Here in Oregon they skip all that. The APS and insurance company all work together create false allegations. Invalidate the Durable PoA then have a guardianship hearing without notifying you. Meanwhile you can not get any help at all from a lawyer especially for contested guardianship. Folks in Oregon need to speak up and contact senators and state representatives for reform. Skipping human and constitutional rights altogether
My friend attorney is filing a petition when someone petitions to the court they may have an attorney and even if they don’t, they are required to serve the defendant and any next of kin who may contest. Serving a notice of the petition through the act of service either via email from the attorneys office or being served directly by the sheriffs office that person will have knowledge of the filing at that point to contest the matter or simply sign off on it

Although I visit my mother regularly I’m worried I’ll show up one day to find out someone has guardianship. I’m trying to help my mother transition into a care facility but I have siblings and in-laws that are frustrated with her and want her in a home now.
