How To Beat An Evading Arrest Charge! A Former DA Breaks Down 3 Common Defenses!
Charged with Evading Arrest in Texas? Here are Three Common Defenses
When you’re being pursued by a police officer, your first instinct may be to run - or, if you’re driving a car, to speed away.
Whether you’re being pursued by a policeperson on foot or in a police car, the threat of arrest can be frightening enough to activate your fight-or-flight response. So when given a choice between the two, “flight” may sometimes feel like the smarter option for you - especially when a fight response could land you an assault charge.
However, fleeing from a police officer (more commonly known as “evading arrest”) is a crime in and of itself in Texas, and it carries serious consequences for those convicted.
To help you better understand this serious crime and its consequences, we’ve created a guide to the penalties and possible defenses of evading arrest.
The Penalties for Evading Arrest in Texas
Under § 38.04 of the Texas Penal Code, you commit the crime of evading arrest when you intentionally flee from a person you know is a police officer attempting to lawfully arrest you.
The criminal penalties are actually separated by whether you are evading arrest on foot or using a motor vehicle.
Evading Arrest on Foot
If you are fleeing a police officer on foot, it is a Class B misdemeanor. In Texas, a Class B misdemeanor is punishable by up to 180 days in jail and a fine up to $2,000, or both.
Evading Arrest by Motor Vehicle
Charges get more serious, however, if you attempt to flee using a motor vehicle. Evading arrest in an automobile or water vessel is a state jail felony. In Texas, a state jail felony is punishable by up to two years in jail and a fine of up to $10,000, or both.
Enhancements for Prior Convictions
Similarly, charges are elevated if this is not your first offense. A second conviction for evading arrest in an automobile or water vessel is a third-degree felony. In Texas, a third-degree felony is punishable by up to 10 years in jail and a fine of up to $10,000, or both.
Other Charge Enhancements
Charges can also become more serious if you cause harm to another person while attempting to flee a police officer. If someone else suffers serious bodily injury as a direct result of your attempt to run or drive away from a police officer, it is considered a third-degree felony.
Possible Defenses to a Texas Evading Arrest Charge
To help you avoid the serious penalties that come with an evading arrest conviction, your lawyer has several possible options for legal defenses. We’ve outlined the most common legal defenses for evading arrest below.
Lack of Intent
In order to be convicted of evading arrest, the prosecutor must show that you intentionally ran or drove away from the officer. Your lawyer may able to have your charges reduced or dropped if they can demonstrate you didn’t intend to flee the officer. Lack of intent is a common defense for many crimes.
Intoxication
If you were intoxicated and didn’t notice that a police officer was chasing you, your attorney can use this defense strategy to demonstrate you were too drunk or high to form the intent to evade. Of course, you will still face DWI charges when this defense is used.
Lack of knowledge
Your lawyer can argue that you did not see the police officer, or that you did not know that they were pursuing you.

I live in San Angelo. I've been fighting my only felony conviction of evading arrest in a motor vehicle for 4 years now. The laws ridiculous. I've done 5months jail time. 6 months rehab time in a correctional facility and now my probation has been revoked for Marijuana only!!! Mind you this I'm only a pot smoker, so this is lame. I'm on bail right now. I got 2000$ for a lawyer right now. An undercover cop pulled his gun on me and told me to step out the car. It's been 4 years and I strongly believe he didn't address himself as a peace officer at all! I want to fight it bro. F these law folk putting good hard working people like me behind bars for wrong doing. I want to argue they don't have a dash cam so it's only he and me say. I didn't hurt anyone or destroy anyone's personal belongings by the way!

See if your family will help you get the best defense lawyer possible. And maybe consider giving up weed altogether? It's really more trouble than it's worth, and most employers drug screen. Unless it's for medical purposes, just leave that alone!

I know it's been 10 months I hope you're doing okay as I'm dealing with a same charge in florida. I have always been a hard working man that respects law. I got scared one night when the police flipped their lights on kept driving for about 20 seconds before i pulled over and went into a wawa parking lot and pulled over. Got a felony for fleeing. It has taken a huge toll on my life

But how about if they are in a black vehicle and they didnt put their lights...and just said..hey hold up...hold up, you were about to run...took 2 steps and finally saw they were police...but still charged you with flight to avoid apprehension...he didnt know they were cops nor they said they were cops...just grabbed him and said he detained 2:00

Sounds to me like we aren't free anymore. Stop or go to prison. I was charged without evidence of evading. Lovely.

I was separated from my spouse and had to pick up my things to take to my place. 911 was called but I wasn't aware, due to spouse outside telling me that I could not come in to claim my items and my pet. He said to leave. I did as he said to me, "leave:. When I went to pick up my neighbor so he could be there as a witness with me. I was about 2 blocks away in a rental property. When I parked at my neighbors driveway, which he and another neighbor were outside at that time. All of a sudden tons of cops showed way after I had parked and said that I was arrested. The neighbors knew and saw that the police had no lights or sirens on. I was arrested for evading arrest. The police had weapons about 6 aimed at me, I found out that they were told I was armed, which was a lie. I was moving my items out of spouse's home back to my rental. I had to pay so much out of pocket humiliated being arrested and due to COVID courts have been postponed and this happened DEC 2018 and we are now in Mar 2022. I hired 2 attorneys 1st one was not licensed to practice law had a web page online and he took my money saying he would represent me also took monies for a divorce I filed. He never did follow through only taking my money. Found out that he said that it was dropped etc...etc..then the police came home after a year I came back to spouse to work things out and I was arrested again, because they said I never showed up for court. Had to hire another attorney, which was a referral from my veteran doctor and I still wait for something that I have charged with and was not aware they were chasing me. No speeding or traffic violation. It was only around the corner and I am still facing these charges and the stress has been so much to deal with. My spouse passed away and if he was the one to make call to get me to leave then he is gone and since the amendment stating "facing my accuser" cannot be possible because my husband died. HOW CAN I GET THIS NIGHTMARE out of my life. I am told to wait. and wait and wait...this is 4 years after. What should do?

So, if someone leaves a traffic detention, it’s not evading an apprehension, right? As a detention is not an arrest, I like to call it motor vehicle equipment not motor vehicle, but that me?

If your lawyer can only get you prison time on 1 offense. Your lawyer played you. I’ve seen people with higher bonds than me and have done less severe crimes.

Can they make it aggravated and if they do make it agg ,once they send you to TDCJ is it possible to get the agg dropped? My son recieved 25 aggravated charge out of Montgomery County Jail . Is there any thing I can do to help him get the aggravated dropped ?

Even if the ag is dropped in court,parole picks it back up 100% of the time. It’s a ploy when they say they will drop the agg to get you to sign. Plus Montgomery county is horrible place to get agg charge. Lucky he didn’t get 99

Your best option is to hire an experienced criminal defense attorney. You certainly do not want to take a plea of guilty that results in a conviction. Probation is hopefully your worst case scenario but you need to make sure it is not a conviction and you can get everything removed from your record. I hope this helps! What will go a long way toward avoiding being in such fixes in the first place is watch the life choices you make, and activities you choose to engage in. Yes law-abiding citizens get arrested all the time, but you'll still mitigate your chances of getting arrested by avoiding illegal activities.

Please ignore the wise ass, Life choices are a phenomenal determination on how your life goes. Finish high school, avoid premarital pregnancy, avoid arrest, spend less than you earn, set financial goals, clearly define needs vs wants.

My car was used in a police pursuit in 2 Separate occasions and got away from police both occasions within the same hour but no one was caught but my things (ID,MDOT paperwork, title, a old iPhone) we’re in the car. 1-2 weeks later all while I’m in contact with police saying idk what’s going on I think my car was stolen I ended up being arrested at the precinct with the police told me I could come and get my car released if I sign some paperwork… I am now fighting 2 counts fleeing and eluding, 1 resisting arrest, 1 obstruction of Justice did a bit of jail time. I had a bit of video footage where state troopers asked some of the other officers did they see who was in the car they said no😑 they are trying to use my ID being in the car as evidence so far to my knowledge… best part about this is video evidence from the chase some how got corrupted and they don’t have it 😑

jail is not mandatory and an experienced criminal attorney may be able to get it reduced. Be careful who you hire to make sure they have results for this type of case.
