Is it possible to win your Social Security disability case within 3 months of filing? Yes, but your case file has to contain specific medical information.
In this video I explain what it takes to win an early approval. At the initial application stage, your case will be reviewed by an adjudicator, who functions like an insurance claims adjuster. Adjudicators have some authority to approve cases but only if the medical evidence documents a “listing level” impairment.
An early approval will spare you from the 2 to 3 year delay in reaching the hearing stage and getting a decision from an administrative law judge. Not every case will qualify for the early approval shortcut, but if yours does, you should do everything possible to pursue an initial application approval.

Sir, you are the best, I watched several of your videos before applying for SSDI , I completed the application with all of my medical problems and medications. I applied Dec. 15 , 2021 , I received my approval letter Jan. 27 , 2022 !! (I did have 18 years of medical records to support me and HAD kept the same job 28 years ) THANK YOU SO MUCH !!!

Wow that was fast CONGRATULATIONS. I hope they will look at my work history I work for 30yrs & I had covid pneumonia and end up in the hospital for few weeks but also had other health issues hope I'll be approved 🥺

Does anyone know how long of a time frame it takes after your case goes to the determination center my case went to the determination center Columbus Ohio febuary seventh 7 what kind of time frame do they have after it gets to the determination center

It took me 3 years & that was a great doctor that knew how to fill out the paperwork. I don’t have him anymore. I really hate that.

I wished that I had known of this s few years ago, however I will be going back to my primary Doctor to correct the mistakes on my record. I will be sure that the listings I meet will be documented correctly.. sadly my attorney did not make sure that my medical records met the listings before my hearing. I was so pissed. Oh my gosh I told them why would they proceed without making sure of this? But my primary Doctor is the only other one that I need to see to correct my records. Thanks

I don't understand why you say there is a 2 year backlog? I applied and was approved in 3 months. No lawyer needed. The 5 month waiting period is killing me though. I go to court to be evicted on Friday and seriously no where to go.

For those not approved at the initial application stage, the wait can be 2 to 3 years. Last year 34% of applications were approved at initial. If you don't fall into that category you will wait and wait and wait.

Was very helpful. I've been tryin to get my disability for a while with no success. I'm 59.5 years old recently divorced no ALIMONY (thats another story) I had to quit my Dr. No ins. I have a titanium plate on neck c3 thru c6 scoliosis n bulging disc in lumbar L1 thru L6. N breathing prob But no help been constant turned down I give up n make the best of what I can.

Thanks good information I got diabetic nerves damage n neuraphaty on both feet n had mental health issues like panick attack n inxaity disorder n bulge diss in my back 4 n 1 in my neck now I got chronic pain all over my body is crazy I have to take Percocet that the only way I will function n walk around the neborhood just for half an hour because l loss my balances plus Xanax for my mental health n other condition this April it be 3 years I got a attorney working in my case but damn it take to much I loos my job that I had for 21 years because of my health problem n homeless my brother is giving me shelters until I fix my life

My mom was totally paralyzed from head to toe from a car accident key WORD is totally paralyzed took over 2 years and when she did get before the judge the judge went off said she should have gotten it the same day social security examiners are evil as hell I mean how do these people sleep at night

I have a question regarding the initial application. I have several physical conditions and also several mental conditions. One of my physical condition (a lung condition) meets the listing for decreased oxygen levels however it’s only documented once in my record and ss listing requires two. I also have mental health issues (depression, anxiety, add) which almost but not quite meet the listing. Collectively however they’re debilitating, is there a way to package the initial application to highlight my reduced function due to multiple illnesses?

My experience has been that adjudicators are more likely to approve based on a listing since the listings are more cut and dry. What you are wanting to do is argue "functional capacity" which requires a bit more nuance. I think that you can improve your chances if you get statements from your doctors detailing specific activity and reliability limitations arising from your various conditions. Remember that SSD is about work capacity and if you can get your doctors to focus on why you would not be reliable at a simple, entry-level job, your chances for fast approval go up. Good luck.

I filed for SSDI on Nov 1, 2016. On Nov 16, 2016 I received a call from SSI and was told that SSI was ready to start cutting checks and my first check will come on Dec 1, 2016 in the amount of $12.50 a month..YES $12.50. Does this mean my SSDI case will be approved? And if so is $12.50 all I'm entitled to ? I'm married and wife makes $24,000 yearly. I suffer from COPD/EMPHYSEMA, PTSD and Major Depression.

I sustained a 3-piece proximal humeral fracture (listening 101.7) and a full shoulder dislocation over a year ago. It was also discovered that I buldged two lumbar discs. These injuries prevent me from sitting or standing in one place for more than 10-minutes. I've also had 2 surgeries to repair my shoulder. I can't completely escape the chronic pain, cannot rest well or focus on anything for more than 5 or 10 minutes. I also have to rely on narcotic pain killers on a daily basis. I did file for SSDI and am waiting for the initial response. I think that my injury clearly places me in the mesoskeletal injury listing. I am also 55 years old. Is it possible that I might be approved early in the process without waiting for a hearing? I tried to be very thorough and provided a lot of information to the Adjudicator. Thanks!

Tell you right now ... DENIED!!!! You need to learn to cheat and lie. Maybe 6 months to live will get you it but you need at least 1 million dollars in medical treatment and a job.

I appreciate you sharing this information I do have one question. I noticed this was posted 6 yrs ago is this information still good today in 2022 or has social security changed anything.? No disrespect intended I just know some places change rules and so I was curious. I've been watching all of your videos. Just got my 3rd denial and trying to find a lawyer so working on getting everything as in order as I'm able to assist them in helping me better and hopefully win.

Wendy, good question and I think I may create a new version of this video. Basically the process is pretty much the same but the time frame is much longer. Initial application review used to take 3 or 4 months, but now it can take 8 or 9 months. This is due to personnel shortages at SSA. Secondly, I am finding that more adjudicators are familiar with the grid rules so both a grid rule argument and a listing argument can result in an early approval. Finally, when I file an application or get involved early I now can get access to my client's electronic folder which tells me what SSA has and what I need to argue to the adjudicator for an early approval.

I have had 3 adjudicators and they have said the same thing. Once Covid hit that hurt me as I had filed just around when it started coming on pretty strong. Not gonna give up and your videos helped to learn this aggravating process better. Thank you ❤️ next step I'm going to familiarize myself better with the grid and listing rules. wow ive got 2 listings and still having issues with mine. thats if my back doesnt meet a listing or it will be 3 or more listings. had to file my own appeal and fired poor representation and havent found new representation yet.

If your looking to get an approval on application I would suggest NOT hiring an attorney right out of the gate. To be "approved on application" will result in no back pay award. When you consider that most attorneys will work your case contingent on a percentage of your back pay award, it only makes sense to realize that they will have not much incentive to work your initial application in a way that will get you approved on application. The longer your approval is delayed the higher your back pay award becomes. The higher your back pay award is, the more money an attorney makes!!! I will be pleasantly surprised if this post stays up for any length of time.

I have Disfasia (spelling) swallowing issues lot 80 + lbs not eating food only ensure etc. Causes fatigue. Also COPD. But dr questionnaire is based on how long I can sit or stand. Lift xx weight. Nothing about fatigue. I take a nap at around 11am to 1pm to make it during day. For energy. But how should dr fill out these forms? Im 57 yrs old. Filed June 19th last work 4/30/19

What I do in my practice is to modify the form questionnaires so that the forms I ask the doctors to fill out are customized for my clients. You can always add relevant questions to the questionnaire.

I have two herniated discs and my right ankle is always swallen from cellulitis in 2010 plus I have Diverticulitis and gallbladder issues so I can't take pain meds I hired a lawyer right away they filled on July 15 this year do you think I have a strong case and can get approved quickly? The maximum SSI amount is 2022 is $841 per month. Then SSA starts subracting from that using the income/asset deeming rules.

IS 411.B solid one for ssdi,I'm an RN,and it took me out of fulltime work and full life over the summer of 2017.Theybsent a vascular doctor to examine me as doctors were failing to diagnose and just writing symptoms,not underlying,and I feel like it's still not the root cause.I want the cause so I can learn all about it and try to resolve it as much as I can.i like having a full life vs, laying on sofa all day and night,and will moving to my mom's in a different state mess it all up?

Linda, 4.11B is a very doable listing and I have won cases using it. Moving to a different state will not mess things up as SSD is federal. Just make sure to notify SSA about your new address. I would confirm that they have it 2 or 3 weeks after you call or mail in the change of address.

@@jonboll-LGM Well I ran dry on savings and had no choice but to move to a different state which was living in my mothers home extra bedroom,,she was awfull,she does not believe in diseases or doctors,,hounded me to work daily..And I did have a 4 month delay due to lost paperwork,,Thats what I worried about with moving to another state,,the paperwork being lost.And it was..On reconsideration I was approved,no court or anything,so I got my SSDI.Thanks for all of your videoes they really helped me to understand the way it works..

Do you think I should get approved pretty easily? MRI report= 1st thing is I have lumbar scoliosis around a 49 degree curve. I have degenerative facet arthropathy at L3, L4 and L5 all resulting in moderate formal stenosis. Diffuse congenital central canal stenosis mild severity. Spondylotic protrusion l4 l5 encroaching l5 descending nerve. Had Diskectomy l5-s1 20 years ago. I'm to the point I can only stand 10-20 minutes before I have to lay flat on back. Thanks.

Joe, remember that the issue in a disability case has to do with how your medical issues limit your capacity for work. An MRI report on its own won't necessarily help you. A report from a doctor detailing your activity limitations (and supported by the MRI and ongoing medical reports) will be much more persuasive.

I recently received a favorable letter from SS stating I meet their medical requirements. Took 98 days from the time I turned in my application. This was my second attempt, first one was in 2015. I used my onset date on my original submission.

Look at 1.04 - www.ssa.gov/disability/professionals/bluebook/1.00-Musculoskeletal-Adult.htm#1_04. You can also use a grid rule argument or a functional capacity argument for a failed back.

This guy I know sells drugs, smokes dope all day, fly's plans, Does stair steppers, moves all around the country and collects. He laugh's about it and cheats the irs from his drug sales. Been cheating the system since he was 18. My kid nothing wrong with her but she got disability when she turned 18. She is smarter than I am and because she plays dumb has you all fooled. Dear sirs I left the United States about a decade ago because I could not meet my child support payments and my student loan payments and I decided that it was better that my daughter not see me instead of seeing me in jail it turns out that one of the reasons I left was because I could not maintain a job because of pain I had radiating from my neck all the way out to my hands medical attention was non-existent for me in the United States therefore I moved to Ecuador where doctors were much cheaper about 3 years ago while working for DHL I was diagnosed with the pinched nerve in my neck which explain the problems I had been suffering for more than a decade I have more than 25 years of work which is documented with the Social Security Administration in the United States I would like to know if I have a chance of getting 100% disability for myself and what type of benefits I could obtain for my daughter and her mother are these payments retroactive all the way back to 2007 when I started having these pains the hospital which took the x-rays and MRIs is affiliated with John Hopkins University Hospital in the United States which I think is a plus I have copies of the x-rays and MRIs in a digital format if this would be helpful. Also if you know of any type of relief which I may abtain for my student loans it would be vey helpful. I have a masters degree in aeronautical science this has ruinred my life. I would be much happier working as regional manager of latina amerca working for American Airlines, but the pain is always present and increases when I am stressed out. I am residing in Ecuador right now since I am pretty sure I would be arrested if I went to the US Embassy to renew my passport I am not a deadbeat it’s just that I am really not able to work considering the condition I am in

I notice that Mr Ginsburg does not answer many questions in all his videos and does not comment on many important things. Is it because you are busy Mr G,or picking and choosing the easy or more beneficial times to speak in your video comments section? I hope your just too busy and not just lazy or something else

What I don’t like is that many questions to you don’t get answered. I definitely understand you are probably a very busy man. But the fact is you started this blog and you should really address all the peoples concerns. I see many questions not answered. So if you are to busy,too overwhelmed then perhaps you should close down this blog. Or hire your workers to answer all the questions you get. People really need your help and depend on all your knowledge and skills

YES he's a very busy man and doesn't pick and choose questions to answer, I feel he answers when time allows. How dare u complain Paul. And if u don't like it then simply get off his blog. For your selfish stupidity he will not ever answer u bcuz what?? "he's too busy" and certainly doesn't have time for ignorance. Mr Ginsberg u don't owe him or anybody an explanation concerning your busy work day. As I was saying to that guy nobody is paying u for the great information u give us. That man was totally being disrespectful and rude to u. Which is why I just had to intervene. I will not allow anyone to say rude, uncalled for and demanding remarks to u.
