You have to focus on the best interests of the child. As a father who has primary custody of our child, I saw how in any divorce, there is the best interests of the child, of the mother, of the father, and of the judge. Too often, judges make decisions in the best interests of the mother, mistakenly equating that with the best interests of the child. Judges are generally not qualified to make intelligent decisions for separating families. We have seen that time and time again. Most psychologists can run circles around most judges.. it's time to overhaul the family court system.

But the law needs to do away with the best interest of the child. And go back to protected constitutional rights. That standard sounds like it was created for women but pretending like it doesn't favor women. If both parents are on equal footing, then why do they always want to give physical custody to the mother, making you a weekend dad or can't see your kid at all. Or always trying to use domestic violence as a reason why the man shouldn't have custody? The women is committing abuse the moment she wants to limit your access to your child because she's mad or because she's hoping to get more child support if the kids are with her all the time.

@@Mrjones-ed7hi Good to see you here, too. Even though the law says parents are supposed to be on equal footing, I think the core problem is that family court judges apply the law completely wrong. Judges usually either carry out their agenda of gender discrimination against dads, or they are incompetent, or they are corrupted by title 4-D child support where they only want to maximize child support payments and so they give the mom custody to do that. Any revision in the law has to handcuff judges to prevent them from engaging in the usual and customary bad behavior that they engage in. Ultimately though, there really are some bad parents and we do need to protect our children from them... I know that because I lived it. But since most parents are fine parents, I think we need to establish automatic 50/50 custody on day 1 of any Child custody proceeding until the Judge can get a clue as to what's really happening in the home. Take away the judges gender biased desire to start off by giving the mother an advantage in a custody trial.

How? Get caught sleeping with the neighbor. I caught her while she was pregnant with my daughter. I destroyed her in court. Life is good.

Can you post a citation for that study? The only one I can find that is similar to what you discuss is the GW study on custody and allegations of abuse, not abuse determinations. I’d like to research this more. If anyone knows the citation, please post it. Thanks!

The court system is more abusive and intrusive than a man or woman. Separating kids from fathers that truly want to be there for his kids. Because mom doesn't want to co parent they just pass the kid off to the mother. They dont really care what the man has to say. You be in court for years and cant see your child because the mother makes accusations of abuse, but she is the perpetrator. And because in society, we have this idea that women don't do anything wrong, or how could she be this crazy woman. You have a hard time believing the men. Even when you have evidence they block or ignore the abusive behaviors of the mother. But she must be acting like that because you did something to her. The discretion of judges and non judges needs to go because it creates biases. Then you have the appeals court that is afraid to evaluate evidence, the conduct of the judges how they made the decisions that they made and a lot of times they overlooked statues and case law when its in favor of men. All of sudden, you dont see the proper protections that protects the mens rights to custody and control of his child.

Want to know how I've beaten my childrens' mother in court over and over again? I document everything and stay the course. When I argue my case, I don't get caught up in hear-say, I present indisputable proof/evidence. Don't get punked by an attorney trying to posture and force you into submission. Your children need you, don't let the focus be on anything other than what is best for your children!
