To determine if you can clear your criminal record with a domestic violence case, we must first ask - how did you resolve your case? If you took jail time, deferred adjudication or straight probation on a domestic violence charge, you are ineligible to get it removed from your record.
If your case was a felony and it was no billed by a Tarrant County Grand Jury. Under Texas law, you must wait 3 years from the date of the no bill before you are eligible to file a petition for expunction. I know that frustrates many of my clients. I agree, it is unfair for the law to force you to have this arrest on your record after he had been exonerated.
What if you had a misdemeanor family violence case? Under a misdemeanor, there is a 2-year waiting period from the date of the dismissal before you can file for an expunction to have the case removed from your criminal record.
Under a Class C citation of Assault by Contact, you may be eligible immediately upon dismissal of the charge.
How do you actually get it cleared? You must file a petition for expunction with the District Clerk’s office and pay a filing fee of $425 and then show up to a hearing in front of a felony judge to argue the expunction at a hearing.
