This sounds like an extremely rare occurrence. TPR usually takes place after years of child being in the system and following extreme attempts at reunification
In the state of FL TPR is done on the 1 year mark of the case starting. So it does happen here quite often where parents get TPR on cases and the child is then out in the system for adoption

On a personal note "Statute of Limitations" 2 years mark the anniversary date when the suit was filed. After that, I would think a new suit would have to be filed to terminate if not amended before the 2 years.
Well, if the parents' rights were terminated by someone other than CPS, or if the child has been placed for adoption, then the parents cannot get their rights reinstated.
What can you do if you can prove perjury on behalf of the cps investigator and attorney ad litem. My case was closed last year and my child was going to be adopted to family.
ad litem said my last visit was bad because my daughter was crying and didn't wanna leave me. Texas really needs to do an overhaul on the system its set up against bio family 100% because they get federal funding for every child in foster care and if they don't take more than the year before these poor counties sit at a deficit, basically relying in child trafficking from one family to another for those fed funds.
Oh goodness. I have so many questions that won't fit in a RU-vid comment. But most importantly, you should hire a local attorney who can advise you on your next steps. You might be able to request a new trial, appeal, or seek a bill of review. There are a lot of ways to attack, depending on how much time has passed. I would highly recommend speaking with a local attorney without delay.

I have so much proof of perjury, and corruption in my case. It was rigged from the beginning, I was at the last step and about to get them back and I was blindsided. My attorney was kicked off the case because he stood up, yelled to me "the wool is being pulled over your eyes and its rigged for you to lose!". After court that day, the CASA worker (very corrupt!) Walked up and told me if I reach out to him (the attorney that was kicked off the case) they could bring criminal charges against me. Found out years later, that was a lie, they couldn't bring any charges on me if I would have reached out to him! My son is 14 years old, has been through 10+ foster homes and was just moved again. He wants to come home to mommy but I don't know how to even try! I need help. I pray to God an attorney helps me with even just a little advice🙏🙏🙏🤞🤞🤞 Ps, they never had a single bit of proof against me, I've taken hundreds of drug tests, not once have I ever EVER failed one. They had 19 witnesses to testify against me... None of them had a single negative thing to say about me or my parenting! Infact, they all had positive things to say about me and my parenting, there was a few there that was confused on why they were even summoned in the first place. One of them was a lady from the doctors office that you walk up to and sign in for your appointment... She was on stand visibly confused, they asked her "did Ms, ------- (my last name) seem under the influence?" And other ridiculous questions like that. They just wanted something on me. They never got it though, but I still lost 😢.
(forgot to mention I'm a joint managing conservator and they are trying to act like I abandoned her when they hid her moving) Fosters mediated after actively fighting reunification our cps case worker told them when she placed my daughter that she was up for adoption which was a lie. We did court with cps for 2yrs then mediated with fosters for 1 year and joint custody they vanished with my daughter and 5yrs later sue to change her whole name I now filed for an enforcement of visitation and my county seems to be ignoring it. They are rich and got legal aid so now I cant get a lawyer unless private and no one wants or is interested in my case. this was all over less than a gram of weed and I passed all my cps drug tests for 18 months. they also lied about the drug tests I had to go to another lab and get my lawyer at the time another drug test and it was clean while I was never given access to the "Failed" tests they just talk and judges let them take kids... cps really needs to be shut down.
That is terrible! If you're filing motions, don't think that the Judge is just going to set it for a hearing. You should contact the Court to get hearing dates and get your motion on the docket. If you don't already have an attorney, you need to get one immediately. CPS is a broken system and they're not going to do you any favors.

Yes, this is a Texas law, but many states have instituted laws for reinstatement of parental rights. Unfortunately, it looks like Michigan hasn't yet done so. 😥
Ok. I have a different situation to get information on. What it there is evidence of a judge, 3 lawyers, 3 mental health therapists, DSS, and law enforcement acted unethically and in some areas illegally and the child was taken? The child even tells the therapist that they are not afraid or in danger or anything like that. The child also says that "I wish I could be with you always" as he hugs his dad and cries. Again there is evidence consisting on video, picture, and paperwork.
Unfortunately, the options available to you in your state vary greatly from those that I know here in Texas. If you do not have an attorney to help guide you through this process, then I would highly recommend that you seek counsel immediately. There are deadlines to filing claims in these types of cases that run very quickly.
My wife and I had CPS Involvement I signed a guardianship I have never lost my rights CPS actually released my children to me after completing my program my step mother filed for full guardian ship. My wife was served by publication and the judge gave both our girls we are biological parents found fit and everything. The judge gave them to a third party we get visitation every two weeks. Their is no precedence for this case. The judge broke multiple statues and violated 4 individuals constitutional right to be together. We are fighting this in Montana supreme Court right now.
