Sir, My specific query is related to section 65(a) of Indian Evidence Act... The section says "When the original is shown or appears to be in the possession or power of the person against whom the document is sought to be proved, or of any person out of reach of, or not subject to, the process of the Court, or of any person legally bound to produce it, and when, after the notice mentioned in section 66, such person does not produce it;" Now suppose if the one party, Mr. A(as an example) has fabricated and manufactured some document and has affixed the signatures(act of forgery) of the opposite party say Mr. B on it by using some cut copy and paste techniques or with with the help of some computer software(say for example Photoshop), and thereafter that party, Mr. X presents copy of such forged document(original document will never be produced in such cases because it has been fabricated using some techniques and some pre existing signatures have been transmitted using computer softwares) with the averment/allegation that the document was duly executed and the original is in possession of the opposite party, Mr. B. The opposite party, Mr. B, will obviously deny the existence, exexution and contents of the document and will even counter these allegations of possession of original document. Now Mr. A may say in the Court that inspite of the notice to produce the original docunment under Section 66 of Indian Evidence Act, Mr. B is not producing the original document(whereas the reality is that no such document ever existed and Mr. A has created and fabricated that document by using computer or other techniques), so he(Mr. A) should be allowed to prove the contents through the secondarty evidence(xerox copy/photocopy). Mr. A can also bring his friend Mr. C, as attesting witness to depose that the alleged agreement was infact signed in presence of Mr. C. How will Mr. B defend and convince Court that unless the existence of the original and also the possession of the of the original of the alleged document is proved with Mr. B, the Court should not allow Mr. A to lead secondary evidence i.e the photocopy to prove the contents of the original document...Is there any requirement of Law that Mr. B will have to infact prove in the Court the existence of the original document as well as he has to prove the possession of the alleged original document with Mr. B before he can lead secondary evidence (in the shape of Photocopy) Please reply Sir.... I am going through similar situation and the opposite party has fabricated a Partnership retirement deed and has alleged that original deed is in my possession

Sir, Please advise if one public documents /Original ROR, not accept in first appellate court in addition evidence before pronounced of judgement, in partition case, then I am filing second appeal , what are the legal provision for acceptance that ROR in the Court and give me in suitable citation as examples in favour of me.one most important that property is mention in plaint,but lower court excluded that property for different reasons (i.e.disputed or has not clear title),but I am say I am that property has been show by way of original ROR by filing additional evidence before the pronounced of judgement, that is my question.Sir please give me idea or suitable citation in my case.
