I would never deal with a court appointed attorney for a cps case. Many of them work with CPS, have lunch with them, etc. Find one that will fight for you and your children, not a court appointed one.
Well, if you can afford a private attorney, then I highly recommend that route. However, depending on your state, your appointed attorney could be the same one that you couldn't afford. I've taken countless CPS appointed cases, and have never fraternized with CPS.
Umm...that's not accurate. Appointed CPS Lawyers are typically private attorneys who have agreed to accept a lower rate from the County in order to represent indigent parents. Why do you think that Appointed CPS Lawyers work for CPS?

I have a court appointed attorney on the other side. What I mean is that my ex has been withholding the kids and abusing them and CPS stepped in and I was served and I obtained a Public Defender to represent me for the safety of the children so they are returned to me. It's not always for the accused, but sometimes to ensure that the other non-accused parent has their rights represented as well. Had already filed in Family Court as well. Advice is to at least speak to the Public Defender and if you really feel they are incompetent you can respectfully fire them and go pro se. Just be realistic about your case and how court works.
I need a court appointed since I can afford right now I have a cps case I was falsely accused of I need help. My mother and granny have custody of my daughter but my family are over there heads as well. My mother says she’s not trying to take my daughter away from me but at the end of the day I didn’t tell CPS to give custody to them nor the safety plan and if anything they pretty much did that and because of what the hospital said about me making it seem like I was a bad & unfit parent. I need help & need to talk to someone I refuse to sit up here and lose my daughter a whole year and she’s a year old when I see her she’s currently 1 month at this time , I don’t mind taking these services but I didn’t do anything to deserve to take any type of services. My rights have been violated 😞 I need my baby back I haven’t see her since I left my mothers 😢
@@MatthewHarrisLawPLLC Well my cps worker I have told me I didn’t have to go to court and she is nice to me so if anything I will see how things go it’s just temporary custody my mother has , I’m just trying to get situated so I can go head and get my baby so it might be private custody but I haven’t went to court or anything at all

We are in NC. I can’t afford to hire an attorney. When I went to court, I asked for a court appointed attorney and was told I didn’t have the right to have one. Is this right? Both parents, plus a step parent were appointed attorneys, I don’t get it. Also, it’s been over 6 months, is it too late for me to GET an attorney now? Thanks for any help in answering my questions.
I don't know NC law, so I'll give you the Texas answer. If they state is trying to interfere with your parent-child relationship, then you're entitled to an attorney. If you're the grandparent, then they aren't affecting your parent-child relationship, so you wouldn't be entitled to an attorney. NO. It is definitely NOT too late! I would still hire an attorney if I were you. I know that the cost might be difficult to afford, but perhaps you can find someone willing to take payments.
😲 When you get served with a Petition, there is usually a Citation that comes with it providing instructions or a Precept commanding you to appear. Did you get served?
No, appointed attorneys aren't available for Alternative Response cases since the State isn't attempting to take conservatorship rights or to terminate the parent child relationship. I think they SHOULD be available, but that isn't the current state of the law.
How do you find a attorney to help without paying so much for consultation, don't mind paying but paying not knowing if they could help us hard to swallow.
That's understandable. However, think of it like a Doctor. How many Doctors can you schedule an appointment with, have them perform diagnostics, and develop a diagnosis without payment? The doctor may not have a diagnosis to treat you, but that doesn't mean that they aren't paid for their time. Unfortunately, there are no guarantees in law. However, when it comes to dealing with CPS, having an attorney to guide you through the process is ALWAYS helpful even if they cannot protect you from mistakes that have been made.
