its unfortunate bc i know for me, and alot of other ppl in fandom, we dont treat fanart as a sneaky way to get money. We do it because we are genuinely passionate about a show/film/book, and we want to share and buy any and all kinds of merchandise; official or not. It makes sense why its illegal, but its pretty sad

everyone sells fanart everyone is being sneaky and illegal problem is most go unnoticed or meh what ever is the metodlogy- cant get everyone but i don't what to be the 1 person they go after. many others want to be that person!

Same. I was born in the mid-80s and grew up in the 90s. My environment has been always been hyper saturated with licensed characters and copyrighted art, which definitely influenced my artistic style and how I view art. My first little baby art sketches were technically illegal! I'm going to cut myself some slack as an up-and-coming artistic person. Now that I know better, I will be doing better (in the paraphrased words of Maya Angelou).

If it wasn't for the fan artists, they keep those characters alive. Disney and the likes should be thanking them. I don't think corporations can stop the world, because truth is, there are people in every country doing fan art and it's probably never going to change, infact it'll most likely grow.

Useful video. Im a designer, i use redbubble and have had a few of my own movie themed designs taken down in the past. There are SO MANY people breaking copyright on there, im astonished how they get uploaded and go unnoticed! Im sure some people have permission but not everyone does. For example there are hundreds of star wars designs on there using characters and slogans etc...with hundreds of sales!

Plenty of corporation simply doin't care. In the case of Star Wars, Lucas had 100% of the IP rights of all Star Wars merch (he exchanged 100% IP rights for 100% ticket sales for his first screenings because the theaters didn't believed in the movie at all). So in this case they don't really care.. now 100% of it has gone to Disney, or so I assume. He still probably get some royalties. As for everyone else who did the art.. I guess they got nothing from those sales...

@@alyssadiceflipper5201 Etsy. They did massive cleaning in November for all trademarks under their umbrella. Etsy btw never paid me back the money owed at that point even not related to the sales regarding this issue ever since.

@@NguyenHieu-uw2sx I paid everything out of my pocket at that point - shipping, materials, and Etsy froze the money and said I still have an obligation to fulfill the orders and after that never replied a single email, I managed to get my money 6 months later by complaining to BBB and everywhere I could

I think I saw some people selling fanart on a convention the other day and I questioned them ~ they told me that it's allowed as long as it's your art, you made it yourself, the style differs or something from how they are made by the company or something...then of course you've found out that FANART sells more because a customer is familiarize with this character etc... I mean think about it some famous artist do it like Artgerm, Sakimichan and so on...even without permission from the company. heck even freakin Death Battle......whose some of these famous characters are on their t-shirts. & motherfreakin Sonic...! If this were Japan though, I think we are more ease than what most Americans/foreigners feel

I would like to sell my own characters too but as you said, of course it's not easy and you make me realize that I should try to do my thing, even though it will be hard, it will be because they really like what I do, instead of the character we already know and love. So it's kind of up to chance in the end? If I make Fanart and sell it in my store, that would be illegal, but according to what you're saying, there's a minor risk I would have to pay the consequences? That's a super difficult decision to make! But thanks for the insight, I was wondering about selling Fanart!

Disney is the reason that the copyright changed in the first place when Disney died. And they made money by doing a lot of stuff in the public domain. Very unfair.

Warner Brothers actively goes after people who make fan art of Harry Potter. Names of even objects can't be used. Muggle Magic had to change his channel's name and his free art tutorials/ products. He can make things that look like the props from the series, but the names need to be different and I think they can't look the same as what WB is selling.

I don't get it. By these rules every Comic Con out there is a fair of illegal copyright infringers who make good money AND do it whilst the very actors they're painting are there shaking hands and taking photos with fans. But no one gets in trouble and no Comic Con gets shut down. I upload my own fan art to Redbubble and it gets taken down less than 12 hours later, meanwhile there are dozens of other artists on that site making tons of the same fan art and they're not getting infringement slaps? This whole "fair use" law is an absolute mess and needs more clarification.

Good video, but Disney will and DOES sue small creators if they sell the fanart.. not necessarily if they make it but they will if you sell it.

If fan art is BS then put a 1000 dollars on a plate as installation art. If people help themselves to a few coins or a dollar of two it is OK because they need it. If there is no law against it no one will be guilty of theft right. But if there is a law that says you shall not steal then everyone should obey it regardless of whether they are poor or not. I use to think only poor people steal, yes I was naive. But poor people are often the ones that excuse themselves as ones that are not accountable to the law or to the rich. For example, they already make so much money that if I put my hand into their pie, that is not a crime, or is it. Greed is the reason why the rich steal, but wanting what someone else has for yourself is also a sin. You covet your neighbor's iPhone, car, wife, house etc. As much as you shall not steal you shall also not covet. If you started that way then start creating your own unique things. People who always copy other people's work never discover their own uniqueness because for them it is not about ART but money. And the love of money is the root of all evil.

I am on the fence about Redbubble. I posted a 13 design collection recently and 3 of my designs were pegged for infringement and yes, my designs were kind of parodying a famous movie poster but for an entirely different purpose. And I definitely made it my own. And I see other people who have their own similar parody still up. So it's infuriating that all it takes is one a-hole (probably my competitor) to cry to Redbubble (not having to prove their OWN ownership or their actual case), and BAM, my design is removed. It really tired me out. I am not sure the best market for my creations at this point ... It's depressing to work so hard at something to have it taken down, probably by some jealous competitor. I'll have to re-watch this video a couple times, as I know many people are making a KILLING doing much worse than what I do, in terms of referencing another artist. And from what I've seen also, it varies tremendously from artist to artist. Some are taking down "infringers" daily but others couldn't be bothered...

I asked funimation permission for anime merchandise and they want a guarantee of $25k in royalty. But apparently they don't enforce copyright only trademark.

I still observe so many artists drawing or painting celebrity portraits (not just for social media but commercial use) and they even do exhibitions of it! :( Cannot understand how is it possible that even the gallerists don't know anything about copyright, and they don't suggest the artist to not do this. Maybe because it's a small town (or even country, I'm from Slovakia and I see those copyright issues everywhere! :D ) and they don't think about it as worldwide... I think a photographer is an artist too, he doesn't deserve so much stealing and disrespect like "it's just a photo". Not because of a sue but rather ethical reason. It's so sad because I'd like to help every artist I know selling celebrity portraits, but am afraid they'll be offended or upset. :D I'm thinking about writing a blog post at least, and I'll link your video there. Really great explanation, just found your channel now, I will explore it more. :)

This is a great vid. Thanks for breaking it down. I've done so many artist alley shows where fan art is illegally for sale. It'll always be an element of a show. It's a bummer, really. I know the almighty dollar has greater value by selling IP over your own original content. It's unfortunate. But money isn't everything. Don't always view success of your original art by monetary value and social media stats. Do fan art for: yourself, to improve your craft, to be inspired... but bring your original content to a show and challenge the art world. It's us artists that can set the tone of what sells. Don't feel pressured to draw yet another scantily clad Sailor Moon just to turn heads at a show. Selling fan art shouldn't be thought of: "can I get away with it?" or "Disney has billions and I'm just little 'ol me." It should be a morality check. Just because you can sell fan art, doesn't mean you should. Artists should create new worlds for us to explore. Let's not show yet another version of Calvin and Hobbes dressed up as Batman and Robin...yawn.

question !! if i were to sell art of anime characters, except i draw them as mice would that be copyright infringement? for example i'd just be drawing mice wearing the clothes of different anime characters

I've been aware about some people commissioning artists for specific copyrighted characters for private use and using transaction statements as "art commission". For example, an artist gets commissioned to make a Samus fetish art for personal use. At no point will the art become publicized and the artist agreed that they will not be credited for making the art. Where does that lie?

thanks for this video! it was really informative. however, if you for example are a freelance artist and someone commissioned you because they liked your art style, and THEN asked you to create fanart of someone, that wouldn’t be infringement right? since your art was sold because of how good your art was and not because of marketing from huge companies?

hmm ok, is it possible to create a character in your own style (that's probably very different from the original style of the animation/cartoon/anime/manga/comic/manhwa/etc) that let's say is wearing completely different clothes from the character you're thinking of, has different hairstyle face shape/features but keeps let's say the color palette? like hair color and eyes. Would that be legal? Also can you use that character's original SEO keywords for the product? let's say sakura from naruto, done like i described, and putting sakura and naruto as keywords?

I know this is random…and is sort of on the same subject as this video. But I was wondering if you draw a realistic drawing of an animal. And it is very heavily based off of a couple references is it illegal if the refrences were just pulled off of pictures from someone else. Is it still illegal… I’ve been trying to find some kind of video or some kind of information on it.

I fell in love once again on Doom games. And I would like to make an anime style version of doomguy with a human form of his rabbit daisy. I'm not planning to sell it since it can put me in danger. As of now, I just planning to display it in social media without selling it. If ever I sell some drawings, it should be my own creations.

I use RedBubble to test which listings would attract the attention of corporate IP bots, and which wouldn't, as a barometer for what I dare put on my Etsy. Story: after having every large down to middle-range famous/kind of recent movie being knocked down off Redbubble within hours, I decided to try music. So I posted Stevie Wonder's "Hotter than July" album as an album shirt as well as all the other Redbubble cheap auto merch. I get an email within an hour: "Your submission is being reviewed. Fear not! It could be for many reasons, including....1. Doesn't fit merits of our fan art program....2. IP violation issue..." something like this. "Welp, the record company didn't auto-takedown me on this one, but Redbubble themselves will see an album from arguiably the most influential living popular music artist breathing on the planet, and obviously know that I don't own the rights to this album...." LOL. Next day: "Re: your submission. Good news! You're submission has been reviewed and it's just fine. It's now live on Redbubble! Have a good day!" Were they just, 24 year old lazy reviewers who hadn't really ever even heard of this "Stevie Wonder" person, or maybe thought he was a mythical character from the black community, or something? A superhero? "Stevieeeee WONDER is here to save the day!" LOL. shrug. Lesson learned: No way in HELL will Etsy ever give a shit if I sell Stevie Wonder fan work.

I like to create my own characters . I have a very small online presence. I dont make much money from it cause no one knows these characters . I don’t like drawing IPs . Havnt done It in Years . BUT being told I can’t draw characters not even for myself makes me wanna draw them . Im Gonna draw what i like . No one will tell me what I can and can’t do when I’m at my drawing board , sorry . Whether it’s for me or for sales.

It's very simple. Don't do any Fan Art. Create your own line. Fan Art just helps the big brands even more and at the end, they will sue & bancrupt you.

There's no way the artist you featured have "official permission". You don't have to ask for permission to get a license, you just have to have money (which we don't). But it would be dumb for Disney to prosecute this artist since they're extending their IP to a whole audience they otherwise wouldn't be targeting. Everyone knows it's illegal. And what are they gonna do about it?? If you're a serious artist, probably nothing. Such is art. Banksy risked his life and so does many artists, caricaturing politicians they can't, representing religious figures they can't, painting on walls they can't pain on, and so on. There's no way even an artist *from* Disney would ever get permission for free to sell Disney-themed art. Not in a million years. But it's stupid for them to prosecute him.

I desperately need someone to look up the artist Mark Drew (from Australia) and explain to me how he gets away with his art.. he just puts rap lyrics in the speech bubbles of Charlie Brown comics and that's it. and his paintings sell for tens of thousands of dollars. it throws everything I know about copyright infringement, IP theft, and fair use, right out the window..

The concept of Fair Use varies by jurisdiction, but it's typically understood to permit limited use of copyrighted material without acquiring permission from the rights holders. It is applicable when the copyrighted material is transformed into something new or used in a completely different context, such as for commentary, criticism, news reporting, teaching, scholarship, or research. In the case of Mark Drew's artwork, he's arguably not merely reproducing the Charlie Brown comics but instead is transforming them. He does this through the insertion of rap lyrics, juxtaposing two elements from distinct cultural realms to create a new and original piece of art. This hybrid work then provokes a different set of emotions, reactions, and interpretations than either the original comics or the rap lyrics would do alone. While this might seem straightforward, the legal waters are indeed murky and deep and absolutely strange and barely understandable. As for the pricing of Drew's artwork, this is dictated by the art market. The value of an artwork depends on a wide range of factors, including but not limited to the reputation of the artist, the quality of the work, the demand for the artist's work, the uniqueness or novelty of the piece, and the willingness of collectors to pay for it. In this sense, Drew's art isn't inherently valuable because it's a hybrid of Peanuts comics and rap lyrics, but rather because it's a unique piece of contemporary art that collectors deem worth the investment. Of course, it's important to remember that while this analysis fits our current understanding of fair use and art market dynamics, the law can change and is often subject to interpretation. If the original rights holders, in this case, Peanuts Worldwide LLC or the music publishers of the lyrics used, took issue with Drew's work, there could be a legal dispute.

The issue with that is that most algorithms on social media sites prioritize the search results for popular tags. When you create your own character or world setting, no one is likely to see it, because it will be lost in a pile of others works.

How come its one rule for fan art but another rule for fan fiction though? Fifty Shades of Grey was famously fan fiction based on the characters of Twilight. The After series was fan fiction based on the member of One Direction. All they had to do was change the names from the twilight characters and change Harry's name to Hardin and it was considered original works despite the fact they used already established Intellectual property but they can officially profit of it. Just a point of interest for me.

So, does this mean that I can create my own, for instance, Mandalorian from Star Wars, or Mobile Suit from Gundam, and be able to sell it, even though it’s based on an established IP, while using something from the public domain as a reference, and sell it on redbubble?! i have a huge question, there is an overall art style being replicated called splash arts and sprite. people replicate this style from a video game and make their own characters sprites and splash arts. some people sell these sprites and splash arts. is this a copyright violation?
