Im fighting wirh state farm right now with getting the roof on my house replaced because of discontinued materials and they have statement from the manufacturer saying materials cant be mixed and city code department saying that not allowed by the city and they are refusing to accept the information they have been supplied.

The real takeaway is you can't do insurance work in Iowa without a public adjuster's license. Both parties agreed that the law is written so broadly that any back and forth between a contractor and the insurance company would constitute public adjusting, Further, he marketed himself as an adjuster. The Supreme court only deals with issues of law, it's not a factual hearing, you are stuck with the facts from the lower case. If he had a public adjuster on staff, that may have satisfied the requirement, but if that was not brought up with the lower court it can't be brought up later. His lawyer's argument that the only remedy to public adjusting w/o a licenselawyer,

In one of your videos showing red flags 🚩 on contractors. This guy did several of those red flags. From aggressive and predatory solicitations to acting fraudulently as a public insurance adjuster. I watched the Supreme Court case on this. His attorney even said he didn’t apply for one because of his past criminal history would prevent him from being a public insurance adjuster. So he willingly broke the law. Heck three other insurance companies sued him and won. All I can say is the two most shady types of contractors are roofers and sheet rockers. Because they usually only have a tailgate warranty. Once you can’t see the tailgate the warranty is over.

I own appliance repair company and I had to stop taking any insurance claims. if somebody has a water leak on wood flooring and they have State Farm insurance we will not repair the appliance until they submit the claim for the flooring first so that way we can ensure state insurance won’t try to pin it on us.

1 you should have an arbitration clause. . 2 i separate my trades. I do roof 1st and get paid. For roof. 3 they should of had someone who could estimate for the right amount- include the fascia soffit and the sunroom at the beginning. You have know how insurance company works.

This is why Appraisal is such a huge benefit. Litigate or appraise. Both are a roll of the dice but Appraisal is such a better angle.

I watched the trial/hearing on this case and what is clear to me is this roofer still doesn’t know what the issue was. They were acting as Public Adjusters and were not licensed to do so. They were not part of the insurance contract. What is surprising is this survived a motion to dismiss. Everything this guy is speaking of is about the damage BUT the issue is if his company had standing to even present litigation against the carrier. This is contract law not insurance. His lawyer’s competence has nothing to do with what happened. The policyholder could have authorized you to submit a supplement on their behalf but you had no STANDING to bring litigation against the carrier. Your assignment isn’t worth the paper it is written on!

I built cabinets for a plumber who used Xactimate and never were his estimates low, in fact many times they were over what my bid would have been. He told me what he would pay, I either accepted it told him where he was missing something. So I don't think the problem is the software.

There's nothing in the policy about Xactimate. They are in violation of policy if they don't answer the scope based on merit and not on how it's presented

This is a spectacular story. Dudes a good narrator no doubt.. So much to digest. But i have to believe ya lost due to the ponytail. Judges and cops no-like a rebel. Was state farms attorney a certified adjuster? Beacuse if she wasn't she can be sued and state farm under the law correct as she could be considered an adjuster because she was assigned the claim and argued details about the claim!

In every state, attorneys are permitted to be adjusters or public adjusters without an adjusting license. That's because adjusting is a very limited practice of law.

I'm an adjuster for State Farm. State Farm is a process more than it is a company. In order to get things done you have to understand the process. Half the stuff you are saying doesn't get covered, actually does. But it's about dealing with someone who's reasonable and not someone who's new. You might have to go through 2 or 3 people to get to that one guy who actually understands what you are talking about

Never heard of a $77,000 roof for a residential even if replacing all the sheathing. Idk maybe it was made of copper. In general the contract is usually with the homeowner. If you can’t do the work for the price offered then walk away. If you find more damage write an amendment to the contract. If the homeowner doesn’t want to fix it walk away or have them sign a waiver.

@@ryanjones3043 nope. Then again not sure where prices are. My body won’t let me do that work anymore. However, my dad got his done last year 45 square for $15k not including sheeting. Synthetic underlayment, architectural shingles, and union labor. Last big roof I did was 54 square for $12k. Do remember one job that cost $12k just for the tear off as it was asbestos tile. Total cost was over $20k. Generally a roof costing over $20k just becomes unaffordable for most people I would think.
