I would suggest checking with your employer as it appears that these 26 weeks leave includes company provided baby bonding leave along with pfl and disability as you also need to use vacation time.

Disability insurance is for the period you are disabled as mentioned by the doctor per medical certification. However pfl can be availed anytime within 1 year of baby's birth. So you may or may not be able to club the benefit periods unless they are used back to back.

So the information provided is applicable based on state regulations. And to your specific question. Yes you can apply pfl and sdi. However, see definition of disability per edd in California is as follows. Disability Insurance (DI) provides short-term wage replacement benefits to eligible California workers. You may be eligible for DI if you are unable to work and are losing wages because of your own non-work-related illness, injury, or pregnancy. Pfl qualification requirement is: If you or a family member takes time off work to care for a seriously ill child, parent, parent-in-law, grandparent, grandchild, sibling, spouse, or registered domestic partner, either of you may be eligible for Paid Family Leave (PFL) benefits. Per edd.ca.gov website on 08apr2021, All PFL claims must be completed and submitted no earlier than the first day your family leave begins, but no later than 41 days after your first day of leave. Please check edd.ca.gov website more specific questions.

I am sorry to hear that Jason200031. I agree that sometimes reaching EDD can be a painful process. Here is what I would recommend in your case: 1. try to send them an email, I have heard they respond to emails, there must be a contact us section at the bottom of the page, that is what I remember using. 2. This is what I read on the EDD website on 15MAR2022, "For claims beginning on or after January 1, 2022, weekly benefits range from $50 to a maximum of $1,540. For a PFL claim to be valid, you must have at least $300 in wages in the base period. Claim beginning February 14, 2022, uses a base period of October 1, 2020, through September 30, 2021. You may not change the beginning date of your claim or adjust a base period after establishing a valid claim. If you have any questions about your claim start date, please contact PFL at 1-877-238-4373 before filing your claim. If your highest quarterly earnings are less than $929, your WBA is $50. If your highest quarterly earnings are between $929 and $6,803.34, your WBA is approximately 70 percent of your earnings. If your highest quarterly earnings are more than $6,803.34 your WBA is approximately 60 percent of your earnings". There is a breakdown on the EDD calculation on their website: edd.ca.gov/Disability/Calculating_PFL_Benefit_Payment_Amounts.htm As I put all of this information together including EDD's response it appears that the highest quarterly earnings may have been less than $929. Also, there is information on the website that talks about the special base period, I copied that info below as well for quick reference if any of these apply to you EDD: "if your current base period was negatively affected by military service, industrial disability, trade dispute, or long-term unemployment, contact PFL at 1-877-238-4373 to verify if you are eligible for the special base period and provide additional information to support your request. Your benefits may be reduced because of prior Unemployment Insurance, PFL, or DI overpayment or for a delinquent court-ordered child or spousal support payments". Again this is not any legal advice, I am just going off of what I read through the message and EDD website and trying to come out with a reasonable explanation that makes sense. Turns out my employer messed up and never deducted State Disability Insurance (SDI) taxes from my paycheck so I am not eligible. The payroll team was able to contact EDD and they are going to try and fix it and get me my benefits and have me pay the taxes

yes reaching EDD can be difficult sometimes. You can just say yes/no, they do verify the information prior to issuing the check. The disability claim ends the date doctor removes you from disability when they fill the medical form.

@@fatimamorales2416 thank you so much, Fatima. You need to get the medical leave certification form filled from the doctor office following the post partum checkup. Based on your recovery your doctor will fill in the last date of leave which the doctor needs to send to edd as physician statement is also a requirement. Also following disability leave you can add on the paid family leave.

Yes paid family leave is applicable for fathers as paternity leave.

Before pfl application, disability leave needs to be used. Pfl is state benefit and my understanding is that as long as you received pay in last year, you will receive 60 to 70 percent of the income as you have paid taxes on that.

Thank you. Yes fathers can also take pfl. You have to apply for bonding if its within 1 year of baby birth. You get paid 67 yo 70 percent of previous year contributions just like disability leave.

Yes Kaitlyn. You can apply when you hit 8 months for paid family leave if you wish. I would also recommend to please check with your company regarding teh short term disability leave terms as well as pregnancy leave disability terms or any other maternity leave benefits.

@@karnikakreations From what I read on the EDD website I thought you had to wait until the child was born because you have to provide the child's birth certificate?

@@kaylad951 yes you need to apply for sdi first and on completion of sdi apply for pfl. See my video on maternity leave checklist for more details.

Typically for maternity leave you transition from disability to pfl leave. Disability leave is something you can only apply when you are actually disabled and are unable to work while pfl can be applied for paternity, taking care of sick child or family member and more. From my experience sdi was 6 to 8 weeks (based on delivery method) and pfl was 6 weeks following sdi. However since covid they increased 6 weeks pfl to 8 weeks, it appears. Please check edd.ca.gov for latest updates for accuracy.
