The officer commanded he come out. If he didn't obey the officer, he would have been charged with failure to obey a lawful command. They want it both ways...the suspect obeyed a lawful command, with hands raised, and was shot! He would have been shot, or beat, if he stayed in the closet! If a person files a "protection order" then the petitioner should not be allowed to harrass the person who they filed the protection order against to get that person jailed as well.

Before video this would have been in favor of the police because it would be officers (plural) word against the suspect. This case would have never made it to a police defendant position. Accountability is what body cams are for both the officers and citizens safety. Police officers frequently abuse the power given to them over and over. It’s a power ego mind set. It’s not about bad cops and good cops it’s about balance, justice and accountability. Like a spoiled child without consequences an entitled bully more often then not arise. 🙃

This is just another example of our justice system being completely broken. How does a lower court rule this is okay? How does the state defends these officers? The officer should have been fired and charged. Not waste a ridiculous amount of time in our court system just for three judges to say it is not okay to shoot a man with his hands up. I had an officer draw his weapon on me AFTER he had already searched me and my vehicle. As for the Graham factors. No criminal history, I had committed the major crime of being legally parked on the street next to a bank, and as already said he had already searched. Just stupid is what they are.

The cops' lawyer is trying to argue about officer knowing case law at the moment of the event, but then he argues that it is a split second decision so they shot him because of that split second decision, this lawyer is trying to eat his own tail and chase it.

Where in the law does it say the Plaintiff was trespassing? That's a serious charge that the judge made, and without evidence to say Thomas was trespassed from that property. To be trespassed, the owner of the private property must give notice that the individual was told to leave and instead remained or reentered that particular property. There was no evidence produced that said he was trespassing, so the judge made an error.

What an infuriating lawyer! I guess adverbs are not important! “Slowly came out of the closet” versus “Quickly came out of the closet.” No, those facts are NOT the same!
