Im not sure how far this thinking has penetrated so bear with me, if ketanji brown were to try an assault case between Smith and Chris would she recognize this as a male on male crime and judge accordingly cause from my knowledge sex is a determining factor in there cases. Furthermore could Smith determine that Chris was a man and is that why he thought it ok to act accordingly(like a child I might say), and would the public have acted differently if Smith would have smacked a woman Chris Rock.
