Good News: USCIS Waiving Biometrics Appointments for Several Applications

In this video I discuss the recent trend of USCIS waiving biometrics appointments for several cases. Back in March, USCIS issued a statement that they would waive biometrics appointments for I-765 renewal applications and use previously submitted biometrics. Recently, we have seen that they have expanded this to other applications such as I-751, N-400 and I-485.

If that can help anyone, the office of my state's senator was able to find me a biometrics appointment at my local ASC for my I-765 and I-539. To this day I still haven't received what would have been my original appointment notice. Things are still in progress but the senator's help was key.

@@xinhe2590 Hi. Well I do not have a ton more details as everything happened between the person helping me from the office of my senator (Oregon) and their liaison at the California Service Center. My lawyers filed for renewal of my I-539 and I-765 on 04/30. I have never received a biometrics appointment notice and things just stalled until 09/12 where my work permit was expiring and I had to quit my job. That's when I reached out to the senator's office. Thanks to their liaison they were able to find me an emergency appointment one morning for biometrics. That was the key. My contact then helped also speed up the rest of the process. I have received all my renewed paperwork on 12/22 and now ready to work again. Let me know if that helps.

Applied for a GC renewal and got a notice that they’ll be using my old biometrics and that the biometrics fee is not refundable. Did USCIS just steal $85 from me??

That's good news to hear!! However... we are wondering.. if USCIS waives the Biometrics appointment, and you've sent the money to them for Biometrics on I-765 renewal... We bet they are not refunding that money if they waive the appointment.

You should call them anyway. I called and left a message about how is that they haven't called me after 6 months of sending the application and they send me a letter by mail saying they would reuse my past biometrics and my status case changed to biometrics taken.

Yeah this was not the case for my husband We are applying for a few of these forms and been waiting since we filed in June 2020. He did his biometrics in November 2020 and now just doing more waiting Keep us updated thanks!

I can confirm that this is happening for N-400 cases! I filed in May 2020 and just received a notice of Biometrics Reuse stating that I would not need to appear for biometrics and that my previously taken fingerprints would be used! Some good news there!

Just remember each applicant is a unique thumb print and NOT everyone is waived from biometrics.

I’m sorry but you given a wrongly information. 1- the delays is due to whether the state where the biometrics will be done its open or not if has mostly business close in less percentages. So in order to be under “coronavirus control” uscis is using fingerprints on their system that’s for all applications

The websight says your fingerprints have been accepted. The notice of action says. We are working on case and will contact you if we require biometrics (which i paid for). Btw if they did you the favor of waiving you biometric why are you quibbling over $85? You should be happy.

I became eligible for naturalization on March 18th, yep the day of closure. I still applied to get in line. I waited 9.5 months (yep , a kid would have been born in that time) for biometrics, nada. Luckily I got plucked out of the 1.3 m waiting and got reuse after 9.5 months. I have NO doubt I'd still would be waiting now, 11 months later had I not proved lucky. I didn't have a delay in receipt notice-this must be a new thing.

Hello miss D'Angelo. I hope this message finds you well. I just got my I-140 approved by USCIS and we chose to proceed under the consular processing way now. I applied for the EB-1 visa. Unfortunately, there's one thing that is bothering me the most: The processing time. I'm currently living in Brazil and my attorney said that my immigration process would take up to one year after NVC sends my file to the American consulate in Rio de Janeiro. Here's the thing: I really think that's impossible haha. How come a consulate would take so long to finish a process? Congratulations on your approval! Because you are outside of the United States, it could very well take that long. The proclamations and the travel ban have to be lifted. Also, the embassy has to reopen and I’m sure they are very backed up with appointments waiting to be scheduled. In the mean time, get all of your documents submitted to the NVC as soon as possible. The NVC notice has the link to the website where you can check the status of your process.

Every piece of information that you are sharing about immigration is only for those who are already inside the United states So what about those refugees who are now outside of the United states and have been waiting for their departure to the United states since March 2020 ? They waved the biometrics(reused) actually, won't refund the money. I am still puzzle how they sent out 12 months extension for expire Green Card and gave themselves more than that to make a decisions. That means you end up living in the US illegally after the extension expires.

Thank you for the information. I received my employment based EAD recently without the biometrics appointment. The EAD card does show "Fingerprints not available". Does this mean, USCIS has waived it or It will be scheduled in future?

Daca doesnt really help you in applying for a green card. But they may use your biometrics from last DACA for your green card. So yes and no in a way.

This is probably in very very rare cases. They are scheduling biometrics and its significantly delayed. Remember they make money the more we wait so they will do that.

Hello there, thank you so very much for the info, but I’d like to receive a formal notice from the USCIS. I had an appointment tor the biometrics scheduled for March 2020, it was cancelled due to the pandemic. I was waiting to receive a notice with the new appointment date but I haven’t received anything yet. I called and was told that they are going to open a case and that I have to wait 30 days to get an answer. The agent I spoke with never mentioned anything about my biometrics being waived 🤦🏻‍♂️. Check your case on the USCIS website with your case number. More than likely it got waived.

The ASC place was closed for my husband due to the holidays. I didnt trust that they would just automatically send us another appointment so I sent the notice back yesterday with picture of the sign outside the ASC agency to Virginia and requested another appointment. I sent it through priority mail 📬 hopefully I get a response sooner

Call uscis and report it. They will open a ticket if your petition was applied 90 days ago and still Haven't received biometrics application.

My husband had a biometrics appointment on 12/24/2020. The the ASC agency was closed 🔒 bc of the holidays. We went again Monday 12/28. Invalid date Biometrics Appointment Was Scheduled March 4, 2020 We received your Form N-400, Application for Naturalization, and mailed you a receipt notice. It is being processed at our E-Filed Case Processing Section location - does it mean they are going to re-schedule?
