The plaintiff gave the defendant a deposit for an apartment, but after she found out the place didn’t have windows or smoke detectors, she asked for her money back. Unfortunately, the plaintiff says the defendant refused to refund the money, so she’s suing. The defendant says she had to turn other people away from the apartment because the plaintiff put down a deposit, so she is not returning the money.

whether she cashed the check or not she wouldnt have been required by real court, not this garbage made for entertainment nonsense but in a real court to give the money back since that is one of the primary reason land lord take a deposit . I find these programs more in line with reality scripted tv than actual real scenarios . I can tell you what, next time you plan on moving, give a deposit to any company, then call and tell them that you change your mind and would like your money back and see if the court rules in your favor; do that with the moving company or the leasing office to your next apartment. Even better, if you are ever lucky enough to buy a home, put down a deposit and then call them and say you change you mind and see if you will get back a dollar . Now, since you dont own anything, you obviously dont know anything about business and land lord are a business since they provide a product of service in exchange for money and the goal of a business is to collect money and put it into the bank. THAT IS BUSINESS 101!!!

Defendant knew she was going to have issues with her tenants, she was just trying to scam plaintiff. The fact that she cashed the check immediately after receiving it says a lot about her motives, that money was spent before plaintiff even called her to cancel agreement!

What exactly was the scam since everyone is alluding to a scam . What I realize about most people is, they will parrot whatever they hear without knowing exactly what they are talking about because , she listed an apartment for rent, they owned the apartment, she said the current tenants were to more out on a certain day, then those tenants wanted to screw their land lord so they didnt move out so exactly where is the scam or maybe just maybe you dont know the meaning of scam . Now, in real court, not this nonsense garbage made for tv crap, once she said the reason she no longer wanted the apartment was because she changed her mind, she would have lost that case since that is not a standard part of renting an apartment. The reason land lord take first, last and deposit is for these types of reason where people move out before the lease ends, people break stuff or people change their minds which you lose the deposit. This program reminds me of shark tank where nothing they do is by professional standards and its made for tv nonsense. Next time you are planning on renting or buying a car and put down a deposit, claim that you want you money back due to a change of mind or anything else for a matter of fact that can not be rectified and I bet in real life not this garbage you will not get that deposit back in real court

Even if you disregard that the Plaintiff changed her mind immediately, the Defendant still had 2 months to rerent the apartment so no legal right to keep her deposit. When the Defendant learned she didn't have an apartment to rent, she needed to return the deposit. She was completely out of her mind once she learned her tenants weren't leaving in December, she definitely needed to return the deposit.

In Norway it s not allowed for landlords to touch the deposit. It stays in a special closed account until you move out and nothing is damaged. Rules and regulations by law

In some states, South Carolina being one of those ( Landlord and Tenant Act) the remedy is treble damages. I once had an on site property manager tell me she was keeping our security deposit. Her reasoning was that the turnkey cleaning and painting of the apartment was going to cost money and she said " I gotta make some money on it". I cited chapter and verse on the pertinent clauses of the SC Act and warned her that she must return the deposit in full within 30 calendar days. Otherwise I would file a civil suit against her personally and the management company.. We received our entire deposit.

@@patersonplankrd : : You’re correct in your case. Painting an apartment is just one cost of doing business, unless you caused damage to the whole apartment, I can’t see that happening. The cleaning part depends on what your lease says. I have clause in mine, and it’s pointed out before anyone signs the lease. Cleaning is a huge part as far as I’m concerned. I always have the apartments squeaky clean for the next tenant. I give the option for them to clean, do they don’t have to pay……I’ve only had one or two tenants leave the apartment as clean as it was. . Life would be much easier if people weren’t lazy, and did what they were supposed to do. That goes for both landlords and tenants. For me, sometimes I don’t follow the law. If my business relationship with the tenants are reasonable, courteous, and fair, I’ll make exceptions and honor the tenants wishes when I don’t have to by law. Actually, I’m right now I’m allowing tenants to extend their stay at their request even though the lease is ending and it’s eating into my time. Two tenants in their late twenties, have paid every month, clean, quiet, cordial, good communication. Why not accommodate them when they’ve been such great people. Anyway, glad you got your money your money back.

@@Tuturu708 Because she is acting like it, her mannerism, the way she looks (unkept and greasy hair), the way she moves/talk, the way her mouth moves, and then throw in the fact that she stole that lady's money... it all points to her being a current drug addict. If she's going around intentionally stealing people's money, then yes, people should judge her. Pacifying addicts is why they stay the way they are.

@@Tuturu708 I'm 1/4th of PC's cases are about deposits and the such, concerning landlord issues... so I have common sense concerning people wanting to keep back money. But it's idiotic to watch this lady and not think she was straight out scamming the lady just for some quick money. She never planned on the girls leaving, based off their own words, but she tried to set it up as if there was txt proof. The whole thing was a scam, to try and play the system, to get money for her obvious substance abuse problems... And it seem like I must have touched a nerve. If you're a druggy or previous druggy, that's between you and your drugs. Don't bother me with nonsense, trying to stick up for a scammer, who's abusing herself.

Cheque is the English spelling, but Americans aren't good with the language and write "check" instead, nobody really knows why, probably because it's easier for them to drop the extra letters. Aside from the USA, which has absolutely butchered the language, the English spelling is used through the rest of the English-speaking world, from Australia to Singapore to the United Kingdom to Ireland to Canada and beyond! The American-only spelling of the English language still lies wholly within its own borders. and makes it very easy for the rest of the world to tell when they're talking to an American by text online. Cheque, Centre, Favour, Neighbour, Neighbourhood, Kilometre, Theatre, Metre, Colour, Catalogue --- there's lots of examples, hundreds, of how Americans write American instead of English. I hope one day that the USA starts teaching English instead of American in schools, so that the kids learn to read and write properly - it will help secure their future in the global world, where English is regularly used for business overseas. @@girlfriennn3645

The problem is that yes, any dog can bite.....but it's usually not fatal, like it is with Pit Bulls. No other breed (including all the large breeds) comes anywhere close to the number of fatalities that Pit Bulls cause. Over 90% of fatal attacks of dogs, cats, horses, and farm animals are by Pits. More than half the time Pits attack, they kill or maul their own family or visiting babies. There's a reason for that reputation, and it's not "the media". It's facts.

The defendant was caught stealing, she cashed the check that night (which a landlord isn’t suppose to do that) and had no way to give it back to the plaintiff, so she tried to defend herself by saying she had every right to keep it. Nice try

U should have to notify of any animals on the premises because of allergy and safety concerns also that's gonna be extra noise some ppl can't sleep threw dog barking and have to work In the morning u may not want to rent knowing that but it's alot easier for them to never move in, then moving in and dealing with stuff like this when someone leaves early just tell tenants there's animals on the premise very simple.

The plaintiff is an impressive and smart lady (apart from her haste in handing down the deposit) as she collected all the evidence, had the dates ready, issues documented etc. On the other hand the defendant just wanted to have some free money!
