While true unlikely, it's not impossible (for British law at least) even more unlikely for the States, as the courts could not possibly care less about such a petty case. I honestly doubt they would even hear it.
It's dawned on me that an interactive play where you can take your family to court and have pretend lawyers argue the case in front of a pretend judge and jury would be an incredible tourist attraction in London
Get a bunch of improv comedians to be the lawyers. A real court case would take months, or even years, of work to get all the facts so it'd be much easier (and more fun) to have the lawyers just make shit up as they go along and it's all established as canon by the power of Yes And.
As it has been settled by the court, the title should read: "I sued my Sister for a crime she did not commit as a child" as "I sued my Sister for a crime she committed as a child" would be accusing her of being guilty. Though it has been decided she is not. Be careful, she could sue you about this, your family has a record of doing this decades later.
I mean, the terms "sue" and "crime" doesn't go in the same sentence. Max has completely mixed civil and criminal elements together. i.e. Civil cases don't determine guilt but instead liability, civil proceedings are also generally not decided by a jury. Also English judges don't use a gavel.
I mean the whole lawsuit was clearly fake as no way a lawyer would represent someone who didn't even know was hired for them nor of the trial at request of person hiring who also happened to be the prosecution. It's extremely unethical. Civil cases in the UK don't have a Jury, never mind the fact a court wouldn't of allowed filming in the first place. Only the Judge during sentencing and final remarks may be filmed.
@@hassan.sh719 the "jury" is just a mix of what looks like random people, some people in suits, plain t-shirts, comfortable sweaters, general casual wear, etc paid actors would probably all be dressed in professional attire, you aint getting paid to wear a turtleneck to court they were probably law students and the judge, prosecution, and defense were probably professors
@@socialistrepublicofvietnam1500 People don't talk like this, it's overly dramatic; and uses phrases people wouldn't regularly use e.g. "what say you" more akin to a trial you'd see in a tv series rather than an actual court room.
I just realized this guy is literally giving all the professionals a good time as well. He gave 2 lawyers a silly prompt and they probably had hell of a time writing it
After she admitted to scratching you, your lawyer should have instantly fired back with "So lashing out with violence is something you have done in the past? More so this incident was later and would more arguably be a more mature version of yourself which would make it seem very reasonable you had lashed out in this manner prior.""
Imagine being the jury, you got summoned there and thought youre gonna hear a violent sibling fued, then you just hear the surfshark ad and everything descends from there
I mean I’m pretty sure this is not a real court and I would guess everyone involved was knowing at least in a broader sense that something like this would happen lol
@@flyingstock5979 Well i would say the courtroom is real, same as the lawyers, judge and jury. But they were briefed beforehand of course.. although the judges face when Max mentions the Surfshark ad seemed very real. ^^
@@luzifersohn5010 Yes I could imagine that the lawyers are real lawyers, but in this case they are acting. About the jury idk. Maybe he got a real jury for some money to act in this case. In the UK you aren’t even allowed to Film in court. And this case would barred for a long time. And it wouldn’t be legal that his sister shows up without knowing there is a court case. And this would be a civil case, but civil cases don’t even have juries. And so on and so on. Maybe the judge is also real and he has a day off. Still a funny prank on his sister, it’s just worrying how many people believe that this is a real court case lol
they are actors i recognise one of the jury from when i worked as an extra on movies, and tv shows. Although this doesnt take away from the video i love it
@@thetruebeastbro4813 Yeah this is a youtube video... people found out even the most mundane "prank" channels pretty much always used actors. Anyone who believes videos like this is quite a simple person. This is literally an entertainment channel, of course they plan out all of this with actors. They make a large amount of money off of ads, they just need content that gets viewers here.
Everyone's an actor, they hired everyone to do the parts, job done. If we put aside the part where they filmed it (not typically allowed in a UK county court). Civil cases do not have juries which is the first giveaway, the second is obviously the surfshark ad which would not be tolerated in the slightest by a real judge.
@@hk78901 the accents of everyone is also too comical to be true. being in a criminal court before (yes the one in the video is civil court, yet has more audience and even a jury which my criminal court didnt), lawyers and judges dont speak like this at all
As a lawyer, I cringed at first at what would happened if they actually went to court. This wastes a court's time and judges usually don't take that kindly. Turns out it's a fake court, no judge would let it go that far, it's obviously passed limitation and is a trifle. Also UK does not have Juries for most civil cases. In fact, juries are only part of the American system because of the people did not trust the UK trained judges at the time.
You claim that's the only reason for juries to exist? Juries are an integral part of U.S. democracy, and even though their power has been tampered with, jury nullification is very much a thing. If the government continues to make silly laws, we may see jury nullification become actually common.
Honestly, you should actually do a nice video with your sister, like invite her to a theme park and just ride rollercoaster with her. Because at this point, she'll always be super suspicious if you EVER ask her to do anything or be available on any date. I think her paranoia would probably mean she'd always look over her shoulder for what happens next when it's all actually just a nice day spent with your sister for once.
Here's the thing, although to the viewers this is a setup, but seeing his sister's nervous ticks (playing with her hair), clearly emotional reaction, the feeling of unprepardness and what her brother is doing and slowly coming to the realization this is a joke, but still somewhat serious is what makes the video great.
@@meowoasdgjoiagjoi Only the judge and their sentencing remarks can be filmed. Authorised media cannot film any other court user - including defendants, victims, witnesses, jurors and court staff. From the government website, why do you think sketch artists exist? You can’t film in court
I dont mind if its staged, that means he didnt waste any actual lawyers or judge's time on a frivolous suit . Edit: Although I do feel that assuming it's staged, Max could have been honest with the audience, and the video still could have worked (like a prank where we're all in on it except for max's sis)
it’s definitely staged. you can’t film in a UK courtroom, we don’t adress the judge as “your honour”, we say “lord/lordship” and “lady” in the UK. Also, the other person has to know they’re going to court.
More like pure neutral. Chaotic wouldn't care about legal procedure or documentation or making sure they follow what's "allowed" in any of these videos. Neutral works within the law to thwart the law and do what's not intented. Good would use this loopholing for the greater good, helping people. Most of what Max does is just harmless fun for entertainment (ours and his).
Thank you Fosh! Now I know that if I have a minor childhood grievance with my sister that I should take it all the way to court! I need to make a phone call to my lawyer now...
As much as I love Max the fact that there is a full jury in a civil case (which while unheard of isn't common in the UK for civil cases especially ones which aren't big liable cases) and also that there's 13 of them would indicate this was setup. Jolly good fun though.
@@RobDavisAkaMonk It's during the trial too, so that they can continue the trial in case a juror becomes ill or needs to be replaced for some other reason.
LOLOL. I never laughed so much in my life! The moment when he turns to the camera and starts to recite the advertisement. LOL. That is some state-of-the-art comedy right there. Best ever. Mad props to you Max Fosh.
He isn't suing his sister. There is a jury who finds her not guilty, which is not how a civil case works. The entire video does not follow the procedure of both criminal or civil cases. It is entirely a set up.
imagine being in the jury of this case. You show up for a court case that happened 22 years ago between siblings. Then the plaintiff starts telling you about surf shark
Argh no - the 'not guilty' kinda gives the game away. That only happens in criminal cases, not civil cases. But still, this is top tier content. The commitment to silliness is a delight.
@@hk78901 I mean if we're going for the first giveaway that it was going to be a mock trial rather than any real legal proceedings I'd be torn between the fact it was clearly not a justiciable issue and that no court would sit for a case that the defendant doesn't even know about yet 😅
@@katrinapaton5283 considering i'm English myself thats not something you're gonna need to worry about. i probably should have clarified british youtubers though
I have a scar on my forehead, not unlike Harry Potter, after my evil sister wielded the potty of despair against me, and used it to thrust me upon the protruding corner of a wall. You sir, are giving me ideas.
Despite this obviously being actors and not a real courtroom, this was still hilarious! Well played to both lawyers for coming up with good arguments in a case two decades old with no evidence besides the two people involved!
Max Fosh you sir are a genius. How is it you have so few sub's. The video's you make are legendary. It's great to see you have such a good relationship with your sister. Keep up the great work on these video's and I wish you many more years of success.
Don't worry, Max, I 100% believe you. Your sister has proven time, and time, and time and again that she NEVER admits responsibility for her actions. Therefore, it makes sense she doesn't want to admit to something so bad as to harm her sibling. It's obvious she's guilty.
It's scripted man the jury are just a bunch of paid actors it's illegal to film in a court house so how would the video be real and before you say i was joking you legitmately said she was guilty and said how she wronged him multiple times bro not everything on the internet is real.
@legendenfutte4931 Except jokes are funny and set up for punch lines. There is no punch line at all just a slight sarcasstic overtone which doesn't make it a joke. Either you people tell funny jokes or GTFO.
