My wife of 42 years and I are both disabled, and she has survived the last 30 years only because I am here to care for her 24/7. About twenty years ago our HOA ordered us to paint our entire home due to a discolored spot on our garage. Their attorney told me he was going to make our life a "living hell". Through a miracle of God I was finally able to convince the president of the board what was happening, and the attorney was fired and the lawsuit went away. Then, on April 18, 2016 our home flooded, and we had no flood insurance or money. Most of the damage was inside our home, or on the back side of our home hidden by the fence. We cleaned up as good as possible, but living in the filth was making my wife even more ill. FEMA helped, but very little. A year later a wind and hail storm severely damaged our back fence, and damaged our roof. At that same time I received some money when my mother died, and we thought we would be able to repair much of the damage to our home. I immediately set about looking for someone to fix our home...but then we were hit by Hurricane Harvey, which tore open the sides our our home, destroyed the back fence, and now we were short on funds. Our fence backs up to a creek behind our home and is along the perimeter of our subdivision and is a high traffic area. We had to do something fast because now mold was growing in our home and people were coming in our back yard and stealing things and attempting to break in to our home. I went to the HOA board meeting and asked to be able to start repairs immediately, which included erecting a detached garage in my back yard for with a clean room for my wife to stay in while I worked on our home. Getting an approved HOA application to do anything took months so I went to the HOA meeting and explained that the longer our home went without repairs, the more damage to my wife's health. I asked the president of the board what rules I needed to follow to be able to start immediately fixing our home. He gave me two simple rules to follow, which I did to the letter. Two months later I received a violation letter stating I was never given permission to start. For month I attempted to contact the HOA board, but I was ignored. I was finally given permission to come to a private meeting with the board. I then found out that the president had died, and had never told anyone he had given me permission to start work. I was polite during the entire meeting, but I was verbally abused during the entire meeting with board member yelling at me, telling me what I could not say in my behalf, and refusing to look at my documented proof . They said, "James, this is going to piss you off, but you are going to tear that building down." Another board member said, "I will never vote for that 20 foot tall monstrosity". They then fabricated several lies(all of which I can disprove) and after 30 minutes ended the meeting. They would not ever allow me to replace my fence. It has now been two years, and the HOA still will not allow me to replace even our fence. I can not work on our home till the fence is replaced because we must tear our the walls to fix our home. I have already file 5 police reports for theft due to having our fence. This HOA claims that a sidewalk I repaired, which has been on the side of our home for 35 years is now a "flood hazard" even though the county flood control district says it is not. They make up lie after lie to justify the $100,000 lawsuit they now have filed against us. After I wrote them a letter telling them I would hold them responsible for my family's safety, they responded stating that they would "consider" allowing me to replace our fence if I admitted I tore it down without their permission. This is another lie, and they go on and on. For a decade or more dozens of other homeowners are allowed to build multiple buildings in their back yards along with multiple additions on their homes. Others pave their entire backyards to store used cars and build over limit height fences to hide them, but nothing is ever said to them. Last year this HOA announced that they have the power to create any new rule that the HOA board feels is good for the homeowners and to enforce it without any kind of vote of the homeowners. We cannot find any attorney to help because we have little money left after patching our home for over two years. For over two years the bathrooms and bedrooms have been infested with mold, so my wife gets very little rest because she lays awake all night on the couch choking on fluids that build up in her lungs due to the mold in our home. I sleep on the floor next to her to protect her from people who would try to brake in to our home and help her when needed. This HOA si slowly killing my wife. We have flollowed ALL the rules of the HOA, but they have fabricated numerous lies and are taking us to court in April 2022 to sue us for $100,000 and eventually take our home. We have a lot of proof against them , but have no clue how to fight them in court. Will someone please help? @@boomerzman6148 God is still in the miracle business and it will take another miracle to stop what is happening. We used the last of our borrowed repair funds to pay $10,000 to an attorney who says we will have to wait till we are called to court, which because of covid delays will be another 2+ years. We have no other option but to stay in our moldy home while we wait for a trial that is all based on a lie. Now things took a turn for the worse... Last week my wife had an eye operation to save the little remaining sight in her right eye. I had spent several months arranging for her doctor, a professor of Opthalmology at Baylor College of Medicine, to personally operate on my wife. But recently we had to change to Medicaid, so the professor could no longer operate on my wife since his hospital was not in-network. He was training surgeons at another hospital and said he would supervise the operation. Then, just 2 weeks before the operation, the hospital lost its contract with our version of Medicaid. It was a miracle we were able to switch to a different Medicaid insurance as fast as we did in time to still get the operation The operation was on April 13, 2022...but things did not go well. My wife was supposed to be under anesthesia and everything was on a timetable. My wife's arms were strapped down to the operating table and an IV for the anesthesia was finally successfully inserted after 4 attempts in each hand and arm. She was told not to move and the anesthesiologist started the anesthesia...but both doctors were late! She could still hear the doctors as they started the operation which required poking holes in my wife's eye with a needle. Sometime during the operation, the anesthesiologist left and his assistant took over. The trainee doctor was having trouble and my wife could hear them talking. The tube that was to be put in her eye to relieve the Glaucoma pressure had broken in half. The operation was now taking twice as long as planned and the anesthesia was wearing off. The surgeon went fishing in my wife's eye with a needle for the broken piece of tubing but was unable to retrieve it, so he put in a new tube, leaving the old one. All this time my wife's anesthesia had worn off. She was afraid to move or talk with the needle in her eye, so she moaned, but no one heard her. Imagine being strapped down with someone sticking you repeatedly in the eyeball. My wife said afterward that the worst pain she had till then was childbirth, but this was far worse! A week later we went back for post-op and the pressure in her eye was now way too low due to the extra holes pocked in her eye, but the doctor said to wait another week to see if it got better. That is where we are now. Sometimes it is Hell to be poor, but we will never give up on our faith.

we bought a home in an hoa neighborhood. they are corrupt and ignore the cc&rs to benefit their friends. the rules only apply to some. we aren't breaking any rule but they make up ones. we wanted to sell the first month we moved in, but we have to stay for 2 yrs so this house doesn't get considered an investment property. the hoa manager is constantly being sued by payday loans, etc. just imagine what she's doing with our money. the neighborhood looks like shit.

I am being sued by an HOA, that I am not even part of, for $5,400 in "back dues". I keep beating them in court and they keep appealing. Currently, they are trying to appeal me to the Superior Court of PA because they are not happy with the $30 judgement they received after they pushing to go to a non-jury trial.

Since being in a HoA is a dealbreaker for any home I'd be interested in living in, my favorite thing to do with HoA properties is to make them an offering price of what I feel is a fair price, minus the assessment fees for 30 years (and expected rate increases factored in), minus anticipated mental anguish inflicted by the HoA.

I doubt that this strategy would ever stand up in court, but I like the way you think. Owners are being forced into situations where they have to be as devious as the association, in an effort to preserve and protect their freedoms.

We must take the power off the HOAs once and for all, the city has to control and oversees the neighbors. the fines fees are to ridiculous. I forgot to pay my anual HOAs and I just recived a letter saying that I was late on the payment and I have to pay $100.00 late fees of of $510.00 of the HOA anual fee plus 2.58 of interest plus 25.00 dollars for send me the letter.. THAT IS TOTALLY an ABUSE

I think a very important point which was overlooked, was the fact that these boards are volunteer positions and are not filled with competent or professional individuals, who understand the laws, bylaws, and guidelines. If a problem arises, and problems can arise for any reason or no reason, huge costs are then incurred in trying to solve these problems in court.

The HOA claims a buyer is under contract when they buy, but the elements of a valid legal contract are all missing from this pre-existing contract, and so are all of the constitutional rights and bill of rights of a homeowner. It takes two parties to form a contract. It is a one party contract created by the developer with an "empty" lien that ran with the land. This "contractual lien" is not an implied contract or an adhesion contract, but a poorly constructed "contractual lien." It fails the how-to-make a contract test and the how-to-make a lien test.

Here is a way to out smart HOA's contracts....you take the contract...copy it.. remove the parts you do not want in there...write in your OWN small print in the same fashion....if you find there is too much to read in them LONG contracts...so will they...once you have made up your own version of the contract and it looks just like the one they gave you....you get THEM to sign it...then they become the victim of their own scam. You can even write in fines they have to pay you. :)

It sounds like what they are really selling is the fear of living next door to a purple house with 24" tall grass barely hiding all the vehicles on cinder blocks. Oh great and holy HOA save me from the evil purple house people. Heaven forbid my pretentious friends will think I have to live next door to a person who lets his grass grow more than a couple inches tall.

HOAs over step their bounds when the original purpose we to provide services at a certain cost. Not to tell the homeowner how to live. In the 50s, the great migration from the cities to the suburbs builders usual displayed a few samples that what would build. People picked the plot and the type of structure that wanted. However, they were allowed to put their personal creative touch to the surrounding property. This gave people the freedom to create their own individuality to their own satisfaction. While the government provided the overall needs of the community. Police, fire, trash, etc which included parks, recreation and sometimes a public lake. This came with a fee through property taxes, which I’m assuming the HOA must pay as well through the HOA fee. So where is the benefit of an HOA? These places are either run by real estate companies who don’t give a crap and only want your money or Old Fogies who never had a life and want everyone to be as miserable as they are!

Our HOA has a rule that you have to have your property conform to a "Community wide standard." So, that rule can be used to criticize and fine for almost anything.

Early on in the video (around 7 min) it is stated that typically it requires 70% to 80% of the home owners to agree before changes can be made to HOA rules. This is categorically true in most HOA guidelines, the dirty secret they don't say is that the owner of the HOA, meaning the builder, typically gives themselves at LEAST a 51% majority vote by writing into the rules that their vote counts as such. This is fraudulent and should be treated as criminal in my opinion.

@@TheMegalusDoomslayer Well for one thing in socialism the government is in control of your life they can move you wherever they want to move you. Under HOA's the board can cause you all kind of problems if you don't go along with their program. You can't decide you want to op-out of something that affects the community, nosy neighbors can report you to be fined if they catch you breaking the rules. Under socialism you neighbors can report you if you do anything they concede as out of the ordinary need I say more?

@@politicsinplainenglish1791 Socialism is a democratic system of governance which relies on the federal government to perform a large variety of roles while safeguarding the rights of the citizens who vote for their representatives. It is the purest form of a republic. Unions and direct or representative voting in the work place are the primary safeguards that socialism uses to protect the rights of workers and by extension, safeguard the economy. Everything you accuse socialism of are already everyday occurences we hear about in this country under the 233 year old set of rules we've been operating under. People are allowed to report a crime or violation; the government abuses eminent domain; and you can't opt-out of laws. You can bring a suit of equity in court, but you can't ignore laws just because. How is democracy the enemy of the people? Are we supposed to hand oveer absolute power out of fear that doing otherwise would lead to scary commies? I bet you can't get the first thing right about communism, either.

I don't understand this. if I pay for a home. or townhome, or condo. I see no rules I have to follow when I buy said home. How can someone else come in and take my property, or fine me. I own the home and the land correct? it's mine, no one else's. anyone who tries to take it, don't I have the right to defend my property?

The rules are in the contract you sign to purchase the property in the first place as supplemental documents. If you don't sign, the sale doesn't go through. If you don't read what you sign, well, good luck in life (you'll need it).

Let me get this straight, just to see if i am understanding this correctly. You get a home loan from a bank, lets say your mortgage is 600 to 1200 dollars a month, so you buy a house in HOA. In this HOA community they charge you another 500 to 800 dollars, and with that money they are suppose to mow your lawn, and do any maintenance that comes up. Then on top of that, you pay other people money to tell you, what type of tree you can have, or what type of followers you can plant, or rather you can or guest can park on the street. They even tell you what you can do with your backyard. Then if you miss to may HOA payments, they can seize your home, so now you owe the bank on a home you dont even own. What type of fresh hell is this, what ever happen to making your kids mow the lawn, what ever happen to fixing your own shit, do people really make that much money where they can throw it away on some one or a organization controlling your life, because if you do i take all forms of charity. Anyone who lives in a HOA community gets exactly what they deserve, and dont complain when shit does not go your way, you created your hell. First and for most you need a lawyer before you go to the closing. NOT the banks lawyer or the relator lawyer BUT your own lawyer. to read any and all contracts If a HOA involved read the covenants before you sign anything so you know what the hell you are signing

Any increase in property value brought about from an HOA, which hasn't been proven, is offset by the fees you pay to the HOA. It's simply not worth it.

We bought a new home in a subdivision with no hoa. We wanted nothing to do with that stupid concept. 15 years later our neighbors are doing very well with keeping up the neighborhood and the home values are as good as the ones with the stupid worthless hoas. We save the money and have no disadvantages. Our neighborhood looks the same as the ones with hoas and we don't have to worry about stupidity. As a matter of fact, our homes are advertised as hoa free when one goes up for sale and they sell within hours with multiple offers. HOA's are worthless and dumb. A couple years after we bought our home, some stupid homeowners wanted to establish an hoa. They called a meeting, the whole neighborhood showed up and we bullied them to death. They ran with their tails between their legs and never dared say another word since then...LOL....that was fun...we laughed about it for a long time.

I am looking for help. I live in an hoa in east texas. They recently payed me a visit about my rv. Saying some one was living in it and their was not. Then they said they have the right to come on my property anytime they want. Does this mean that i give up my rights to protect myself and my property? I have been here for 7 years. Now and only got 1. News letter. They say it cost to much to produce one. So i really dont know what to do here

Do not buy a home with an HOA. We might as well live in a communist community, living under the rules and regulations of a dictatorship, and have to pay to do it or they will foreclose on your home! What ever you do, do not trust the HOA, and do not build a home in a neighborhood with and HOA!

In California there is a fine schedule that is sent to the homeowners. My association is fining me for made up rules. The weirdest thing they haven't given me a chance for a hearing. Taking them to small claims court. Definitely in my case they are not following guidelines.

simple solution is to do away with the HOA, they should not be allowed to tell you what you can or can not do with your property. The property belongs to you not some greedy bunch that wants to get rich by issuing fake fines and what ever they want to get rich. They should not have the right to put any type of lean on your property. Not a good practice for what is supposed to be a not for profit orginization.

I’m DV vet. While I getting out the Military to civilian world, I fell behind on my HOA. Then I had a faulty construction water like where copper pipes were embedded in concrete created $2800 repair and they added to my HOA bill along with liens etc my current bill is $7840 MAy 14 2019. I had a payment plan of $300 for year now they said $570 is minimum they can accept. I have limited income I’m afraid they will take my condo for hoa payment. What can I file bring HOA TO TABLE?

I think they need to get away with all of them HOA for good. It’s wrong to tell people how to live. If you want to have nice neighborhood then do it yourself. Keep your home nice and clean.

Easy fix, all HOA council members cannot be retired or not live there. Now you only have working parents making the rules, instead of investors, crooks, and old people with nothing else to do.

In my area the hoa's have destroyed the value of homes. Many people have just walked away from their homes because the HOAs are so expensive and restrictive that they could not sell the house and there are so many levees and fines against it they end up losing their investment because of the HOAs. Hoa's should be illegal.

Almost 95% of the subdivision in Texas are governed by mandatory HOAs all the subdivision build after 1992, and there is no other option if you want to live in Texas. they don't want owner sitting on the balcony and porch, and also i put a park bench next to the house and and give me 24 hours to remove it . and charge to for having a bench on my property. homeowner can't park on the streets, I feel stressed because i feel like i lost my rights and i have no freedom. board can not change o remove rules, but board can add guidelines (rules)?.

HOA's are no more than a dictatorship and you will end up with cookie cutter homes. We lived in an HOA development. We continued to paint our home every 5 years. The original colors (of the builder) were light and dark gray. We are now told that the board changed that rule and have to paint it only what the board has approved and now we have to paint it 3 colors (adding to the cost of painting). We noted one house to be painted purple and no where in the specs does it allow for a purple house and the HOA has done nothing. The HOA simply does what they want much like the government. I will never live in an HOA development again when I sell this property. The idea of having several parked cars and long grass is a violation of City code and a complaint to the city should result in the rectifying of the problem. If not speak to city council, managaer or mayor. HOA's do NOT have the best in mind for you or your house.

As stated in the opening, HOAs are to maintain common areas. My property is “My” property, not a common area and should not fall under their radar for judgement. The county appraises property in Harris County and each property is assessed on its own, nothing to do with neighboring properties. THE COUNTY WANTS ALL THE TAX $ THEY CAN GET! HOAs are lying to property buyers/owners if they are claiming they are responsible for property values. Furthermore, restrictions in CC&Rs are too vague and left up to personal interpretation when aesthetics is used in the rule. There should be tighter control on HOAs and management companies by governing body they have to report to after every meeting and be scrutinized by lawyer to protect homeowners. They should have to give instructions of the process when you are not in agreement with their decisions on what has to be done and when and who needs to be present to work out the differences. I lived in my house through Hurricane Harvey and felt the power of the winds and rains, and since then we have had storms producing hail. I am trying to replace my roof, leaking and 21 years old with 40 year warranty that failed early, but HOA won’t allow a metal roof that has 150 mph wind resistance, 2” hail resistance, insulation factor and 50+ year warranty, on the basis of aesthetics -it has too much of a horizontal look and they won’t allow standing seam either. Not sure what to do, they have no common sense and would prefer to have failing 20 year old roofs on homes as their aesthetics for neighborhood conformity reducing sales prices, bothersome sales reps canvassing neighborhood after storms and signage clutter due to repairs. I guess they like lower prices to look at comparable sales. I will be looking to move sooner rather than later if I can find a property not located in communist ruled HOA. I have blue roofed my leak at the moment, until I can work through this hurdle. I am considering holding the HOA liable for damages if I install a new “HOA approved roof” and it fails due to the factors of the roof I wanted that they wouldn’t approve. I feel that would be the only fair justice in my situation and will write it into the paperwork for approval. I will see if they agree to that, if not I get my roof. State of Texas, give homeowners our Constitutional Freedoms back from HOAs.

And now in Sharpstown, Houston, the Civic Club is trying to switch to HOA chapter 209. They only want more money and power. A lot of elderly homeowners are going to be homeless. HOA is bad and should be banned all over. A lot of people loose their houses daiy to HOA. I dont care about payment plans and all that, any one can go through hardship any time where they can not afford the payment. This is really sad.

The government needs to make sure these HOA's follow the law. Often times there is no government enforcement and the homeowner has to incur considerable legal expense to fight the HOA. Many homeowners don't have the means for a legal fight and they have to give in. HOA's often abuse their owners because they know they can get away with it. I had to buy a condo HOA because rent was going up way to fast and there were no affordable houses, this idea that the average person has all these options and can find the perfect house is bullshit.

We're taxed twice moreless... Assoc fees & city taxes! Our freedom of rights and speech are swept under a rug by the Board of Dictatorship! I received a letter to sweep my deck!?! Wtf.... I take pride in my home so this is absurd! My request to cut down the garbage tree that sheds crap daily & overhangs my deck also attracting wildlife with up to 7 nests. The squirrels romping on the roof that have clawed holes in soffets, additionally the crack in my basement wall is not good enough reason to cut it down & has been denied? Associations are a form of Socialism! Selling ASAP!!!

My association nobody knows a lot of investors the people are afraid to voice criticism for fear of retaliation. No one has fought them with fines don't coincide with actual CCandRs and bylaws. They are fining for something that should be going to remediation. $1000 may I add.

They should do away with HOAs. Simply have a property mgt company to schedule the maintenance & repairs when needed. Let people have some freedom. Keep the campus clean & pick up after pets but the nonsense is turning this into communism.

If I am looking for a place to live I will always buy where the junk cars, RV's atv;'s buggies and tall grass is. That is where you find the good neighbors willing to help and not a buch of self centered slaves. Also lower property taxes if you are lucky.

I live in North Houston Area. My HOA does not follow there own bi laws, and does not strictly enforce deed restrictions at all. Example; dog barking all day and night is a violation of deed restrictions. I complain to the HOA about this, then they say we will send out notices. However, what they don't tell you is that after the 3rd notice if the violator doesn't comply the HOA will do nothing further. They force you to take that violator to civil court and sue them as the only recourse. SAD!!

Where does it HOA's do not have to follow non profit laws of the state they register in? How about laws- guidelines for 501 C 4 homeowner assn.'s. It does not say anywhere i can find that they do not have to follow. CCR's? When board picks and choses why by laws they want to follow? HOA's are one of the best places to commit fraud.
