When I moved to GA 3 years ago I went to title my car in GA. When I moved, I owned my car outright, never made payments and had always been in my name. My car itself was worth about $5,000 but they valued it at $8,000. So I essentially had to pay the state the tax just to "re-buy" my own car at a higher value than it was worth.

Sadly... These guys are unfortunate enough to know now what gun owners in America have been dealing with for years. There's nothing better than the government saying we're going to change our reinterpret a lot and you're going to be made an instant felon overnight. I e the ATF wanting to change the ruling on a bump stock being a fully automatic weapon.

Honestly in my opinion this is just another way for the government stealing money from everyone. Just excuse to get money out of people. I do agree that it is very stupid to pay tax especially on a used car. Government never see the bigger picture and you ask why America owns so much in debt.

We won't spend much more time on the Montana issue here on the VINwiki channel (unless one of the two subjects of the investigation want to come in and tell their side of it) but I wanted to get some of these thoughts out there to clarify a lot of unanswered questions.

Been enjoyable to hear it all, Ed. Though I should note U-Hauls, like many other commercial vehicles, have apportioned registrations. So each state (and province) gets their piece of the action. TAVT sounds like a train wreck I'm happy to avoid (shoutout to buying in South Carolina, then moving to Indiana), but I figure you want to use the most effective weapons in your arsenal. :)

Considering that the cars are 'owned' by the business and it's an LLC, the owners themselves may be exempt from personal liability. You could refer the state to the 'owner in-fact', the LLC in Montana. 'They' an agent of the company or attorney representing them, can make the assertion that the car is being 1) used by an employee or agent of the business within their discretion; or 2) borrowed by an authorized party on a person use-basis, without remission of ownership on the part of the LLC. (i.e. If I lend you my car, you don't pay taxes on it, I do, as well as I retain ownership.) Because the 'owner in-fact' still resides in Montana, they are not subject to the taxes demanded of Georgia. Georgia also cannot technically demand payment because of a lack of residence, to an entity that never existed within the confines of their state. (The sales tax is the burden of the merchant if they have that beef.) Further, the individuals can file a retort under what I believe is a rule 9A procedural failure in the court if they try to take them to court for the taxes. (Rule 9A is a requirement that the person in the civil matter must be actionable, and LLCs are designed to insulate owners from direct debt liability, so they are not.) If one of these guys can set an antithetical legal precedent based on the legal nature of their transaction, they can refute the state's authority and clear everyone of current and former liability. (They can cite the case.) People might then buy their cars in other states, harming only the GA dealers in this process.

Honestly, I don’t think it’s beneficial to them to speak about that right now. They can incriminate themselves and there is no way they can get benefited by that. Too bad the issue is not of a general public interest. People could put pressure on legislators and vote out public officials in an upcoming elections.

The good folks of Georgia did not want this tax, it was rammed through by the used car dealers association (lobby) that felt it unfair that private sellers of used cars was somehow unfair competition. As usual, the tax burden falls mainly on the middle class after the Great Recession.

California has it. In NC I payed 400 a year for my 370z. To move it to Cali registration was 3200 dollars for the California Use Tax

Davonte Little GA used to do that until about 2011. It was a small mileage rate usually about $40-70/yr for a normal car. Now it’s all up front when you attempt to register the title under a new name.

florida does to keep northerners from driving rusty junk down there when they move there. i lived there for 3 years. i kept my ohio drivers license and went back to ohio once a year for plates. it was cheaper than the impact fee

I'm from Montana and the best part of their plates is the selection. There is probably 60 different plates all with different colors and designs so you can pretty much find any plate to match the color of your vehicle

As a Montana State resident, the reason vehicle registration is so cheap and accessable is because cars are a necessity for daily life because of how rural and spread out it is here. That's also the reason we have Permanent tags so you don't have to register your car every year if it's older than 10 years

The car belongs to a Montana LLC. The LLC is based in Montana, obviously. No matter where the car is, how much time it spends abroad from the state, it still belongs to the Montana LLC. Even if the “owner” of the car and the LLC is a resident of Georgia, the LLC on paper and in legal terms is the owner of the car. Georgia needs to get over it

No one has brought that up, how does GA transfer ownership of an LLC back to an individual, regardless of how easy it is to know who the owner is on social media, where is the paper that says that this GA resident owns that car. Makes no sense. They are treating a loophole like a crime and that wont fly.

Rick Kruse I’m pretty sure like me as Georgia residents they paid their state incom taxes and property taxes. They paid the price to live in this state. The car does not belong to the Georgia resident. It belongs to the LLC. Why should the pay taxes on something that doesn’t belong to them?

I moved from TN to Georgia(about a 5 mile move) and I was unaware of the rediculous world of TAVT. When I was made aware that my 15 year old Silverado with 260k on the dash and significant cosmetic damage was going to be taxed based on a 7,000 dollar book value I just said no thanks and chose to roll the dice. The ticket for an expired tag in our county is $100. TAVT on my $1,000 old truck would be nearly 5 times that. It took me nearly 4 years to finally get cited for my expired tag. In those 4 years my truck's book value fell enough that I came out a bit ahead after the ticket and TAVT. Made me proud to be an American. #taxationistheft

LOL!!! I moved from West Virginia due to serious medical issues and had just bought a year earlier a "new" Buick LaCrosse from the new restyled bodies and they wanted WAY too much money to do things legally for a car Id just paid taxes on when I bought it.So,after 4 years,3 on an out of date plate,we traded it for another new car,but a Kia this time.Now that its done,I dont regret a thing.If they made it reasonable to be "legal" here without emptying your wallet I would have done it.But to pay 1/3 the value of a car in a year for taxes is ridiculous.So I guess the Georgia moral of the story is,get your crap together and people will do the right thing but if you continue on an outdated principle you will lose money in the long run. (and I liked this....#taxationistheft....)

I'm all for finding the best tax code for your situation. But if you sign a paper saying you're going to take your car out of Georgia and you don't, you should expect bad things to happen when people pay attention.

There should never be taxes on used items, it's just double dipping. A new item is taxed and that should cover it for the life of the item regardless of it changing hands down the road.

Once again, you don't get that sales tax is collecting tax on money you spend. period. get it? you spend money, they take some of it as tax. They do this instead of income taxes or property taxes. Property tax, wtf is that, how can they keep taxing you every year on something you own. Taxes are how government get money to pay for things, they can do it all kinds of ways, but they have to do it someway. Look how Apple, Google, and every big corporation avoids paying taxes, now go complain about THAT, because that is billions of dollars they cheat you and me out of.

@@nimblemotorsports except my state sales tax on cars is only when its bought from a dealership, a private party sale has no tax. However, what Ed is saying (I could be wrong) sound like they are charging this title tax even on these private party sales, so that every time it changes hands it gets taxed. That's not right. As for taxes, what are they really going to anyway? Roads aren't great, infrastructure needs to be updated, education is poor, etc etc etc. Taxes aren't going to benefit us, they are going for private spending, whether its personal, military, foreign or whatever. At least those corporations are providing jobs and wages to people in this country, they may avoid taxes but they are doing something for us at the same time.

@Jack Murray There would never be another 'new' car sold in the U.S. (or 'new' home, or 'new' anything.) Not to mention that the various governments would raise taxes to multiple times the purchase price to cover the 'lost revenue'. Government and Business aren't stupid. Not when it comes to taxes. Government needs money. Businesses need customers. They both know how to do it and what won't work. Nice try, but no, that's never gonna happen. If it ever did, you're quickly going to discover that the owner is "collecting" the taxes he paid because "I had to pay this much in taxes, if you want this, you have to pay me back what I paid. Why should you get this tax free?" Like I said, not gonna happen. Everyone is too greedy.

I hate this new tax on cars. I hate property tax too. A county official told me that the residents of Georgia don't really own thier property. They are just taking care of it for the county and state.

curtis, probably its going to be a unknown number those "small business" owners that leave the state because of Georgia tax brackets and enforcement, but at the same time while some of the hypercars will leave the state, i'm sure some of the normal people might leave for taxes in another states that are as crazy, so overall this "policy" could have a big impact on Georgia population.

Nightowl I’m a small business owner, I pay a lot in personal vehicle state sales tax and I wouldn’t consider firing an employee if my personal tax situation changes. In general well run companies don’t employ people because they like giving people jobs out of the goodness of their hearts, those employees are essential for the day to day operations of a company so they would be hard to fire without disrupting business.

@@mitchmontona I think the point is a small business owner wouldn't necessary fire anyone but if they were suddenly faced with an immediate and unforeseen 100k cash expenditure it could potentially stifle the growth of said small business and prevent them from hiring additional employees, expanding inventory, purchasing real estate, etc. etc. etc.

Doug Montgomery That’s really stupid. Dealers in OR must hate that. In northeastern states, tax is payed when you register the vehicle. I live on the Mass/NH line and we have a HUGE Porsche dealer in Nashua. And yes many Ma people come up but they still have to pay tax.

South Carolina makes you prove residence if you do not have a SC drivers license. Gas bill, electric bill, etc. Believe they have a $300 cap on vehicle sales tax. So its gonna be a no in SC unless you have a residence.

So long story but I'm fighting this exact situation. I bought my 458 back in August and had it registered through a Montana LLC. I own the car outright and bought it from a Texas owner and had the title and everything. I did not have plates but I drove the car with a bill of sale showing I owned the car for less than 2 weeks and even had my Montana paperwork but not the actual plates (in the mail). I get pulled over for "speeding", I don't want to mention how fast because the officer did not clock me. Anyways, she wants my info and I give her my Nebraska license, scanned copy of my Montana registration, as well as a bill of sale, and proof of insurance was on my phone. She not only didn't believe I owned the car but started questioning how I could afford the car and etc when I told her to run the VIN, it will not come up stolen in any database as I was the legal owner. She calls for backup and next thing you know I have a half a dozen sheriff SUVs and a K-9 unit. All for a TRAFFIC stop. She claims my insurance is invalid (completely valid, I'm in the insurance business), and that the car wasn't legally registered. I showed her Nebraska law that showed that even if I had Montana plates, I would be fine as I have 30 days to register the car (unless I had the car registered in Wyoming or North Carolina), not to mention, I technically would be fine running Montana plates because as Ed stated, tons of people in many states use this to their advantage. Long story short, I got a ticket for NO PROOF of OWNERSHIP, no insurance, and something regarding having "fake plates" when I had just a local dealership's plates on (like an ad for a buddy's dealership). I fought this in court and long story short, my lawyers got everything thrown out since I was looking at misdemeanors with $5,000 worth of fines and up to 6 months in jail. The officer even showed up to my court date to try to tack on a speeding ticket as well. Absolutely ludicrous and cops seriously need to find better things to do like stopping criminals like murderers instead of alleged tax cheats like myself.

There was this great news segment in Baltimore (if you don't know one of the most dangerous in the country) and they sent out a police helicopter and dozens of police officers over people riding dirt bikes on the street. An absolute waist of resources. Like I'm sure someone was murdered, raped, or robbed in the time that took. Police don't care for stopping real crime. No money in doing so

I absolutely understand if people believe the laws and unfair, oppressive and unacceptable. I absolutely agree that state taxes are meant to make a state preferable to other states. I even agree that the current Georgia taxes make little sense. However, just because you don't like a law does not mean you get to ignore it. You can fight to change the law into something that makes more sense, you can move to another place with better laws. Sure exotic car owners may experience financial hardship and may have to sell some of their cars. Their businesses may experience slower growth. But if they could afford to own exotic cars they were not putting the money into salaries and growth, and they have enough income to afford paying the taxes.

If they wanted to grow their business they wouldn't tie up their wealth in luxury purchases, they'd use the money to invest in their business. A person who behaves this way, crying about taxes and how they're hurting their business while maintaining multiple exotic cars is a drain on their community. They don't want to create more jobs via business investment, they want to put their wealth in appreciating tax advantaged luxury items; hence all the moaning over paying taxes on "used cars."

When I moved to MD there were no taxes if you switch the title within 30 days of taking residence. After that you pay the difference in tax between the previous state and MD. Just enough leverage to keep people honest.

I don't see why Georgia thinks they are entitled to taxes on property already owned by the person when they move into the state when no transfer of ownership has occurred. A person, like me, with a collection of old cars would not be able to move to that state at all.

Sales tax on used cars, yearly property tax on used cars. All this is TYRANNY taxes to be taxes. Im paying taxes YEARLY on a 40 year old motorcycle with historic tags. Its fucking disgusting. I know plenty of people with tiny property in Montana for this reason. We left Britian for TAXES AND TYRANNY yet here we are.

You can fill a form out to argue the state value of your car down to pay less. My dad was the first to do it in my town and he argued the value of the car by half and was refunded half of what he already payed to the state.

I did this as well. I think they knocked 30% off the tax. Didn't match what it should have been, based on the fact that it was a salvage rebuildable title, but it's always worth filling out that form.

The problem with this logic is that Georgia is setting arbitrary values for the tax amount on vehicles, rather than basing it on sales price. Someone may purchase a used Gallardo, register it under a perfectly legal Montana, and now owe upwards of $9K. Georgia says they cap at 9% of fair market value, but what they consider fair is based on how much money they want, it could easily be $20K if you go by MSRP instead of market values. All of a sudden your used Lamborghini is costing you a significant portion of its value, meaning unless you can float the cash, you will be forced to sell the asset to pay the tax, or use another asset to do the same. If it gets sold, now the buyer has to pay the tax again. Within a few sales the state of Georgia has collected more in tax than the car is worth.

If you look at the license plate on the back of semi truck trailers, almost all are from Maine. Apparently Maine has some crazy loophole that you can register trailers there for little money and no inspections.

I bought a car from my dad and titled in GA. They appraised the car at 5k more than I paid. I paid the taxes and was told I could submit a form to recalculate the cars value. Did that. 3 weeks later I was sent a check for the difference of taxes I should’ve paid based on what I actually paid versus the valuation determined by the state. Most people don’t know this.

Rhode Island has something similar to Tatv. I bought a rusty $1800 Miata with 220,000miles, but we have something called a CPI (Cars of particular interest). It’s a list of more desirable or (collector) cars. Most cars in RI are taxed by KKB value. But cars on the CPI list are valued on a special book value. So even though I overpaid for my $1800 rusty 220k mile Miata, the DMV still valued it at $6500. I don’t think I’ve ever seen a Miata sell for more then $5k I’m the past 5 years. The list can be incredibly vague too. The Miata and RX7 are specifically on the list, but also on the list they just list BMW. So according to this list, a 2002 BMW X3 is just as desirable as a M3/M4/M5 or any other BMW. They do this for Mercedes as well. The car tax in this entire country is a complete mess.

I recently bought a car for $7,000. I didn't mind the $7k, or the insurance increase, or the cost of registration, or even the eventual cost of maintenance. What bothered me was the check I had to write for $490 in sales taxes, on a used car, and the amount I'll pay each year until it's 15 years old in excise taxes. The government doesn't even do an adequate job paving streets and yet they seem entitled to a large (relatively speaking) chunk of cash. Thieves is all they are.

According to NADA I have $84,225 worth of cars. If I moved to GA @ 7% taxes I would have to pay $5,900 just to bring my cars in? My cars are more realistically worth $20,500 But I paid nothing close to that because they were all clapped out hoops.

Very good rebuttal. Obviously many strange laws in Georgia. Just for the record if buying a car new or used here in NJ Its a 6 pct tax to title plus the price of registration and tags is additional. Did I mention that each of my motorcycles cost $65 except my antique but to register my Toyota is $42.50. For all the rich people crying , most all of us not only pay interest on the loan of the car but also pay interest on the sales tax that is usually amertised into the loan if you buy inside the state. So do I feel bad that the rich don't like paying. No.

Dont you feel if you buy a used car that 6% is ridiculous? We arent supposed to be taxed upon taxed according to the constitution. Rich or poor why is this acceptable? The car was taxed once when it was new. Also if someone wants something nice like a car most of the time they barely drive,its fine for them to pay as you do. If registration is used for road maintenance as they claim, why would we not charge registration by mileage? If someone for example has a Toyota car and drove it 35,000 but another person has a La Ferrari and they drove it 200 miles. Why would the La Ferrari have to pay $20,000 in registration and tags? It was barely in use. Also when someone buys the La Ferrari and they pay lets say 10% sells tax, that person has payed plenty of tax. When it came into production it was at 2 million and now I believe is 4 million. Would it not $400,000 in sales tax be enough?

If a small business owner is having so much trouble hiring, paying, or expanding their business shouldn’t they be using the the money for that instad of buying a supercar that just site in a garage and really used? It’s no different then a poor person using their money to buy cigarettes, iPhones etc.

We may be the only people on this thread who have who have this opinion. The gist of this argument seems to be that these are rich people who pay a lot of other taxes so they shouldn't have to pay this particular tax. I wasn't aware we got to pick and choose which taxes we felt like paying.

in this case Taxation = Theft. even with a friend of mine he bought a subaru legacy gt 2.5l Turbo 5sp that had a blown motor for $1000. he bought a replacement motor (EJ20DET) and installed it him self. he was charged 460 dollars for his registration. 300 of witch was tax because they put it in kbb and chose the highest dollar amount as its value. witch was around 5500 bucks. if this car was sold again as it sits now it will most likely get 3500 bucks.

Hey Smart Ass....Do you actually know just how much of your tax is spent on Roads, hospitals and cops wages...? In Relation to how much is boosted and milked that you never see again? Probably not....so wise up...

Actually not, taxation without representation. People living and driving in Georgia have representation, they can vote to end these taxes, but what IS taxation without representation is how they tax you on cars when you move there, they did this to me in Florida, THAT is taxing people that can't vote to prevent the tax.
