In sunni, if child is illegitimate, then is mother is his guardian but in shia, neither mother nor father is guardian

Very nice lecture thank you. To clarify one point as per Supreme Court judgement in the case of Gohar Begum Nazma Begum 1960-1 - SCC597, woman or the wife can be a natural guardian to the illegitimate child and not father.

Agar aapki beti kehde ki mujhe maa ke saath rehna hai or agar aap uska dhyaan achhe se rakh skti hai .or uska kharcha utha sakti hain toh kanoon apki beti ko aapse nahi le sakta

In sunni mother is natural guardian for illegitimate child . In Shia law neither mother nor father is natural guardian.

I also thought that but in the books it is written that she is custodian , the books i have were silent on the guardianship aspect of illegitimate children. If a question comes on this , just mark what your instinct tells you 😅

@@YGLAW Among the Sunnis, the father is the only natural guardian of the minor children. After the death of the father, the guardianship passes on to the executor.

An illegitimate child is regarded as “a child of nobody” under Islamic law, and the father has no legal claim to custody or care of his illegitimate children. However, the mother is still entitled to custody of her illegitimate minor children.

Under CrPC 1973, a muslim father is bound to maintain his legitimate or illegitimate children, till he or she attains the age of majority or if the adult illegitimate or legitimate child is not able to maintain him or herself or if the same child is suffering from infirmity

Muslim law also does not provide for the guardianship of illegitimate children, but, it seems, in modern India, by judicial legislation, it has come to be established that guardianship Of an illegitimate child vests in its mother. I think it might be the answer but as the google says illegitimate children are considered as a child of nobody

Illegitimate Children ka De Facto Guardian hoga, In case agar Custodian Mother shaadi kregi to uska Custodian ka right nhi rhega to court hi Parent appoint kregi jo De Facto Guardian Honge. Muhammad Rasool had married his daughter-in-law (wife of his adopted son) and so to justify his mean deed , one verse got revealed dictating Muslims that adoption is Haram in Islam.

Muslim law doesn’t recognise an illegitimate child but upto the age of 7 years it will be the duty of mother to maintain the child. After that child is free to chose that he wants to live with father pr mother.

A bastard belongs legally speaking to neither of its parents and it is in every sense of the word filius nullius but for the purpose of securing its due nourishment and support, it should, until it has attained the age of seven years, be left in charge of the mother. After that it may make his own election with which of the parents it will reside, or it live may them altogether...

Islam does not recognise adoption. In Mohammed Allahabad Khan v. Mohammad Ismail it was held that there is nothing in the Mohammedan Law similar to adoption as recognized in the Hindu System. However an adoption can take place from an orphanage by obtaining permission from the court under Guardians and Wards Act,1890. Whenever their is conflict between provisions of Muslim Law & Guardians and Wards Act,1890; Guardians and Wards Act,1890 shall be applicable. So, Yes, she can Adopt by Court.
