Are you confused about how lump sum payments work in Social Security disability cases? Does the “5 month waiting period” just add to the confusion?
Why do I advise that an end-of-the month “onset date” (like April 29 or August 30) will result in more money than choosing an onset date after the first of the following month (i.e., May 2 or Sept. 3)?
I wish I could tell you that Social Security’s rules make sense and that they are easy to understand. They are not. But in this video I try to make some sense out of the chaos and reveal how you can maximize your lump sum payments.

Thanks for the information. I am 36 years of age. It's a known fact receiving ss or ssdi easy. Last year 2017. About the end of May, I started to become I'll. During this time, I was working. Something kept saying go to the Er. My health deteriorated immediately. Sepsis first , lupus second, still disease third , fibromyalgia fourth. Seven blood transfusion, every 2 weeks iron infusion, shortness of breath. Repeated hospital visits , and stayed over night . Low blood pressure. Muscle skeletal pain daily. Migraine headaches out of no where. Ended up in ICU, & had a asthma attack. There are good , and bad days. Life compelety did a 360. I've applied for handicap parking placker, and received it not long ago by mail. Walking, standing, sitting, bathing, dressing, steps, driving, shopping, cooking holding a cell phone , remote etc. All this have changed. Now I relie on a wheelchair, & walker, & cane. Mentally it's rough on a daily basis. As a mother three, my children seen me go from 200, down to 136. They assisted me in almost every thing. Currently I'm taking medication to control pain. Honestly pain can be so excruciating. I became bed written for a short period of time. Couldn't eat by myself nothing. Sickness hit so hard my body has weakness. Remaining positive isn't easy all the time. Social security denied me . I decided to seek a lawyer, and , when I interviewed in February. The representative stated. I should hear something by July. Even after leaving the hospital, I returned to work multiple times. It finally came to a point I'm unable to keep up. Also notice, every time I returned to work hospital here I come. Love working, sadly I had no choice but to let go , and I did. Within me ive done all I can, therefore I'm at peace with this decision. My body has taken a major hit.

We worked while we could and PAID into this lousy system. The system is all askew. I don't understand why we can't get paid for all the years missed while waiting for OUR OWN money THAT WE PAID into social security with each and every paycheck we earned. I wonder how congress members would feel having to be a peasant status as we citizens are treated. I would like to think that congress would immediately change the countless flaws within this askew system.If they themselves had to deal with this BS.It makes me furious and the greed is absolutely disgusting. How about, " WE THE PEOPLE" get on the government for the TRILLIONS of misplaced money from as far back as 9/11 that was illegally "TAKEN" from social security ? Where is the outrage? AMERICA WAKE THE HELL UP ! Perhaps there wouldn't be a 2/3 year wait for benefits if the money was still where it belongs. Perhaps people would not be dying while waiting for their SSDI.

I wish you were in my area I can tell you are very compassionate about your work. It’s sad I’ve worked since I was 14 years old up until I was 43 (almost 28 years) and was denied. I have all kinds of health issues. One in particular caused me not to be able to work any longer. I see 2 neurologist, been hospitalized 3 times, take a lot of medicine which I cannot even function on. The medicine makes me so sleepy. I’ve had 2 MRI(s) and 2 CT(s) of my brain. I have a small leak in the menges of my brain that cause chronic migraines daily even with medication to help as preventative. I have visual disturbances; sometimes I loose my vision depending on the severity of migraines. It’s all documented. My gait it impacted when I have migraines. I have fallen and recently hit my head and recovering from a concussion. I am scared to drive and I won’t because of the migraines; I don’t know when I’ll have one. Just failed my PFT’s my new asthma dr sent me for Bc I stay sob all of the time. Disability said I was disabled as of right now now in July 2018 but per their medical examiners they foresee my condition changing. I have been sicker since then. Gallbladder out, hospitalized for migraines, overgrowth of bacteria in GI tract and lost 30 lbs in 2 months. Now recovering from post concussion trauma which could be 6 months my pcp and neuro ophthalmologist said. I’m experiencing double vision, and dizziness so that’s why I went to see my NO. Only God knows and that’s not even all that’s wrong with me but it’s sad you have to get an attorney when you have worked for many years and now that I need it I have to fight for it. My total wait time has been 15 months in Arkansas. I got my denial letter at 1 year and that’s when I contacted an attorney who Disabilty Determination finally got the last of my records last week. It’s sad my life is nothing like it used to be almost 2 years ago. If I could have my old life back I would gladly take it. This pain is so debilitating; nerve blocks or nothing has helped. Just imagine going to sleep with a migraine, waking up with one and having one to two during the day. You take medicine but it just makes u sleep. No relief because the migraines just come right back.

Angela , We have to be nearly dead . I have been turned down twice. First time because of my age. I am 47 currently. However , I was 35 when I had late stage 4 thyroid cancer. Since then my health has been a downward spiral. Several auto immune disorders ,3 herniated and 1 bulging disc , kidney failure, congestive heart failure, copd, and on and on. I got turned down again . I am on my third try and I have had an attorney each time. I know a young woman who got her ssdi within 3 months and her only diagnosis was ptsd. Not from being active military . She had been in an emotionally abusive marriage. That she could have and should have gotten out of years sooner. Sorry , but to me that was self inflicted. Nobody has a say in whether they have the issues you or I have. I sure as hell didn't want or ask for cancer and losing a main organ due to it.To have all my saga of chronic health issues. This system is so messed up. My latest 3rd hearing was 12/12/18. I am awaiting an answer from the judge. I waited 21 MONTHS for this 3rd hearing. RIDICULOUS. AND get this , as if that isn't long enough of a wait. It could be 2/3 MONTHS before I get my answer. Then ANOTHER several MONTHS before pay out. They want us dead or in complete poverty before getting a damn thing.

I filed myself 16yrs ago. I was told that I had to be unemployed for 12 months before applying, then it takes around 2yrs. So we were homeless for 3yrs. I got approved on my 1st shot, then got a $27k check & $1700 a month plus $697ea a month for my 2 kids but that stopped when they turned 18 & now i get $2k a month non taxable Disability, plus my Wifes Income. $45k a year total income. Hard to make it but you can. Especially when I was making $150k a year.

You don't have to wait a year before applying. You can apply the day after you stop working as long as the medical evidence shows that you are likely to be out of work for 12 consecutive months. I'm glad you were approved but you suffered unnecessarily for that extra year.

Your videos are so educational, thank you for all the great information you give us. I was denied and I-have already got an attorney an appeal. My attorney has very por social skills, no where near your communication skills. It sucks trying to communicate with him. I pray to god he is a better attorney than he can communicate. I had been tempted to switch attorneys but I am unsure on what would be best to do. Thank you again for all your very educational videos!

Hi Dear, I’m right now a 59 year old lady with medical conditions listing below: - Left side Thyroid surgery 10 years ago. -Right side Thyroid Hypothyrriodism now. -Removing Uterus surgery 4 year ago. -Having a Neck surgery to replace the C3-C4 ,C4-C5, C6-C7 ....3year ago. - Suffering from L4-L5 degerenated dics of back pain. - Both sides of eyes cataract surgery 2 years ago. - Left side eye ambliopia( lazy eye) Because of those weak health condition, I can not work long enough to earn for living. I received my ssdi and ssi at the same time...they stopped the ssi.due to the ssdi starting...I still have the ssi check that is expired due to to me being homeless with no address at the time and being held to long..when I called the local ss office to see if it could be reissued I was told that they would but would cancel my ssdi..I called last week the national numvCardber they said if I bring it into the office they will reissue it..I don't really trust them..I need my ssdi to live..do you think I should try?

I've never seen a video on the papers you get from ODAR i got mine before my award letter saying im approved and telling me my onset date but nothing on how much my monthly payments are my attorney said i would receive it within a month but it's frustrating knowing I'm approved but not knowing for what amount even my Social Security account still says pending so what is this stack of papers from the ODAR. i filed January 16. 2015 and my onset date is September 8. 2011 they approved me for both ssdi and ssi and want me to come to an appointment on the 14th of November 2017 to find out how much money i have and any money coming to me but I'm just lost on where i stand. please help

I received over $83k in 2017 going back to 2013. The SSA-1099 has a formula that ends up telling me I can be taxed on half of that. Why isn't it divided between the time frame of 5 years, when the yearly payout does not reflex a payment of over $23k per year? Fantastic Videos BTW !!!

Hello Mr.Ginsberg, I have a question that hopefully you can answer. I recently got a fully favorable decision from an ALJ, and I have received award letters from ssdi and ssi,and I was told to expect my first monthly payment on November 23rd, but when I go on the my social security website it says my next payment will be November 3rd. Would I be correct in assuming that the 3rd would be my lump sum payment?

Can you please make a video on odsp and non earner benefit and explain what happen if the recipient doesn't want to receive it every 2 weeks anymore and ask the injury lawyer to settle this matter in one lump sump of money instead so it is not viewed by odsp has a income and can that work if giving im 1 lump sum of money and use that money to buy a primary home or a car as a non exempt asset . I'm am discouraged I've been on Google searching for this answer daily loosing sleep can't find the answer .

Well that explains a lot. I filed in 2014 but I just received a partially favorable decision in 2017. My attorney told me to expect that after the hearing that they would only go back two years. I got my decision yesterday but it wasn't two years like the lawyer said there was some months missing, now I know why. Still I would like to know when I can expect payment? The SSA website says next month but with this process I just don't know. I do know this much, however, this is the most torturous thing I have ever done.

James, normally it seems to take about 30 to 60 days after the written decision before the money arrives. I expect these delays to increase until such time as SSA can start hiring again.

Very informative video, thankyou! However, I’ve been waiting for my back pay that was granted by the judge almost a full yr now. Ss office tells me there’s nothing they can do because it’s a different department that issues out the money. Has anybody heard of this before? Is this normal? I’m starting to feel like I’m never gna get my money. Can anyone help me with what I can do to

Thanks for the wonderful videos. I thought back pay was capped at 12 months total? Is that a new change? So for instance if you filed in 2015, alj approved in 2018, it doesn't matter if 3 years passed, you only get 12 months max?

You can recover past due benefits up to 1 year prior to your date of application in an SSDI claim.

You can't double dip - if past due SSDI covers the same time period as early retirement you would get a sum equal to the highest of the two options.

How long do you plan to be disabled? That should one huge deciding factor in whether you might want the lump sum or monthly payments. If it is a disability not expected to improve and you know you will need the money for a long time the lump sum is probably not a good choice. That is because you don't get any more payments after that. It is very easy to spend that lump sum on medications and food and other things and if you are out of work you won't have any other income.

Mr. Ginsburg. I received my award letter in May of 2021 and received my first monthly payment in June. I was awarded a substantial amount $92,000 yet I have not received that back pay as of yet. A supervisor at social security put in a manager to manager request a few weeks ago and nothing. Is there anything I can to speed up the process and if not, how long would I have to wait for that backpay? Thank you

Thank you so much for all your information you share SSDI and SSI. Are there any reasons why I should not apply for backdating my disability to 2005 when all the pain symptoms started and I didn't realize would never go away. I did have extensive Medical Treatments and testing from 2005 to present and I am still in contact with the caring cooperative physician that treated me at the time.

I was declared disabled in 2015 after getting out of mental health hospital, but always thought id get better,,, bit i didnt apply for SSDI until 2018,,, with supporting doctors memos and extensive medical records," is it possible my onset would be set in 2015 when i was declared by doctors to be disabled" , by a judge or adjudicator ???

Question: If you only draw SSI and your given an asset forgiveness once for buying a home or updating the one you have, Can I acquire a small piece of land first without the home and then get the home next year (put one the land)without it hurting me? I currently rent. I didn't want to acquire it at the same time to keep the payment affordable... Don't want to loose my SSI for having the small home asset after purchasing the land. Does this make sense??

I filed for ssdi in mid 2017. At the time I was working with a big name attorney that will remain nameless. None of my emails or phone calls were returned and l was denied as a result of missing my appeal date. I was told by SS that I had to reapply, which I did in 2018 with a new attorney. The difference is night and day. New attorney is very attentive to my case. Question: if I am approved...is there any way to get credit for the original application date?

Hello Mr. Ginsberg : I appreciate your work and due diligence you present to us subscribers.Question: I appointed a Disability Advocate and signed a form in agreement on the Fee, I was assigned a local Attorney by the firm representing me: to represent me at the Hearing,in the Decision letter after fully favorable decision , judge is disapproving Fee Agreement, saying that I the claimant appointed more than one representative from the law firm and that all representatives did not sign a single fee agreement nor did they waive charging or collecting fees, . How should o handle this, the 15 days requesting a review has passed😮

SSA makes the fee process overly burdensome. I sometimes try cases on behalf of a non-attorney rep and this issue pops up. Typically the Advocate will pay the attorney a flat fee for his/her representation at the hearing. Then the Advocate will need to file a fee petition in order to get paid. Assuming you signed a fee contract I encourage you to do the right thing and pay the company who represented you.

At my hearing my lawyer straight told me I would get 951 a month n around 35000$ in back pay but SSI called me asking about all my income so I don't know if I got SSDI n SSI or what I got .bc it says SSI don't give out lump sums .so I'm very confused on to how my lawyer told me the amount right there now could he have lied to me ????????????

Hello. I have a Spinal Injury..Im on Workman's Comp..for 20 months having a Spinal Fusion .Next Week. When should I file for Disability Benefits? Do I need to wait to file? after I'm done with Workman's Comp? I do have an Attorney...for Workman's Comp..but He isn't it hasn't offered Me any information on Filing for Disability Benefits at this point.. I don't want to wait to long to file as I'm aware how long it takes to file and even longer to get approved. Thank you. Melissa

I had a hearing yesterday. The judge allowed 14 days for an AOD and more medical records. Is this normal. Also the judge requested that my lawyer change the AOD

Well yes, as I tell people what the minimum I would be expecting after 25 months is, and they think it's a lot, but I quickly have to remind them 25% goes to the lawyer, I'm over $30,000 in debt mostly medical because I don't qualify for Medicare, and even outside that I couldn't pay the last 2 months of my apartment and my credit card got maxed out and those have gone to collections, and I have people I need to pay back for helping to support me. I don't plan on retaining a single dime of it.

Chopsticks, I could be wrong..but I do believe I read that the most a lawyer can get for a SSDI case is $6,000......Now my workers comp attorney got 25% of my final settlement. But again..I'm almost possible the SSDI cap is 6k, but I think it did say something about office costs, printing of copies etc. as items the attorney can bill you for. It might be worth your time to check with the SSDI website....Good luck :)

The attorney can only get a max of 6 grand and also bill collectors CANNOT garnished your social security checks also for the large back pay put it either in a safety deposit box or buy a small safe to put it in

Hi thank you for helping me with that question what I meant to ask and wanted to know is what happens when both SSI and SSDI owe back pay for example if SSI owes $11,000 in back pay and SSDI owes $7,000 in back pay how are those installment paid she was approved by a judge on May 5th and on May 12th she met with Social Security to discuss her finances and the judge that decided her case set the onset date as of January 2011 but I’m still a little confused because Social Security stated that they can only go back 24 months so what does the onset date essentially mean does the onset date basically reflect on how much she might get or she will get in back pay for her survivors benefits AKA SSDI and do you know usually how long it takes to actually receive payment and start receiving benefits after you have that meeting with SSI to discuss finances from what I’ve read people have waited three to four weeks is that generally the timeline thank you so much for helping me with this your information is very helpful thank you

You can only get SSI as of the date you applied. Usually, your SSDI will offset your SSI as of the date of application. The only time I see clients getting SSI in a concurrent case is when (a) they get SSI during the 5 month waiting period or (b) when the SSDI amount is less than the SSI amount, but this is rare.

Yes her mother's SSDI amount is not set in stone but apparently it's somewhere around $360 and apparently she's going to get more up on SSI so that's where the confusion came we're unaware of what she's really getting but as far as payments go the process is very confusing but she was approved for both so she wanted to know how would that work out if her SSDI lump sum is more than SSI lump sum will she get her SSDI lump sum and not have to wait every 6 months to break that one up and get SSI

Hi Jonathan. I have seen many of your videos. You do an excellent job of explaining the process. I have been approved for SSDI and SSI for a closed-period(10 months after the 5 month waiting period) three years ago. Both SSDI and SSI list amounts that are due but only say "we will be in touch with you about your back payments." I am in California. Can you offer any insight as to when payments will commence...or lump sum? Thanks in advance for your insight!

+rallisoify - thanks for the kind words. Normally, you will see your money about a week after the "payment letters" are issued. Payment letters detail how SSA calculated your payment and any reduction for attorney's fees or Medicare. If it has been more than 2 weeks, I would start calling.

monthly benefit 2500 and lump sum estimate ssdi 40000 a year I'm asking Monday I'm excited about ssa lawyer I'm claiming one year onset Oct 2017 25%. No lawyer personally is employed in lufkin at their place. I had lone star legal aid fax an application and i mailed my taxes. They said my file is up for review. I'm approved and to watch the mail. I was given no letter.

Some judges say that the two are inconsistent. I take the position that saying you are ready, willing and able to try to work is not a medical determination that you actually have the capacity for work.

+Death notes true author - normally, you will get "payment letters" detailing how much you will get around 30 days after your favorable decision. The money should arrive within a week from the payment letters.

For SSDI its all in one lumb sum. With ssi i think its certain amount every few months depending on your total amount

Under the terms of most employer provided LTD policies, the LTD carrier will require you to apply for SSDI and if you win SSD, your SSD benefits will reduce what the LTD carrier has to pay you. You will also have to sign over your lump sum SSDI payment to the LTD carrier since there is a good chance that your past due SSD benefits represent months where you were getting LTD benefits. Many LTD carriers contract with non-attorney rep firms to assist you with SSD. Some of these non-attorney rep firms are good and some are not so good. The common complaint I hear relates to poor customer service. In my experience, LTD companies will only ask you to repay the lump sum you received, meaning that the LTD carrier will, in essence, pay the attorney's fee for your SSD case. So, bottom line, whether you use the LTD company's non-attorney rep firm or whether you use a private lawyer, you will not pay anything.

8 years suggests that there have been multiple appeals. If a favorable decision is issued based on that 2010 application then the claimant may very well be entitled to 8 years of past due benefits.

Right at the beginning I went with a big-name lawyer that does so-called Social Security cases, three different lawyers and a bazillion different assistance, case managers, receptionist, etc. if it seems that besides maybe the initial application being filed which I had to do over the phone and redo after my lawyer did it, that I pretty much am doing everything and I get information direct from the determination and all of that andat first I talk to somebody different every time I had contact with the officeand I have yet to ever talk to one of the actual lawyers there. Should I be concerned with the law firm in that case? I finally got a case manager, not a lawyer, and my last few times I've tried to contact him he's not in the office and the receptionist didn't know if it's going to be a while or if it's just for the day etc. So if I'm doing everything which mainly involved filling out paperwork for the determination office, after thatapparently it's just a matter of sitting around and waiting for their initial decision. They won't even look at my 30 years of medical records they said they only look at the past year or eighteen months. is there any reason to have a lawyer that's not going to do anything except wait until it's done so that he can collect$6,000 of your back pay or however much he would get for showing up at the very last minute if there was even a need for him if they ended up approving you....wouldn't it be better just to do the process yourself which isn't that difficult until the initial decision, saving yourself all those attorney fees that weren't really earned by him or her? I'd like to hear your take on all of that.

Under a standard fee contract your attorney gets paid 25%/$6000 if he wins, regardless of what work he does. You should not be filling out forms or responding to SSA letters. That is what the lawyer is supposed to do. I think you deserve to have a conversation with either the attorney or the case manager to discuss the progress of your case.

@@ssdattorney thanks, I finally talked to my case worker, and he said that the social security office lost the form that allows the lawyer's office to request my information and to have information sent to...etc ......in the things I'm filling out right now are the pain report and functionality reportwhich I have to do a second time because the determination office shuffled my case to a determination office in Arkansas I believe. Up to now yes I have pretty muchdone everything is the office has been sending everything to me rather than to my lawyer. Thanks again

This month or next month lone star legal aid took my case and is done I mailed them my 1099 my number is 6 and I have over 25000 filed. I'm up for review since yesterday I'm waiting in my direct express card. No estimate for the disability program.

Only a very small percentage of hearing denials are reversed or remanded by the Appeals Council. The odds are not good at all.

I a have question I was receiving SSD and they took it from me in 2012 because they found me non disabled. I challenge the desion right away. I won the appeal and got a letter in June 2016. I recieve 803.00 monthly but haven't recieved any retro yet....What should I expect in retro?

I got approved for SSDI but I applied on November 2017 but my AOD of being disabled the judge put it as February 21 2017 and I got approved on February 26,2018 is it possible I will get paid for 19 months because I already subtracted the 5 months already because it’s been two years since I been disabled

If the onset date the judge used was 2/2017, I believe you would get past due benefits from August, 2017 thru the date of your decision.

I applied and my date that the lawyer said I became disabled was may 2017 I didnt know about the 5 months that I don't get anything for that. I would be happy just the judge saying yes I already had my hearing may 23rd 2019 and I been waiting 4 weeks for my answer from the judge. Thank you for the video this helps answered alot of my questions. I became disabled due to multiple car accidents and all in with in 2 year perdiod and had eight different doctor with medicals evidence including two neurologist. My injuries were to my neck between c6 and c7 herniad disk and hernidiad disk in my lower back.

I've been waiting on a return benefit check in the amount of $4,600 for I don't know 7 weeks now and they just say that it's been processed I mean it had been tried to been deposited twice in the past and old bank account but it come back twice from the same bank I was out of state I didn't know I got to take care of when I got home but I had to deposit the other day hit on October 7th for 4,595.90 really close to it but it said it was for an additional lump sum payment what's going on man I mean what's up can you help me

Could you help me ..... My lawyer told me at my hearing that I would get 47 grand back pay n 951 a month n I'm now getting 500 a month n 20 grand back pay so my lawyer was over 20 grand off n almost 500 off on my monthly .now how could a lawyer on my side be so fare off .n I have a daughter n I'm supposed to live off 500 a month with a house .I won SSDI n SSI n it's in writing but SSI claims that paper don't me a damn thing n I just got SSI bc 9 plus years ain't enough to get SSDI but yet my father has only worked 3 years in his life n makes almost double what I get I simply don't understand it

So how does one collect workers compensation until april 2012 , followed by SSDI payments starting in June 2012 ? And then receive $38482 in SSDI benefits in the same year. Can a person collect both? The total benefit of income in one year was $45,023? Have you ever encountered any situation like this ?
