Highway code update - vague, misunderstood and reported badly

The highway code was updated on the 29th January 2022. The most notable update is that drivers should give way to pedestrians waiting to cross the road at junctions. The update is unclear and some of the updates have been reported incorrectly leading to the new code being misunderstood. This is causing danger on UK roads. In this video I explain some of the terminology in the code and I focus on the actual written meaning of the updates that affect drivers.
Note from the driving test centre:
The most notable change for candidates and trainers is “At a junction you should give way to people crossing or waiting to cross a road into which or from you are turning”.
People driving or riding a motorcycle will need to take this new requirement to give way to people crossing into account as they plan their approach to the junction. This includes being aware of:
The actions of the person crossing
The actions of other road users nearby
If someone is waiting to cross, they’ll normally be standing at the edge of the pavement, actively looking in the direction of the traffic and the direction they intend to cross.
People driving or riding a motorcycle need to be aware of the person crossing’s actions and those of the other road users, so they can plan their approach safely and take the right action as they negotiate the junction.
Assessment on test
On a driving or riding test, failure to give way to someone who is clearly waiting to cross the road but is standing safely on the pavement would normally be assessed as a driving or riding fault.
This is because the candidate would be deviating from the defined outcome. It’s clear though that our examiners will need to consider all factors, including:
The presence of following traffic
The speed on approach
To the visibility and actions of the person waiting to cross
Whether it was clear the person intended to cross
Serious or dangerous fault
We won't be changing the assessment level of a serious or dangerous fault with the introduction of this new rule.
If the learner driver or riders’ actions place a person crossing at risk, for example if they failed to give way to someone who is actually in the road, a serious fault would normally be recorded.
But the actions of the person walking and other road users nearby will have a bearing on how our examiner assesses the action.
They’ll consider things like:
What they might have done driving in the same circumstances
Whether the actions of the person walking were reasonable and could be anticipated
The presence of other road users nearby
As novice drivers, candidates are more likely to err on the side of caution and this will be considered.

As a pedestrian I know that I am fully responsible for my own safety. I will not be testing driver's knowledge and application of the new rules by crossing when i don't think it is safe to do so. As a driver i am now much more cautious of pedestrians waiting to cross the road.

the rule that pedestrians have priority at junctions is incredibly dangerous. nobody in my town gives way so i always stop and check before walking out - but these new rules give people a false sense of security that everybody will stop for them if they just walk out, which is just not true. this is going to lead to tons of people being hit by cars

if you are going to give way to pedestrians, make sure you do all your mirror and blind spot checks as you would when stopping normally. if you are walking, check before stepping out on the road as we always used to.

@@supremeleader9838 you don't carry out blind spot checks when stopping on a road. You're only supposed to look in your centre mirror as that's where the danger of being rearended is.

The main danger is from both drivers not following them and from councils/highway authorities not updating the designs of streets to reflect the changes (e.g continuous sidewalks, side roads with zebra stripes, dutch style roundabouts etc). Road design changes behaviour more than rules do. You might not read the rules but you're constantly 'reading' your environment when you're driving or walking or cycling.

Had this situation just today as a pedestrian, waiting to cross looking back around a corner as I saw a car was coming signalling into the road I wanted to cross. Then she stopped unexpectedly. I realised she was following the new rules but it was completely out of place, she blocked the cars behind her while I then had to look around to make sure it was safe from everywhere else, and I felt rushed to cross the road

I've had a pedestrian smile and wave me to continue when i've slowed down for them because they didn't want to make a fuss and be the highlight of the situation. I waved her thanks as i passed, it to be honest made my day.

If she was driving according the the highway code then it was hardly unexpected. Or are you saying that so few drivers obey the highway code that when one does then it is unexpected? Never feel rushed to cross the road - make your own decision. But it is surely better for a car to wait for you when you don't want to cross than to have one drive into you when you do.

@@simonavarne9635 the rules are new and while I was aware of the them, it's the first time they've impacted me as a pedestrian. I don't think they make sense. They're not mandatory so now, as a pedestrian, I still have to figure out if the car is going to stop for me or not, so I still need to wait, which means I'm holding up the traffic that's behind the turning car. Since I have to look and wait anyway, I might as well wait a few seconds more for the car to pass so that everyone flows better 🤷‍♂️

@@pocky1scot1 but it's quicker to just let the car go anyway, it's like when the last person in a queue of cars let's you into the junction it would have been quicker for them to just go and you turn after rather than waiting for them to slow down and for you to be confident they are letting you in

Very helpful video. It also make it obvious that we should read the highway codes for ourselves, instead of going by what interpretations are reported in the papers or on social media. A few word changes can make a big difference to a statement. Thanks for this.

Absolutely first class video highlighting the faults relating to these new rules and how they have been communicated. I'm retired as an ADI now, but several weeks ago fed back my thoughts to the ADI National Joint Council so they may pass them on to the powers that be. There are so many different ways the many aspects can be interpreted. What do they mean by 'junction'? How far from a junction is 'at' or 'not at' the junction? Does this include crossing the major road, and how is a child or non-driver supposed to know the difference between a major or minor road? Consider a T junction where the major road takes a sharp left or right turn . . . the list is endless. Your video exposes the faults in these rules brilliantly and shows why an effective consultation with road safety professionals should be undertaken before roll out by some civil service department. One of the fundamental rules of the road is the question of who has priority. There's a very important distinction between a pedestrian having priority in the first place (e.g. at a zebra crossing) and a pedestrian having priority after a driver has given up his priority (e.g. pedestrian steps into the road elsewhere). It's worrying that the authorities making the rules don't seem to understand the difference, and certainly don't know how to explain it in a clear and safe way to Joe Public.

@@ScottishMan304 I know what you're saying could and probably has already happened but to be honest most people wanting to cross the road will instinctively look for vehicles first. Survival instinct will kick in, but the stubborn people you speak of will probably put one foot on the road edging towards crossing whether it's safe for you to stop or not which could still cause you to brake hard. Anyone who just walks across a road without looking due to sudden self importance is just plain dumb.

The implementation of these new rule changes has been such a missed opportunity and so badly handled as to be unprofessional and even negligent by the DVLA. Telling one class of road users that they have priority in certain circumstances is madness. Tell others to give priority, but never tell people to assume they have it. Priority is given, not taken. .

Great video, I’ve planned to do a video on the new rules particularly pedestrians to cross at junctions and just like you, waiting to get a clarity before posting such. Brilliant explanation and well put together 👏👏. At the moment I advice my learners to give way if it’s safe to do so (interior mirror) otherwise carry on safely and so far haven’t had a learner get a fault for junctions since the law was changed thank goodness.

I stopped for a pedestrian this morning, he stepped back onto the curb and told me to go! I don’t blame him, I don’t feel safe trusting drivers to stop for me when I’m out running.

The biggest issue I’ve noticed is that pedestrians have been walking in front of me without any indication that they was going to cross, this is a problem as I drive a large vehicle that WILL NOT stop in time if you are to walk in front of me last second. This is very dangerous as this has been misinterpreted far worse than I expected

As a brit living in Germany, the UK basically adopted the same rules as Germany. It took a little time to get used to them but now are second nature. Also one rule which I like that wasnt adopted is 'Zip merging'. I think that would of stopped many road rage incidents

Assistance dogs for the visually impaired are trained to wait at the kerb if there's cars, even if the car is stopped. This new rule means all those dogs have to be re-trained.

I observed the new rule twice yesterday. Even though I felt like continuing, some pedestrian was waiting to cross the road at a T-junction, and I - carefully - checked my mirrors, before "waving" them across. (How are you supposed to indicate to the pedestrian that you mean them no harm, and that they should cross, if you're not allowed to give any kind of signal?) EVERY act of courtesy on the roads MUST be tempered with extreme vigilance. If I wave a pedestrian across the road - they will duly oblige, only to be floored by a cyclist I didn't notice or consider. Why has the Highway Code changed? ... the more "complications" you insert into a system, the more likelihood of carnage and death. These new rules are an improvement to nothing at all. They're bollox. Ill thought out bollox.

Ignore the new rule. If a pedestrian is clearly waiting for you to turn, go. The new rule is there solely to put the blame on drivers who bully pedestrians already in the road.

The rules have just changed. They did that under a different ruleset. That's like saying they changed the road from a 30 to 20 so everyone whoever drove on it in the past at 30 should get a speeding ticket.

@@pocky1scot1 No. I don't agree. Passing a driving test is not just about obeying the laws and rules. You can only fail instantly for causing danger to other road users. If giving way to them was considered causing danger to other road users on the 28th January, how is it suddenly safe to, (and by implication not safe if you don't) give way to pedestrians? It's nonsense.

Courtesy on the road is a good thing, that mean by and towards everybody regardless wether in foot , 2 or 4 wheels, abd as for sounding if horns abd kight flashing they are simply visual or audible warnings eof your presence and dont mean anything other than hello, im here, don't drive in to me, thats the onky kegal interprutation

Funny thing is I actually did stop for a pedestrian crossing at a junction in my lesson a day before these new rules were announced because he was already in the road so I had no choice but to stop, blocking the flow of traffic in the process. It really is going to increase the number of traffic accidents and people will definitely NOT be following these rules because they just aren't clear!

Even with the old rules you were required to give way if they are already crossing. It's an incredibly ignorant and car-brained approach to complain that they are 'blocking traffic'. You are a guest on public roads, as are all drivers who are entrusted to operate their machines in a safe manner (by virtue of your license). I see it a lot, that many motorists spend so little time on streets outside of a vehicle that they think driving is the natural order of the world and that they have some kind of priority over other people. If you have to slow down for a pedestrian, and if that causes other people driving to slow down, that's on you and the other drivers, not on the pedestrian, who has a RIGHT to be there, when you do not (at least in a vehicle). 'Traffic' is caused by too many people deciding to drive - that is in no way the fault of the pedestrian and to think that they should sacrifice their time because of you is misguided and quite frankly absurd.

@@toddlithgow Clearly you did not understand the comment I posted. I am a LEARNER driver who does no other driving outside of lessons, therefore I would identify as a pedestrian more than a driver. Being tooted at by other drivers as a learner is not something I care about because so long as I am doing what I should be doing, others can get upset with me. In terms of stopping for a pedestrian crossing... Of course I will stop, I'm not blind, ignorant and neither do I think I control the road or have priority because I'm behind the wheel. My ultimate concern is that A LOT of pedestrians, particularly in the London area WHERE I LIVE AND GREW UP have now been given the authority to cross anyhow they want, even if that means causing drivers to have to stop abruptly or endangering themselves because they assume a driver will stop for them automatically. Some will not. I have seen first hand where a cyclists blatantly steered HEAD ON towards a car thinking she would stop, and she almost knocked him off his bike. It could have been a fatality. Instead of seeing their mistakes, they then proceeded to argue in the road for 10 minutes. So before you post about "motorists in vehicles spending so little time on the streets outside of a vehicle" get your facts straight so you can understand why a post was made and what it meant.

@@Yveness you’re right. Some probably won’t stop. But things will change, streets and junctions will be designed so you have to drive at a lower speed and there is more redundancy to allow people driving to give way etc, look at continuous sidewalks and side road zebra crossings etc. But it’ll also require most likely stricter driving education cans harsher punishments compared to the slap on the wrist motorists currently get given for the violence they cause. Blaming pedestrians for existing or blaming the Highway Code for trying to restore the natural order of things is wrong.

@@toddlithgow I feel as though pedestrians, cyclists and drivers (in cars, lorries, motorbikes or whatever..) ALL have a responsibility. It is about people using common sense and not relying on somebody else to take a wrap for their failings. In the case of humanity, accepting blame proves very difficult for some even if they are clearly at fault. The governments new Highway code changes and the way they deal with traffic offences will only fuel irresponsible behaviour on UK roads. You would think they would implement those essential physical road changes you mentioned before changing the laws. I do agree that further change is necessary to coincide with the new rules and ensure safety for all but the bottom line is, people take liberties, whether they are pedestrians or drivers. I'm not saying other countries are excused but like I said before, in London it's a different set of rules for each person. Tbh I am not even scared of learner drivers, it's the other "experienced" drivers that get away with a lot of crap on the road. Imagine a pedestrian walking out in to the road and the driver hasn't even bothered to indicate to suggest where they are turning, let alone considering slowing down for someone who may need to cross or has started crossing... 😭

21:55 that does happen, I've seen it in London, on streets with no driveways. I've only seen it with the car parked directly outside the house it's charging from, and they've always put a mat over the cable on the pavement

Very good video. As a cyclist and pedestrian, this has been put very clearly. I think it doesn't help when the actually HC won't come out till April in the shops so people cannot really see the HC easily. The reporting has been absolutely terrible, so thanks for pointing this out. Your video on roundabouts is really useful and easier to understand than a lot of YT videos

I feel like most of this is trying to emulate the Netherlands' approach to traffic rules. It seems very vague though and I wonder how much of it is gonna be observed by people who are already driving and may only hear about these new rules through the newspapers. Over here in the Netherlands, the rule for letting pedestrians and cyclists go first at junctions is that you let them go first if they are continuing straight on and you are turning into a different road and crossing their paths, but not when they are crossing perpendicular to you. The thing is that it's mostly reinforced by the infrastructure design, like raised pavements and a separate cycle lane on the outside of a roundabout, which makes it much more intuitive. I don't think relying on everyone knowing the rules by heart is a safe approach at all.

I've cycled from the Hook of Holland to Amsterdam via Leiden and as you say the roads are different in the Netherlands. It makes sense as there are proper cycle paths alongside junctions that cars need to cross to turn left or right. As cyclists here are already in the same lane as the car traffic a car would be waiting behind a cyclist at a junction anyway in the same flow, so it's not a problem. Our code is more referring to cyclists filtering through a traffic jam. It doesn't make that clear though.

@@ConquerDriving The new H3 rule also applies to cycle tracks though, which means where a cyclist is on a cycle path next to the road, drivers need to give way to cyclists going straight ahead when turning into/out of a junction (unless markings say otherwise of course).

My take on all this is the government are laying down the legal framework now because in the next few years cycling infrastructure will essentially be mandated to councils, authorities and housing projects. They will be expected to deliver active travel projects (and retrofit existing infrastructure) to meet the all new LTN1/20 guidance. A new organisation, Active Travel England is coming together this Summer to overseeing all new major road projects and will start penalising councils that don't meet spending criteria. Exciting times ahead.

As a cyclist i will always assume the worst and try never to put myself in a compromising situation even if i have right of way . Eye contact is crucial in many instances and why i suspect driverless cars will never be a thing . I get happy driver waves and toots when i can pull over on narrow lanes . Common sense goes a long way too .

Yes cycling in middle of lane comment. Taking up a primary position. Spot on. All experiences riders/cyclists are aware of other road users and come back in when safe quickly. Only there so not wiped out around dangers or very rutted ruined roads exiting winter before re sealed.

The rules are the rules even if you don't agree with them though. It is dangerous to only follow the rules you like and disregard the rest. Roads are getting increasingly crowded and it is safest if we all follow the highway code.

But people are allowed to ask questions and challenge rules that appear confusing, contradictory or unsafe. If you like the new rules and believe that the DVSA can do no wrong, that's your prerogative, but others have the right to think differently.

Good luck Clara. The key takeaway to these changes is be considerate to all road users. That can mean many things of course, but essentially, too many drivers are impatient. When you pass your test and start driving places yourself always try and give yourself more time than you think you actually need. Not only will you be driving more safely you will arrive at your destination less-stressed out.

Time will tell. I think encouraging drivers to be considerate to pedestrians by allowing them to cross safely is no bad thing and will make our roads safer and more pleasant for everyone. Remember before the changed often pedestrians were unable to cross at junctions or zebra crossing and so had to either risk stepping out into traffic exert their priority or more commonly give and go by car adding to congestion and pollution.

By the way Richard, the reason I think vans/minivans should have greater sense of responsibility than cars/SUVs is because most of them have a large blind spot and no rear view mirror. So, they can more readily cause accidents. What do you think about my opinion?

Congratulations on passing! As the code says vehicles that can cause more harm should bare the greatest responsibility. The mass of the vehicle should be the deciding factor as that determines how much harm it can cause.

@@thegrandmuftiofwakanda Yes, 5 years ago almost most licences passed by the Transport department were based on corrupt practices but since the last 5 years, this number has reduced dramatically due to starting of automated driving tests based on cameras and sensors. It is a good sign. I also passed this automated test in my second attempt.

The idea of giving pedestrians and cyclists 1.5m to 2m clearance was a rule dreamed up by someone who has never driven on rural roads where there is barely enough room for two cars to pass each other, you have to get onto the verges if a bus (often a school bus) or HGVs (often farm traffic with implements as well) are on the road in order to pass each other. I blip the horn for pedestrians and cyclists a good distance away to make sure they know I'm coming and slow down for a slow pass, very slow for horses, and it keeps everyone safe and happy.

You should do a collab with someone like GCN here on youtube, showing cyclist behaviour from a driver perspective, explaining why the cyclist is doing what they're doing, and how the driver should approach the situation. My own driving instructor (in London!) was totally clueless about cyclists and was teaching dangerous behaviour. I imagine it's pretty common from instructors who never ride a bike, and a lot of learners don't get good instruction on that part of driving.

Brilliant video and thank you for taking the time and effort to deliver it so well. As far as I can see these new rules do the opposite of what they were intended to do. I am totally confused now, whereas I knew exactly what to do before. What sane pedestrian would take the chance of expecting all drivers to know that they should give way to you if you step out in front of them at a junction? It’s a bit like Russian roulette!

22:21 On my street we actually have a charging point at someone's house whose wire goes across two pavements and along two flights of stairs (the pavements are trenched so the road is higher up). They have 3/4 warning yellow trip hazard signs and giant yellow tape along the cable. TBF it does look a bit silly.

That will never catch on it's too dangerous unless the pedestrian is already committing to walk out into the road. Bigger roundabouts are too busy. Smaller suburb roundabouts maybe, but only if its safe to slow down and stop.

As an instructor myself I’ve been erring on the side of not giving way unless it’s necessary when leaving a roundabout. In all honesty if someone’s already walking out and the risk is weighted towards the pedestrian then of course you slow down and stop if needed. If the pedestrian seems happy enough on the pavement and the risk is weighted towards getting rear-ended by someone else on the roundabout I’ll be carrying on with caution thank you very much. It’s a should and not a must anyway so as long as it’s safe it’s likely going to be fine.

In the Netherlands the rule is simply: *Traffic following the road has priority over traffic turning onto or of from the road.* The word" traffic" includes pedestrians, bicyclists and such. Otherwise the word "driver" is used, which would still include bicyclists and horse riders.

Looking at it from a farther perspective - are drivers expected to read up on the highway code yearly just in case there are changes? Is that another rule in the highway code? I can imagine someone older who does not watch the news or access the internet have no clue of this change

Yes. It is a condition of having a driving licence that you take responsibility for making sure you are up to date with any rule changes affecting your responsibiities as a driver, including but not limited to updates to the highway code. You agreed to this when you applied for your driving licence, you just didn't read the small print, or have since forgotten you read it.

It your responsibility to know the highway code and if you have an accident having failed to observe it then you will be liable. In an extreme scenario if you fail to give way to a pedestrian at a junction because you didnt know of the new rules and end up hitting and killing them then you would be looking at 14 years in prison.

Excellent video. You are one of the few people who has clearly explained the difference in the highway code between must and should. How many pedestrians are going to be killed by walking in front of traffic near a junction exercising their 'right' to cross the road. What about guide dogs for the blind, they are going to get confused when cars give way to their dog owner at junctions. One question, what about light controlled juctions with a pedestrian light crossing. Are we still supposed,see to give way to pedestrians waiting to cross and obeying the lights. Keep the videos coming, really enjoy them.

Thanks so much for this update. I actually failed my latest test last week (only 2 minors in the end) because of exacly the scenario you started to explain at 3.35. I was slowly turning right and there was a couple slightly further into the road before the edge of the junction, where I was heading, that started to wait to cross. I came to a slow stop with someone behind me, allowing them to cross and I was failed for it. they said it wasn't safe and I should've driven on.

One super important thing that hasn't been considered by those who make these rules, is that support/guidance dogs are trained specifically to not cross the road unless the road is absolutely clear. Stopping your car in front of the dog won't magically allow the dog to understand what you're doing. It won't move until you clear the area, and I think it's simply illogical to expect these dogs to be retrained. We've also been taught from a very young age to not cross unless it's clear. As a child, that always felt like the safest but most obvious choice. As an adult who grew up with these rules, do you now really want to be telling your children that it's okay to cross when traffic is approaching, relying instead on the drivers to know these rule changes and to stop for your children? I know I wouldn't. Absolutely madness.

@@dankshiz69 no. If a driver hits a pedestrian who walks out it is now 100% the drivers fault whereas before it was only the drivers fault if he was driving dangerously or didn't do everything he reasonably could to avoid a collision. That's the issue.

Like many of the older generations, I was taught to cross the road when I was 4 years old. 56 years later I still haven't been run over. In 42 years of driving I haven't run anybody over. Recently I have had children just walking out into the road, maybe they think they have the right of way or something. If they are introducing new rules for cyclists maybe cyclists should have a driving test to prove they are competent and not a danger to others. Motorists have forked out over £7Million for cycle lanes in London and there's now a 20mph limit just incase someone crosses the road without looking. Taking the responsibility away from people only makes them more stupid. 🥴

Observed two pedestrians actually crossing directly through the middle of a small round about with no sign of checking for vehicle movement. Younger generation do literally walk across roads without checking and I find a minority of cyclists are wreck less with their actions. I personally feel that cyclists are riding a vehicle and as such should have insurance as if there is a collision the vehicle driver is automatically taking the full costs on even if not at fault.

Three years ago in my SC, my learner gave way to 3 ladies out of which 2 had prams and all had little children holding their hands, so as well as prams little kids were present, they were waiting to cross the minor road we were turning left into. My learner realised that the little children holding their mums hand were irritable and thought that if one of those kids run into the road their mum will not be able to hold them as they were also holding a pram, so my learner gave way, and I have allowed this because I have seen and thought the same thing, but at the end of my SC I had point deducted for this, SE said I should have pulled her up and explained to my learner that she should not have gave way to those parents. At that point I thought surely it is safer for the driver to decide if it's safer to give way to pedestrians and hold the cars up or not.

They will also know that pedestrian deaths are only one of many categories within the published death rate stats. That said, to be fair, it's no wonder that people are upset, if you allow peds to jaywalk without consequences (name another civilised country that allows that) and then you tell them that they have priority over cars then obviously this will lead to mayhem.

Very good video - I agree with all your points. The door opening with the left hand is as useful as a choccy fireguard and the giving way to pedestrians will result in damage to property and potentially injuries or deaths.

"Vehicles that cause the greatest harm in the event of a collision bear the greatest responsibility to take care and reduce danger". This is frankly bizarre, in practically all other hazardous situations the opposite is true. The bigger the hazard - the bigger the priority should be given to it. There is a reason trains have priority at level crossings even though 95% of train accident risk arises from attempts to 'beat the barriers' or run red lights. There is a reason aircraft have absolute priority over other vehicles on airport aprons. There is a reason plant machinery and large vehicles in general have flashing lights and sirens. Use your common sense, people - give way for safety reasons not because of some political word salad in the new highway code.

That is a very good point, it's harder for larger vehicles to avoid hazards. I do agree with the code though, a person driving a larger vehicle that can cause more harm should take more responsibility. That does not mean smaller vehicles have priority.

If the goal is to minimise risk, this is the wrong way to go about it - by virtually all other metrics. If the goal is to get more people walking or using bikes, and less people using cars however...

As a cyclist I like and I get the idea behind the "should give 1.5m clearance". Far too many cars overtake me way too closely, even on empty roads (I don't get why they do that). I make a point of moving to the other side of the road when overtaking a cyclist. However, as a driver, I don't think the full practicality of these guides was thought out. Especially saying we should stay behind them if the clearances cannot be met. The big issue is with many town roads here - they are wide enough to allow cars to be parked all down one side whilst traffic can still flow but you have to be careful. However, if a cyclist is using the advised 1 metre gap from parked cars, there no way you can give them a 1.5m gap, even safely driving on the other side of the road to overtake. There are some long roads here where that is the case. If you have cyclists riding two abreast on roads, it is also impossible to give them a 1.5m gap even with safely overtaking on the other side of the road. It would also be impractical to stay behind them in the hopes they go to single file.

It does depend greatly on the width of the road. Keep that one metre gap at speed though, doors do fly open. I keep the gap when driving and definitely when cycling. My advice to pupils, "if you're less than half a metre from the parks cars, then less than 10mph."

If you can't overtake safely then don't. Just stay behind them until it is safe to overtake. I know it can be frustrating but remember that if they were not on their bikes they would be in cars causing a traffic jam in front of you.

My point was I can pull completely over to the other side of the road and safely overtake a cyclist but... given the width of the town roads here it wouldn't be a 1.5m gap. When cyclists ride two abreast, I can pull completely over to the other side of the road and safely overtake them but....given the width of the roads here, it wouldn't be a 1.5m gap. There needs to be an addition to rule 163, something like overtake safely and provide maximal width road allows if 1.5m gap cannot be met.

@@54356776 I don’t work for anyone or belong to any relevant organisation. I am retired, a driver and not a cyclist. I am just an ordinary member of the public. The public consultation was open to the whole public so everyone had the chance to vote and express their views, including you. Of course, like any election, only the votes of those that bother to vote count. That said, after the consultation, an independent study was commissioned to ensure that the results of the consultation were representative across all types of road user and across all sections of society. The study did indeed confirm that.

An easy way to explain the changes is that we just treat cyclists the same way as another vehicle on the road. Edit: It's also way more practical and safer to use the opposite hand to open the door latch whilst holding the door handle with the closest hand.

Last time I checked, another car trying to cut you up on the left before a junction would be prosecuted for careless driving, but it seems to be encouraged for cyclists. So no, not really.

@@adamspencer95 It should go without saying that you should take into account the type of vehicle. My point still stands as the different types of vehicles on the road are all treated differently by good drivers. Anticipation of idiots on the road is a major part of using our roads.

What really gets on my goat, is the fact that we, as drivers, PAY to use our vehicle on the road - tax, insurance, etc - yet we seem to be losing more and more rights to cyclists and pedestrians with stupid and dangerous new rules that are putting cyclists and pedestrians at an unnecessary risk. We also have to pass tests to allow us to drive on said roads, and i see time and time again when on the road that cyclists are riding dangerously on busy roads, and there are no rules for them as road users to follow. IMO we should have the road rights back for the safety of everyone.

@@MianCowell i dont know, but i have a 0.9L petrol Renault captur and pay £30 on tax, and £900+ for insurance, only been driving since last year though, but tax depends on CO2 emissions i think, which is weird cause my mums got a 1.8L Octavia diesel and doesn’t pay any tax on it. But if you have an electric or thinking about buying one, unit should tell you on websites or ask the sales adviser, and you’re insurance will just be whatever the insurance co. says

@@MianCowell I’m not saying cars pitted against each other, I’m saying you and i both pay road tax and car insurance to legally be allowed to use our vehicles on the road, as well as having to have passed a driving test for our licence, whereas cyclists who can use the road without insurance and without a licence can use it how they please? I myself have been on the road and seen cyclists taking risks that drivers wouldn’t, like pulling out onto fast moving main roads when not safe to do so, etc My feeling is that if these folk are to be treated similarly to cars, with more priority, then there should at least be a exam or something, a criteria to allow them to do so, if not there should be an appropriate off road cycle lane or an adaptation to pavements as they are not safe road users.

Roads are paid by Income Tax, Council Tax, and VAT. What really gets on my goat is the fact that we, as pedestrians, PAY for drivers to use their vehicles on our roads but they act like we don't deserve a say in them. Fwiw though I do think the new pedestrian crossing rules at junctions are stupid - it always annoyed me when drivers would suddenly stop to let me cross when I was planning to go behind their vehicle anyway. Really disrupts the flow of walking.

To be honest all of these sound like common sense. You're not gonna start turning if you see a cyclist overtaking you, you're most likely going to let people cross if they're not stopping for you. Though I guess for some people it's not that common.

Most of the changes are only supporting what people do. But giving way to pedestrians waiting to cross is a big change on what I have been teaching drivers and the code is not concise in what they mean by junction. Also, many people interpret the rules differently, partly due to poor news and partly due to it not being clear.

Rather than revert to the lowest common denominator of intelligence (pedestrians), the creators of the Highway Code SHOULD recall the Green Cross Code, or maybe, if they are old enough, the Tuffty Club. As a pedestrian, don’t walk in front of moving vehicles, it IS going to hurt! As far as cyclists, why is there no rule stating that they must use cycle lanes where provided. There are many complaints that motorists don’t give room to cyclists, but once a separate provision has been made for them which is then ignored, they have to carry some of the responsibility.

Great points on H2 Rule. It's either been badly written or does mean all junctions. As you point out every turn at junction involves a vehicle turning from one road into another. So giving way to pedestrians would apply to those pedestrians crossing both the minor road and the major road at all junctions. The lack of clarity from the Department of transport is deafening. I have just read through their 'think' publicity campaign briefing and it does not add any clarity at all. This rule will lead to much confusion for all concerned.

Found your explanations really interesting, thorough and helpful. I can see what you mean about the lack of clarity on what is a junction with regard to pedestrians and cyclists though and for that there are bound to be errors in the real world of driving. Re the new rules on giving cyclists preference when turning, may I say that as a driver with a lot of experience, there are too many people who fail to remember their car has an indicator! It seems to be the same on roundabouts. People enter one with no indication of how far round they are going, and may only indicate when they are coming off so it is difficult to anticipate and prepare. I'm not moaning, but your excellent explanations of the changes in the HC would be enhanced if we all remembered that point. Thanks

It says.. If they have started to cross, you should give them Priority... This to.me implies that they do not have priority if they have not started to cross. Therefore one should keep going as anyone that is waiting to cross should also have read an highway code and should have looked to see your turning cars indicator. And the said car should not stop or slow other road users by giving way to a waiting crosser.
