The i’s housing correspondent Vicky Spratt travelled to Bradford’s ‘eviction court’, where homeowners have just minutes to argue their case.
Expecting to see private renters being evicted by their landlords, Vicky was shocked to lenders like Nationwide attempting to repossess the properties of homeowners.
Speaking to Ali, a ‘mortgage prisoner’ along with solicitors from Citizen’s Advice, Vicky investigated just why lenders are acting so aggressively.

Let’s deal with the facts - mortgage rates were previously at a level unprecedented, not even in modern times, but in history. People were warned time and time again that these ridiculously low rates cannot and will not continue indefinitely and HAD to return to what was considered normal and sustainable rates. Although the rates seen today are a bit higher than what many experts consider to be normal, the rates aren’t that far off. My point here is that as much as I really do sympathise with anyone in this awful situation, those people were warned and advised. It’s not the banks fault. They’re doing what they warned would happen. It’s a really sad situation, and I myself struggled during the previous recession and only just managed to keep my house. So I understand how hard it is and how unhelpful banks can be. But in this instance, people were warned. Sorry but a lot of responsibility lies on those people making financial commitments beyond their means.

Those who give mortgage payments a low profile will receive no sympathy from the lender/s. I'm amazed that people think otherwise. The lender owns the home, not the person living in it..!

Getting on the property ladder with a monthly net income of £1500 or less is a recipe for disaster,even 2k net will be quite a stretch

What do the borrowers want? Do they want the house without paying for it? Clearly the commentator is bias. Referring to a borrower as a prisoner when she knows the borrower can sell. Banks are not charity organizations.

The only advice to take away from this is to strive to save enough money to deal with unforeseen circumstances. There is no other solution and I'm not really sure why anyone would expect otherwise.

I have 28 month left in mortgage and I don’t know how to continue paging it. I had not option but to get 6 month interest only. In November I start paying £970 they said. How? My ex left to WA 16 years ago and he’s not responsable for this but his name still and will be in the mortgage because The One account said he’s the one that can afford it even knowing he’s not the one paying for it🤷‍♀️🥺🙏🏻

I think the problem is that the country has been inculcated to believe that those things we live in are "homes" (and we tell ourselves a narrative that compounds it), and that we own them. The reality is we buy an interest in a dwelling - usually a Term of Years Absolute (a lease or tenancy); or an Estate in Fee Simple Absolute in Possession (mortgage). It's from The Law of Property Act 1925 and they are the only estates in land which are capable of subsisting or of being conveyed or created at law. And if you fall in to default then they take the dwelling...

How can they justify that? Because they lent you hundreds of thousands of pounds and they'll owe their depositors/savers the same level of interest. It's not the boogie man, it's economics. Don't buy a house you can't afford and if we all do that and vote so that only UK nationals can buy the homes, they might finally come down in price. Lots of us are stuck at home in our thirties because we're responsible and we can't afford to move out.

My daughter and her partner got a mortgage on a house 4 years ago, I told them at the time only get the mortgage if you can afford twice what you are paying. The rate that they had was 1.8% and it’s up for renewal next year . I remember in the early 80s a couple of friends of mine handed the keys to their homes back to the mortgage lenders because of the mortgage rates going up

The financial crisis was 16 years ago to this day. Ali Akbar could have changed mortgage lenders after being settled with Topaz Finanze Ltd. He most likely didn't bother switching. Or other lenders where too high in interest.

This is really ill informed about the process and one sided. You often have most mortgages at a rate of 2-3% above the base rate, that no doubt has caused problems. It was like that so banks made money during the 0.25% base rate period post 08' but not all are like that. Most people are in significant arrears spanning years, that 3k mentioned could be about 10 months of non payment if her rate was £300 pcm or if it rose to £650pcm then its to account for the difference in the interest. The bank has to start the process as its automated in the system, if they don't then people will default every day of the week which has happened with rentals arrears. You could say a solution is to have the US system where rather than a variable interest rate it is fixed at a certain rate for the length of the mortgage, that would lead to less of these situations from rising rate but also mean no benefit if rates fall. We have a 'fixed rate' but that usually expires after 2-5 years and then gets renewed so the alternative has more stability. Alternatively people could be pro-active, plenty of these mortgage evictions are for expired terms where loans were gotten on interest only and at the end need to be repaid in full so the property must be sold. Sometimes the banks can be harsh which the courts balance out but much of time its an inability for people to face a harsh reality, borrowed money is not free and comes with consequences which are in the contracts they agree to. Ultimately, lenders are doing more but people also need to do more to engage, banks can be lenient but they need evidence.
