Excellent! We heard a sad story recently. My sister's adult student had a similar injury but with trauma. Unfortunately she has had to change law firms underneath due to insurers bad treatment. She has lost income. Insurer not paid anything to her. She is deprived, in pain and not been even able to afford to get to treatments. Apparently her current lawyer is doing nothing to address the disputes or prepare the case. Lawyers is just law balling her whenever the real questions about progress or how to deal with insurers denials. Given it is couple of years and changed lawyers, she has no way to get another lawyer. Likely going to suffer a huge loss and more pain and trauma. How do you address this kind of situation?

Sure will do on structured settlements :) Here, the insurance company did not pay the policy limits when given multiple opportunities in writing by plaintiff's counsel so the policy became OPEN which means the insurance co has to pay whatever the verdict is.
Well my mom had surgery, had a stoke from it, I lost my car, have a higher interest car payment, n loss money and my attorney is only going after whatever the DUI driver who hit us insurance has which is only 15/30 and then dipping into my UIM coverage of 25/50, no money goes to my pocket only pays some of the bills! I need help!😢
That is what happened here but the insurance company is on the hook b/c they refused to pay the policy and the plaintiff used a bad faith settlement opportunity letter

Love your verdict stories. The only reason why i agree with this verdict is bc the Defense acted in Bad Faith. I totalky believe Mr. Holistic Healthnut injured himself at the gym and was looking for a Payday. Ignoring treatment and working the system is borderline insurance fraud. Plantiff didn't win this case. Defense lost this case handed on a silver platter. Big ups to soft tissue, but very sus.
Thank you for your .02 cents Its always great to get everyone's opinions especially if they are against a plaintiff. This is what I do when I pick a jury as well. When you speak to 30 people many of them have the exact sentiments you are expressing. But this is a GIFT b/c now you know to exclude them from your jury for cause & only leave on those who are completely fair, impartial, and neutral to both the plaintiff and the defendant. You want someone who can examine the clinical evidence and render a clinical verdict.
@@AttorneyArkady Good point. But justice isn't finding every angle to exploit. IMO, if the guy rejects normal conservative treatment everything thereafter is Contributory. Defense lost a winning case IMO. In poker, we call this Plaintiff an Angle Shooter.

@@AttorneyArkady I agree to that point. I didn't get 3 Epidurals bc the first 2 didn't work. Nobody is 100% not even an Olympic athlete. But id argue he chose certain treatments for reasons I cannot consider valid. If he had religious issues, I may be on his side. But that's another topic for another day. @digitalaudits As a person who has treated their body as a temple and is used to exercising daily and able to lift heavy things without feeling pain and live an active lifestyle. Are we supposed to completely change our lives when it's the fault of another? I was used to lifting up to 100 lbs with minimal effort and pain, so now because of the injuries sustained I can no longer lift heay weight without feeling pain in my neck and spine. Even holding my 20lb baby for long period of time causes pain and discomfort. The plaintiff in this case, like me will NEVER be the same again. There's no magic pill or surgery that can make you whole again. Look at the state of the economy at this time. Everyone's insurance premiums are going up regardless. Food is 4x more expensive. Taking low settlements for permanent changes in physical and mental health is not a good idea. If they'd offer to build a time machine and take back the accident I'm sure the majority of us wouldn't care about the "lottery" settlement defense. The problem is that insurance companies undervalue the human body. They believe we all want to get rich quick. Some of us would rather be poor but in the best health. This man got justice. The insurance company had a chance to settle for less. Thank GOD there are good people in this world who were selected and didn't come in with a predisposed opinion of someone they don't know. I guess I'm considered a "Holistic Healthnut". I'll make sure my jury is filled with them too.
How do they come up with the percentage when they do the settlement letter? Like 25 percent more? Does that depend on the attorney or is the a set amount. When you add interest to settlement?

So I was in a accident in queens back in November & a driver ran a stop sign causing him to turn straight into me(I’m passenger) . Been through physical therapy ever since; lawyer said the other driver took 100% fault . Me & my driver both received injections & surgery’s . What do you think our settlement could be ? That sounds like a very strong case. It can be a very large settlement if the policy is large enough. No fault just allows you to get medical care like health insurance but the bodily injury insurance of the other driver will determine how much you can get. What about New Mexico? I have an attorney. Im not sure if hes still the best option. Was in a tbone accident. Not at fault. Fed ex delivery driver ticketed. Wife and i both suffered concussions and bulging discs. He wants one of us to take an offer. Too low for the damages. Im in similar boat. No prior health issues at all. Never needed to see a doc or go to ER. Did 6 months PT. Have MRI and VnG tests. PT referrered me to pain management but i havent been because we had a baby. 9 months have passed since and still have post concussion syndrome and back pain. I am just like this client.
No we do the opposite. We get full justice for injury victims. Lottery is the defense spin to avoid paying for all the harms and losses after a life changing injury
They can start settlement discussions right away. Depositions come later usually they are court ordered in the scheduling order. Mediations usually after depositions once you know more facts and have some evidence
@@DaValleyy17 that usually takes a few days to a few weeks. Most lawyers will just transfer. Some lawyers don't transfer but then your incoming lawyer can file a motion to have the court compel
I'm *NOT* being judgmental but I feel that do to the plaintiff's decline in his *mental and physical health* I believed there was -abuse- present. I get that from her leaving him and stating he was different. If it was because of his *physical* appearance then good women are doomed.
