Fear that a child will be permanently removed from the state is an affirmative defense for withholding a child. That's why the lawyer said it. Because the mother presented no other valid reason to withhold the child.
If she's a toddler or younger, I can imagine baby grabbing a nipple ring if it shows through her shirt. I can also see them laughing about it. That's no reason to stop visitation. My grandson's all breasted and have tried to push or pull my shirt at some point. You just move their hand and ignore it. No big deal. Or maybe it never even happened. Who knows.

Can anybody explain to me why a mom that said her parents were tired of having to pay for diapers, wipes and clothes for her would spend more than $260 for a first birthday party? All the child wanted would be a couple of gifts and most importantly ATTENTION from parents and family.
It was almost $500 for that birthday party - for a ONE YEAR OLD!! Ridiculous... Between that and the fact that she seems to still be minimizing his faults and sort of protecting him, I'm almost done watching at only 24 minutes in. I'm sure her attorney is playing the bad stuff up, but I can sense her frustration with the answers she's receiving now tgst her clients on the stand. Clearly this woman has told a set of detailed stories and painted her ex one way, but is now backtracking. I'm, frankly, beginning to not care how this turns out... I truly can't stand when moms or dads withhold their children from the other parent because of their own selfishness or control . Moms lawyer said the child got covid 2 times from being with dad, that wasn't the truth, she said the music was so loud in dads car when he pulled up with the child in the car for the bday party that she couldn't hear the child calling out for her (again lie, she was inside she said and grandma was the one that went out and she said she could hear him talking never mentioned music was so loud she couldn't hear anyone speaking). Lawyer tried to paint him as an alcoholic but the mom testified that he drank on occasion Lawyer then asked but he drinks mom then said oh yes he would take a bottle of Jack Daniels and drink on the front porch but when questioned when he did he would drink to get intoxicated and again mom said no he wouldn't get drunk or intoxicated. I think mom was just being spiteful .IMO Dad's testimony came off as more credible than mom
You can see in judge Wolfe's facial expressions how draining these hearings are when both attorneys spend at least 1/2 their time at the podium asking completely irrelevant questions that nobody cares about.

I have a Walmart account for ordering groceries and I live alone. But I've got a couple of cards listed as payment options. I have one main card that has great cash back rewards that I typically use. The other cards have promotional rewards where I earn extra cash back for groceries in some months so I do sometimes switch around. I've done exactly what she did - got my items in for the order and hit the button to place the order without thinking. Like her, my accounts notify me immediately that a charge has been placed and is pending and I was confused for a moment as to why it was coming out of another account. Then I realized I'd switched cards for the extra promo cash back reward but forgot to change accounts. It's very easy to do unless you're specifically looking for it. I didn't really care so I left it. Otherwise, the only way to fix it is to cancel the order, reorder all the items and change the payment source before hitting the button to place the order again.
I was coming to say the same thing. She knew she was using his card and tried to lie. Mom's words "I use chime, I get notifications when I use my card when I didn't get the notification right away I checked my order and that when I noticed it wasn't my card" she then said she called him to tell him and that she used it by accident and she'd give him the money back but couldn't pay him back until she got paid and then he said don't worry about it but you just pay for the divorce filing. She knew she was using his debit card, especially since she admitted in court she couldn't pay him back the $168 dollars until she got paid. Especially using chime that is an online backing platform she knew she didn't have enough money in her chime account and that's why she used his debit card that was already saved to (which was probably used when they were together) the Walmart account.

Many people get child support even with 50/50 custody if there is a major discrepancy between incomes. The courts want the children to have an ‘equal’ way of life at both homes.

Dad deserved so much more. I think the fact the judge was like 'they are both cheating on each other' was very counter to the facts shown. Yes, he was in a new relationship... which happened after the pair split up after mom was found to be twerking in sexually suggestive manner with her paramour roommate. They were clearly separated in heart and soul with neither making an attempt to come back together, so he was in my eyes clear to open to new relationships. IMHO, judges ought to recognise that the law works slow, and some people aren't going to spend four months feeling alone and sorry for themselves, but find other people to socialize with who DO appreciate them. As such, I feel like that should AT THE VERY LEAST have had a considerate amount of makeup time, IF ONLY to correct mom's stupid idea that she could take the kid away. I thought for a bit that he'd lean that way when the judge initially questioned her 'so it is okay if he raises the child the next few months', but he didn't do that. IMHO, the most justified way to go about it was to make dad the primary parent for the next sixth months with mom getting visitation (to make sure she DOES get her time with daughter and isn't shut out in turn), and that from there they can figure out who will be the primary parent, if any. Maybe they'd do a 50-50 split. But alas, I'm not a judge. IMHO, the nipple ring comment was just some silly comment made in a conversation; it makes sense that a baby would try to grab a nipple ring if it for whatever reason noticed it on the girlfriend. It stands out, which is the purpose of the thing! (And regarding hygiene... typically people keep piercings very damn clean to avoid infections, so I'm not worried there.) Dude skipping work... everyone skips work sometimes; he just got caught. Finally, the weird comment regarding a finger slip... I don't know who said it, but I do know it is uncouth. But regardless of that, it is very much a concern. People will ALWAYS worry more about dads changing diapers on daughters than moms changing diapers on sons. I get why that is even though I don't like it, but it also makes me understanding very clearly (as a man myself) why I would be paranoid about avoiding any sort of misunderstanding around a younger female especially. One accusation destroys a life, and for better or worse, mom has in her behavior shown EXACTLY that she'd jump to making such accusations in the loudest of ways by bringing that comment up in court. Finally, regarding dad's alleged comment about minced meat... if it happened, it is not a shining moment. But at the same time, did he mean anything negative by it, or was it a factual statement? Sometimes people just say shit without realizing how others may interpret them without meaning any harm, and I can imagine that if a man were to be dragged into a discussion about stretchmarks, that might be his best point of visual reference. He shouldn't have said anything, sure... but we're all dumb foot-in-mouth idiots sometimes.

Men need to start making noise when it comes to equal parenting rights. For a majority of the time these 2 split custody 50/50 (except when she withheld the child), they make the sane amount of money and even work the sane amount of hours, and he has to pay her child support plus back pay? Make it make sense! I do live this judge but it seems backwards that Mother's her rewarded for withholding a child from the other parent.

I think it was more about proving that she was in a romantic/sexual relationship with the roommate while she had the baby with her.… all while she is in a new relationship and asking the court to block new partners from being around the baby (because she doesn’t want HIS girlfriend around their baby). The other aspect that the judge mentioned was that both were committing adultery since they were still married to the other party, so morally they were in the wrong.
I don’t believe that he didn’t say that about her body or leaving the state with the kiddo. Even if he did it to hurt or make her understand what he felt. I just wish he’d be honest. He still comes out as less of the vindictive parent but acting like he never said or did anything is just not realistic.

I have fibbed to get out of work on occasion, everyone does! My daughter, who was a baby at the time (6 and 7months old), would grab on any boob she can find when being held, all babies grab onto things that is right in front of them, thats what babies do, you can't help that. That whole boob ring thing was ridiculous, so the dad made a joke out of it, big deal, most guys are infantile when it comes to joking about stupid things like that and think all of its hilariously funny. Its no reason to keep a child away from the Dad. If that was the case, NO DADS would EVER get to see their kids. Judge was very fair. I wish parents were forced to attend counseling/mediation to have it drilled into them that if they want their children to grow up feeling happy, content and loved they (the parents) have got to get their s-t together for the sake of the kids
My ex and I split. We were/are determined to be the best co-parents we can be. We made it a priority to attend counseling so that our children wouldn’t suffer. Got to be an adult and realize that the kids are the ONLY thing that matters.

Wow! So, she unilaterally removes access to the child and then gets credit for being the primary caretaker. There is no downside to her actions. In fact, she is all but getting rewarded. @@SuperNoahsmom That's not how CS works. The idea is to give the child a relatively even and equal standard of living in both homes. In a nutshell, they figure the incomes and time with each parent (equal time for each in the case of 50/50) and whoever has higher income owes CS to the one with lower income. Imagine if one parent earns $40,000 and the other earns $150,000. The child has the right to the same quality of life and living conditions with both parents.
If Mom was laughing about the kid playing with a piercing on her boyfriend's private parts, there'd be police and CPS involvement. I think the ex just *really* wanted her to know that the new girl had pierced nips, so he found a reason to slip it into conversation without thinking about how that comment could be perceived.

It's very common - a child is entitled to maintain a lifestyle enjoyed by both parents (or the average thereof). So in a 50-50 custody situation, if one parent is making, say, $600k/year and the other is making $40k a year, the kid would be entitled to some average of that.
