Hey brother. Was looking up more information on trademarking since i finished my book. Was looking to see if I should trademark the name now though from what i gathered from you i have to wait until at least the publisher accepts it. Hey Houdini, great question. You can start the process now using the Intent-to-use basis but your mark will not be registered until you convert the application to use-in-commerce. I'f there is a chance for the name to be changed between now and then, I would wait until it is being used in commerce. Hopefully, that helps.

Question; for where you said you can be denied for another company having the same name… what if I had my domain, name, and etc and was using it in commerce actively and another company formed with the exact same name. In the exact same industry. Would I be denied for them having the same name even though I used it before them and I have evidence of that? They are 90% of the reason I applied for a uspto trademark

So if someone has trademark on a business name in a different state can they prevent you from naming a product with their trademark name (not a business name)? Even though you are not using the name as your business name but just a product name? For example a cream? Can the cream be named a name that is a trademark name in a different state?
