Hey bro, I understand what your doing with your keyword terms at the bottom of the description, using certain ones to extend the reach and all that, which personally I think this needs to be seen far and wide to help you get justice, but using terms like comedy or entertainment and the like I just worry could you used against you in someway but any lawyer with the average Iq and not the average lawyer with a shoe size Iq. Holy crap, that man was begging for his life and they shot him in cold blood. If the man who shot him, wearing full body armor with an assault rifle, really feared for his life, he should have never become a cop. He shouldn't even own a gun. Mans on the ground, crying, crawling towards you as you commanded, and you're the one that's so scared you have to use deadly force? The guy giving the commands, really? You should be forced to go through that and see how well you'd comply. (I would make sure that the guy with the gun doesn't have bullets, but I wouldn't let you know that.)

I’m loving these rejections of qualified immunity. This case was so crazy. That man was murdered by the government and his family was left with nothing. And nobody is in prison for this horrific crime.

I remember when this happened. The cop has the guy crawling on the ground telling him to be moving forward, but also telling him not to move the wrong way. This was a setup and the guy was murdered. Disgusting how the cop wasn't even charged, he should he rotting in prison.

It seems their sole strategy is to try to get the case kicked out on immunity, and if that fails, pay a big settlement to stay away from a jury, which would likely destroy them.

That middle judge said it best, "What if that was a child on a tricycle?" I am appalled just hearing that attorney's argument that someone called 911. Just because someone calls 911 and the police get dispatched with information, it does not mean it is factual. Anybody can call and make an allegation to 911 that could be a mentally challenged person hallucinating events that never happened. The alleged suspect victim was given a lose lose situation escalated by these officers by their shear cowardice and neglect of sworn duty to protect the rights of all parties involved.

They don't know the Constitution, most can't tell you the 5 rights in the 1st Admendment. They need 6 weeks @ least in police school to go over the Constitution since they swear to uphold it. I'm not against good police, but most are clueless to how the law works or what is even said in the Constitution. They should be tested on the law and actually have a degree of some sort about the law, not just training on how to detain a person and preserve their safety. Things need to change.

​@@MrDhalli6500 This was the civil trial that follows after the criminal trial. Cops don't have immunity in criminal court, only civil. The lower court denied qualified immunity, the cop is appealing. The widow got $8 million from the city, $0 from the cop.

It’s because they are attempting to defend the indefensible, they grasp at straws because that is all they have got. If the lawyer wants to know what precedent disallows this shooting he should read Garner v Tennessee which set the precedent you can’t shoot an unarmed person on the ground when they don’t pose a direct threat.

i remember that. the dead victim DID realize the gravity of the situation. there was NO good reason that he was given those ridiculous commands. he shouldve been told to lay flat, arms out, etc, & cuffed & searched. the cop is barking immediate orders to a guy clearly submitting, cooperating, & very scared. its almost as if the cop gave super complicated, nit picky orders with death threats so that he could shoot & still be able to CHA, or, he actually wanted to shoot, so made commands & threats so that he would likely make a mistake. under those circumstances, who would NOT make some little mistake, or make a small movement that is a reflex or done by habit or unconciously?? do cops not know that being THAT fearful makes ppl mess or "flub up".??

If your child was on trial would you rather the lawyer gave the best defense he could or just make sure your kid isn't railroaded too badly? Even if your kid is guilty, odds are you find excuses and reasons why it's not their fault and you would be very glad the lawyer helped get an acquittal. Btw, the officer that pulled the trigger was charged, tried and found not guilty. Pretty sure the criminal trial is already over.

The exact same things telling a completely different story. It is perfectly fine to not defend yourself, just don't cry about the outcomes being unfair. Honestly I don't know exactly what you are trying to say, I suspect it's not as pointless or ridiculous as it might seem. It would be wonderful if people were always honest but unfortunately this is the real world. Not even the police, the prosecutor or the judge can be or should be trusted to be honest. When you get politicians, judges and cops to be honest, we will stop arguing. That's how I see it, you can't, we won't, now what?

In you read the constitution, article 6 paragraph 2, an officer shall uphold the articles and treaties of the constitution .The Bill of Rights, amendment 5 , says " Nor shall ....., not be deprived of life , liberty or property with out due process of law . Surely the constitution and Bill of Rights must be the first notice of duty for a police officer .

But can you offer any real, tangible and unquestionable proof that such a requirement is upheld? The reality we see in video after video, thousands and tens of thousands of times, the reality suggests that officers not only don't know the constitution but that they have zero interest in learning or upholding the principles put forth in the constitution. Here's an analogous situation. Years ago I took a class to get a professional license. The first thing the instructor said was this. If you want to know how to do this job, you are in the wrong place. If you know nothing at all about this industry but want a license in the industry, you are in the right class. I'm not here to teach you the job, I'm only here to make sure you can pass the test. This is what government regulation really means. I didn't have to know how to do the job, do the job safely or correctly. I only needed to know the answers to the questions asked, I missed two, got a license and was considered an authority because of that. Cops get training. Trained how not to get caught violating rights, taught what can be excused not what is necessary. Trained how not to leave incriminating marks, how to mute or remove body cam, how to answer questions without giving answers...... You say cops are required to know and understand something you can't even prove they are required to read. And every bit of factual evidence available as empirical and indisputable on video, says exactly the opposite. Why would you believe they are "required" except you really want, maybe you need it to be true? But what if it isn't? What if the top most law enforcement agent of the world said, no, cops are not required to know, understand of interpret the constitution, just the laws. Would you be shocked? Currently as far as we are concerned the order of law enforcement goes president, Director of the Department of Justice, The attorney general..... Trump famously said regarding red flag laws, take the guns first, due process second. Clearly not in alignment with the constitution, the DoJ and Attorney General have backed equally unconstitutional positions. They lied to the people regarding matters of national importance and acted as the armed enforcers of unconstitutional policies put forth by the government. Is the president required to know, understand and uphold the constitution? Maybe we want to think so but since George Washington every single president has found the constitution to be a burden and obstacle for their own desires. Every single president has tried to erode and pervert the constitution for one purpose or another, always shielded in benevolence and protection but in reality motivated by cowardice and authoritarianism. Lincoln decided to suspend the constitution and override the very basis of it. Roosevelt stripped citizens of their rights, suspended/repealed the constitution in order to lock up innocent citizens without charges, trials or any form of due process. The list is long and expensive. The crimes against the constitution, indisputable and obvious. Yet these crimes have been sanctioned and warranted by the courts, another branch of the government. . I'd love to agree with you and know that if a cop actually violated the constitution that officer would face criminal and civil consequences. The fact is, they don't. The fact is there is nothing you can point me to that will make me believe there is such a requirement. If there is, please share. But I think I can show you ten videos, all new within the last week, showing officers who either don't know the constitution/law or don't care to abide by it because they clearly don't have to. Give me that thing I can point to and have these officers charged. Show me the consequences, the charges of not knowing the constitution that one would expect if your claim had merit. I would love for it to be so but I find no actual evidence that it is.

It’s seems to me that this is the most blatant case of a cop desperately wanting to shoot someone. When he saw his first opportunity he pumped 5 bullets into an innocent unarmed man crawling in his boxers , sobbing while pleading and found NOT GUILTY by a jury. Holy cow !!

The mcsc judge disallowed evidence against the shooter, Brailsford. One was that Brailsford used his own rifle. The barrel was engraved with "Your F++k+d.

I saw the video and the guy who was shot was so scared. The police officer used intimidation tactics and failed to de escalate the situation. I think the worst part is that the officer got disability

He lost here to the tune of$9.5 Million but a jury of dimwits was able to see video of what happened and find him NOT guilty for participating in this murder. According to the "warning" he could have been killed if he raised his right hand instead of his left hand. I was aware of this murder at the time it occurred and the disgust I felt then has only ground with time. The idea that you can get 12 random citizens who approve of murder on a jury.

The cops didn't go to prison, but that's the fault of a broken system where to many of the population still believe cops tell no lies and do no wrong, combined with the ludicrous invention of qualified immunity by the supreme court.

Imagine being that guy who chose that career. He made the choice to go to work as a lawyer for cops… which puts him into the position of having to go to court and do everything in his power to get violent killers with badges off with no consequences. That’s the job he chose. I know… I know someone has to do it. Everyone deserves legal counsel. I’m just saying. Imagine having that job. Imagine how flexible your morals would have to be.

I just watched body cams and camera footage of another case where a female cop shot a "suspect" for not complying and she was charged with attempted murder. Poor lawyer. He has to defend this client under pressure from a corrupt and broken police union. I actually feel sympathy for him; personally I would start looking for a different job or I would never be able to sleep at night. He is left with the weakest of defenses based on the reprehensible actions of his client. His only defense is that if a police officer gives a command and it is not obeyed it can constitute a clear and present danger, even if that danger is an unarmed man, wearing a t-shirt and shorts, crawling towards them on the floor. Glad to hear immunity was denied otherwise officers could shoot citizens anytime they give them a command and it isn't followed (i.e. step out of the vehicle... no... bang, bang).

He tries to make light of life and the life of an officer is more important than that of a citizen. This is where these loose cannons take control and try to justify their actions. If that is the case, then all officers should be on notice that their lives are on the short. We should all be aware of protecting our property, lives, and our defense of such.

The parents and widow filed civil lawsuites and appears they settled. 1.5 million to the parents and 8 million to his widow and kids. However, you make agreements that either they did no wrongful acts and such. I get the settlement is a common sense of admitting guilt. I'm glad the family got a settlement, bit this officer needs to lose his pension.

The call was a person with a rifle. A rifle. A citizen crawling on his hands and knees within 6 ft of his executioner. The executioner could see the victim was unarmed and not a threat. The victim was not hiding a rifle in his shorts that were falling off his rear end.
