It is just act. A skit. They probably already know who the Diamond ore thief is. It is meant for the viewers to guess and also creates colabs with hermits that usually don’t interact with each other but it also is meant to show their viewers other channels.

Boom! One possible defense argument: temporary insanity from Hivemindosis. This is also a civil lawsuit, tort law, not a criminal trial, and would ask for monetary compensation. But who cares? They both start with the letter "C"! Much rather see a judgment for execution with a based "Yo Momma" joke that will be a meme for years.
