I have been employed for 16 months. A year ago a new manager started. 10 months ago he brought in 4 of his lads in. Myself and his lads are all doing the same job. March comes Covid hits , were all in shutdown. Come the end of May, the factory starts to open up. The manager brings back all his lads. July 9 I received my “Warning Letter of Redundancy “ If Government guidelines on redundancy were used , last in first out, voluntarily, disciplinary records and job performance. I wouldn’t be of been receiving the letter. Right at this moment I’m feeling angry, victimised and worthless.

It sounds a very tough situation. Government guidelines are not enforcable, but completely voluntary. To be honest most managers will want people they feel closer with around them during a tough period. How many football managers take on a football club in a relegation dog fight and bring in their own players who theyve worked with before? It might seem personal as youve been there longer, but its probably the manager just sticking to what and who they know. Its a rock and a hard place scenario though so I feel for you.

That makes sense, I do think he’s protecting them though.The company I work for is also finishing other staff members off in other departments. Again it’s people who have less then two years service. Sadly the company are given them the absolute minimum as severance. But that what happens when the main boss is a millionaire. Thanks for the reply.

Hello, I saw this video and its very helpful. My boss literally told me yesterday that the company are making me redundant as of today! so less than 24 hours notice! I have been with the company since September 2021. My contract says I have to give 6 weeks' notice of leaving but they only need to give a month!

Thanks, informative video! Would be good to have some information about the redundancy notice period and redundancy pay. For example - is the redundancy notice period starting when the company tells you that you may be one of the redundant employees or when the company tells you that you particularly were chosen to be redundant? And if you are being redundant, are you paid for the redundancy notice period AND for the redundancy pay or they are the same thing and you are paid once for both?

Thank you. I could do another video but I thought Id covered that in this video. My memory must be slipping. Redundancy pay and period start from the point you sign to agree to redundancy.

@@RevorecRecruitmentSolutions So if I understand correctly from your words "redundancy pay" is the same thing as "redundancy notice period", you are paid once for either, doesn't matter how it's called?

Redundancy period is the period between between being notified and getting your money. This period can be anything from a few hours to weeks. The redundancy pay is the payment. Basically a company can make you redundant but say we will still need you for the next 4 weeks as an example. If you leave before the redundancy date you dont get your money though. Make sense?

Unfortunately I worked in a retail store who has gone into administration during covid19 and was made immediate redundant over a conference call with regional manager reading pre-prepared statement and no Q&A session. Call just went dead after being told. We don't have any rights.

You may need to put a claim for a settlement in with the administrators or the liquidators. If you were paid on a monthly basis then you should be entitled to a month's notice money plus redundancy according to the formulation shown in the video. I am not sure where you stand with regards to employer references. It will take some time before you receive any money as the company will be in a process of being sold off and you can simply be regarded as a creditor, so unfortunately you may not receive the full amount that you are owed from them. I understand that there is also some sort of government scheme for when these sorts of redundancies occur and it would be worthwhile contacting your union or citizens advice beureaux. Some unions allow unemployed membership, so do investigate that too.

Thanks for pointing out how quick redundancy can happen to a person, in as little as 2 days. Question - Can the employer pressure you into agreeing there and then before the meeting finishes?

Yes but on most occasions they wont. They know a decent redundancy payment will be the better option for most people so they'll won't need to. Plus if HR are present it'll defo be fair.

Really interesting and informative video! I’m wondering if you could help me in the following situation; me and my colleagues have just been informed that all of our jobs are at risk for redundancy due to business costs and have been presented with the options ( shift patterns and hours ) that the company would like us to consider and “apply” for them. Now, I would very much like to not go for any of the options and just ask for my redundancy offer and leave - is this something I could be asking my employer?

I would advise playing your cards close to your chest. Put yourself in their shoes. Theyre putting the feelers out to see any bites. Who they got on the hook they have control of. I'd hang back and sit on the fence until you see how theyre playing it. Say you need to have a think. You dont want to leave but you need to see how the shifts can fit in at home etc. It'll give you more leverage to negotiate a redundancy. Otherwise if you just go for it theyll offer you the shittest pay off they can. Thats what id do.

Unfortunately not all companies are empathetic about redundancy. It's a stressful process and the least a person needs is common decency and respect. I feel for you.

I was redundant 3 days ago, and I worked 5 years in that company. The only question is if I take the redundancy pay, will I be able to work for another company? Is redundancy pay and working for different company at the same time legal? I am afraid that I will be sued for working and taking redundancy pay same time.

Redundancy will have a final date in the agreement. Itll lay out the terms which are typically to get your redundancy pay you cannot get another job until such and such date. If you want the redundancy money, dont take a new job until that date.

So I have a question. I work for a company that it closing the depot that I work from and I have been given options to work out of a satellite site. But instead of travelling the 18 miles that I’m currently doing, the site is 32 miles away from where I live which isn’t viable due to fuel costs and overall travelling time. Can I ask for redundancy? They are offering other people in other departments redundancy and I was wondering if there is any advice that you have for a way to go forward? I had no idea I was being made redundant until today. Went in for a meeting thinking it was job related to find the HR turned up and in 5 minutes they told me I was be made reduundant. No explaination other than a mumble from the boss. Are asked if there were other positions as I am qualified. They said no. Although I have been there 6 years and they have employed people in the last few months. No real consultaion and probably none after. Would this be treated as unfair?

Sadly not. In Corporate talk this is a restructure. Very common and not unusual for redundancies. It could even be the case where your own boss was unaware until a few hours earlier.

What happens if your told the company your working for is going to be going into a kind of business with another company and they don’t need you anymore. For example your on maternity leave and in that time you’ve now been told your job no longer exists. Is there a legal obligation or some kind of resundncay payout that should be made

It depends. 1-youre entitled to nothing if you've been employed by the original employer for under 2 years. 2-If over 2 years you should have the option to apply to a different job at the newly formed combined company, take a voluntary redundancy or take compulsory redundancy. 3-you need to have an employment contract to be eligible for the 2nd section above as it gets complicated otherwise

great vid to break down the necessary info. Is there a duty for the company to have to go through Suitable Atternative Employment? Can the company just say we have looked suitable alternative employment and nothing fits? If I feel there was no real intention to look for that, can this be breach of contract?

All they have to do is be seen to offer some equivalent alternative employment if it's a voluntary redundancy but in truth that's often subjective as to what constitutes equivalent. For example they could legitimately say the best we can offer is 20 minutes drive further, 2 hours a week more and a slightly harder job and most people will just take the redundancy. It's not breach of contract as it's voluntary on your part. With any redundancy youre being paid. Even if it's compulsory redundancy they'll make a fair offer.

So what happens with a disabled employee (cancer) who was 4 weeks away from planning a phased return to work and speaking to occupational health and then was furloughed, whos workplace is now having to make a third of its employees redundant? How do you work around reasonable adjustments when they make redundancy criteria? I am very concerned that throughout my cancer treatment (which is still ongoing) I have tried to work as much as possible throughout, but have had mental health issues as a result of not just the cancer but also my managers/HR's behaviour/failure to handle my situation well through lack of policies to follow/experience. I also feel that whenever I do get to return to work (whenever that will be considering I'm supposed to be 'shielding') that I should still be entitled to a phased return especially considering my anxiety is through the roof and I am struggling with depression (not diagnosed) and fatigue.

Hi Collette. Firstly I wish you all the best and thank you for being so open. Morally speaking your company should be very flexible and reasonable considering your circumstances, but sadly you tend to see the true colours of employers in your moment of need. What should happen is occupational health and hr should structure a plan and communicate with support for employees at all stages through a consultation period regardless of the affected individuals circumstances. However what is more likely to happen is a basic, rushed and unsympathetic process fulfilling the bare minimum requirements of redundancy protocols. Therefore my suggestion is possibly seeking an employment solicitor as you could have a reasonable argument for constructive dismissal if it can be argued that you have been singled out because of your condition. I don't know your employer, but you're not the first and won't be the last to contact us with a similar circumstance. I hope this helps and whilst it doesn't solve much, my hope is you'll find some benefit from it.

Thank you for your prompt reply. I thought it would kind of come down to morals. This is going to be a real test to see if my workplace actually does value me. I've also had a real issue with trusting my manager throughout my cancer journey which has caused me to display emotional distress at work. This is due to previous issues that I've had with them.

The payment will be 1 lump sum. Dependent on tenure it could be anything from a weeks worth upwards.

Good morning, I'm hoping you can help me. Can a company make a person redundant and replace that persons position with an employee who's cheaper? I'm concerned that a person I've worked with and trained will replace me in my position as they are £4,000 a year cheaper. I work in the aerospace industry and once an employee completes their training they received a stamp which means they are at a level they no longer need to be watched. The main reason I'm concerned and writing this is the person I work with and helped train received their stamp two days ago, yet I've not received mine. Alot of other trainees have received their stamp aswell. Apologises for the long winded question, briefing. I've not slept since Wednesday due to worry. Thank you again.

That's a tough situation. And to be honest it could mean nothing or it could mean redundancy is coming. Therefore whilst I'd love to put your mind at ease all I can do is answer the question with facts and logic. To make a person redundant, a company is saying we no longer need someone to do that job, but someone with a different job title can basically do it and be an unofficial replacement. The purpose of making redundancies is to save costs but if you need a job done and can get someone else to do it cheaper with a different enough job title/level then it solves a problem. Being honest the stamp situation would concern me too. My best advice would be to prepare for the worst. However one positive is that in my experience aerospace workers are hot property in transferable industries especially the better skilled ones. Don't believe everything you see on the news about doom and gloom. Other sectors are hiring and recovering quickly so if the worst happened you should be able to find something transferable quickly. Plus when aerospace picks up again you'll get back in fairly easily too. Hope this helps. Good luck.

Hi....I work for contract caterers for 36 years (full contract)....the company I am based at will be closing their doors by year end, have misplaced my employment contract, so not sure where I stand in relation to terms and conditions (tuped over during this time of employment). Have been told that the workplace I'm based at will make the decision on whether we are redundant or not....where do I stand in terms of payment, legal aspects etc.? Can slso see another offer of work, but at the same pay, which I do not want.... could I negotiate over this too?

Misplaced your contract? That's a legal document that they legally need to have. Do they have a hr? If not id ask citizens advice. Im not sure of the best answer.

Great video. Unfortunately I'm going through this process right now. The normal shift pattern is being altered which I agreed to and I was informally offered the job, however since then "things have changed" and I've been offered redundancy or a crap job which they know I can't do due to childcare commitments, so I'll have to take the redundancy (2 years service, plus 4 weeks redundancy period). However I believe another employee who has worked at the company for longer than me is being trained to take over my role after I leave. Is this allowed?

Yes. Fairly easy and referred to as a restructure. All a company would need to do is tweak the job description a little so it looks like an ever so slightly different job. Your pay off is fairly low so unfortunately as is often the case, last in first out, kind of thing

@@RevorecRecruitmentSolutions Thanks for the response. My employers have since offered me an alternative role, the hourly rate is less but I’ll be doing more hours. I was told by HR that my hourly rate will be paid at the same rate as my previous role for a few months and then slowly dropped to the correct level for that role, however my boss has said that as I’m working more hours my take home pay at the end of the week will be the same so they don’t need to temporarily adjust the hourly rate. Who do you think is correct?

Sounds like they dont want you to go. If anything they must value you so thats a good thing. However it does sound like theyre just trying to keep you as long as possible for a little as possible by drip feeding bad news. I'd keep my eye out for something else better but take your time so you defo find the right thing.

if an employee is at risk and in a pool, if they don't apply for the jobs (employees are invited) in the smaller new team, are they guaranteed termination payments? would not applying, risk forfeiting discretionary additional non statutory payments being offered (e.g. 1 month salary for each year of service) or must the company offer all terminated employees the same packages?

They have been pretty good for the first 5 years until they employed my apprentice and paid him 5k a year more than me... they also refuse to give me a contract of employment, and now they have given me a pay cut of 100 pm... CAN YOU HELP?

For one reason or another it sounds like they are trying to manage you out of the business. Either they dont need you or want a different direction but youre a good employee who has done nothing directly wrong so theyll try these tactics. I have been in your shoes before but ive also been told by directors when i was a regional mgr to manage certain ppl out. Personally i see it as a weak tactic. An honest man to man convo would be fairer. So id confront them, not in an aggressive way, but in a diplomatic way and challenge why. But that sounds like its probably time to move on being honest with you.

Hi Seb I have been told that's ill be forfeited of my redundancy money because I didn't accept an alternative role that my company offers me!! I asked my line manager several time that's I won't take anything unless they are on My T&C actual contract that I have since 6 years ago. She couldn't find me anything that suit me or the hours that I usually do, so I ask her to file me for redundancy, but she went with HR a denied me of my redundancy cheque!!! What is your thoughts here!? Thank you

I think theres more to this. From my understanding you are saying youve worked for a company for 6 years and they are making your job role redundant. And they offered you an alternative job role which you dont want so you turned the alternative down. And HR said you arent therefore entitled to redundancy. On paper you should be but is there more to this story? If its as simple as you say go to a solicitor as from what youve said then you should get redundancy pay. But if HR have denied it then as I say I think there is either something youve missed from the story or youre company is doing something illegal. It doesnt sound right to me.

I would. However who tells you that will indicate something. If its a company message then its not specific to you but if your line mgr says it then its often a nudge to use that time to find something else. If yours owed redundancy money then youll probably want to hang around for it but if not then use that time for job interviews.

I’ve been made redundant been offered a completely different jobs and with hours that I can’t do been here almost 4 years but only 2 years on my contract as I was on a 0 hour contract am I entitled to redundancy pay if I don’t accept the other job

It sounds like a no to the question. Im not sure what theyve done but moving you around but with the timing of this sounds like theyve tried to get around a redundancy. They should/would have offered redundancy if they could.

Just quit if you want to start a business. Deliberately doing less work in order to get fired is not only unfair and unreasonable on an employer and if anything could come back to haunt you as reputations carry but unnecessary. If you want to start a business quit and get on with starting a business. But if you think it might not work in just 6 months Id question have you really done enough homework as sounds like if youre doubting whether itll work you may be being too hasty anyway.

Correct in theory. However its not difficult to get around. The idea of redundancy is to make the role redundant and not the person. But in practice a company could slightly change the wording on a job description and get someone else to do the job and itd still qualify as applicable to allow for a redundancy. Again, in theory correct but I wouldnt read too much into it in practice.

Question, is it legal that your employer forcing you to be transfer to a different position? And if you decline they will accuse you of insuburdination and a sanction will be provided that will lead to termination? Tnx in advance. More power to your channel.

If its that theyve presented you with take the transfer or we formally discipline you for insubordination then that sounds like grounds for wrongful dismissal or if you stay a Grievance procedure. However you need to be careful because, presuming your company doesnt really have a HR department because that sounds a very un-HR type procedure, they could blackmail/dig up dirt on you to justify a dismissal. It sounds, from what youve said, very wrong on their part.

I have questions, my company is asking to find solicitor myself and they said I have pay half of it and they will pay like 300 pounds I work with them for 4 years and I don't understand were should I get one solicitor if you know ? And what should I do I believe company should pay all money for solicitor not me. If you could help me please.

A company is meant to recommend you to seek legal advice for redundancy as it is a legal process. Often, but they DO NOT have to, they will offer to contribute money toward your solicitor fees. They are well within their rights to tell you to pay 100% of your legal fees. So to offer 50% is very reasonable to be fair to them. Any local solicitors firm can help. Its basic contract work so most solicitors companies will have a solicitor that can help. Find a few on google and call around.

No. However a quick google search as to be honest 90% of solicitor firms can help. Its standard stuff for them. You wont need a top lawyer or anything.

I'm not an employment lawyer, but from having a reasonable level of experience of victimization grievance processes typically once you sign a settlement agreement the case is seen as closed. You've effectively said you are happy for the matter to be closed by signing it. Well, at least that is how the legal standpoint tends to see it anyway. But as I say I am not an employment lawyer so it's worth taking professional advice if you believe you have a case.

Hi everyone, I just got redundant today. My employee asked me that it is upto me weather if I still work for the company for the next two weeks or leave today. But however whatever I do I’ll still get paid for the next four weeks+2 years of service. I just wanted to confirm weather if this is the correct information if I continue working for the next two weeks and will get paid for 4weeks+2 years of service or can it be me working for two weeks and only getting paid for the two weeks I work for as my employer has given me enough notice to make me redundant? Can anyone please confirm. Thanks.

I've been working for the company for over 6 years, and recently I've been laid off for almost 6 weeks without pay, until now the company still not giving us specific date on when we can come back to work. So theyre still employing you but not paying you as no work to do? I presume you are paid hourly without a guaranteed basic? As for voluntary redundancy, they have to offer it. Theyd have to pay you for redundancy in that instance but if they simply dont give you any hours then sooner or later youll resign to get another job as youll need the money. Maybe thats what theyre waiting for you to do.

@@RevorecRecruitmentSolutions Thank you for answering me, but my problem right now is, if i will resign to the company they will not give me all the benefits including my length of service. thats why my plan is to send them a letter asking for a voluntary redundancy and make a settlement, then after i will go home straight to my country and look for another job or source of income. Is this the right thing to do or i will wait to the company to offer me? because cost of living here is too expensive and we dont have enough budget to sustain and have a family back home depending on me. thank you so much..

You can ask but if a business thinks youre going to leave anyway theyll just run down the clock until you leave yourself. Why would any company voluntarily offer you redundancy money if they think youre going to leave anyway? That wouldnt make any business sense. I do hope youve kept your intentions quiet because if they think you might leave youll have more chance of winning the lottery than getting redundancy money. Keep your intentions very quiet.

Keep your intentions quiet about wanting to leave firstly. Secondly either wait for voluntary redundancy which, if the company recovers ok, may never come anyway OR resign and just move on with your life. Forcing a redundancy can risk you getting fired for misconduct and generally takes time. If you can afford to wait for months or possibly years then wait but if you cant then bite the bullet, resign and move on.

Hi, I’m wondering if you can help. Someone I know is waiting to hear the news if they will be made redundant or not. However, they no longer have a representative and are currently waiting to receive 1 of 3 letters to see if they have to be interviewed for their own job. Can you give any type of advice what this person should do? As their company have been keeping them in the dark.

@@melissaharvey2568 Yes it is common to be interviewed for your own job. Companies, to be seen to be following a fair process, when looking to reduce the team size will interview each person for their job. Being bluntly honest, this is more a public show of fairness then a legitimate process typically. They've most likely already decided who to keep and who not to. If they're interviewed try their best just in case though don't presume either way as they may not have decided yet.

There isn't much you can do to be honest. If it's a compulsory redundancy then you don't have an option. All you can do is try and get a little more on your redundancy pay. Good luck and I feel for you.

If an employee is also collecting the state pension, eg, 67 years of age does the employer need to pay anything to make one redundant.

Admittedly the video waffles on a little bit. However there is a reason. Bear in mind its a 250k off viewed video at this point. The way youtube pays us is based on advert slots per video. The more adverts in a video, the more money. So if I cut the video down in length by 60% I lose 60% of my revenue.
