UPDATE: Although this topic will likely remain a lively discussion for the forseeable future, Brock's claims have been released: ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-6N9yyVMM7oA.html ~~~~ Hey folks, wouldn’t call this going ”viral” but it has gotten more attention than I was expecting. Let me clarify a few things. 1) Sorry if the audio quality is down a bit. I left my mic in my work office but didn’t want to wait to get this out last night so just used my iPhone voice recorder. 2) To those saying fair use does not allow for monetization on RU-vid: that would be news to me. RU-vidrs have always been able to supplement small excerpts (again, *small excerpts*) of copyrighted work with original content. Again, the biggest frustrations at the moment are a) the sudden, almost overnight change and b) zero communication as to where the line is drawn. 3) The NBC Sports article says “countless,” not “endless.” Like I said, I was in a bit of a rush to get this out. 4) Go watch NBR's video here for more context and commentary on this subject: ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-XZucXZqxrAc.html

And that’s something I don’t disagree with. While it’s a massive gray area, I’d be a bit more understanding if NASCAR had communicated that they were going to start cracking down on this a bit more clearly rather than simply mass claiming them virtually overnight. Been watching your videos for years my man! Keep up the good work (at least as much as that’s possible going forward) and #FlyEaglesFly

I've been getting constant emails from RU-vid stating NASCAR copyright claimed my videos containing NASCAR footage. I don't create content for money, as my channel is not monetized, but its a bad situation for those who are monetized. Thank you for shedding light on topic.

Yep, i'm dealing with the same problem as well with all of my old reaction videos. I really hope both parties can find a solution very soon and I hope this will not remove our monetization status entirely.

Reaction videos have always been a gray area, but if it's part of a larger purge like this without any warning or set guidelines...the lack of communication is honestly the most frustrating thing here.

Yeah I’ve been seeing “video cannot be monetized” on emails even when this channel (which has not been monetized at all) and my original channel (which hasn’t been monetized since 2018), I’ve been getting those emails too.

Eh, I still think it's a net win overall. Someone else brought up NASCAR Classics, which may be part of it, but my hypothesis is still on the production studio. But who knows for sure at this point...

I checked my channel & the number of videos claimed on my channel went from 21 to 40. Not all the claims are from NASCAR, but that is a tad bit weird. I hadn't even gotten an email about it. I just checked it on RU-vid Studios. I don't do this for money (I've actually never been apart of the RU-vid Partner Program), but it does suck for those affected.

I had one of my early videos hit. A compilation of videos shot at the track on my cell phone (which as I understand the laws, is a pretty big stretch to say those would be protected. There have been cases in other sports where courts have ruled that videos shot by an individual on a personal device is not protected by copyright laws) was actually taken down. At first I thought it was an error, so I disputed, and after review, NASCAR Media upheld the strike. I'm a defender of copyright laws because I don't want my work being stolen. Here is where my issue lies as it relates to my specific video strike. I have been attending NASCAR races since 1993 at age 8. My day job? Driving the hauler for a race team (the entire format of my RU-vid Channel), and I found a way to take videos I already had on my phone for personal use and present them in a way that specifically targets new fans, and gets them pumped to get to an actual event. And absolutely EVERYTHING I have found suggests they can't touch my videos shot live at their events... I wasn't looking for a Christmas card or a check... But to take it down when I am literally working to get people excited about motorsports. I'm trying to share my passion with others.... I guess no good deed goes unpunished 🤷

We shouldn't misconstrue fair use with monetization. They are not interchangable. Fair use only means your video can't be wiped from the internet, per the ruling of Lenz V. Universal Music Corp. in 2015. Monetization is a private policy through RU-vid of which there are many guidelines you need to adhere to, other than fair use alone. RU-vidrs are lucky this went on for as long as it did, but with NASCAR's new streaming deals expanding across the internet, copyright claims will only increase. RU-vidrs could call NASCAR greedy, and I could call RU-vidrs greedy, for riding NASCAR's coattails after already taking donations on patreon.

Your points have some validity to them for sure. But I'd take slight issue with the "riding NASCAR's coattails" accusation. Again, this isn't an issue of RU-vidrs re-uploading full, unedited broadcasts and trying to claim monetization rights on them. In the vast majority of circumstances, they're only using *small excerpts* from those broadcasts to supplement and illustrate their own original content. Are some creators more, well, creative than others? No doubt. But for those that are pouring their heart and soul into the work that they're producing, I think it would at least be nice to have some communication as to where the line is being drawn.

@@bcschneider53 While I empathize with creators' passion, I think the line has been made very clear. Fair use is NOT the only factor that qualifies for monetization. Fair use I protects your video's EXISTENCE on the internet. Using the likeness of any teams' sponsors, cars, or NASCAR's broadcasts at all can disqualify anyone from monetization if you're not employed by NASCAR, because they are all trademarked. Anyone can USE their likeness for fair use, but not anyone can make MONEY off their likeness. I believe the difference here is very clear. Most RU-vidrs have Patreon or other means to accept donations anyways, so I dont see a reason why this is big deal unless the sole purpose of creating videos is to make money.

@@bcschneider53 Conversing respectfully and professionally is the only way to change someone's perspective. I duly recognize your passion for the NASCAR RU-vid community, and whole heartedly share the same sentiment. I also believe creators deserve to have their productions funded 100%, because videos take ridiculous amounts of time to record, edit, review, render, and upload. Theres plenty of documentaries and shows that are fantastically put together by folks who aren't employed by NASCAR. It's a great means of exposure to topics and events that otherwise go ignored. I do think NASCAR and it's partners are going about this the wrong way, by shrinking their rate of exposure instead of helping to expand it, because without reimbursement, there's no incentive. They've profited more than enough already. However, a lot of folks from the inside started out doing volunteer work before making a real career out of it. There's no reason why RU-vidrs can't do the same. I wish NASCAR would partner with social media influencers more to create incentives for reporting, so they don't have to do their own PR, because right now it just isn't working. Nobody really wants to go to nascars website to hear them toot their own horn. There's clearly a market for licensing RU-vidrs to create documentaries, podcasts, and other digital endeavors, because otherwise they wouldn't claim your videos. The Internet is still relatively young in the world, so perhaps in the future we could see monetization policies change with a Supreme Court ruling, but for now it doesnt look to be headed that way with NASCARs newfound investment into internet streaming platforms. Go to your local short tracks, buy pit passes, document your experiences digitally, and try to interview teams and drivers. You might find someone who knows someone, and end up licensing your footage for real money or find something else really cool you might like doing like working for the track, or even managing social media for one of the teams.

I don't think NASCAR is going to "squash" any non-NASCAR produced media about NASCAR, but it does seem like they will be cracking down on the at-length use of broadcast footage.

My suggestion for NASCAR RU-vidrs --- do what F1 RU-vidrs are doing. Remove any sort of broadcasted content from your videos, at the end of the day the copyright warning does claim "This copyrighted telecast may not be reproduced, retransmitted or reused in any form without the authorized written consent of NASCAR Broadcasting" and so they're well within their rights to do what they're doing. Go watch The Race and their F1 videos, literally none of their content has any sort of broadcast video in it, just filming day content provided on behalf of the F1 racing teams themselves and photos taken by photographers at the races. While it's not an ideal way to make videos, they're still very doable.

That’s where fair use comes in. No one is asking to monetize reuploads of full races without transforming the content through original commentary. The broadcasted content is meant to illustrate and supplement the videos, not replace and infringe upon the copyright of the original. And even then, non-monetized channels have been uploading full races without issue for years. If a new line is being created, I’d at least like it to be made clear where exactly it’s being drawn.

​@@bcschneider53 It's a gray area for fair use, because while the videos are typically based on commentary and criticism, does the point of the video benefit from the footage being shown? Like if I was pointing out flaws in the NASCAR Overtime system and I showed 5 examples of where it went wrong, I feel like that's in fair use, but just showing random racing footage for background I don't believe is protected in the fair use portion. Obviously, there's no straight guidelines to the fair use doctrine, and I'm absolutely not a lawyer, but I feel like if this was taken to a court of law, NASCAR would likely win against a fair few NASCAR RU-vidrs, but there would be some that may use it in a way to better convey their commentary or criticisms that would win. All about how they use the footage, not if they use it.

@@mistertheking Oh no doubt, your first example is 100% what I was referring to. Your second example would be much harder to defend (which is why I used video game footage in the background where I didn't have screenshots in this very video). It's a tough thing to define, but as I said, it's not like that definition has changed since this latest round of demonetization started happening either.

@@bcschneider53 You're absolutely right, and that's down to NASCAR finally putting their foot down on the footage they own. Is it the right thing to do? Perhaps morally no, but at the same time they're well within their rights to do it. Hopefully this means more NASCAR produced content on RU-vid and more NASCAR races are uploaded to their NASCAR Classics website. NASCAR RU-vidrs will make it work I feel, just a matter of changing how they've made videos in the past to conform with stricter guidelines.

Nascar is nothing more than another corporate entity, and as such, don't value consumers or fans of their product. It's not that they don't SEE how it benefits them to have a fanbase that is passionate and involved in promoting the sport, it's that they want total control of everything related to the brand. There is something about these corporations that makes them stubborn and willing to hurt their own bottom line, in the goal of having complete control. This is never going to change unfortunately, and it only gets worse because RU-vid is also just another corporate entity, and will always side with their peers.

NASCAR can and will do as they wish, as another RU-vidr "Bologna Burger" has said, "NASCAR is gonna NASCAR". They lost me with their stupid charter system, stage racing, their chase and the next gen cookie cutter race cars. I only keep up via RU-vid. This coming from someone that has been a fan since 1966. I've helped build race cars for others, built and drove my own cars in the NASCAR weekly racing series. Pains me to say it, but I'm done with them. Good luck to you, Brock Beard, Bologna Burger, BannyB and all other racing creators.

Control, Control, Control......and money of course. All of your points are valid, on point and moot. NASCAR doesn't want anyone but NASCAR to make $$ on any NASCAR footage. It's not that NASCAR is greedy, just very poorly run with a huge DEBT load and they're scraping around for every dime For reasons not entirely understood, NASCAR had a zeitgeist in the 90's and 00's that drew in millions of new "fans". That resulted in a dramatic expansion and DEBT. The zeitgeist went away and so did the "fans", but the DEBT remained. Almost all of NASCARS current problems are as a result of servicing the DEBT from expansion. That debt has driven ticket prices as well as every other cost paid by the fans through the roof, which of course hasn't helped track attendance or fan loyalty. Tracks get an enormous amount of TV money to service their DEBT. The inability of NASCAR to share $$ with teams because of DEBT has created a situation where it's not talent that gets you a drive but sponsorship $$ that gets you a ride. That lowers the quality of racing and you lose more fans. It's a vicious cycle out in the open for all to see. I could go on but most of you can see where this is leading. DEBT has reduced fan base. NASCAR and other deeply indebted sanctioning bodies are desperate for new "fans" so they can service their DEBT and it's the lifelong fans who suffer. Playing with race formats, fiddling constantly with the rule book to make a better show, adding gimmicky race tracks to the schedule, bickering between teams and the sanctioning body around money.......So, am I describing F1 or NASCAR?

I mean I get Nascar owns that, it always at the end of the broadcast but if Nascar would just chill it just puts more Nascar stuff out there. More Nascar content is great for Nascar. I think they are being too greedy and they will hurt themselves more. Good luck Nascar. I think this is a bad look for them. At the same time i get why too though so for me its a toss up. I kinda of see both sides i just think it could hurt Nascar a little too but i could be wrong. Why not just go to the race and record some action yourself and then use your iwn footage

it sucks but unless you filmed it yourself. it is THERE content and they may have not striked you before. but don't think that you are safe due to that.. its there property and its well out of fare use if you post a full race of some sort. and if they opened at new media then they will start pulling.. youtubers think they own everything and when the companys that own the content pull from them they cry... you made money off it.. well above fare use.

I think you’ve completely missed the point of “fair use.” Also, “going to the races” was a reference to working in the media center to create more content, whether it be for their own channel or for another outlet, which is not exactly something fans are doing…

I’d argue that, especially in the era we currently face regarding Nascar within the public eye. Content creators are crucial, for the newcomers and the longtime fans. Coverage means everything, especially if there’s a story to tell. From the teams that finish in the back to the frontrunners who are a threat to win. Without the Content Creator, these story’s could never see the light of day and captivate someone’s interest into becoming a fan. There’s also the issue where Nascar Media Group is copyrighting Gameplay footage. But that’s can of worms that’s to be opened later

What part of "Copyright Disclaimer: Under Section 107 of the Copyright Act of 1976, allowance is made for FAIR USE for purpose such a as criticism, comment, news reporting, teaching, scholarship and research. Fair use is a use permitted by copyright statues that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of FAIR USE" is so difficult to understand?

@@TarHeelsKenny No, we would strike someone if they reuploaded our content without ANY sort of modification or transformation to supplement their own. I’d have no problem with anyone using my words provided they use it to help illustrate their own point in their own context. Ripping the entire video and reuploading it as their own to monetize is a completely different issue. Again, “fair use” is a thing.

this is just really terrible thing NASCAR what are you guys doing the NASCAR RU-vid fans are trying to get new fans interesting into the sport but this is what you're doing to them like these people work hard to get new ones interesting into NASCAR like this is crazy and if you don't have the time and energy to people that work hard to bring fun content for people who never watch NASCAR before then they aren't going to to it anymore because you keep taking down their stuff like this is garbage NASCAR you should definitely be grateful for having people who want to get New fans interested in NASCAR and if you keep doing this then they are not going to do this anymore and also I what to have what everyone else has to say about this so please let me know what you're thoughts about this .😊
