Atlanta News First Investigates recently tailed U.S. Drug Enforcement Administration task force officers as they walked, otherwise unnoticed, from gate to gate at Hartsfield-Jackson Atlanta International Airport. We watched them search passengers right after they scanned their boarding passes.

Thanks to the deliberately and dishonestly named "Patriot Act" we no longer have a 4th Amendment in any airport, government building [OUR buildings actually], or in 100% of our electronic communications. DHS is no better than the former USSR's KGB.

@@darksaint0124 There isn't a law against it there are laws that give a Law Enforcement officer the ability to take your cash through civil asset forfeiture. Depending on the amount it likely going to cost you as much or more in attorney fees to recover the money. I have read stories of highway patrol taking as little as $5000 in cash off people. Most attorney's are going to cost upwards around 10k in fees to recover that money. LEO know this so likely you won't show up in court when it comes time to prove to a judge the money was not gotten by illegal means like illegal drug sales.

The stop and search is not illegal if you give consent. First Question you ask when stopped is "Am I being detained?" or "Am I free to go?" Remember if they ask you for permission its because they don't have the right to do it without consent.

It is only illegal if you don't give them consent and they don't then get a warrant. Just say no. Yes, you'll miss your flight, but you retain your civil rights and they will waste all day trying to get a judge to sign a search warrant.

To start with, your bags have already gone through security by the time you are in the boarding area. Anything you could have purchased in the gift shops have passed through security. The area is secure. There is zero reason for an additional search. This is attempted robbery, plain and simple. Civil asset forfeiture must be abolished.

They are searched for weapons and dangerous items. TSA does not search for cash. In fact since its a mandatory search by TSA seizing the cash would be thrown out in court. Only consent searches or search warrants are found to be legal means of searching someone when seizing cash or evidence, except for weapons or dangerous items found by TSA, hence why people are approached after the TSA search, plus its safer for all involved because of the lack of possible weapons.

@@scottperry7311 Nonsense. The TSA searches for cash all the time. In fact, many times, dogs are trained to sniff for people carrying money and those people will be pulled over. Usually, issues will only arise if you're carrying more than $10K. If you declare that you are, it's not an issue. Look, at the end of the day, this is simple: it's not illegal to travel with cash, so no one should ever consent to such a search. But as was mentioned in the video, they stop them right before boarding and you know that you have one of two options: either let them search your bags or miss your flight. Sadly, there were people who will defend authority, no matter how far they go in trampling your constitutional rights.

This same tactic is used by the highway patrol in some states. No crime but you have cash on you. Once they've stolen it, it's almost impossible to get it returned. It's a sad and disgusting situation. 😡

They call it 'Drug Interdiction" but we can see what it really is. It happens all day every day and it needs to stop. My family was stopped by a 'Highway Interdiction' cop and hassled for nearly an hour while the cop debated if he should check the van we rented for a road trip..

Can they keep you from going on your flight if you don't consent? While I'm not ever doing crime, I don't like this wasting of a person's time without legitimate reason for searching. What can you do if they don't quickly yet you go free? It seems people have to spam the 'am I being detained question?' as it looks typically that they don't release the person they choose they want to inspect.

NEVER give your name, identification, travel details, or reason of travel to anyone unless they can provide their identification and reason of stop. Ask why the search is being done, why was I chosen, what are the suspicions, am I being detained? NO ONE IN PLAIN CLOTHING should stop you and demand a search without your CONSENT.

I am a Brit and if this behaviour happened in my country it would be a national scandal. The authorities and would jump on the police officers like a ton of bricks. I like America but feel disappointed with the laws in some areas that allow these miscarriages of justice to continue. It looks like legalised theft. That victim was justifiably upset, not only did they steal his money but they humiliated him in public as well. It is a disgrace.

it does happen in this country. The police can seize cash at the airport if it is over £10,000 and to get it back you have to prove it is legitimately earned money and it belongs to you.

I'm white, and this happened to me as I was departing Madrid, Spain. I came very close to missing my flight home after they took their sweet time searching my carry-ons and purse in a 'randomly selected' search, pulling everything out and laying it all out on a folding table for everyone to see - including my measly $100 travel money, which they didn't take, thankfully. It is demeaning and incredibly stressful and makes you feel completely powerless, scared and angry.

Yeah... but that's how the crooked system works. Same with cops pulling people over on state and federal hightways. If they catch you with drugs / money / etc they will not only arrest you but seize your vehicle and any other property and sell it at auction. They local agency that makes the find / arrest gets to keep a big chunk of the cash and proceeds from sale of anything else they seize. It's a dirty game. But so is drug dealing. So in those case, I don't feel too much sympathy for the criminals who get caught with a trunk load of meth or fentanyl. But in the airport??? On the other side of the TSA checkpoint??? Oh, hell no. Fvck that.

The DEA (and ATF) tend to partner with local police agencies and they "deputize" them into federal service. Additionally, the city of Atlanta does not have a Port authority Port police or anything else like that. The Atlanta Airport is wholly owned by the city of Atlanta and is covered by Atlanta police and Fire. However, the land itself is in Clayton County, hence the shenanigans with random Black people getting "random screenings" from Clayton County police. Not to say the Atlanta Police Department is perfect by any means check out ANF coverage of "Cop City". It's just that Atlanta tends to steer clear of a certain type of bias by definition.

It's known as Civil Asset Forfeiture, they seize billions a year this way. They don't use the money as evidence, if they did the seized money would be checked into evidence and stored. They grab it, count it, and then spend it themselves.

Yet another reason why I don't fly. Years ago I flew to FL (the last time I have flown) to pick up a car that I had purchased on eBay. And I was carrying the full amount of the car with me, in cash. I was paranoid the entire time that I would be stopped, searched, and my money seized "on suspicion" of a "crime." We need to curb the excesses and abuses of warrantless searches and the ability of law enforcement to confiscate personal funds. And we 100% need to get these @$$holes out of the airports!!!

The same tactics are used on major highways by state police. Arizona State Police, Utah Highway Patrol, Florida Highway patrol all use these tactics and seize money. A combat veteran recently had his entire life savings seized for no lawful reason after being by stopped by police on the interstate.

That's the bottom line. Without articulable probable cause, they can't detain you for the time it takes to get a warrant (remember they don't have to articulate it to you but be able to in court later, and "he/she looked suspicious" doesn't fly). If approached by them, I'd start filming right away, tell them you do not consent to a search, and when they ask why say you reserve the right to remain silent. The only thing you should say beyond "I do not consent" is "am I being detained, am I free to go?".

I'm happy that the news is covering this kind of abuse. What's even more terrifying is that they keep the money they seize, and getting it back might take months or years, if ever. This happened to me once in another airport. The first thing I said was that my bag had already been xrayed. Then I refused to consent to a search, and they threatened to detain me and make me miss my flight. Fine, go ahead, check the bag. They asked me all the same annoying questions, and I responded with, "I'm not talking to you," over and over again, like a broken record. They gave up.

Naturally they catch people in line for boarding. Who wants to miss their flight and the hassles associated with that? So they consent. This is ridiculous and needs to stop. they have absolutely no probable cause to search the bags, they cant get a warrant. This is simply stealing. Any why are they targeting flights to L.A.?

I watched a video about civil forfeiture on Steve Lehto's channel. He talked about a man that was flying out of New Jersey ? arriving in Miami. He had a large amount of cash for a purchase he was going to make in Florida. He told the TSA people about the cash. The TSA called DOJ and his funds were seized. The Lawyer he hired argued that the TSA was responsible for flight safety and had overstepped their authority. The man got his money back, Lawyer fees paid and $3900 extra for his trouble.

The lawyer is 100% correct. I went thru a body scanner at an airport and TSA pulled me to the side and demanded to know what was in my left pocket. I pulled out a pill, he asked what it was. Caffeine, I said, which ended it. But what the hell does a single pill have to do with flight safety?

Why would anyone agree to these searches? I would miss my flight instead of agreeing to any searches of my property. Why people so easily give up their rights shocks me every time watch stories like this. People just bow down to the cops. If these cops knew that people would not give them permission to search and would defend their rights no matter what, they would not use these tactics.

Don't blame people, many of us have lives that we have to live and being late can cost many of us dearly. What if you miss a flight and the next flight out is the next day, you miss work or late in picking up a child, or whatever. You should blame these disgusting tactics by these "cops" who victimize us and put in a really bad situations for profit. Stressing us out and making us give up our rights just to make a few bucks to pad their department's budgets for new shiny toys or fancy office dinners.

Always wise to advise the officer/s they're violating your constitutional rights, and if they persist in doing so, they lose their qualified immunity and are subject to PERSONAL liability. Make sure you're recording (video & audio) said rights violation, and advise the officers you'll be filing a public records request for their body cams if they have them. Intimidation can be a two-way street!

Unless LE can articulate reasonable prior suspicion, if you miss your flight, you have a very sound basis for a lawsuit, both against the agency and personally against the officer/s. Probability is high the LEOs will fold and cut you lose if YOU articulate this to them! Again, intimidation is a two-way street!

The reason they're allowed to do this is because, we as citizens, complain in comment sections, but do absolutely nothing else to prevent it. The news report gets our attention, but not our action. This practice takes place in neighborhoods outside of the airport everyday, but because it affects certain communities no one cares. Even this report didn't emphasize that the citizens had the right to refuse these searches.

The article doesn't address one issue. How do these keystone cops get past security at Hartsfield Jackson? I have been in this airport many times. I need a boarding pass to get thru TSA security. If these folks do not have a legitimate specific arrest warrant for someone in the airport, they should not be permitted to enter airport concourses. Shame on the airport!

@@dskains Good point. Yes the reporter probably bought a cheap local flight to gain access but i highly doubt the cops did the same. I hope the reporter investigates these crooked cops further and discusses this with TSA and the airport management. Those cops know that wealthy travelers tend to carry lots of cash especially when traveling overseas and they’ve chosen to literally commit robbery against innocent people who are unaware of their rights.

That's fine and I'm not saying I disagree, but they do this specifically to force you to choose between boarding a flight or waiting for the warrant. Most all, if not all, will want to complete their boarding so will give their "consent" and they KNOW that. I don't hear about these searches happening on incoming flights, only departures. Gee, I wonder why that could be? If my flight wasn't at all important or only cost me maybe a few hundred bucks, yeah, I'd demand they get a warrant first. Most times though, it's a very expensive flight or an important one and people don't wanna dink around with missing their flight (most didn't take the cancellation/rebook fee).

There are a lot of people who paid top dollar to be on that flight and they're not going to risk losing it because of a search that will yield no fruit. A great deal of people would do likewise. Agree to this BS search just to avoid missing their flight and that's why they choose to conduct them in the manner that they do, because they pressure passengers to play along or risk losing their flight.

Same thing is done on the roadways. Seizures without base happen all the time to people who have cash on them when driving, with no evidence of illegal behavior. Just having cash gives ground for civil forfeiture to happen, and it is usually not a Federal level agency carrying out the seizure (theft).

This happened to me at Lambert airport, I was standing in a little magazine store a DEA agent walked up to me identified himself as a DEA agent and said they would like to talk to me. They had me surround. I had no idea that these four men were DEA agents. He said don’t make a scene we won’t make a scene I said first and foremost what do you mean come take a walk with you explain to me what’s going on. You don’t just say come take a walk with you, they said something suspicious in my luggage. I don’t have to let them search it, but I will not be let on the plane and I will put out the airport. So I let them search my luggage which they already had in a hallway waiting on me crazy right they found nothing didn’t offer a apology or nothing so I told kcuf you and I hope you have a dekcuf up day

This needs a ruling in the Supreme Court. This forfeiture law is being misused and is based on cases where there were ships holding barrels of alcohol contraband in a port and law enforcement could not determine who owned the ship so they could not indict the owner but "arrested" the contraband cargo. We clearly know who owns the money at the airport, the person carrying it, it's not a mystery.
