His motive was suspect and probably was caused by either hoping to video a mistake by the officers, or he was just expressing anger. Neither is a good motive.
Yea but nobody is under no legal obligation to help another officer. It's cowardly in some circumstances but you should always do what you feel safe. You gotta get home also.
2:35 the gray SUV’s situational awareness saved him from a certain wreck; slowing down and pulling to the side the moment they came into view around that corner. I’m impressed considering how oblivious most drivers we see in these chases are.
What an amazing amount of patience these officers had. I expected the driver to be full of holes at any second for all of that bobbing behind the rear door he was doing.
The officer really had every right to use lethal force on the driver. The driver refused to comply kept moving around, crawling refused to listen. The driver could have reached for a handgun. These situations are so dangerous.
That dude in the back seat, looking around, squirming, scheming, hiding his phone, making calls, checking his social media, screaming at the cops, hiding his phone again, making another call, looking around some more, yelling for the cop again, as soon as the cop comes to get him, all of a sudden he's hurting so bad, my god.
And the fact that the Troopers didn't find the phone during their search, there's a lot to unpack here, like what else did he hide while ducking down behind his car after the PIT, I mean the phone was in his prison locker, if it's big enough to hold that, what else is up there???
There would have been more arrest in a different state. The ones in the middle of an active scene filming could have made the trip as well. Officer safety is paramount and those two individuals were impeding the officers doing their job and certainly they displayed no regard for officer safety. Instead of filming, why not lend a hand securing the perps. It takes some ignorance to charge in to an active scene on an interstate highway to be the hero and try and catch an officer doing something wrong. Get in there and be a real hero and help that officer! Storm in to an active scene like that and get your self shot is what could have happened. The officer’s attention doesn’t need to be pulled away from an active situation having to deal with ignorance.

Seriously he went from minor traffic infraction to jail time and they jacked his car up good so he lost that to and insurance companies tend to frown on paying out when you use your vehicle in the commission of a felony

As a 30 year Law Enforcement Officer I was so mad to see the detained suspect pull out a phone. They are all lucky it was just a phone and not a secreted gun! I was mad at the officers, not the suspect .They should be reprimanded for such lack of basic search procedures and forced to under go more training. This could have been a very bad situation!
Somewhere along the way they think they can slide over to the passenger side or hop in the backseat and deny being the driver. They are scaring themselves way more than the police are.

I hope to hell that furtive conversation he had on his phone at 18:57 was able to be used as evidence against him, as well as against whoever he called after they got his phone and checked its records. Clearly he didn't realize he was being recorded. Oops. What scumbag thug.

There is something strangely graceful about this pit. The amount of people at risk and barely any vehicles (and no people) were damaged, the scarily close spacing to an innocent civilian that was hard to see in the moment that applied their brakes at the perfect time but also watching the fleeing drivers tire separate from his vehicle, continue in a straight line along the road and eventually sail off over the side of the overpass in the distance, hopefully not hurting anyone below. Seemed almost like something out of a movie, where it would be hard to take seriously had I not just watched it happen in real life.
