I think Mr Faulkner was still experiencing some trauma with his memory from the accident about the timing of his only drink, one beer with dinner to the officer at the time of questing.

In that context, nobody's like Jack Reacher, with a highly accurate clock in their head. Nobody will pay close attention to the time on a relaxed night out with their Mrs and a friend. The "2 hours" or "A couple of hours ago" fits very well with the narrative from the defense witnesses.

Look at the jurors laughing at the prosecutor’s desperate, irrational attempt to find some way that it could gave conceivably been possible that he could have somehow managed to have access alcohol without the witness noticing.

yeah he is grasping at straws big time! only making himself look even more foolish than he already is. he spends more time with his face buried in his phone than paying attention! Judge should sanction him for unprofessional court conduct! i find it very disrespectful to the court for someone to have their face right up in their phone like that in court!

Why is the cop allowed to sit there and hear the testimony of other witnesses, but other witnesses are sequestered before their testimony?

Yaah that is a problem. Even the Georgia hearings over Fani Willis, she clearly listened to testimony from outside the courtroom when she wasn't supposed to.

The cop has already testified at this point as the State already closed its case. That's why Defense is calling its witnesses and State is cross examining them

Guss is clearly a trained witness. Observe and listen to how he answers the questions and take this to heart in the event you may be called to be a witness sometime in the future.

Indeed, once they state that they suspect the defendant was under the influence, the human psychology thing to do is to act with extreme confirmation bias. Which in this case and millions of others like it across the globe escalates into an arrest. Having made the arrest, the incentive is very much there to double down on the arrest. Because their job and livelihood is on the line if it can be proved that the arrest was a load of baloney. To my mind, from this and the other video from this case, the commonwealth are a long way short of proving guilt beyond reasonable doubt.

I would have liked to seen the wife say something like; Mr Persecutor, I understand it's your job to make me look like a liar in order to get your conviction, but from my perspective you and the officer are the liars, and are trying to wrongfully prosecute an innocent man.

That judge is amazing he's the happiest person LOL that makes things so much nicer. Now the other attorney is it typical that they don't even stand up to ask the questions it seems weird because you do such a good job at interacting with the people and He just seems lazy and just sits there while he asks random questions

its all because his is trying so hard to convict the guy with basically no evidence he will try every dirty tactic he can to discredit anyone helping the defense. I think he would have tried harder on the defenses first witness but the guy was a former cop and i think knew the playbook so he couldn't use it on him

The 100mph is the testimony of deputy King, and as remarked upon by @TheDUIGuy+ in his opening remarks and on the direct by the prosecutor objectionable due to the officers lack of expertise in the field of traffic accident reconstruction as well as at the time the accident occurred being less than 90 days on the job and unsupervised. The only evidence against Danny at this point is this unschooled inexperienced rookie cop vs the eyewitness testimony of someone with many years of law enforcement experience and a 27 year veteran of the medical field specializing in respiratory therapy. If I am in that jury, the prosecutions case has more holes in it than a strainer.

The prosecutor is a shady, slimey guy... if I was on the jury I'd pick up on that and it would really make me wonder about this case. Without any sort of breath test or blood test results I'd have trouble trusting anything coming from the state in this case. Anecdotal, circumstantial evidence based on observations alone wouldn't convince me of guilt beyond a reasonable doubt. We are talking about taking someone's freedom away here...

The word of a police officer in any country in the world would never be enough for me to convict someone. Because cops can and do make mistakes. And they can and do lie. And they can and do police via their feelings. And they can and do get vindictive if you don't lick their boots. Which always puts reasonable doubt in place. Convictions have to be based on objective evidence (for them to be lawful). The word of a cop is NOT objective evidence.

In proper countries both drivers involved in collisions just get breathalyzed at the scene and if they are in the clear that's the end of the matter. And if the test is positive it's followed up with a blood test, that way there's no dispute and no need to rely on subjective judgements by ill trained cops with perverse incentives. Sadly the Land of the Free likes to find ways to complicate matters.

Mince. It's not unreasonable after an accident to be obliged to submit to a breath test. That's not incriminating yourself, if you're drunk you've already incriminated yourself. Of course there is always the right to refuse but refusal in such circumstances is a different offense in (for example) the UK. The alternative is anarchy and drunks killing people on the roads without sanction.

Essentially when the other attorney would object and state ''asked and answered'' because the subsequent question is redundant due to a previous answer 👍👍👍👍

That prosecutor pulled some dirty tricks, and was just gross. And I believe the cop has a MUCH bigger incentive to lie than the fiancé. He needs his quota, he can’t be called out as a liar, so he will say whatever he needs to say to justify his actions.

If I was on the jury, I'd be thinking "I can work out for myself that she's his wife. And what that means. I can also work out the nature of the arresting officer. With me having all the Lackluster videos I've seen in the back of my mind. Balance of probabilities: both sides are lying or exaggerating. Therefore Not Guilty due to reasonable doubt."

This is a cliff hanger of a trial. When Guss comes up - I was like ok so the friend is some guy at the bar - OH NO a former police officer as the friend of 5 years at the bar that see him not drink alcholic drink and even bought him a club soda with lemon and lime all night :) Q) I wonder why you did not ask Guss when they departed from his experience was the defendant showing any signs of impairment etc.. slurred speech, smell of alcohol or unbalanced walking..

What is the state/commonwealth/whatever charging the defendant in this case, it sounds more than just a DUI based on the testimony of the witness's leg being crushed in an accident. Was there a death involved and/or multiple vehicles and injuries sustained?

This is a multi part trial story, so you can just go back and look. In short, his client crashed his car and got arrested for DUI at the hospital later, when he denied to take a field sobriety test (alledgedly - we haven't come to that part of the testimony yet).

There's always something to learn/notice/pick up, from how everyone in the court behaves 👍👍👍👍 [Edit to add] Look up the Uniform Code of Military Justice, then watch A Few Good Men, and then keep a tally of how many times Tom Cruise's character commits 'Conduct Unbecoming an Officer and a Gentleman' (It's a Looot of times... 🙈🙈🙈🙈) Even that is a learning experience 👍👍👍👍

that prosecutor is quite the slime ball in my opinion! he sure is trying to go to the extreme to get a conviction. i also just don’t like his attitude in any of the videos i’ve seen of him. he seems like he doesn’t like larry because he got called out in open court. 🤣🙄
