You have no legal expectation of privacy on the outside of your vehicle. If it's in plain view in a public place and anyone, including the public, can see it without having to move anything out of the way, they can use it without it being a violation of the 4th Amendment. Reading a license plate displayed on the outside of your vehicle does not come even close to being considered a search by a reasonable person, because it's not intrusive. Claiming it is a "search" is a very long stretch of logic and it holds no weight, constitutionally. Also, a temporary detention has been found constitutional numerous times by the Supreme Court of the United States, even in cases of border issues, so long as the detention is a not an unreasonable length of time. About two and a half minutes of your time is pretty reasonable, actually. You have no power here....

Imagine driving home where none of these checkpoints exist and being jumped by a group of Roaming Patrols accompanied by a spotlight shining helicopter at night. The guys at work clamored how they'd like to capture that spectacle on film, each time another was stopped leaving the GM Desert Proving Ground in Yuma. Others ran and ignored the flashing CBP lights to find themselves chased down eventually. Some waited hours for a canine when they refused to consent to a search.

Judging from the vid, it did not appear the agent signaled for Trudell to take any action let alone roll his window down in the time that it would take him to come to a complete stop for at least 3 seconds, look both ways for hazards, and proceed as taught in driver's ed. Most checkpoints have an R1-1 stop sign (MUTCD) which must always be obeyed. He likely could have continued on (before the agent signaled him to pull into secondary, which the vid does show) and, if these agents felt that him exercising his 4A, 5A, and right to travel threatened their egos, they could have gone after him and ordered him to pull over, although it would be unconstitutional (Martinez-Fuerte may say otherwise, but one reading of the ruling and anyone with a fucking brain can tell it is a fuckup by the Supreme Court that needs to be overturned). By this point, he would have not broken any (constitutional) laws. But, given how volatile and fragile USBP agents are, they definitely would have tried to have him charged with a felony count of fleeing a checkpoint.

And they did that with no plate on the vehicle and viewed the photo on a walkie talkie in ascii characters.
