Dr Hlophe needed by MK more to lead MK in Parliament. His involvement in JSC is a non-issue, and he must focus on the more challenging task of Leading the MK and consolidating the opposition. The Chief Whips and Rules Committee unlikely to revise Rules as it will render a lot of MP unable to carry out in the roles they were appointed for. This JSC matter should not occupy the Leader of the Opposition. The media is infact de-campaigning MK on GANu/DANC instructions, the party must get going on fine-tuning structures in preparation for 2026. This guy has been asking same questions over a week on a non-issue.
I don't really why there's such noise about the appointment of Dr Hlophe because this is the beauty of our so called best constitution in the world....

Mxm. There is no perfect person serving on that commission. Even the judges that are chosen are not perfect... and unfortunately, parliament does not have a single perfect politician either. We are pleased to see JP Hlophe deployed in the JCS. Simply swallow your 💊 The problem is that "Capital" has long controlled the judiciary, and now that JP Hlophe is in there, they are paranoid that they will be exposed, lose the rails, and kiss privilege goodbye.

When you are done analysing here, there will still be no legal impediment barring former JP Hlophe from serving in the JSC. The only issue is whether there are any ethical implications. My view is that all our agreed ethics and moral principles find expression in our laws. This is so that these so called "ethics" are not arbitrary and are not applied arbitrarily but through a law of general application that give substance to these ethics and moral principles. Without this law of general application, it is unconstitutional to bar Dr Hlophe from serving in the JSC.
