There's another thing that you wouldn't notice if you don't speak German: the use of the 2nd-person formal tense. In English, we only have one word for "you," but in German there are two words, "du" and "Sie." Those two words have separate grammatical constructs, and this is used to convey familiarity ("Du kannst"/"you can") or deference/respect ("Sie koennen"/"You can"). The jail staff speak to him using the formal tense. The closest thing in English would be like telling him "This, sir, is your cell" instead of "here's your cell." They're conveying with their manner of speech that they see him as a person deserving of respect.

The reason why the prisoners can lock their own doors, is less for when they leave the room, but more if they want to stay in the room and not be disturbed. I remember Larry talking about a big part of the stress of prison being the need to be awake and on your feet at 6am everyday in case someone was coming to get you. On the topic of the cell phone. In Germany there is no such thing as an escape charge, the general belief is that it is natural to want to be free, but the prisoner will be billed and charged for any damages or crimes committed during the escape.

@@LarryLawtonJewelThief What's crazy is that in a lotta the world, even Third World countries that a lotta people think of as backwards or brutal, that's the case and then some. There is no charge for escape or for resisting arrest cause it's viewed as natural all over the world. But in the "land of the free, home of the brave" it's an extra charge for not immediately submitting to law enforcement, right or wrong, and a huge charge for escape. It's crazy. It should also be said that most prisoners, who do escape, return to the prison eventually. They can't go to relatives or friends because police will look there first, their cards won't work and their passport and identification will be noted etc. they cannot look for work, for a flat or anything. So in most cases they return to finish their scentence and be done with it.

The first sentence of the first article of the German Constitution states '(1) Human dignity shall be inviolable. To respect and protect it shall be the duty of all state authority'. This was because this constitution was written shortly after WW2 and all that went on during the Nazi period and the Holocaust. The Germans were intending to be as far away from their past as possible, and to ensure that people were treated better, including inside prisons. People who are arrested and put in prison are still human beings, and the Germans remember that and are not embarrassed to admit that.

In Germany, if a convict is diagnosed with a mental illness or an addiction, he/she is not put in a regular prison. There are special mental health and rehab clinics for convicts, which either cure the mental illness/addiction, or, if the convict presents a danger to the public, hold convicts indefinitely, after they have served their sentence.

All the people around you try to get under your skin and try to make you really angry (and belive me the professionals in the room are really good at this). The goal with American prisons is to keep people incarcerated, that's how they make money. Punishment is so glorified in the US, but people don't understand that because the system is so flawed and thus the recidivism rates are so high, there are ultimately more victims of crime. The sad truth is that American society would rather punish criminals and ruin their lives to fulfil some sick sense of justice rather than help the convicts get their life back on track and prevent people from becoming victims.

Untrue. Long sentences on violent crimes are often given "mit anschließender Sicherheitsverwahrung". Means, they serve i.e. 10 years of punishment - and then keep being locked up (under somewhat relieved conditions, more privileges and so on) until it's determined they're not a danger to society. Just this April in Berlin there was a rather public case of a serial rapist who got 14 years "mit anschließender Sicherheitsverwahrung".
@LS-Moto
@LS-Moto 3 года назад
@@decnet100 Sicherheitsverwarung is a different thing. I'm talking about the sentences themselves. No court is going to hand out 50 years, or multiple life sentences. Anything over 14 years, you're looking at life.
@decnet100
@decnet100 3 года назад
@@LS-Moto Well, it's true that the possible sentences don't include "6x life-sentence" or 50 years. In Germany since 1986, such punishments are combined (prior to that, it was exactly the same - see Heinrich Pommerenke - 6 times life sentence + 165 years of prison; actually died in prison in 2008 after 49 years). But the maximum duration is not set in law as a clear number - the principle is that inmates must be presented with the opportunity to re-gain their freedom (showing by their behavior in prison that they're no longer a danger to society). And the *minimum* duration of a life sentence is 15 years (not 12 as your original post implied), after which a shortened period might be granted according to that principle (so no possible probation after 2/3 of the time as with other sentences!) - if the inmate deserves it in the eyes of the justice system. One might receive a minimum duration higher than that as well. And while it's true that Sicherheitsverwahrung is not "the sentence", doesn't count as "Freiheitsstrafe" and comes with additional privileges, for the inmate it may absolutely mean they spend their life behind bars. By the way, that serial rapist could not have gotten a life sentence, as that is not a possible punishment for sexual abuse that didn't result in death. The 14 years he got were a result of him confessing, he could have gotten more years actually, but not a life sentence.

To clear some things about german prisons: This is probably one of the worst prisons and it still treats its inmates as humans and that is important. Most prisons are actually not that bad here because in germany and in our law, prisons prime use is not as punishment but more as a way to keep society save from those who want to harm it. But since everyone can get into a situation, that will get you into prison, you can't just go around and treat the inmates like some crazy maniacs without any feelings. It's save for the world outside to lock them in but it's not done to punish them and break them. And I think that is the way, prison should be, ofcourse it still is a form of punishment, since you're not allowed to go where ever you want but it's not supposed to break you or enslave you.

Life sentence in Germany means 15 years + X. "Normal" Life sentence: After 15 years you can try to have the rest of the sentence to be transformed into a suspended sentence with 5 years of probation. If your sentence is not suspended, you can try every two years to have your case checked again. Life sentence "light": If the judge finds some mitigating facts for the offender, you can ask for suspended sentence after 3 years. besondere Schwere der Schuld: Roughly translated to "exceptional severity of guilt" is a addition to life sentence that will earn you more years to the 15 you already have to be in prison. About 10 Years after your trail a comission will decide how much more will be added to your sentence. It can be just one year or any other number like 50.

In Stadelheim Munich, a high security prison in Bavaria, the lockdown times are usually from 6 am to 4 pm, with 2 times a week an open evening from 5 to 7 pm. They have "Hofgang" 2 times a day for 30 minutes each, which is the time they have to spend outside, and work goes from 8 to 12, when is meal and then from 1 to 3. From 3 to 4 is the only time the prisoners can socialize.

'Ok, that guys the regular local drunk who thinks he owns the place, avoid him. Hey Larry, the maximum you can get in Germany is 25 years. If you are, however, really dangerous you could get "sicherheitsverwahrung" which translates to "safekeeping". Safekeeping is much more relaxed than prison, but you cannot exit the premises at any time. Every year you have a chance for parole to be released from safekeeping. Austria, switzerland and norway have a similar system. The American prison system is unbelievable to me. I have a family member in the US who stood watch outside a home when he was 18. The robbery went wrong, someone died, and he was sentenced to life for standing watch. He is still in prison 50 years later. I cannot believe how such an unjust system can exist.

Lawyer speaking: not true. Life CAN mean lief. Fifteen years is the Minimum before parole max be considered, mit necessarily is granted. This riss to 25 MINIMUM if " especial severity of culpability" is part of the sentence. The court can also add "Sicherungsverwahrung" I.e. literally "Safekeeping" for convicts considered dangerous, which means they stay locked-up AFTER the original sentence is up.

In Belgium, a lot of the issues were with no women could be hired for the male areas of the prison or even teaching. The issue was, cultural clashes. The prison was built around Belgium cultural life, and many in prison were refugees (often there because the patriarchs of the family were back home, and the young men were sent away so they would NOT end up drafted into terrible wars). about 20 years ago it was 80% "foreign born", and some anger at paying for prison for non natives. (they have Trumps there also!). The problem for me was more not having a prison built around the needs of those 80%, who honestly often just needed a strong father figure.

In Germany, life imprisonment has an indeterminate length and is the most severe punishment that can be imposed. A person sentenced to life imprisonment may normally apply for parole after having served 15 years. If the parole court rejects the application, the inmate may reapply after a court determined blocking period no longer than two years (§ 57a IV StGB). If the court has determined a "severe gravity of guilt" exists ), parole is delayed for a non-specific period beyond 15 years (§ 57a StGB). In declining a prisoner's first application for parole, the parole court determines a lack of suitability based on the extreme gravity of the offence, as well as the development (or lack thereof) of the prisoner behind bars. Such determination includes how many additional years the inmate must serve before again being eligible to apply for early release. There is no legal limit on the term the parole court can hand down, though in practice the average term is about 5 years, and longer periods are rare. I copied this from wikipedia, cause I wanted to save me some effort of writing it in english or translating it to english from german

Since I am from Germany, I will briefly explain, why prison is like that in germany. First of: If you are in court in Germany, they try their best keep you from prison. They let you rather pay huge sums and let you of with a warning. If you even walk over a red light, you will get locked up. That counts for minor crimes, murderers and rapists still get locked up. Now to another point: They ask for permission, since they care about your rights, the goal is to rehabilitate someone after all. For example, it is legal to break out of prison, though the resulting property damage isnt, and if u get caught u will be locked up again. Prisonguards are told to treat the inmates as human beings, so they behave like one. Treat someone like an animal and they behave like one. Though the quality of their matress is bad, since it is a prison, not a hotel. They've done bad and they should know it. The goal is to rehabilitate someone, so they can become a part of society again. They even offer education there, so you find a job afterwards. There is a reason, why the prisoners in the US who did their time, get more often locked up again, then in Germany. Hope I could explain the german point of view more, have a nice day

It’s insane when prisons in Europe are less barbaric than American prisons. Do you plan to review prisons in Norway or Sweden next?

There are a ton of things less barbaric about most Europe countries, even beyond the prison system. The U.S. does a relatively shitty job of providing for its citizens.

There's different types of levels in prison guy. For example level 4 is for serious offenders rapists and murderers

Video idea you should do a video on a RU-vid or called boogie 2988 getting charged of an aggravated assault by shooting a gun as a warning shot.
