The country of 'We the People' is a country where no one is simply above the Law because it is a real democracy. It has its Constitution (after a revolution that was fought before that) for a reason. Its a fundamental reaction to the very concept of absolute rule and immunity. Absolute immunity existed and ruled before that: it was called Kings (or autocrats, authoritarians and despots). That's the essence of what the creation of The United States of America was a reaction against. So America created a government of the People, by the People, for the People. And so it is called 'The People against...' in the legal system for a reason. (The Constitution and The Oath of Office exist for a just reason and the People deserve the answer in a balance system of separation of powers and respect for the rights of citizens.)
The Presidential Oath of Office is found in Article II of the United States Constitution:
"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."
Every American President beginning with George Washington has sworn this Oath.
