Thanks Joseph. This video took forever. I shot it on Thursday and it was almost 20 minutes long. I spent 10 hours trying to edit it down and realized that it would be quicker to reshoot it which is what I ended up doing. I know you've watched several videos of mine and I really appreciate it. I know, I know. This was one of my first videos and I ended up editing out all of the playing to make it more concise. 90% of my channel is me playing. Oh man did you misread me. I've been in a very public battle with Henley for almost two years. I've spoofed him repeatedly. Check out this video or at least the first 2:30 and you'll die laughing if you hate Henley DON HENLEY VS RICK BEATO: BLOCKERS AND THE FAIR USE BATTLE ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-wqyHrEkk064.html&ab_channel=8MinuteAxe. I also levied a counter copyright claim against him for basically taking $2500 out of my pocket for playing 20 seconds of Hotel California in an earlier video. I wrote a parody about him which was taken down. And I've seen Jethro Tull in concert 7 times and I've met Ian. I simply don't think that Don Felder intentionally pinched We Used to Know. Simple as that. Either way, I do appreciate you checking out the video. Everybody is entitled to their opinion. I'd actually rather have you disagree with me with vigor than agree with a whimper. :) I just wanted to make sure you know where I stand when it comes to Henley. He's a world class deuche. Even if Felder wasn't part of the Eagles in '72, it doesn't mean that he couldn't have listened to the song anywhere else. And moreover, Felder first wrote HC in E minor but Henley couldn't sing in that key...so they shifted all of it to B minor. Ian Anderson is a gentleman...that's all I have to say but I wish Henley got bit of a taste of his own medicine coz he really is a prat.

The solos of flute and guitar are also had similarities between the two,u may say because of the chord progression similarity, but except for the intervals there aren't any notable audible dissimilarity too much.

When I saw Jethro Tull on their 45th anniversary tour Ian Anderson Introduced the song We used to Know by saying "and next we will be playing our greatest hit Hotel California" so yeahh....

Listening to the Tull song again after all these years and knowing Hotel so well after hearing it millions of times on the radio, it is clear where Felder got his inspiration for the melody from. For the record I like Tull's song more

Was Felder even in the band at that time? He did some session work for the Eagles album On the Boarder after that was asked to join in '75 when the Eagles began recording One of These Nights....

As Mark said, Don Felder didn’t even join the Eagles until 1974, so that’s that. The two songs sound nothing alike but for the “mellow vibe” which was certainly not exclusive to either band.

LMAO. Hey Dan. I know, I know. This was the first topical video I ever did and my channel was just starting to break. My friend says 'you know new channels should never do videos over 7 minutes'. I have no idea where he got that info so I listened. The video in its original incarnation was primarily me breaking down the two songs musically. But, I cut....and cut...and cut....to the point where.....I'm just a guy with a guitar. DOH! I'd really appreciate it if you'd be willing to check out another video. 90% of my videos are me playing. This chord progression predates both Tull and Eagles by centuries. It is so common in Flamenco Music, it has a name - "The Andalusion cadence", from that Region of Spain.

I had never heard of the Andalusian Cadence, so I searched for it on RU-vid. The first guitar player I landed on has a different idea of what the Andalusian Cadence is than you do.

I disagree that the songs don't sound similar. Not saying Felder consciously plagiarized the song but just because he wasn't a member of Eagles when they toured with Tull doesn't mean he never heard the song.

Although they were popular when I was young, I didn't know much of JT's music. A friend of mine just gave me a copy of Stand Up, and as soon as I heard "We Used to Know" I was reminded of HC. So, there's a definite link.

When Hotel California first debuted on pop radio I had the nagging feeling that I already knew this song. Every chord change and phrase of the melody felt very familiar and could be anticipated in my mind as I heard the song for the first time. I must admit that I didn't make the connection until someone pointed it out to me and it all clicked. I had been a Tull fan throughout the early 70s and even Felder's guitar solos had the familiar ring evoking my memories of Martin Barre's solos on We Used To Know.. The Irony of that title was not lost on me once I realized why I felt an immediate comfort and familiarity with the melody, chords and guitar solos. Anderson says in an interview about this controversy if it was copied from his song that it is flattering and almost a bit of a tribute to him and his song. Anderson's dry wit then points out that the watch he is wearing is also a bit of a tribute to Rolex.. . ( an exact copy)... Ha ha ha ha ha

I think Mr. Anderson was bothered but knew that taking on a huge record company would be financial suicide. If you ‘listen between the lines’ of some of his comments since you can pick up some subtle cut very cutting digs about it. Luckily he is very rich and successful enough to be able to live with the situation. But artists being ‘heavily influenced’ by other artists is all part of the game, without it there perhaps would have been no ‘Hotel California’, a lot less Led Zeppelin’, and a much duller world. Long live being ‘heavily influenced’… 😉

Thanks for the link to this video Mark! I remember the song We Used To Know by Jethro Tull; before Hotel California by Eagles. Honestly, I picked up on the similarity between the two songs immediately (back then in 1976). I even thought the guitar solos on the two songs were too similar to be a coincidence. All these years I wondered how Eagles were able to keep that on the "down low" even in the face of their continuous harassment of folks who simply enjoy learning and playing Hotel California just for fun (like me). You are right Mark, it is hard to back the Eagles band; I love their music but hate their attitudes, I can't give them any support or sympathy! Sorry.

@@8MinuteAxe Thanks Mark. I saw your Henley video a couple weeks ago and thought it was hilarious. Every guitarist I know loves Henley's music but they offer him no warm and fuzzy feelings. Your video is funny, unfortunately, it is mostly spot on, as well. Thanks for the reminder of daylight saving time (DST). I plan on cutting a foot off the top of our favorite blanket and sewing to the bottom of said blanket as well. Our youngest son (40 years old) lives in Phoenix; I asked him why Arizona didn't participate in DST, he replied with, "Why would someone want to add an extra hour of heat to their evening." LOL... The two songs may be different but why can’t we accept the fact that The Eagles used to open up for Jethro Tull and in all probability could have been influenced at least a little by their music !

I am not a musician, but I have just listened to them both again. No they are obviously not the same song but there are also parts of the guitar solo's that are very similar, also even in the flute melody. So I would say that with the similarity's in the cord progression, that hotel California was heavily influenced by Jethro tulls song.

Hey Edmundo. I know man. The original version was 15 minutes and I did an entire analysis which included playing. Making these topical type of videos is a bitch and I didn't want to have to reshoot from the beginning when I started cutting. RU-vid analytics told me 5 to 7 minutes is best and I trimmed, and trimmed, and trimmed. LOL. I'd really appreciate it if you could check out one of my live covers where I actually play. I went yesterday to a concert of JT. Prior to that. I made a playlist of the concert for my wife who never heard Tull, when she heard the song.. she said, wow, did he rip it off the eagles? It was a great show, a pity Ian lost his voice. Cheers

I can't believe We Used to Know got past me back in the day. I had never heard it until this video made me want to check it out. It's a damn good song. I can hear some similarities to Hotel California but they're 2 totally different songs. I had to unlearn a lot of what my first guitar teacher taught me but the 1 thing I did learn was song structure. He knew how to write songs and he always said there's 2 things that can't be copyrighted. A title and a chord progression. In these 2 songs, I personally could note a similar, yet minute, similarity in cadence and strumming but not to the point of plagiarism. 💩, they now go as far as to break out computers and meters in court to measure similar sound waves. There was a time that plagiarism cases were determined by the percentage of the 2 songs similarity. Not because the intro was similar or the rhythm and chord pattern was similar. If that was the case, rock and roll would have died in a 1950s courtroom.

Hey Frank. I love the last part of the comment. You're right. Thanks! I took a copyright class at Berklee and we were taught that only lyrics could be copyrighted by law. This was almost 20 years ago thought and seems like case law has changed the landscape dramatically. I played the hell out of my Stand Up CD but I would always play the first 6 tracks and then put something else on. Then one day it was playing through, Fat Man, came on, and then We Used To Know and I thought, man, how did I miss this song. It was my favorite Tull song for a while. Same thing happened on Benefit when I heard Cry You a Song for the first time. Great stuff! I really appreciate it!! -Mark

I don't think the Jethro Tull song is all that close. If this were the Plagiarism standard, a lot of bands would be in trouble.

I had the Jethro Tull album as a teenager that has We Used To Know on it . I thought it was the best song and listened to it the most . Probably because its in E minor ! i notice I enjoy E minor tunes ... 😂❤ I later loved Hotel California and listened to it also a lot . Later on I read about this thing with Hotel California , and Tull said they toured together with The Eagles and he is not really that upset about it because he says it was most likely unintentional .

On top of the cord progressions it is also curious that they also both have two guitar solos. It sure seems to me that Don Felder was at least inspired by the Jethro Tull track.

Hey Jim. I think that's as likely as any scenario and certainly a reasonable assumption. This was one ot my first videos and sadly I hacked all the playing and theory out of it. I was advised that new channels should never exceed 7 min . So I edited to the point where I'm inexplicably holding a guitar for no reason. Lol. Thanks so much for checking it out. I was present at Jethro Tull's concert in Oslo, in March this year and Ian Anderson introduced "We used to know" with this plagiarism story. I couldn't help but smile as I've been thinking about this for quite some time. I've been a Jethro Tull fan since the 70s and have been playing "We used to know" on guitar long before I introduced to "Hotel California". I discovered quite quickly that I have played this chord sequence before when I started practicing "Hotel California". Several songs have several chords in succession, but this sequence is quite long. Conscious or uconscious copy, well, only the person who wrote "Hotel California" knows? They are both great songs the a completely different musical expression!

Great comment. This was one of the first videos I ever did and it was misunderstood by many people. I love Tull and I can take or leave Eagles. I was trying to make the same point. One of the things that speaks to me about the plagiarism thing is that nobody pointed it out for almost 20 years and then all of a sudden it's obvious. With the chords coming twice as fast and the 6/8 time signature, I think a trained musician could identify the cadence but it cracked me up one time when a guy told me that he and his wife went to a Tull show and at the fourth chord she said "I didn't know Jethro Tull wrote Hotel California. LMAO. The implausibility of that is off the charts. The cadence is very old and several people on here have linked oodles of songs that use it. Some like to point out that Eagles opened for Tull in 73 and were exposed to a daily dose of We Used to Know. Unfortunately, that theory falls flat because Felder wrote it and he wasn't in Eagles in 73. Bernie Leadon was their lead guitarist. Felder didn't join until a year later. Anyway, it's nice to trade comments with an even keeled, rational person. Some people on here have lost their minds. You wouldn't believe some of the comments I get sometimes. Hey Joe. You know your stuff. I originally shot this video on Thursday and it was almost 20 minutes long. Berry/Wilson, Parker/Lewis, Davies/Morrison were all the 'editors cut;. LOL. I even did a bit about Ghostbusters where Parker was on the witness stand and kept saying 'I ain't afraid of no lawsuit'. My fiance thought it was too random for the video. LOL. I have to check out Warning by Green Day. I never heard of that dispute. I know the Kinks tune. Thanks so much for taking the time to write such a thorough comment. You're right songs sound nothing alike. I think the internet is too full of people who think chord progressions can be copyrighted. It's actually astounding to read the comment sections and all these people calling the Eagles all bad musicians who are only remembered for one song. Lot of revisionism going on these days. I know some of the Eagles contemporaries didn't like them like Gram Parsons for example but Gram was probably jealous of their success as he basically died a "painting"(his value went up after he was gone). Some Tull fans think the world revolves around them. Who knows maybe this was all started by Tull themselves or their record company because sales were down? I think that's why Spirit tried to sue Led Zeppelin.

Hey Billy. Great comment. I agree with everything you said. Gram never lived up to his legend and stuff like Sweetheart of the Rodeo was groundbreaking the songs don't hold up enough (at least for me) to make it an all time classic. Jealously for sure. My favorite Gram song is Hickory Wind. My second favorite isn't even his song but the song Bernie Leadon wrote about him, My Man (an Eagles tune. LOL). I'm a Tull fan for sure but I agree with the either underrating them or OVER rating them. There's no middle ground. All of this is absolutely because of the record company. there is definitely a 'shadowing' of the Jethro Tull song. It is not so different for much of the important bits. this does not validate claims of plagiarism when content and circumspection are employed. tricky, tricky... who would want to judge??

LMAO. Called out again. Yeah Fonz, this was one of the first videos that I ever did and the original cut was 20 minutes. The guy that was helping me get the channel going told me that I should never go over 7 minutes in a video until I'm established. Who knows where he got that. LOL. Anyway, I cut out all the damn playing. I didn't realize until I was done that at the end of the day...I'm just a guy inexplicably holding the guitar. My ego took a bit of a hit so I made sure to play some flashy solos in the some of the follow ups. Anyway, I do appreciate you checking it out. For what it's worth, I've only done about ten topical videos ever. Over 95 percent are focused on some aspect of playing. Take care and be well. Mark

I think some of these lawsuits are just a way of making money without hard work, Let's face it if these lawsuits were restricted to only working performing bands that were actively touring a lot of the lawsuits would disappear.

I think for most of the younger bands, you're spot on. I watched a video this evening that theorized that a lot of the old school musicians have old school managers. I played We Used To Know to a number of my friends who had never heard it before. I asked them all each time "Does this sound like a song you have heard before?" Each one of them sits there and says along the lines "yeah, it does remind me of a song, but I can't quite pick it". I then state "Hotel California" and everyone of them says "Yes" or "Of course" or "Certainly" or similar. There is no doubt about the similarity. But yes, they are different.

Felder does a nice job describing in detail how he came up with the intro rif in his tell all book. I believe it is not a copy, but everyone is influenced by what they hear. The fact that The Eagles kicked him out made me an anti Eagle fan.

Every songwriter borrows a little from everything he or she hears. It's impossible not to. Almost all 90’s rappers would use older songs’ music. For example Wild Wild West uses the music of a Steve Wonder’s song. Or Can’t Touch uses the music of Super Freak etc... I didn’t know they could get in trouble for doing so, since so many of them did it.

Yeah, it got really muddy in the 90s. I know on Wild Wild West, Stevie Wonder got songwriting credit. I did a semester at Berklee and took a music business course where we discussed how Super Freak / Can't Touch This was a game changer. Rick James argued that the bass riff was fundamental to the overall song and it changed the old standard of lyrics and melody. I think the big deal with Vanilla Ice was that he refused to even admit that he sampled the song. He claimed that the riff is original. LOL. Surprising to me that I've never heard of this allegation nor was I familiar with 'We Used to Know', but I've always been more of a casual fan of Tull. Listening to it for the first time, I found it brought to mind a couple of other songs (which I can't *quite* name) but NOT HC. I hear more resemblance between 'The Ballad of Gilligan's Isle' and 'Stairway to Heaven' than these two. The Shangri-Las and George Harrison seems like a far more legitimate comparison, though. In fact, my girlfriend, a rabid, OG Beatles fanatic and amateur documentarian, has claimed that George Harrison played 'My Sweet Lord' for John Lennon, possibly for inclusion on 'Abbey Road', and was upset by John's comment that he'd just written 'He's So Fine.' An apocryphal story, maybe, but no doubt it's a great video, Mark, thank you.

@@8MinuteAxe LOL! PLEASE don't spread that rumor, the Interwebs have enough to deal with already... although a Jethro Tull cover would have been interesting to hear. While I love the Jethro Tull I know, I've never delved that deeply into their catalog. Anyone I know who saw a live show (my current girlfriend included) says they were amazing. They were such a singular entity in the genre it's tough to imagine a credible claim of Anderson plagiarizing anyone, or needing to. The similarities I heard between 'We Used to Know' and unidentifiable songs were more jazz-related. Although I still can't quite identify just what it's reminiscent of, it's not plagiarism... more like 'in the style of.' I never heard about the Schwartz/Page connection until I caught a recording of 'Stairway to Gilligan's Island' and thought it was genius. Insofar as John and George are concerned, my resident expert offered that she got it from an interview (possibly Playboy) and that George's refusal to hear what John was saying (or what he'd written) points to how far their relationship had deteriorated at that point. She also pointed out that his first album after The Break Up was a triple-disc effort of Brobdingnagian stature, packed with years' worth of songs turned down by Paul and john. At that point, George probably didn't want to hear *anything* John had to say about what he should record and publish. Plagiarism accusations aside, it's still a great song.

Hey JM. Every time I see that somebody commented on this video I think "uh oh, what now". I was pleasantly surprised by the great question posed. The #1 thing that I would argue against the rip off is that how come it took 17 years before anybody on the planet said something? Did you know that one of the biggest blowouts the band had (at least according to something I either read or saw, I don't know how credible) is because Felder thought that he should get the lead vocal on Victim of Love. I do not like Don Henley, but, there's no way Felder could have delivered the performance that Henley did on that tune. Thanks so much for checking out the video. I appreciate your time and comments. Don Felder who composed the music for Hotel California didn't join the Eagles till 1974, they toured with Jethro Tull in 1972,, so Don wasn't around for that tour.

What a shame about "He's so fine" and "My Sweet Lord". I do remember that.....I still do not think that they are the same song.......What next, make all musicians pay money so that we can play a "G" Chord Progression (because it sounds like a Billion other songs)?..Fantasy Records owner, "Saul" did a horrible number on John Fogerty and is probably paying for it now, in Hell.....Sorry, anyway, I read John Fogerty's book. John, was young and Fantasy Records totally took advantage of that. Fantasy stole his music from him and continued to lie to him. The worst for me was "Stairway" and "Taurus". I like both songs but again, they are not the same song. Hotel California is an original song and some idiot Attorney will never change my mind on that.......Thank God, the "Stairway" case turned out like it did..........I love both songs but, Spirit's "Taurus" is no Led Zeppelin's "Stairway"......:)....Again, great vid!.....:).....THANKS!

Hey Greg. I love your comment. The running time on the first edit of this video was 15 minutes. I had to cut so many thoughts and comments out. I figured on a talking head video, I need to keep it under 7 minutes to make it interesting and entertaining. Some of he casualties that end up not making the cut: Saul, Spirit/Stairway, Brian Wilson/Chuck Berry, a detailed analysis of Blurred Lines, Ed Sheerin, etc. I took a copyright class at Berklee (keep in mind this was almost 20 years ago) and if melody and lyrics were different, there wasn't much of a case. There were some exceptions (mostly rap songs that used samples) but the way the judge handled the Blurred Lines claim really opened up a can of worms. Anyone that plays an instrument, at any level, knows that these disputes are utterly ridiculous. Should every 12 bar blues song be attributed to one person? Spirit's 12 Dreams of Dr. Sardonicus may be the best album of all time that very few people know about. Yet, they'll be remembered for their frivolous lawsuit. I was at the gym a couple of years ago and a guy was telling me that there was a Jethro Tull song that Hotel California was based on. He couldn't remember the name. I'm a huge Tull fan so I couldn't wait to find out. When I read We Used to Know, I thought, are you kidding me? That was my favorite song on Stand Up. I have a video I'm planning doing called THE MOST UNDERRATED BAND OF ALL TIME? It's about CCR. John Fogerty got screwed pretty good by Saul. But he mostly screwed himself. His obsession with being pissed off occupied his time during what should have been the prime of his career. Who knows how many great songs we never got. Anyway, thanks so much. @@8MinuteAxeI agree with you completely!......Spirit was a great group..My favorite was the Dr. Sardonicus album....Randy California (the guitarist and main singer for Spirit), died several years ago by drowning. He dove into the ocean to save his son and lost his life doing so. His son survived...sad story but, makes me think that Randy was a very great guy.......Yeah, John had a lot of anger......All the music we could have had from him.........I saw CCR in concert years ago and John WAS the band......LOL

Nature's Way still is one my all time favorite ballads and you don't have a rockin' bone in your body if you can sit still during We've Got Nothing to Hide. I'll piss a lot of people off when I say this but intentional or not the flute intro to Stairway is damn near the same as Taurus. That's pretty much as far as the 2 songs go in the same direction. Zeppelin opened for Spirit when Zeppelin first arrived in the U.S. at the time Spirit was touring with Taurus. It's ironic that Randy California never spoke up about it himself though. I believe the reason for that particular case was for the benefit of the same child that he died saving. I'm with you on Randy California was a helluva man for that.

Hey Nathan. How's it going? Yes, my students are always amazed when I do that first theory lesson and explain that all music is based on 12 notes. To a lot of classical students, all rock music sounds the same (or at least that's their high brow assertion. LOL). I'm sure that 99% of these newer claims are driven by attorneys and not artists. Thanks for this video man! I listen to both Tull and Eagles, but I’d be lying if I said I didn’t have bias. The Eagles are my favorite band with Pink Floyd at a close 2nd. I probably listened to “Hotel California” over 50 times before I heard “We Used to Know” and I hear little similarities. This could be my inherent bias, but I couldn’t hear it. I’m a younger classic rock fan. I’m 18 and probably started listening to both bands around 15-16. Both bands are amazing and produced timeless music. Honestly, I have found that the Eagles get a lot of hate in the classic rock community. I feel this hate perpetuated this idea of the plagiarism in regard to Jethro Tull. I definitely do understand; Henley is kind of a jerk and felt should be the sole leader in the band. If the band members stayed as equal partners, then I don’t think this dictator complex would’ve formed.

Hey Noah. You don't know how good it is to hear from people your age talking about classic rock. I'm in my 40s and I feel like I caught the dying breath of it. But, the good news is, guitar sales are up. There seems to be renewed energy in the classic rock scene. A lot of the old geezers are doing sold out tours and there are quite a lot of young people there. Two great choices for favorite bands. We agree 100% on the HC Tull thing. I love Tull. I love Eagles. I don't think Don Felder had the slightest idea of that song in his head when lighting struck and he came up with the perfect riff and melody. And you couldn't be more correct about Eagles getting a lot of hate from the classic rock community. When I was growing up it was not cool to like them at all. But look at the sum of the parts. On their own, each member of the band is incredibly well respected. Randy Meisner was in Buffalo Springfield and Poco, Henley had a great and well respected solo career, as did Frey. Joe Walsh is a living legend. And Felder as always talked about fondly. There's something about that 70s corporate rock thing that just didn't sit well. All of the bands in that genre are aging gracefully and gaining respect. Journey, Boston, Doobie Brothers, Foreigner, Styx, REO Speedwagon. All of those guys worked their asses off and wrote a lot of great songs. No reason to lay the hate on them! Thanks so much for your comment. I really enjoyed reading and responding. We watched a documentary on the Eagles on Netflix and I got to say Glenn Frey does not come across as a very nice person. Arrogant is a word that comes to mind when thinking about him, his treatment of Don Felder was atrocious. He also tried to take more credit for Hotel California than Felder. Not cool.

That's a great question Aaron. The truth is that most of us have rewritten hundreds of songs. Apparently some guy wrote an algorithm with every combination of melodies possible (it's in the billions I believe) and copyrighted them all. So technically, he is now the grandmaster of songwriting. I think there is a case to make for inspired by as opposed to copied. The fact that someone can claim a certain chord progression, rhythm, etc just doesn't sit well with me. cheers

I just listened to 'We Used to Know' for the first time just now. I immediately recognized the similarity of progression between Tull and Eagles, but it was pretty obvious that neither was a copy of the other. I also got a very Tin Pan Alley vibe in certain places, and a Brechtian vibe in others, so I'm wondering if I haven't heard other songs that used that or a similar progression? In my mind, Fogerty was a different circumstance. One that bordered on harassment. Saul Zaentz hounded Fogerty for years, even though Fogerty had signed the rights to all of the songs he'd written under Creedence to Zaentz. Once Fogerty realized how he'd been screwed by Zaentz, he quit writing, performing, and recording for several years. And wouldn't you know that once Fogerty started recording again, there was Zaentz, wanting another payday. I think part of what chapped Zaentz bue-tocks was that, while he was a decent producer, he wasn't a *creator* like John. And he never would be.

What a great comment. I really appreciate the thoughtfulness. You make several excellent points. I've played it for 5 friends and told them what they were supposed to hear and all immediately heard it. I've only done it twice with the no tell and neither got it and that's my one and only reasonable argument. It took 17 years before anybody noticed. And you're right, that cadence predates both of those songs by decades. I'm open to any interpretation, as long as it's done politely. It would have been more pleasurable to listen to you if you didn't cut so much in your video. There are no pauses in your talking which makes it tiring to listen to. I don't understand why people on RU-vid do this.

Previously, I did some topical videos like this and people complained that it was too long. Most of my videos are performances or countdowns where I don't usually have to worry about too much editing or be so conscious of time. Yeah, but Felder wasn't in the band. Bernie Leadon was their guitarist at the time. The more I listen though, the more I'm being convinced that there are more than just passing similarities. Detroit Buckeye. An OSU fan in Wolverine territory. I admire the courage. I went to UCONN so I just keep my mouth shut until basketball season. Actually, as of late, I just keep my mouth shut. LOL. I honestly don't understand the comment. I've been known to miss the obvious on more than one occasion so I'm sure it's user error on my part. I was hoping this video was going to garner more debate. Not so much. It totally flopped out of the gate and the views have trickled in. Definitely people that are adamant either way. I grew up as a big Tull fan and had listened to We Used to Know countless times before the comparison was made (or at least became widespread) so I don't hear it. Well presented - thought you might have also mentioned the Huey Lewis and the News ' I Wanna New Drug' / Ray Parker Jr ' Ghostbusters' suit as well . Couple of big artists / big songs and a huge movie back in the 80's . I know it was settled out of court - what I found most interesting / ironic was that Lewis was approached first to write the theme song for Ghostbusters but passed on it . As fate would have it , his mark was left on the song anyway .

Hey Jerry. I really appreciate the comment. I actually recorded Huey and Ray's dispute along with a couple of others but I cut them. At the time I did this video, the channel was just starting to pick up a little steam and I had recently gotten a few 'get to the point' comments on previous videos so all the videos from this time period are super lean. You can see that there are way too many rough cuts in the video as well. I'm not sure if you saw Tim Pierce's recent three part interview with Ray Parker Jr. but it was excellent. I didn't realize how successful he was as a session guitarist and songwriter. I was a kid when Ghostbusters came out and he will ultimately always be the guy that wrote (and yeah, kind of ripped) the Ghostbusters theme despite his Marvin Gaye pedigree. I also recently found out that Lewis was first approached to write the song and I agree that it's very curious how the song came out so Huey like. Thanks so much for your time and comment. As an unpublished but a busted and disgusted prolific song writer, I think this anecdote covers the bases prr-rr-retty well as far as ripping off other people's material. I was playing in a stand up mic joint called The Bag 'o' Chicken on 6th street in Austin, Texas when I was starting out and another newcomer with a handle bar mustache from New Orleans with a nickname I've forgotten but who was a fine player among us six-string sound-demons said that a long time ago his neighbor's uncle was working in his barbershop one day when a customer told him that his Grandpa's best friend overheard someone on a city bus say that once when Hank Williams went to hear another musician play, during the song his buddy leaned over and said, "Hank, that guy stole your bridge from your latest tune. What are you gonna do about it?" Hank let his eyes swivel over to meet his friends puzzzled look and said, "Hell, that's nothin', I steal from everybody."

The original running time was 18 minutes and my buddy convinced me that I shouldn't have any video longer than 7 minutes. So I edited....and edited to the point where I'm just an idiot sitting there with a guitar in his hands talking. Doh! Most of my channel is playing. For sure. A handful of other people expressed similar disappointment and I almost didn't do this video because I knew that I wouldn't be able to demonstrate. Don Henley and the boys have a lockdown on Hotel California. The YT algorithm picks it up every time and the video other gets demonitized (I don't care about that, I haven't turned monetization on anyway as I don't want my viewers to have to sit through commercials) or gets taken down, which was my fear. I'm not sure if you've seen any of my other videos but I did a 12-string video 9 months ago where I get into a fight with Don over royalty money. That sparked a 'feud' . Every once in a while I spoof him in a video. In this one, I sell my soul to him at the crossroads MORE CLASSIC 12 STRING RIFFS ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-G2WKmNYO6Uo.html and I did one on backwards messages where at the end I 'uncover' a hidden message in Dirty Laundry. I figured if they're going to take people to court over them, they're not going to let me freely play them on my channel. The original cut of the video was twice the length. Several versions of the Jethro Tull song 'We used to know' on RU-vid, both the album (Stand up) version and many live versions. Apparently The Eagles released 'Hotel Calfornia' shortly after supporting Jethro Tull live.

I think the claim doesn't hold up. However I feel Ian Anderson has taken some creative liberties borrowing from others. Compare Tull's "Living In The Past" to "Changes" by a band Flaming Youth featuring a young Phil Collins. Or Tull's "My God" to Blood Sweat and Tears arrangement of "God Bless The Child". Both of these cases sound way more similar to my ears than "We Used To Know" and "Hotel California".

@@mah38900 Only problem is Living In The Past was recorded in March 1969 and released as a single in May 1969, which was 6-8 months prior to the October 1969 release of Flaming Youth's Album Ark 2 that contained Changes. Therefore it's more like Flaming Youth borrowed from Tull regarding Living In The Past, not the other way around.

Jethro Tull was one of my favourite bands in the 70s... watching them perform live in Sheffield City Hall is still in my top 3 concerts over 50 years later. Hotel California was the first song I heard by the Eagles. Unfortunately I immediately threw them, along with several other bands into my rip-off artists bin. It was 10s of years later before I listened to them again and recognised the quality of their music... I'll be starting my 72nd orbit of the sun this year and my musical tastes have mellowed. I'd probably heard We Used to Know a hundred times before I heard Hotel California, so the similarities stood out like a sore thumb to me. If it didn't annoy Ian Anderson, it sure doesn't bother me anymore. I don't even have a tribute Rolex.. wink

FYI, George Harrison has said he was not copying He's So Fine for My Sweet Lord. But what he was trying to do instead was to borrow from Oh Happy Day by The Edwin Hawkins Singers. There is a transition chord in both songs between the verse and chorus which proves this. This transition chord is not present in He's So Fine. Rock on !!

I've read the same. I think what really makes it a tough argument is that the melody of the second part is pretty similar too. I'm one that believes the entire history of Rock n Roll is standing on the shoulders of your predecessors. George Harrison is one of the greatest songwriters of all time. He certainly didn't need to copy anybody. I wish they would take the entire situation into account when they make these judgements. People go crazy about the Jethro Tull thing. Most do it because they don't like Henley and or/ Eagles. How come nobody noticed the similarities for the first 20 years. I really appreciate you checking out the video and for your comment. Hey William. I've had that happen too but every time the person doesn't know what they're supposed to be hearing, not a single person I know hears it. Let's face it. The real issue is with this video. This was like my 5th video ever. I did a very elaborate breakdown of the melody, rhythm and harmony of each song. I realized that I was so in the weeds with some of the esoteric theory that I started cutting...and cutting,..and cutting. What did I finally end up with? Now I'm just a guy in a video inexplicably holding a guitar. LOL. Seriously, I do appreciate you taking the time to check the video out. I really don't do a lot of topical stuff. If anything is most definitively shared between the two, to me, it's some of the solo bits. But what I REALLY hear "We Used To Know" echoes in is: "Nothing Else Matters" by Metallica. I'm amazed that despite so much searching, it doesn't seem like anyone else has connected those dots. Once again, not full key matches, but the backbone, feel, and solos definitely taste like they've stewed in the same broth. Hey ZA. For sure, feel has to be taken into consideration and it's not. Nothing Else Matters has that descending feel and I know what you mean. Key really shouldn't matter. Everything has been turned upside down since sampling. It's hard to know where to draw the line. I mostly play on my channel. I'm not saying that the songs are the same or that "Hotel California" is a ripp off of Tull's "we used to know", but the fact that Felder wasn't in the band doesn't matter, because the album was a a very popular album at the time.my bet is Felder heard the album. That would have been enough.

Hey William. One of the most logical and useful comments to the discussion I've received (and I have gotten lots of comments). The funny thing is, many people mistaken me for an Eagles fan boy. I've been fighting Don Henley very publically for the past two years and I've spoofed him in many videos. I've seen Tull in concert 5 times and I wouldn't be caught dead at an Eagles show (because of tix prices). I pointed out that Felder wasnt in the band because the most popular argument that Felder ripped it is that Eagles toured with Tull in 73. Hey John. Great call. I just listened to that and the Chet Atkins version and you definitely get that melody feel out of it too. At the beginning of the year I started really focusing on getting proficient at Chet Atkins/Tommy Emmanuel fingerstlye. I wish I had an extra 10 years to practice. LOL. Do you play? There is an Italian musician called Giorgio Penetti, whom is of the opinion that there was a chord progression made by a Jazz band fronted by Clarence Williams in the1920's. The chord progression can be heard in A song called "i Found My Baby".

Ok, so maybe 10,000 comments and I think you win the prize for going the deepest. Holy Moly. How the heck did you come up with that. I just listened to it. Might be sped up but what I listened to was in Bb but you're on the money. The descending line at the end of the head is certainly a very similar progression. Your larger point is taken and I tried to kind of make it clear in the video that if you could copyright chord progressions we'd have about 100 total songs out there. A lot of people told me that they heard Hotel California immediately in We Used to Know. For sure if you're looking for it. But no one noticed for 30 years. Anyway, thanks for the gold nugget. Thanks for the history about those lawsuits. My knowledge of music theory is limited, but when you consider there are only 12 notes to work from it seems to me that similarities are inevitable. That said, I have no sympathy for any musician that intentionally steals any part of a song from another musician. I would not want to be a jury member for any of these lawsuits.

Hey Alex. One of the first reasonably successful (merelu meaning we gigged regularly) was called the Horrorshow Groodies. I'm guessing you know the reference. Felder is a class act for sure. I caught him in concert a few years back. A lot of people misunderstood where I was coming from on this video. I have waged war against Henley in several videos (I've spoofed him in a bunch of ways) and I love Jethro Tull. I think This Was through Thick As a Brick stands with the best as far as consistently awesome albums. I've seen Tull a bunch of times and wouldn't give Henley a dime. I just think that the reason people think the similarities are 'obvious' is because they are looking for it. What about the 20 years that went by when not a single person ever brought it up. They demanded a bigger cut of the profits but both of them had very successful solo careers. Why not help the other members out that weren't as fortunate. Nope. Had to be greedy & arrogant. Also both the Tull song & Hotel chord progressions are built off the cycle of fifths. When dealing with the western diatonic music system theres bound to be some overlap sooner than later.

Felder and Bernie Leadon went to the Gainesville High School together. Don jammed with Eagles and Joe Walsh for years before he was asked to join. He even played on a couple of Eagles songs (Already Gone and Good day in Hell}, before Joining. The probability that Don never went to an Eagles concert or listened to Jethro Tull in the late 60's or 70's is slim to none. I love Ian's take on the matter. They're not the same song, but it seems to be heavily inspired by "We Used to Know. It's most likely subconscious and coincidental, but the first time I heard HC I instantly thought about WUTN.. It's not a rip off but is much closer than some that have been judged to be. HC is a much more complex and well written song and Ian is happy for their success. Hey Ric. I really appreciate your comment and I do value your time. I definitely need to start using time stamps in my videos. The funny thing is, this video was all about HC when I made it. At the time I only had a few hundred subs and I was worried about running time being too long. I cut it from about 15 minutes down to its current length and unfortunately I feel I cut a lot of meat out of it. Also, as a small youtuber you end up using the most ridiculous titles sometimes to stand out. It's hard to compete with the big guys on a video titled 'The Most Famous Song Rip Offs' or something of the sort. Recently, I've been doing a lot of classic rock covers. A video of Don Felder explaining how to play HC came up on my RU-vid and someone in the comments mentioned that the song was stolen from Tull. I was curious so I then played the Tull song and though I know nothing about song writing or playing music, it sure seemed to sound similar to me. I often wonder how musicians can come up with original music that's never been played before. It would be nice to have a song come to you in a dream, wake up, save the idea on a shoe box recorder, go back to sleep and then days later find a hit song you'd forgot about like Keith Richards says has happened to him.

I was planning on doing a video on Zep, Spirit, and Randy California but the video did really poorly so I put it on ice for now. I'm a huge Spirit fan. 12 Dreams of Dr. Sardonicus is one of my all time favorite albums. Ridiculously consistent for an album that never got any fanfare. Eagles were support act for Tull on tour, would have heard the song daily so quite possibly subconsciously or otherwise may have inspired hotel California. Ian Anderson has talked about this many times

Hey Paul. Thanks for checking out the video and weighing in. Old video and I don't really have a strong opinion anymore. I have do have a strong opinion about Don Henley. All he should care about at this point is his reputation/legacy and the guy us so outspoken about royalties when he profited more than ANYBODY after Napster changed the paradigm. He invented the $500 concert ticket. The cadence for HC and We Used to Know is 100s of years old and in tons of songs. As far as hearing it on tour, Don Felder wrote the chords and melody. He wasn't in the band at the time Bernie Leadon was their lead guitar player on that tour. Who knows, maybe Felder was a Tull fan. Take care and enjoy the rest of your week. Mark

It's funny, when I originally shot the video I was holding my Taylor mini and I had both hands awkwardly leaning on the guitar. So I shot it again with my tele. ??? LOL. I have no idea why in this video I had it in my head that I needed to hold a guitar. I've done 2 or 3 other talking head videos, all without it and it was easier to frame up. Likely, Felder had been to an Eagles concert or two before he joined the band... But, Felder claims to have written the chord progression. I find that difficult to agree with. He might have written a song using a known chord progression, in a different key, and mixing up the tempo, yes. But to claim he wrote the chord progression, well. I think he would have been better received if he took the Ian Anderson view of it himself and not tried to claim it as "his own".

I've got to respect Ian Anderson of Jethro Tull for being honest about the two songs being "drastically different" instead of taking the self-aggrandizing and publicity seeking path of fanning the "conspiracy theory" flame that the far more famous Eagles stole their song. Artists (and estates of deceased artists) who do the latter over vague and generic similarities leave a bad taste in my mouth, so I've got to give him due credit and respect for his honest assessment.

Ian Anderson is supposed to be a really nice guy. Tull was my third concert ever back in 87. I feel like it was the last tour before they really started to look old. Ian still had tremendous energy. I saw them again 4 more times but it wasn't the same. They are definitely one of the most underrated bands. Still no RnR HOF although that whole thing is a joke. I listened to We Used to Know so many times before the connection was posed (or at least before I caught wind of it) I just don't hear it. Obviously, as a musician I understand the similarities. I thought more people would take an opposing view an interesting debate would ensue. I love doing these topical videos but my core fans don't have a lot of interest. When I upload a 12 string cover I get 1000 views in the first 24 hours, I think this one got 100. The toughest part is that one of these videos takes me 10 to 12 hours to make whereas a live cover takes 2 hours. When the channel grows a little more, I'm definitely going to do more of these. I don't have the book Heaven & Hell any longer to refer to, but there is a passage where Don mentions (either prior to joining FLOW? or the Eagles(Country Rock Band) or some other musical situation he was placed in prior to the Eagles, ...that he had never played/listened to that "type" of music, Country Rock?, etc....and was more much likely to be listening to the "British" bands of the day, late 60s and early 70s, etc, which suggests he likely listened to Tull, listen to the vibe of band Flow for instance, it would make sense he was aware of Tull. Maybe someone else can find that passage in the book, thought I would put this out there with all the other good points, songs sound pretty similar to me, start and finish, etc. Both are interesting songs of course.

The fact that this is so often discussed proves that for many people the similarities are very strong . Tull wrote this song in 1969 and it was frequently played in live performances some of these sound even closer to Hotel imo . If this happened today then Eagles would certainly be in court as said the reason it hasn’t happened is Ian Anderson is a cool guy

Whether it is or is not in the ball park is not the question. When you listen to the chords progress it is not that obvious, but the main feel (and parts of the solo) are a straight copy. i like Hotel California, but for me it sounds like they stole the defining parts of the song

You cant copyright a chord progression. They sound a little bit similar, but there are a lot of differences too

Hey Alison. I agree. A lot of people have told me that they here Hotel California immediately but I do too now that I know what I'm listening for. It took 25 years for this allegation to surface. Before then, millions of people, me included, listened to We Used to Know and didn't hear it at all. I do a ton of playing on my channel and I give away a brand new guitar every month.
