You can't sell via lease/option or land contract in Texas. That's about it.

May not be for the novice but is very concise explanation of the 4 models: L/O, LC, Wrap, and Subject To. I had the last 3 slightly muddled together. Thanks for sharing and clarifying.

This was great, thanks, been searching for "beginner real estate investing" for a while now, and I think this has helped. Ever heard of - Ponasson Estate Earthman - (search on google ) ? Ive heard some decent things about it and my work buddy got excellent results with it.

The "Subject To" is a good starting point for negotiations. Be ready to offer a "mirror wrap around" (all inclusive trust deed AITD) that exactly mirrors the existing debt parameters, so the former owner can foreclose for default. The Contract for Deed (CFD) or Installment Land Contract (ILC) is a form of mortgage that requires judicial foreclosure, which may take months while the deadbeat lives in the property rent-free. The Sandwich Lease Option has similar risks like the CFD. AITD is best.

Actually, the judicial foreclosure on the ILC is not necessarily true. Depends on the state you are in and how much "equity" the buyer has. For example, in California and Colorado, the courts usually rule that a land contract default is the route of an eviction. Ditto for lease/option. Illinois, Pennsylvania, and Iowa have a specific procedure for getting people out on an ILC, which is longer than an eviction but shorter than a foreclosure.

A relative of mine used this same tactic and it worked fine for him. He has 3 townhouses that he rents out now. I never knew how he did it as he was one of those guys that never seemed to actually be employed. Guess I know his secret now :)

Question about the 2nd method (land contracts). If I'm mirroring my seller's loan and then turn around and sell this contract to someone else for a higher monthly amount, isn't the person I'm selling it to paying me more than what my monthly payment to my seller is? If that's the case, they aren't really entering into a land contract where you just mirror the mortgage are they?

You mirror the payment with the seller, then mark up the payment on the resale to a third party

hi i have a land contract on some land.where i send the owner monthly payment until the land is payfor and i receive the deed, question HOW WOULD THIS WORK WITH PURCHASING A HOUSE WITH NO DOWN PAYMENT.

Same way - you sign a land contract with owner on a property with a house on it, and make monthly payments. Typically, seller has a mortgage, so you just mirror his monthly payments. This is called a "wrap".

Land contracts have become outlawed by the Feds. How do you get around this? I recently tried to evict someone who quit paying and was told because it was a land contract, I'd have to talk to a lawyer. No legal advice being asked here, just wondering what you'd do if faced with a situation like this?

Sure, if your seller is a FSBO and motivated enough. Not going to work as well with a corporate seller.

Do you have any book recommendations? I currently own a landscape company and am looking to get into real estate and start flipping homes and having rental properties. I am having a tough time with banks because even though I have a successful landscaping company I am only 22 so they don't take me serious at all.

mam those things you talking about find Tenants to buy in 2 years all that stuff you have better chance to get hit buy lighting. I'll just keep my day job till I fund a better way

Obviously you haven't done it - if you screen your tenant/buyers thoroughly, get a good down payment, and follow up with them properly, they will buy; especially so in a market where prices are rising (like now).

Sounds like it's time to get off my butt and make some changes. I'm in Canada and I think that we can do something similar with your plan to purchase property with little or no money down. Those all seem like sound proposals. It's really just a matter of someone approaching the property owner and making the offer. Or finding a real estate broker that can set these deals up for them.

I don't think there are too many sellers out there who will fall for this deal. Landlords will only do this if they are falling behind on their payments.

In all of your scenarios. Isn't the seller just giving you the property without making any profit. If that's the case why wouldn't the seller just sublet the property himself at least he would make a profit.

Seller who is motivated enough to do any of these scenarios isn't concerned with profit. They have a bad emotional relationship with their property and they want out. They see what you are doing as a favor to them, and they are generally not concerned that you are making a profit.
