not really depends on how or what happened, if you have ~CCJ's did you know about them ? did you acknowledge them at all ? if not then you could use an N244 to set them aside and get your defence sorted, look on facebook at any of the "help with bailiffs" groups or this guy of course
There is a simple way round CCJ’s. Offered to pay debt. Make one payment then call and say you can no longer pay !! Claimant can no longer re open CCJ. It works !!
My CCJ is from a £40 final broadband bill that I never received after moving house. Had no idea until I failed a credit check 5 years later and checked my credit file to see it had been issued the month before. No loans and didn't ignore on purpose. Some companies are ruthless, I paid £689 that same week to settle the amount but it's going to be on my file for 6 years.

This old video just popped up on my feed, but its still relevant. So if we say 'he who makes the claim has the burden of proof' then would the CCJ form have the reason/proof for said claim? ie, claimant says you own me £1000 for services rendered and the defendant says there is no signed contract clearly outlining the fee schedule. Would the CCJ tell this story..? If no then surely a conditional letter of acceptance would work along with an appropriate affidavit, which in turn is rebuting the CCJ..?

If the CCJ is over 28 days old it will stay on your file for 6 years. If it has been issued incorrectly you can try and challenge but the process is long.
Entering into a Tomlin order is entering into an agreement with the creditor hence admitting you owe a debt.I think by entering into this agreement is just a way for a creditor to win/get money from you.After all a lot of debt companies that buy debts in bulk like lowells are nothing to do with your personal financial circumstances merely a 3rd party interloper.If they were not named in the original agreement they have no legal standing as you cannot change/alter an original agreement.It's like rewriting your original agreement which as far as i'm concerned is not legal...I personally would not therefore enter into any sort of Tomlin order as the dca/creditor eventually gives up and zero's the account...This is what has happened when iv'e dealt with my wifes personal finances ref to a dca...No ccj and nothing entered on credit reference agency.I think it's just a blag because they know they cannot win if it went to court.Thanks...

It's interesting you cite that if the claimant "hasn't used a solicitor" isn't serious, I've filed my own paperwork to recuperate debts from customers and I'm quite serious, why do I need the added costs of a solicitor or using a middleman when I am familiar? Also when I comes to filing a CCJ I am also incumbent of the fact I've tried to politely get my funds or instructed the defendant quite politely
To be honest with you, I’m not focused on individuals like you. I support you recovering money from customers after honestly providing goods or services, I’m focused on banks and bank debt collectors.

Yes, if you go through an agent you will fail the references due to adverse credit. We found out one had been applied through the wrong address while we were planning to move. We still got a rental house but it's just much harder. As long as you have paid in full, show the agent proof that the CCJ is satisfied, ask them if the landlord will let the property to you despite this. Sometimes the landlord will see you as a better tenant as you have been upfront and honest with your situation and you also paid your CCJ. It will be harder if you have a payment plan so it's better to settle before you plan to move. You can also try the private rental route and ask landlords directly but they might be skeptical. The advantage of using an agent is that they can influence the landlord to give you a chance because they have seen other tenants with CCJs, some agents may turn you down straight away but you just have to keep looking until you find one that will help you.

I 've got a Judgment for claimant in default over an unpaid private car park invoice (penalty charge) It is my x.misses car but still on my name, I have moved from that adress and live in a different adress. Court and civil enforcement don't have my current adress but her adress, so I'm not worried about bailiffs comming to my door. All I'm concern is if I don't respond and totally ignore it would they continue chasing me and get access to my bank account or eventually find where I live cos the car is on my name .?

Very use information. Please could you advise me on my situation. I have received the CCJ to my old address from where I moved 12 months ago. I was not aware of any letters or orders sent to that address. I just noticed on my cr score app the CCJ order was added on the 18th Feb. Shouldn’t the claimant be checking my current address on the DVLA before sending out any orders? Please advise.
Arrow global brought me to court ( or wanted to) last year because of a £1400 Capital one debt they "bought" i requested to send me proof of the alleged debt but they didn't. So one day b4 the hearing Arrow closed the court case. Happy days so i though . The Debt is stature barred since May . I have a county court hearing. The claiment refused mediation. My initial l defense was based of the fact that they didn't respond to my request as I asked for a breakdown of charges.(it was far to high) They just said I owed the 2.5k. I repeatedly asked for breakdown and they refused. Now they want to take me to court. Should I reach out to them to they negotiate outside court or just attend ?
I wouldn't advise people that if a claimant hasn't put solicitors details on the form they're not serious about the claim. That's ridiculous! Many people don't use a solicitor for small claims court as you don't need to!
You haven’t been to many hearings, I can tell. The court won’t take you as serious as the other side if they have a solicitor. The court house is their playground. I don’t advise, I give opinions.

Hi Mora, you’re very welcome. Unfortunately CCJs stay on your file for 6 years. You can try and ask the creditor that you have settled the debt on to ask for it to be removed but the chances of them doing it is slim.

Doubt you'll see this in time. My friend has mental health issues. She was served CCJ papers on Wednesday, with a Hearing booked for the following Monday (3 days + 2 weekend days). She was so shocked, she only told me about it Saturday night. I am so unprepared to help her. Its for Court costs, plus access to rental property by contractors. Thing is, she never denied access. They didn't turn up, many times! The last show up they actually did, she & I were in a cab, 8 mins away, on the way back from her benefit Tribunal Hearing. Contractor refused to enter, as it was only 2 x 12yr kids at home, while the babysitter went to the shop for milk. he said he'd be back, but never returned. She has no money, is disabled, and has 3 young kids on her own, and can't afford Court Charges, never mind food for herself every day. I don't know what to do to help her, apart from get her to tell the Judge if she's always been willing to allow access. If you see this early enough, any advice is greatly appreciated. The hearing is at 10am, but we have to be there at 9:30am. Many Thanks.
As I don't know the full story (as I am sure it is quite extensive) I would say the following. She should inform the court of her disabilities and explain her side of the story about the times they simply have not turned up. Any proof about the incident when the contractor said he will return may help. Regarding the court costs, she should request a payment plan that is affordable for her that she can stick to no matter how little it is. Try and get a duty lawyer at the court to help you as well if you do not already have a lawyer. I hope this helps and good luck.
Hi Oye, if I have recieved a claim form but not yet a judgement is it still possible to offer the claimant token payments? Would this be enough to satisfy a court of my attempt to pay what I can? I really hope so. I made a token payment today and informed my creditor that I would continue do so (quoting section 7.3) but did not realise having a claim form may change things. Hi, go on www.experian.co.uk and obtain a credit report. You should be able to see who has given you a CCJ. It is too late to stop it as you already have it. If it is incorrect, you can apply to the court to try and remove it.
If the CCJ was incorrectly assigned to you, you need to inform the court and the creditor. The court will provide you with the full details of the creditor. I hope this helps.

I've got a letter from Marston bailif saying I owe them money ordered by the courts I contacted the court fines team and they told me if I avoid the bailif for 6 months it will go back to court and I can make weekly instalments. John Ward watch my videos regarding bailiffs I have 2 of them. They are very important for you to see especially for the bailiff you mentioned. No need to panic just try and make a payment arrangement with the court. Do not let bailiff into your house.
If you've responded call the claimant solicitor if you do not have the case number to get it or the court may give it to you. You should have filed your defence within 28 days.
Hi, I have a question; it’s too late for me. I’ve made stupid mistakes at uni with payday loans on a part time wage and have 2 CCJ’s, one totalling £580 and one adding up to £240. While these have been paid off I am really struggling to improve my credit through methods such as obtaining Credit cards or an overdraft. Does the amount of the initial debt matter as I have a friend with 1 CCJ totalling 4000 and he can still obtain a credit card, I am a lot more better off now and I find it so unfair to suffer another 3 years without having a chance to obtain any credit at all.

Write to the so called enforcement and ask them do you have a contract with them and if so produce evidence? Did they breach GDPR rules in obtaining your information. You want the name of the man or woman making this claim against you and evidence that they have suffer financial loss as a result of breach of contract. You want to see the deed of assignment, allowing them to peruse you. You want a copy of the warrant issued by the courts, along with the court seal and name of the judge authorising them to make contact with you. Tell them until those conditions are met, you do not wish to hear from them again. Put it in writing and make sure it’s a Royal Mail, signed for letter. Oh and also tell them in writing that you will only transact business via the post, they do not have permission to use your telephone number or email address either. If they pass your details on to another 3rd party interloper, you will seek legal remedy in a court of law - reason for this, when they realise you are not a pushover, they will sell on your debt to some other goon. Mohammad Bappy Chowdhary contact the court who issued it. They will give you the details of the claimant, then you can contact them and get the details of the claim. If it's incorrect then contact the court again in order to contest it, they will tell you how to do it.

At what point does a CCJ appear on your credit file? Would it come on as soon as you get that piece of paper? I got a letter from a parking company threatening me with legal action if I do not pay £165 for a parking fine. The company car park has already sent a waiver to Parkingeye, but they continue to send letters :/

Hi, you can certainly apply for it to be set aside on those grounds, whether or not it will be granted really depends on the judge and what the claimant says. So keeping it simple it's 50/50.

I received a county court judgment claim form over an unpaid private parking notice... OyeTv Channel There's no name of any solicitor on the top left two boxes of CC. FORM. Only the name of the civil enforcement company on the both boxes. Please would you tell me what that means. An advice center told me that they won't take you to a magistrate court for hearing.
Hi at the start of the video you mention if the "address for sending documents and payments (if different) box is empty they are not serious about the claim, well my box is empty but has a small 6 digit number at the bottem left hand of the box, any idea if this is a form of solicitor detail?
Adz 8888 if it doesn’t have a solicitor name or address in that box. It’s unlikely the claimant is being represented. You still need to deal with the claim form though.

got a ccj in april 2013 but because i needed to open a business account agreed last week to pay by installement to get a letter for my bank. The question is in a year it will be 6 years for the ccj,will it be cancelled or it will start again because of the new agreement

I've tried several organisations on line and each one say it's out of their specialty - The last advice I got was to wait till it goes to court and then dispute it.

I've got myself into a bit of a pickle with a couple of Lowell Solicitor debts which are now showing on my credit history. Basically 3 years ago I was with BT and cancelled to switch to another plan, this was all sorted without issues, so I thought, however later on in the year Lowell started contacting me to collect a debt to do with BT, I saw online their bad reviews so just ignored their letters. I went travelling and continued my life. A few years on I am back in the UK and have received a letter this week saying that they entered a CCJ against me late 2019. This unfortunately is the only letter I have kept. I have 2 Lowell debts on my credit history which started a few years ago, both under £500, however I would ideally like to avoid paying them and get these debts removed from the system. I've checked online and am seeing some various answers like asking for proof, conditionally accepting if we have me and lowell have a contract, and now I'm confused with what to do. Has anybody dealt with Lowell Group/ Lowell Solicitors before? Thanks for your help.
Hi Oye, please advise what can happen if a ccj is ignored? Does one just get a bad credit rating or anything worse than that? Personally I’m not too concerned about receiving one as I never borrow money from banks (due to dealing with interest). Could this lead to anything more serious than that? Kindly advise.
