From another video, this whole thing was apparently the cops literally trying to find a scapegoat to avoid blame, because the person being in a coma ended up that way in a car accident caused during a police chase where the person they were chasing crashed into the dude and the car blew up. They were trying to accuse him of being intoxicated to make the claim that, because of that, he was responsible for the crash, not the cops messing up the chase, then that led to this. Just to give you more insight on how corrupt departments can be.

The nurse was only doing what she was told. she was not an individual but an agent of the hospital. Arresting her would not get the LEO the blood. The order has to come from someone above her. Nurses are not allowed to draw blood with out a doctors order. When given the standards that the police gave then one when blood can be draw. Exigent circumstance was on the legal document. When the watch commander was told this. He should of order a warrant to be . . . oh wait they don't have probable cause. SO they have no rights for the blood.

I disagree with you about the hospital because I has seen a similar situation and the hospital protected the nurse. The hospital lawyers, higher ups, and security was on scene to protect the nurse but this hospital higher up was talking through the phone. I am an ER nurse and this was so illegal as to be insane. You cannot force a blood draw without a warrant or consent PERIOD. Every ER nurse I know was so pissed at this.

I bet his training says to make sure he says "exigent circumstances" for the camera whenever he's trying to circumvent a warrant, just like they train him to repeatedly yell "stop resisting" while assaulting everyone regardless of any actual resistance.

She should have been given a, " huge Promotion and Raise!",.. especially for "Protecting the patient Rights, while he was unconscious and willing to go to jail for her patient!",... She is the most responsible and respectful NURSE I have ever seen and heard,. Considering most of the time,.. a lot of them are unable to deal with the public and treat incoming people like they are not worthy of their time or having to do paperwork,.. but don't get me wrong,.. I do have the upmost respect for the ones who love their job and helping citizens with their needs,.. it's the few who just want to sit back and earn their living for doing nothing!😮 !.. as the saying goes,;.. "If you can't stand the heat!,.. get out of the kitchen!",... In other words,.. When you feel that the job is too much for you or too stressful,.. get another job or quit!.., B4 you make yourself and your fellow workers look like they lack any kind of "Empathy!"... 😮!😢!..😢 Stay home and take care of yourself and your family,...😮

At 6:36 the backup officer asked, "Why don't we just get a search warrant?" The 1/2 million dollar question of the day! By this point in the medical evaluation and treatment, the hospital had already drawn the blood sample. It is part of the medical record. If they had Probable Cause, any Judge would have granted them a search warrant. The original blood draw would be enough to use in court, they did not need to do a fresh draw. In fact, the blood draw that the officer was trying to get would have resulted in a LOWER blood alcohol content that the hospital's original draw. My bigger question is, how can they charge an individual with refusing to perform the blood draw when they don't have the authority to force someone to perform it. Even with a warrant, she, personally, can't be held accountable and forced to perform the draw. The responding Supervisor was clueless.

Exactly this line of logic at the end. I was questioning; how can you force a medical professional to perform a procedure against their will. The worst you can do is get them fired and get another professional to do it but there is no grounds whatsoever in any Western country let alone America to compel someone to do a procedure. This is on the level of what you’d expect from North Korea or a terrorist organisation. And I don’t make those comparisons lightly

Being a victim of a car crash is not exigent circumstances. Nurse Wobbles is not required to help with what ever investigation this cop thinks he’s performing. Doing nothing is not interference. Is he going to arrest every nurse in the hospital who refuses him? Then he endangers other patients by taking away a charge nurse.

My wife works for a hospital and I’ll tell you those people are real hero’s. About 6 months ago a nurse talked down a gunman that wanted drugs from the emergency room at providence. Talk about friken amazing

My wife was an RN charge nurse in a hospital and i can gurantee she would have done the same thing this nurse did. She was very good at protecting her patients well being and their rights. Nurses are special people and very devoted to their patients. My wife was a nurse for 45 years. God bless all nurses for they truly are special and needed.

The fact that Payne didn’t apologize means he didn’t want to admit fault and just blamed his superior officer who in turn blamed him for not getting all the facts. Large egos cost the tax payers money. She was defending her unconscious patient’s constitutional rights and didn’t let them win. Good for her!!

In the UK. the Nursing and Midwifery states that the patient's nurses are the patient's ADVOCATE. An unconscious patient CANNOT CONSENT, they had NO warrant AND the patient was NOT under arrest. END OF!! Well done Alex!!! ❤❤❤❤❤

@@thewhitefalcon8539 Indeed, so called 'civil servants' are employed by taxpayers. They are required to know the law, their jobs and understand citizen rights under the constitution. Those in 'authority' MUST be held to much higher standards. I always say bring back public sentencing, SHAMING, executions, the pillory, tar n feathering, maybe even stoning. Let's make some example of bad behavior for once and all. It's an excellent deterrent! Politicians and many other local, state and federal workers are also known as 'civil servants'. I used to be a contractor to NASA a few decades ago. I worked for 'civil servants' What I witnessed in just 5 years was just a drop in the bucket regarding government corruption. I resigned on account of petty political BS, but my actual work was actually fascinating, even fun. The corruption has been going on for much, much longer. How is this not clear to average citizens? I believe that at the very least it's highly likely that the majority of 'civil servants' fail to understand the definition of that term, much less the meaning of either of those two words! The term in and of itself is really ironic. The sad part is that these settlements are most likely paid ultimately by taxpayers. These incompetent cops should pay out of their retirement benefits and or personal assets.

He would follow my mom around town, in his cruiser, pulling her over when ever he could. I couple years back he pulled her over and tried to come up with something to get her in trouble with so my mom brought all this up to the police chief and now he’s not allowed anywhere near my mom, if she ever were to commit any crime/ infraction and he’s the responding officer, he has to call another cop in because he was absolutely obsessed with her. 🙃 he’s also a huge racist and I’m mixed so… that’s probably a part of it too

This guy specifically, he got caught messing around with under age girls while he was on duty, in his cruiser, and got suspended with pay for like a week and he’s still on the force somehow 🙃 not to mention when he hit my ex fiancé (who was driving my car at the time) with his cruiser and then tried to ticket my ex 3 days later for scratching the paint of his push bar, as if he didn’t crack my whole front bumper

The entry level qualifications for LE Officers are very minimal. So its unsurprising they're often not the brightest. Also, psych studies found the top 3 career choices for those with psychopathic traits are: Corporrate CEO, Medicine, Law Enforcement. They go for roles that fill their need for power, status & control.

This incident is a perfect example of why you should know your constitutional rights, especially when dealing with law enforcement. Most of our police do not know any titles and details of any amendments. My heart goes out to the brave nurse for protecting, hers and everyone in that hospitals rights!

This nurse is a hero. The officer was basically holding her hostage by saying he would either 'leave with the blood or arrest her'. Holding her freedom over her head for merely following policy (which also was the legal course of action). Even if she was incorrect, arresting her for reasonably trying to protect a patient is insane.

I laughed so hard at that line. I’ve definitely seen good cops, and seen them stand up for people’s rights, deescalate situations, and use discretion in not ruining someone’s life over one incident, even somewhat serious ones. But they’re increasingly the exception rather than the rule. Obviously we get a biased sample considering mainly the bad incidents get shared, but considering a cop doing their job properly and having common decency and respect towards citizens is celebrated as a great cop, the bar is clearly that low for a reason.

My mom once had to run outside, leading hospital staff, to break windows and evacuate elderly patients during a fire. I can picture her in the same spot doing the same thing as this nurse, along with all the other nurses she worked with. Nurses intimidate me, honestly, and I think these cops were afraid she was tougher than they were! And she was.

Absolutely commend this nurse for standing her ground and protecting an unconscious patient and keeping her cool by having evidence to present to the law enforcement officials and didnt react until the officer grabbed her for an arrest. Whoever she is, she should be awarded and givin a raise and educate other healthcare proffesionals!!! Yes, that was what really got my blood boiling, supervisor shows up and is basically gaslighting her "why are you involved...do you know him...etc...etc". I read a long while back that this whole thing is because they wanted to get a blood draw for any chemicals because the person/family may sue the department for the collision because of a police chase. So if they had even the slightest BAC/drug it gives the police an out in court. Mind blowing.

I come in the hospital and the nurse they did an outstanding job those two police however should be in the unemployment line neither one of them deserve to even be in any kind of law enforcement. My daughter is a charge nurse I pray she would be able to emulate Nurse Wubbels in the face of such condescending and aggressive confrontation. I have seen this incident on several channels and all of them have missed something. The nurse is reading from an MOA, a Memorandum of Agreement between the hospital and the sheriff's office. This is a mutually agreed upon set of guidelines agreed to and enforced by both organizations. Taking that into account, it is the officer who is guilty of obstruction by attempting to force the nurse to breach the agreement previously approved by his own administration and the hospital. i find this ridiculously ironic.

Personal Update: Although Det. Jeff Payne was fired for the incident, he still claims he did nothing wrong. He sued the City of Salt Lake City for 1.5 million for wrongful termination. He lost and his appeal was denied. He then was hired next door in Weber County as a Jailer. - The University of Utah medical center changed their policies now to where the police cannot contact anybody in the hospital until cleared by upper management.

There's absolutely no chance of him taking out his temper on prisoners! Or abusing their rights because he likes to throw his weight around and demands immediate compliance. No sirree bob.

Given Utah's culture and it's dominant religion what do you expect? Of course he did nothing wrong he was "just following orders" you know that old Nazi line that brought about one of the greatest tragedy of the 20th century. Ordinary people are not allowed to think when a order is given "the brethren (authorities) have already done all the thinking" Once after 38 years I understood how dangerous the culture is, I knew it was time to get out of Zion!

She doesn't have a choice. If she had taken that man's blood, she would be opening the hospital up for a possible lawsuit, losing her job and possibly her license. She's not taking a stand out of mortality. She's doing what is required of her because she understands the violation that would entail.

No, she was actually breaking the law if state law required a sample in the event where injuries result from a motor accident, and hospital policy can not say otherwise. What saved her and the hospital in this case was his animalistic behaviour because his ego was bruised. Would you feel the same if your child was killed by a drunk driver and she refused the draw

I am of the mind that these kinds of cases should be treated like child support is treated in the US. Base it on what we know the person is capable of making. If you made 50K per year, you need to pay at least half, if not more, toward what is owed on the lawsuit. If you can make 50K, but voluntarily choose to take a lower-paying job, you should have to pay the same amount, regardless. A refusal to pay will result in a seizure of assets, and potential jail time. In addition, the debt owed to the individual should be treated like a student loan in that it does not go away by declaring bankruptcy. The taxpayers should DEFINITELY not be the ones who have to pay for the poor decisions made by officers.

Another reason why all police officers should be compelled to undergo Constitutional law training before being certified as an officer. A 4 year law degree would eliminate many of these tyrants before they get to strong-arm people and violate basic, Constitutionally protected rights.

The last time someone said to me they been doing something for over 20 years … It was a doctor who almost caused my death. He said he could look at me and tell that I didn’t have a kidney stone. Later in an E.R. after pain and a fever a CT scan was done. It was found that I had a stone the size of the cap on a coke bottle which I ended up having 3 surgeries to rid from my body.
