And his expensive lavish vacations and other extracurricular activities are payed for by his "dearest friend". I'm not 100% sure but you don't have to report when you get stuff payed for by others like trips and stuff. Idk

In situations with such insanely drastic stakes, they were *incredibly* arrogant and stupid to risk distracting themselves with interoffice romance instead of going after almost literally anytime else on the planet, especially when dealing with psychopaths who would be liking for literally any dirt on them to air to the public, regardless of how relevant it is.

That cash thing is true. I know some people with a mother from Georgia. They prefer cash to keep better track of finances, and hate leaving a balance on credit cards

It's one of those budgeting techniques recommended to anyone who has struggled with credit card debt. It's also really common among people who don't trust banks. I know a few people who immigrated to the US after a financial institution in their home country collapsed and they lost all their money so they keep large amounts of cash on hand at all times.

Its not even just Georgia. I'm a white woman in Canada and have many black friends/coworkers/acquaintances that have said they all were taught to keep cash stashed away as well. And although the amount changed, having money to escape from a bad date was very common - an not just among black women.

Agreed......but when you are the boss and you hire your significant other, and they pay for all kinds of things for you, their boss.....it looks fishy.....especially with an accusation of dragging out a prosecution to create more billables to further pay your boyfriend who is buying you stuff. Also basically being caught lying about how long you've been together seriously doesn't help.....and I believe they are both lying about that at least. Most people would keep their partner off major national implicated cases for literally every reason that caused this particular part of the circus.

The problem is that you would have to get the house and senate to impeach him, and that will never happen even if he is proven to be corrupt. The same would apply to a justice from the other side as well. They won't impeach their own.

This is a "two wrongs make a right" argument, the argument of hypocrites. Yes, both Thomas and Alito have clear conflicts of interest, and when it's against your bias, you have no trouble recognizing that it's wrong. Conflicts of interest aren't suddenly okay when they happen among liberals. If you think it was wrong in the Supreme Court -- and it certainly was and is -- then it's wrong when the DA does it, too.

Funny how Fani Willis dating a coworker is a ginormous problem, but Clarence Thomas overseeing Trump related cases is _married to a Trump accomplice_ and no one's making an issue of that? How does that make sense? Because Thomas is male and conservative, that's why. One thing I disagree with Willis on: it's not (just) about race, it's politics and misogyny. I don't believe for a second that they wouldn't have gone after a white female DA in the same circumstances.

Then they should investigate the people on the defense team who are in a relationship, and have one of them step down. Why should it only count when it's the prosecutors?

I am no lawyer, but I fail to see how the private misconduct, that doesn't rise to the level of illegality/criminality, of members of the DA's office has any bearing on the case? It's not like Fani was sleeping with Joe Biden or Eric Trump, which would give her a motive separate from the facts of the case or inside knowledge of the defendant, and the fact she was sleeping with the special prosecutor doesn't change the fact that said prosecutor is qualified for the position, it's not like she assigned an incompetent to the position out of nepotism. The judge admitted that the defendant's representation failed to prove the facts of any "kick back scheme", which would seem to me like the only potential source of conflict, that pursuing the case would enrich Fani or any other party in any way. Has the judicial system really devolved to the point of disqualifying cases/attorneys because of social faus paus?

Yea, I don't see how the conflict could harm Trump. The incentives of the DA and SP are aligned. The DA didn't recuse herself due to any conflicts, etc. The worst case is she assigned an incompetent prosecutor, which can only help the defense.

At the moment this hapless, probably corrupt prosecutor is a Trump adversary, but that's no reason to turn her into a hero. Fulton County voter here. We are reelecting Fani Willis. Nathan Wade lead that team from the beginning through two grand juries, indictments, and notable like guilty pleas. His work has been stellar, thoughthat is not heard. If the work had not been stellar, every clown with a legal thought would be hawking a book right now. 😊

Because she's prosecuting one of the most important cases in American history, and out of all the lawyers in the world she could choose from to be an "independent" counsel, she picked the one she was knocking boots with. I hate Trump as much as the next decent person, but this was just inexcusably stupid on her part, and makes me doubt she has the judgment to effectively prosecute this case.

Because appointing the dude she slept with to (arguably) the highest profile case in the history of the state, and potentially setting him up to benefit from all the rewards (financially and legacy wise) should the prosecution win is a conflict of interest. Does it do anything that derails the case against trump? No. In fact, it doesn't impact the evidence in any way. And the argument that the whole case should be thrown out because of this is laughably stupid. But the appointment is corruption (as are all forms of nepotism amongst the powerful) and I agree with the ruling that either she needs to recuse herself or she has to pick someone else.

I think it is safe to say, that while District Attorney Willis' actions didn't rise to the level of conflict of interest and doesn't warrant her or her office's disqualification (and certainly not an outright dismissal of the entire case), her actions *_DID NOT_* do the smooth functioning of the US justice system any favors. She *_DID NOT_* appear to fully appreciate the seriousness of the entire case, and what that would require of her - up to and including relinquishing certain aspects of her right to privacy and a "normal" personal life.

I think you're looking at this through the wrong lens. If Mcaffee did nothing about it, it would've just been another avenue for appeal and could potentially screw up the final outcome. The case has to be water-tight, and Willis should've known that anything that could ever be considered improper, whether it was or not, would be used against her, given the stakes. By dealing with it now, when the election conspirators are found guilty (it'd take a miracle for them not to be found guilty when they committed these crimes in broad daylight and there's so much corroboration) that's one less thing the guilty will be able to claim prejudiced the case in an appeal.

Ok, Nathan Wade is gone because of a conflict of interest, well the appearance of a conflict according to the presiding judge. I know of this different guy, I think his name is Clarence Thomas. He has been accepting numerous bribes.... I mean gifts.... from billionaires and involving himself in cases in which is wife is a player. It seems the Supreme Court has lower standards on conduct and accepting gifts than College Basketball players have on them. This whole situation I can only describe as having an "odor of mendacity".

Both are separate matters. And are equally important in their own rights. Stop this "woe be me" drama because the guys you support are being subjected to proper procedures. If a defendant was on trial for a serial killing charge, and it was found that the prosecutor tried to get their sibling to be the defence lawyer, it would constitute a conflict of interest and the court would move to pull them out of the case. Because leaving it be would create a doubt that the trial could be prejudiced against the defendant. You shouldn't then, as a friend of the prosecutor or the defence lawyer, complain that the guy on trial possibly being a serial killer is a bigger problem and your buddy's hijinks should've been ignored. Both are equally important issues.

This argument is no different from Trump's "I repaid the loans so where's the fraud" There are rules in place that apply to conduct, and do not require a direct negative outcome. Those rules (e.g. prohibit a prosecutor from benefiting from a decision) can have edge case applications like here (she benefited from appointing him, how?...) but the whole point is that the facts are applied to The Law, not the other way around, and the process can be used by any party to give them a better shot at their case. In a criminal trial, that means the defence is permitted to try everything possible to help their case, even if it's immoral in the subjective opinion of everyone else.

It's an interesting moral question! The question is: "is it unfair to the defendant for a prosecutor to have a financial or other stake in reaching a conviction?". Apparently you disagree with the justice systems' position, which the video describes at 18:20. Obviously it's wrong for a prosecutor to have any reason to "go easy" on a defendant, but it's harder to see why we'd care if a prosecutor tries "extra hard" to convict, since conviction is kinda their whole job (discussed at 15:09). One argument for "yes, it's unfair to the defendant" could be around the idea that we want every defendant to have a fair trial. A prosecutor trying "extra hard" with some defendants, and giving only "normal effort" towards convicting other defendants, might be a kind of injustice in the process. That's a detail you only notice when you accept justice workers in the real world can't do their jobs perfectly 100% of the time, and so only in our imperfect world could these biases matter. I'd love a video going into further detail on the moral discussion informing the law here.

Even the defence only raised that she was getting kickbacks from a lover, she a prosecutor shes obviously invested in a guilty outcome, and not a defence attorney, throwing her defendant under the bus for a guilty verdict which your comment would make sense with. She would hire a special prosecutor, regardless, she hired 3, and they're all being paid the same. Their a prosecutor, and as the video says, a prosecutor must by their very position be biased against the defendant and not hold a view that they are innocent. I believe her, based on her beliefs and the reason they had for ending their very short relationship, that she is not one to let a man pay for her, and she's going to be one to hold her, not mention the amount shes getting paid already. Whether a prosecutor tries harder for one defendant over another doesn't make the trial unfair. Just a prosecuctor who does a better job than another would not be unfair, thats ridiculous.

Obviously, yes, the judge reached this conclusion too, which is why she wasn't disqualified. But the reason he reached this conclusion wasn't that it's totally implausible for her to have a financial stake; instead he concluded it because the defense didn't present enough evidence of it. The court thought it was plausible (but unlikely and unproven) that she could have a financial stake. The video doesn't completely explain the details, but I suspect the logic boils down to: "she would have an incentive to continue prosecuting the defendants even after the point where she would normally 'give up' and divert her office's resources to other more important prosecutions." District Attorneys have to make decisions about how much time and focus they put on each case, since they only have limited resources. By hiring her boyfriend, and having her boyfriend use that hiring to take her out and improve her lifestyle (the "kickback"), the logic goes that she would be incentivized to continue prosecuting (or even incentivized to bring the charges in the first place) not for normal justice reasons, but in order to keep the kickbacks coming to her. In other words, without the hiring of the boyfriend, it's plausible that she could've chosen to not prosecute at all in the first place, since the financial incentive wasn't there. Your original comment supposed "even if you could prove she had a kickback scheme...", and your reply suggested a kickback scheme didn't give her an incentive to prosecute. Again, the court found that there was no proven kickback scheme. But I wanted to fill in the gap and explain how a kickback scheme (if proven) could have lead to the extra incentive to prosecute. (And that's why the court entertained this motion at all) And again, I have no comment on any of the other opinions in your reply; I just wanted to explain this one detail.

Yes it wasn't proven, and thats how every case goes when someone is acquitted but generally speaking in 99% of cases, we don't then say well it is possible the prosecution just didn't prove it. Even if their relationship had a sexual component that does not mean they considered it to be a "romantic" relationship. They both admit to meeting and becoming friends in 2019. To me it seems like they hyper focused on the nature of the relationship to make it salacious. Wade, Willis, and all the witnesses said they met and began some form of relationship in 2019. That's all that is relevant to the case. You don't have to be sleeping with somebody to engage in financial impropriety or prosecutorial misconduct. The nature of their relationship has nothing to do with the wrongdoing the defense alleged.

This is so devastating for the trial. It's really inconsequential who tries the case but it just gives the defense so much fodder for the news, they'll be reporting on this over and over for weeks regardless of how the case progresses.

They're trying to be extra on the up and up so the case is water tight. But the same standards don't apply to the SC because they set the rules for themselves. "We've investigated ourselves and found ourselves not guilty of any wrongdoing" type of energy.

That whole excursion into an issue that has absolutely nothing to do with the prosecution of the case against trump and his co-conspirators. The double standard that her conduct in hiring and paying the people she engages to work on cases, yet the criminal defendant get to bring up these matters that are irrelevant to the case all fotlr the desired effect to stall the case. Impeaching her private life and work admin choices by th twice Impeached criminal defendant is extremely ironic.

The judge was assigned to the bench and hasn't won an election yet.... guess what he has to do this year? Run for election. His decision looks a lot like a political move, because a white judge removing two black prosecutors from a case in GA wouldn't go over well. He wants to sit on the fence to give both sides a win. If he did what was right, they'd both be thrown off.

If you think the DA is the reason this case is not a slam dunk, you need to pay more attention. Trump and his shady friends and attorneys are willing to try every dirty trick in the book. And they are permitted to get away with it. DA Willis, as well as Nathan Wade, are among the few heroes in this country willing to take them on. Wade wasn't her 1st choice, or 2nd, or 3rd. Wanna know why no one else would take the job? Because they didn't want to deal with the level of DEATH THREATS these prosecutors are getting.
