The section about the insurance being able to write the right to repair in the policy baffles me, as that is an obvious conflict of interest. Also, has anyone ever been able to sit down with their agent, read their policy in its entirety (it is a negotiated contract between parties afterall), and edit and negotiate some terms of that policy and policy provisions? I think not. Unless the homeowner is able to negotiate terms of the contract, rather than just accept the already written terms, then the party who did not write that contract should have more leeway in court.

It's called the concept of a 'contract of adhesion'. Given that the insurance company got to dictate the terms, the courts decide in favor of the insured when there is ambiguity.

Why are insurance carriers subject to deny damages that can't be seen until the roofing company exposes the damages once the shingles are removed, now the policy holder is held liable not the insurance company, because of how the policy & contract is written. The contractor's contract states home owner pays additional $90. per sheathing upon being damaged, the insurer policy states any additional damages not listed in the appraisal must be approved by the insurance company before insuring any additional cost to damages. The contractor will not wait for the insurance company to send out their appraisers once the sheathing is exposed, it could take months, depending on the amount of claims being investigated by the insurance appraisers. Is there anything the insured can do in this case?

Typically sheathing damage caused by a weather event will be visible. Things like rot are rarely covered. Building and code issues with sheathing do occasionally come up and sometimes trigger option ol coverage. Call the insurance company and let them know, then take pictures and measurements. This does not guarantee coverage however, provided that the damage is storm related or that the replacement is required by ordinance or law and the policyholder has option ol endorsement, I have often paid for sheathing supplements.

It’s not abuse, it that for a 100 years the carriers had the upper hand, level of education was lower than it is today. Insureds today are highly educated and are not afraid to hire attorneys

I have a family member who worked for a personal injury firm. Anyone who thinks that attorneys are shady, should take a look at insurance companies. She once had a client with a 4 year old who suffered life altering injuries because of the negligence of a major company. The kid had to be flown to the hospital. Was going to need a lifetime of care and the insurance company sent someone to the hospital in an attempt to settle the case for pennies before the parents could talk to a lawyer. One of the parents worked in the medical field and recognized that they had already spent more than the amount in surgery and transport that first day. Behavior like that should be a criminal offense, but it’s not. A friend’s house took damage during a hurricane. The entire neighborhood was very clearly damaged by wind and the insurance adjuster tried to get him to take a bag of shingles. Not a repair, but literally brought a bag of shingles and recommended fixing it himself because “it was going to take too long to get a contractor out.” A good rule of thumb is, if the other side is willing to pay someone to work against you, you should have someone working on your side.

If the insurance companies in Florida requires a new roof after been 15 years old but the manufacture states the shingles have a 25 year warranty. Since this is about age of the shingles who pays? (Besides the homeowner).

License for roofers should be in Texas however from the new company to the oldest and biggest company. All should abide to the same rules

We are going to be in trouble when insurance hikes their HO policies to $5000 per year but as long as we keep getting new roofs every other year, why not.

14:42. He’s hoping that the insured is passive, or calls the insurance company, so that they get a chance to talk them down. They don’t want to deal with professionals who know roofing and what is actually owed by the insurer.

31 minutes into the carrier attorneys argument he’s pointing fingers at Public Adjuster‘s as being the ones to overinflate, while Chad just explained that the problem with appraisal process is that it’s taking them that long to get a realistic estimate in the first place. How exactly does that work? He thinks it’s a reasonable argument to only point a finger at the Public Adjuster and not the carrier side for sending some guy who just quit working at a chipotle and took a quick course on adjusting and got sent out into the field to go start scoping claims? That’s ridiculous. Do you know how many independent adjusters I have met that completely agree with my breakdown on the loss, but can’t write it up because it doesn’t fit within the carriers guidelines and they now won’t get work if they try and write it up for replacement? Almost every one of them does this for the carriers. The biggest problem that we face is the carriers getting involved and trying to use an independent adjuster and then taking their estimate and cutting it all down and taking everything out that should be taken care of for the repairs in the first place and only sending it back on their terms. Bait and switch. They try to make these adjusters sound like “independent” adjusters, but they aren’t. They go out there to write up a claim based on the carriers “guidelines” not to get a professional estimate for repairs.

🌞 When will Certainteed revise their LandmarkPremium/TL and their GrandManor shingles so that they have anti-tear strip and also have clear line-markers for the nails? (Those two features in IKOdynasty shingle)

The attorney representing the carriers baffles me with his regurgitated statistics that make no sense and are hypocritical. 25 minutes in he’s talking about how Florida makes up 80% of the lawsuits in the country, then Chad corrects him to say about them being legitimate cases, and his response is because it’s a business decision to settle. That’s his defense?😂 so let me get this straight. They have no problem initially denying and doing unethical practices and reaping all those rewards of the 80% of people that don’t file suit in Florida but when the 20% of people in Florida do file suit against them and win you’re still mad? at what point are attorneys fees a realistic consequence of the initial team that drew first blood by denying and under paining claims? On top of that, at least half of those fees are the cost of defending. It’s not just prosecution fees. They should be responsible for paying attorneys fees when they are the ones that forced the policyholder into having to fight for their money.Then he goes into the next argument of assignment of benefits being the problem. They don’t like assignment of benefits because somebody that is educated in dealing with insurance companies is representing the claim. They like it when the homeowners are the only ones dealing with them because they can intimidate them with their commercials that have brainwash them into thinking that they are on their side, they’re in good hands, they are like a good neighbor, so that way when they deny and underpay, the homeowner is the one that feels bad for filing and complaining about the claim. Absolutely disgusting. Total joke. 😂😅. What hypocrites.

The roofing contractor, after about 7 months, decided not to install the agreed upon shingles & sent back my deposit! What can I legally do? By now my roof damage may have increased due to the contractors negligence.

@@suhwateezea.214 Good question. Their appraiser sent the companies salesman during the winter months, giving me a cheaper price, then came Summer maybe decided that it was not enough money. ? In 2021 labor & materials wasn't that expensive as now in 2022. ? or/and maybe they had a written contract with GAF that would penalize them for installing Atlas product? About 6 months of signing an agreeable contract a representative kept trying to convince me to change over from Atlas StormMaster to a GAF product & about a month later after not willing to change product (contract) I received a sorry letter with a check written out to the amount I'd paid them 7 months ago.

@@KMRenovation Reviewing contract, written Jan 2022, due to freezing weather & snow then our raining season hit us. From Jan-June this year gave our roofing business a slow start. We had 4 different roofing companies just in my neighborhood toward thend of June. This was the time frame in June when my hired contractor decided not to fulfill their obligations.

It is absolutely fair to charge more. You are adding entire new department to the job: supplementing or billing department. And you are waiting longer to get paid. Any business should charge more if they have to wait to get paid. Retail you get paid fast and don’t need to chase money, or pay someone full time to deal with crooked adjusters

Steve......You should know that carriers do not pay for delaminated plywood....Also if the original scope from adjuster is 17 k and the adjuster is new and missed items that account for another 12k ?

​@@eag8999 Carriers use a formula to determine how much time it takes to reach certain stages of rotten materials, if it took over a year for that perticular rot & it wasn't claimed within that year the damage started they wont pay! They would have to be sued, home owners are responsible for there atty fees.

I’d like to know what causes contractors to be flaky and incredibly latent getting back with potential customers! The insurance adjuster wants estimates and one contractor after another fails to communicate. Some never show up. Others come once and become a ghost. Lol…Just today I ran into a guy with experience that I’d spoken with about doing part of the work on my house. He expressed interest then never showed up. All of the sudden when he seen me, he couldn’t get out fast enough. I didn’t stink bad or anything. Aside from the desperate screams of those I have held up coming from my basement, I am clueless about their reluctance to engage! 😁 Also, how difficult can producing an invoice be? Insurance obviously wants them. It seems such a burden to the contractor. Please advise! 🤔 😉 😊

Two reasons: 1) the current labor market and 2) you most likely have a difficult carrier. Let's unpack 1) NO ONE wants to "get their hands dirty" and work in the trades. We are all so overworked because there is no one coming into this industry, but more and more homeowners need work done...there is substantially more work than we can handle. Any contractor with half a brainstem and a middling reputation can quickly become overwhelmed in work. This has caused some contractors to become lazy and spoiled. Other contractors are simply overwhelmed and responses take a while. It shouldn't be this way, but this is how it is in the market right now. I'm sorry you are experiencing this...I understand it is really frustrating. But what you are asking for takes 4-6 hours of work between the sales trip, paperwork, follow-up, etc. You are competing against HUNDREDS of other homeowners in your market who are DESPERATE for a decent contractor. The market and human nature dictate that most contractors are going to follow the easier/better money first because there is SO MUCH of it available. Now we get into point number 2) We roofing contractors KNOW who the 'good' carriers are....the fact that your adjuster is 'asking for estimates' instead of working with a contractor through standardized Xactimate pricing indicates to me that your carrier is most likely one of the not-so-'good' carriers. That's probably why that one guy couldn't get out fast enough. For example, if I know a client has a difficult insurance carrier, I tell them their carrier is difficult to work with, underpays, and I am unwilling to complete the work outlined in their claim unless they pay extra out of pocket (which they are very rarely willing to do). I wish them luck....they'll really need it. Why would I (or any other roofer) do the same amount of work and barely make above break-even (if not lose money), when your neighbors with a decent carrier are BEGGING us to help them? What would you do if you had more work than you could handle and had to choose between a job with a difficult carrier to make 1-2k in profit or a claim next door with a better carrier and make 6-8k in profit for the same amount of work?
