Clearly the caller is from a different culture - and I’m guessing it’s the culture where the adult children are expected to fully financially support the parents and any siblings that are losers. But she’s not going to be blunt here and admit that. Also, the caller’s sister-in-law is pretty bold herself to even think she has a place interjecting herself into the discussion regarding their will. This caller needs to lay down boundaries with her sist-in-law, it she also needs to lay them down with her family. No doubt - her culture is the driving force behind wanting to give the money to her family. No doubt.

The thing is that, in accordance with the belief system in question, it is not "her half of the money". She is married and therefore it is their money (the money of the caller and her husband). Implementing a system of "my money/your money" in a marriage is only going to cause more problems, and that is especially the case in the instance of this situation. She called to get advice on avoiding problems from this issue

This lady is unnecessarily complicating it. If you both are dead and you have no kids, who cares. Just agree to a 50:50 split and go to heaven with peace. lol some people want to create issues even after they are dead.

I have a similar friend. Her family left her out of every shareable asset from familial deaths. And they're not very nice to her. She makes alot of money and doesn't want them to profit from her death.

Even though I am not a religious individual I consider myself a good person overall and agree with 95% of Dave's opinions but hearing from my father that I would not get a penny from him for not being religious would be too extreme IMO. It would probably set a mentality on the kids of 'fake it till you make it' to eventually cash in if they thought differently.

Regardless of my feelings towards My spouses parents, grandparents or siblings....I would include them if that's an option. It maybe not much but it's something. She has to much resentment in her heart!

Agreed! I hate to use such a cliche, but really, she’s “chosen hate”. She could do a good thing that will be FAIR and also make her husband happy… but she wants to cause problems bcuz she’s insisting on being resentful! A big shame. If I was husband I’d tell her NO.

Kind of in the same boat as this caller but we are leaving everything to our niece and nephew and dog shelters/dog rescues as this is a special cause for us. No one is entitled to anything we give.

Disagree with Dave on this one. Regardless of how good a law or in-law family member is with money, if they repeatedly treated me disrespectfully or badly, no way would I bequeath to them anything of value. If they knew about my losing a beloved parent and never expressed condolences despite multiple opportunities, I’d consider it deliberate act of omission meant to invalidate my family or me. There is and should be more to our value systems than simple belief in God and going to church. How we treat each other on earth before we go is more important than money.

It could be the husband has a fine relationship with his family and is acting on that as well. They need to divide up the estate and let her make some decisions with her share. ALSO, this couple is focusing on what would happen if they die together. Not too likely. The real fight will come if the husband wants to carve a share out for others in HIS will and she's still alive...

She sounds like a foreigner and English is her second language. She is correct the niece should of texted her first. The aunt sent out birthday gifts and didn’t get a text thank you. It’s unbelievable how many people don’t say thank you for anything. A lot of kids don’t even say thank you trick o treating. I gave a generous wedding gift to my bff’s teen daughter’s wedding (Mormons). No thank you card! Nobody on my American side says thank you. Guess what? I became less generous. The Thai side of the family does say thank you 🙏 with the wai and a bow. I plan on spending all my money before I die. But if I don’t I would like to leave it to my niece and nephew.

She's mad that the sister-in-law expects her to text her niece on birthday and she thinks the niece should text her on her birthday. And the fact she calls the niece her sister in law's daughter speaks that she doesn't like niece. I'm glad my childless aunt uncle treated us equally.

It sounds like she doesn’t want to give their hard earned money to “his side of the family” period. I’m not sure if “her side” is any more deserving or discipline of getting it either. I suggest they give maybe 10-20% to each side if “both sides” are disciplined or deserve it and revisit it every 2-3 years and donate the rest to your favourite charity if you can’t spend it all. This is a very hard question to answer no matter what.

Actually it is a good reason. However, she doesn’t have the right to override her husband on the matter. They need to divide it and each decides who gets their ‘half’. I’d never leave an inheritance to anyone who caused problems in my life - like my brother-in-law... but my husband looks past his issues, therefor he has the right to leave his brother half of our assets.

The sad thing is she’s so miserable, she’s making a will at 40 or so years old, to make herself feel better about keeping money she’s been hoarding away from her husbands family. That’s pretty sad. She needs friends, needs God, and needs to realize money isn’t everything

I don’t know the entirety of this situation, but it just doesn’t sit right with me when she continues to refer to her niece as “his sister’s kid”. She admitted in this call that the daughter is innocent. You don’t have a legal obligation to her, but she’s your niece and she’s gonna realize that you don’t view her as family. That her aunt doesn’t love her as a niece and only sees her as the sister in law’s kid.

Your next of kin, including through marriage, will inherit your stuff minus your debts IF you don’t expressly will otherwise. Remember that. You can’t just leave them out. You have to expressly and correctly disinherit your next of kin. Simply leaving what the state views as next of kin will be viewed as an oversight on your party and nothing more and their rights are intact.

A husband and wife don’t have to have identical wills. The husband can leave his money to the wife and his relatives. The wife can leave her money to the husband and whoever she wishes.

This recalled to mind--eldest grandson said, "Granddaddy, you have a million dollars!" Well, yes, I do, but I had to reply, "I gotta tell ya kid, a million dollars isn't all that much money." Now to the present case--it sounds like she's just in favor of her own relatives and wants to leave his out. She's a stinker. Me, me, me! My Mom! It's a typical female attitude.
