Total chapter 23 1st chapter -Introduction Ipc is exhaustive in nature? Cannot overlap the other act Can Special law prevail over the ipc ...... Yes, as it is general penal code Why it was imp to make this code? Every area had there criminal justice Princely states gave different different decisions . .. So he took twice the punishment Sec 1[ (sec 95) of j and k]{ table no 1 scd 5}--- entry no 48 (ipc) Previous code in j and k was ranveer penal code Sec 2 Intra territorial jurisdiction( 12 notical miles from coastal side) any offence committed under it, will be charged under ipc Punishment of offences committed within India ( start/ end) ---- it's end ( effect) ---- executed in India and consequences were in India Result should be in India, corporeal presence in India is not needed If a person throw a stone from outside India and harms the indian He will charged under ipc because the result is in India ( is sec 2 applicabke to indian only ----- no ( every person) There is a foreigner and he made a racial comment on indian --- will he will be liable under ipc..... No, we are not about the victim under ipc but offender --- here he is foreigner Not against Every person is liable under ipc if the effect is under India

Sir S.N Misra ki book me sec 3 me indian and non indian dono ke liye Bola gaya hai. Apne bataya sec 3 me only indians ke liye Bola gaya hai. Sir what is right.

Sec 3 punishment of offences committed beyond, but which by law may be tried within India Any indian who has committed the offence outside India will be liable as the same as if he had committed the offence in India For eg raju and shyam made offence in outside country and they will be liable under ipc + outside code If an Indian had done sodomy in outside country where it is not a crime.... Still he is liable under ipc in India ( that act should be punishable in ipc) Krk tweeted in dubia against celebrities, so he is liable Sec 4( sec 3's extention) Sec 188 is read with it of ipc Any citizen of India without or beyond India Without- without application of Indian laws Beyond - Territorial outside / boundaries of India (Indian embassy ) - applicable of Indian law , it is in british territory but law of India is applied Any person on any ship or aircraft registered in India wherever they may be ( they are floating islands or land / territory) if u commit offence on these then u will liable Any person in any place without or beyond India committing offence targeting a computer resource located in India Sec 5 certain laws
