@@Kakwasi very bad. In fact in the case I was handling, I was brought on board at the appeal level. The person did not have an advocate during the trial in the lower court. He was remanded for 4 years until judgement was delivered. When I took over the file had been missing for around 2 years. To make it worse, the appeal file also was missing. It took the intervention of the resident judge for both files to be traced. And then, the evidence that the court relied on to convict my client was very weak. The doctor had proved that there was no penetration but the magistrate went ahead to find him guilty and sentence him to life imprisonment. I thank God that decision was finally overturned by the high court.

Judges cannot be punished for the decisions they render, no matter how riduculous they may seem. The only recourse provided for in law is to appeal for a lower sentence or for acquittal. It's a priviledge judges and magistrates have that is open to abuse. A judge can only be sanctioned if there is evidence of corruption - such as taking a bribe etc.

One can petition JSC to deal with wayward judges. We are not completely helpless
