Correct, but most people don’t realize that. So the intent is to wave it in people’s faces that they signed away there right to sue and hope they just drop it, if it goes to court it would obviously be dismissed, but it still cuts down the number of lawsuits the company has to deal with
You can sue if you sign an arbitration clause. It's just a lot more difficult. Liability waivers require loopholes and jumping around fine print, so again, it is still possible, just very unlikely if it's air-tight.
I remember thist story. Turns out the Lawyer for the company walked into the CEO's office and told him she would not be defending this case and they needed outside Counsel. There was a settlement, the guy got his job back and a Fair raise, an apology from the CEO, and the CEO reached out to the Company that he applied to and explained exactly what had happened. There were firings and demotions. His boss apologized, OP understood where he was coming from, but would never trust him again. OP was going to hide out in the company for a year or so and rebuild his reputation and then go look for another position elsewhere.

If anyone asks about his history they’ll be forced to share he was accused of it and it’ll make others unsure of him. Anyone that is accused of rape will have that accusation follow them everywhere even when they’re proved to be 100% innocent of that accusation. Once it is thrown at you there’s no getting rid of it.
@Alienator-999 Only if they are accused and taken to court. This investigation and accusation took place at his company, and no legal action was involved yet. No one will ever have to put "accused for rape" when talking about him. Also, the company did infact have a word with the other company as well. It isn't like all the big companies have a word with each other, so the HR department at the other company are likely the only people tha5 even know about that. As when hiring someone, you aren't really allowed to talk about their profile with the workers.

I would have gone through with the lawsuit no matter what. They defamed you, slandered you, fired you, and didn't have the common decency to properly investigate some very serious charges against you. A lawsuit is the only way to move forward. How many people are they going to screw over in the future? How many innocent people are going to have to have their lives ruined. How many innocent people have offed themselves over a lie? Take a stand for once.
This exactly! He's got a strong enough case to make heads roll if you ask me... Allthough I personally don't put too much faith in the system either. Once being screwed over like that would understandably make him think twice about his course of action. Why on earth did that manager she talked to after that tell her to go to such extremes? From this video it seems she doesn't even know him really as they're working in different units and have no business connecting them in any way. Why does she just randomly want to destroy someone? Both women should get a very serious reality check for what they did. Unfortunately, more often than not.. these false accusers just get away with what they did. Very often too because the person that was falsely accused doesnt want to pursue anything just to stay low on the radars. As someone already said, once you're associated with accusations like that, people will spin stories, like giving the false info to that other companies hr department. Even if youre innocent, people will think where theres smoke, there's probably fire. So in an effort to keep things as quiet as possible, they won't go after anything even tho it is very very well within their rights to go and get justice.

OP also explained that he applied for other jobs and when he was offered one some from the old company let it slipped that he was fired and he lost the new job . Op only stayed there a year and left

The person that told the IT person can easily be sued for destruction of evidence cause that camera video could be counted as evidence of what really happened.
Non-arbitration contracts are considered null and void if the company violates the law in the process of you working there or being fired. As op was fired through negligence of the company on a false basis, arbitration is not required

Arbitration is not for criminal acts what she did is file a false criminal report. That does not go through arbitration. That means you get your ass thrown in jail and you get sued.
Offered my job back? Yeah they can kick rocks. Two years full salary, a public apology and the CEO must PERSONALLY call and write to every single company with whom I interviewed explaining the truth of the situation or I'll see you in court.

Similar happened to a roommate of mine. School had a 0 tolerance article 7. And revoked his deploma after he walked because of a "she said". It was categorically proven false. But they stood firm. His father had a lot of money to burn and so sued them for every penny that school was worth. He got 25mill out of the school and his diploma back. Now my roommate never has to lift a finger again in his life and still have enough to buy a plane and send 4 kids through private school and college... still to this day dont know why people would hold firm against shit like this... it costs so so so much less to take the first deal.

your the misandry, there have been hundreds of false accusations against men who have done nothing wrong for the pettiest of reasons. All the women is such disputes get no repercussions, and the men have their lives ruined. Often times with no evidence. It's almost always guilty until proven innocent in these cases, and this behavior spits in the face of actual victims. It's all to common for men to be accused with no evidence, and often times they are given the guilty verdict without evidence.

Proven intentional false accusations, not misplaced accusations, but knowingly malicious false ones, need to carry the maximum sentencing of the crime accused.

I never would have accepted the job to work there again. After everything that happened? Sure it was HR who was the cause of all this, but no one dared question them nor handled it professionally. I would have sued for back pay, a year of salary, and a public apology.

Cases like these just get my blood boiling. A whole bunch of people being incompetent AF, supporting(!!!) two psychopaths that, for NO REASON AT ALL... got it into their toxic narcissistic pea brains to try and utterly destroy a completely innocent human being. How did no-one even think to check those camera's? On the other hand, perhaps a good thing no one remembered those camera's but OPs friend... or with the way they tried to go after OP, I would not have been surprised if someone "accidentally" erased the footage of that day. A couple of times when I've wanted to sign up for an American site, I've noticed the Terms of Agreement say that the user can't sue the company and any disputes must be handled in arbitration. Every time I refuse to sign up. Better without a web service I need, than to agree to some American legal BS.

First of all, this man was incredibly lucky. No one should ever take a person into private in a corporation unless there is a recording of it and everyone is made aware of it. Second of all, the HR manager completely failed his or her job and should also have been fired.

It doesn't really feel very adequate that they accused him of rape and spread it around town with the false allegation that he was being criminally charged with it. Like that shit ends people's life in some situations. They should totally be made pay for it.
That being said, cameras or not the guy was a bonehead for having that meeting where nobody else could see. If you are in a workplace environment and are forced to deal with a member of the opposite sex then you either bring a camera to record it, or go to a place where you know their is working surveillance and make them fully aware that they are being recorded.

Given most HR departments are run by women that's a given. Best case scenario you will be ignored. Worst case they will drum up some vague language in your employment contract and have you dismissed.
